CALL TO ORDER Chairman Lemon called the meeting to order at 5:30 P.M. (This meeting is a continuation of the November 18th meeting. ) II. ROLL CALL Members Present: Michael Lemon, Ted Puckett, Jim Hulett, Donna Davison-Ness and Richard Wight Members Absent: Jerry Glass and Bob Philpott Staff Present: Paul D. Carr and Otto Miller III. Chairman Lemon Ken Sweeney said the Port would prefer not to have the five-year maximum limitation on the shoreline permit as condi t ioned in the staff report. The current boom grounds are frequently full. The Port no longer sorts logs at the airport. A certain volume of logs go through the water at present and if the Port is not granted the shoreline permit, the logs have to be moved quicker. Chairman Lemon closed the public hearing. Therefore, the dolphins and boom st icks shall be removed within five years after approval of this permit or within one year after the removal of the gravel bar at the mouth of Tumwater Creek, whichever comes first. 2. The permitee shall permit the City or its representatives or designees to make periodic inspect ions at any reasonable time deemed necessary in order to ensure that the activity being performed under the authority of this permit is in accordance with the terms and conditions prescribed herein; and citing the following findings: A. Otto Miller reviewed the staff report. opened the public hearing. Chairman Lemon Vern Swenson, applicant I explained that he currently occupies a leased building and would like to build a 1000 square foot dental office on East Seventh Street. He feels his proposal would enhance the area, beautify a vacant lot, and 15 out of 26 medical people are located on Eighth Street. Mr. Swenson said he had looked at other commercial sites but found them unsuitable I and more costly. He presented a petition supporting the rezone request. Chairman Lemon closed the public hearing. . . . Planning Commission November 19, 1987 Page 3 Dick Wight recommended denial of the rezone request citing the following findings: 1. The proposed CSD-Cl, Community Shopping District, is not as functionally related or similar to surrounding uses and zones as the present RMF designation and therefore, the proposed intermingling of incompatible uses does not comply as closely with Land Use Objective Nos. 2 and 7. 2. The rezone is a commercial intrusion into an established residential area and an expansion of an existing commercial strip which does not conform to Commercial Policies Nos. 2 and 4. 3. Since there is ample available commercially-zoned land, new professional off ices would more appropriately be located in an existing commercial district. 4. Given the small size of the subject property, its location acoss the alley boundary and the directly abutt ing residen- tially-zoned lots, the proposed rezone lot would not be able to adequately buffer the incompat ible impact sand thus cannot comply with Commercial Policy No.3. 5. The property, as presently zoned, complies with Residential Policies Nos. 15 and 16 of the Comprehensive Plan. 6. There have not been any changes in the area since the initial zoning to RMF. Also, as determined through an evaluation by the Commission last year, the Lincoln Street commercial district is where commercial expansion could occur in the City and be consistent with the City's Comprehsive Plan. Thus, there are not changed circumstances. Donna Davison-Ness seconded the motion which passed 5-0. Dick Wight left the meeting room. v. COMMUNICATIONS FROM THE PUBLIC Leonard Beil, representing the Clallam County Fairboard, explained that they have a mobile home which they wish to use for storage at the fairgrounds, however, mobile homes are only permitted in the Mobile Home Park District of the City. He explained how they acquired the used mobile home, and that it did not have the current tagging required by the Department of Labor and Industries. He stated that they intended to modify the interior of the mobile home, insulating the bathroom and using portions of it for storage of paint. . . . Planning Commission November 19, 1987 Page 4 Mr. Carr explained the definition of a "mobile home" from the City's Zoning Code, and the specific sections of the Code which restrict mobile homes to mobile home parks. He further explained that any alterations to mobile homes must be reviewed and approved by the Department of Labor and Industries. Alterat ion of the mobile home could result in it being classified as something other than a mobile home, by the Department of Labor and Industries. The Commission, Mr. Bei1 and staff, discussed the matter at length. Mr. Beil concluded by stating that he would determine what modifications the Department of Labor and Industries would allow and what they would then classify the structure, and with that possibly new definition, return to the Planning Department for evaluation with respect to the Zoning Ordinance. VI. STAFF REPORTS There were none. VII. REPORTS OF COMMISSION MEMBERS Jim Hulett expressed thanks to the Public Works Department for the light at Race and Boulevard. He also inquired about a travel trailer at the northeast corner of Campbell and Mt. Angeles Road. Staff will investigate its use. VIII. ADJOURNMENT The meeting adjourned at 7:45 P.M. ~~~ u D.
