ADJOURNMENT . . PLANNING COMMISSION Port Angeles, Washington November 22, 1988 I CALL TO ORDER Chairman Wight called the meeting to order at 7:05 P.M. II ROLL CALL Members Present: Jerry Glass, Larry Leonard, Jim Hulett, Jerry Cornell, Bob Philpott, Donna Davison-Ness, Dick Wight. Members Absent: None. staff Present: Paul D. Carr, otto Miller, Craig Knutson. III APPROVAL OF MINUTES Mr. Cornell moved to approve the minutes of the November 9, 1988, meeting as written. Mr. Leonard seconded the motion, which passed 6 - 0 with Ms. Davison-Ness abstaining. . Mr. Philpott read a statement on congregate care and the Planning Commission process into the record. IV PUBLIC HEARINGS RUddell Short Plat Appeal - SP-88(6)lO Mr. Cornell left the Planning Commission on a conflict of interest. Mr. Carr reviewed the Department Report. FOllowing a series of questions from the Planning Commission, Chairman Wight opened the public hearing. . David Cummins, representing the applicant, noted that the staff had no alternative but to deny the application, but there were reasons for granting a variance from the Short Plat regulations: The applicant could remove portions of one building and have two duplexes on one single-family lot. This would be more non-conforming than the current situation. The two duplexes pre-date the Zoning Ordinance, and while the lots do not meet the minimum requirements for duplex lots, the situation exists. Mr. Cummings identified the proposed changes in lot lines and the location of the existing duplexes on the short plat drawing that he identified as Exhibit "3" (the original drawing). They are willing to agree that if the duplexes cease to exist the lots would revert to single-family residential use. . PLANNING COMMISSION November 22, 1988 Page 2 Following further discussion, Chairman Wight closed the public hearing. Mr. Leonard moved to recommend approval of the Short Plat, per the original submittal (Exhibit "3"), with the condition that the following statement be placed on the face of the plat: "Should either of the existing duplexes be damaged in excess of 75% of the value of the building, the structure cannot be repaired or replaced as a duplex, regardless of the amount of time that has passed since the damage occurred."; and citing the fOllowing findings: A. The Short Plat would be closer to the intent of the Zoning Ordinance and the Short Plat Ordinance because there would be a duplex on an individual lot, rather than the possibility of two duplexes on one lot, and the remaining lot with a house. B. The lots face Ennis Street, as do the houses. Mr. Hulett seconded the motion, which passed 5 - 1. Ms. Davison-Ness voted "No" because it conflicts with the existing Short Plat Ordinance and has long-standing implications for similar situations. . Mr. Cornell returned to the commission. Zoning Code Amendment ZCA-88(12)5 - Adult Enter- tainment Regulations: A proposed Code amendment regulating the location and operation of adult entertainment businesses. Mr. Carr gave a brief history of how this item appeared before the Planning Commission. City Attorney Knutson and the Planning Commission discussed the timing requirements in light of the interim adult entertainment ordinance. Attor- ney Knutson briefly explained the interim ordinance, and some of the considerations, including free speech, obscenity, conduct versus speech, and the value of the Planning Commission developing findings for the full ordinance. Chairman Wight then opened the public hearing to receive testimony. Robert Koeth, a citizen, requested additional time to provide more input on the ordinance. Warren Keller and Barbara Gibson spoke in opposition to adult entertainment businesses. . Cathy Vogel suggested that a number of conditions be attached to such uses. James Bretthour suggested coordination with the County. . . . PLANNING COMMISSION November 22, 1988 Page 3 Dave Burch suggested exploring the nuisance aspects of such uses as a means of regulation,' James Bretthour suggested regulating the hours of operation. John Gibson expressed concern that such uses would increase prostitution and sex crimes. Following further discussion, Chairman Wight closed the public hearing. The Planning commission decided to invite the County Planning Commission to review the ordinance and work with the City, if they desired. The Attorney suggested a timetable for working on the ordinance. The Commission felt that ninety days might be needed to fUlly review the issue with a public hearing likely in April. Following further discussion, Mr. Hulett moved to set a work session to discuss adult entertainment at the long-range meeting on January 25, 1989. Mr. Glass seconded the motion, which passed unanimously. V PLANNING STUDIES Zoning Code Amendment - ZCA-88(12)6: Possible revision to Home Occupations Chapter of Zoning Ordinance. The Planning Commission set a hearing for December 14, 1988. VI COMMUNICATIONS FROM THE PUBLIC None. VII STAFF REPORTS None. VIII REPORTS OF COMMISSIONERS Mr. Philpott commented on the letter sent to the City Council. Chairman Wight discussed the adult care issue. The Planning Commission then discussed their hearing procedures and the value of the 10 P.M. closing rule. . . .
