II ROLL CALL Members Present: James Rexroat, John Lacey, Steve Pazon Members Absent: James Clevenger, Evelyn Tinkham Staff Present: Dan VanHemert, Louise Frost III APPROVAL OF MINUTES Mr. Rexroat moved to approve the minutes of the November 2nd meeting as submitted. Mr. Pazon seconded the motion, which passed unanimously. . IV COMMUNICATIONS FROM THE PUBLIC None V VARIANCES V-8l(12)24 - STEVEN R. LAMB. Request for variance reducing the front yard setback from 25' to 9'; to construct a single-family residence. Location: Immediately east of 1130 East Eighth Street. Chairman Lacey said that Mr. Lamb, the Applicant, had re- quested a continuance to the January meeting. Mr. Rexroat moved to continue this hearing until January 4, 1982; Mr. Pazon seconded, and the motion passed unanimously. V-8l(l2)22 - MARIAN B. DOtiNING. Request for vari- ances to reduce the front yard setback from 25' to IS', and reduce the side yard setback from 7' to 5'; to construct an addition to a pre-existing noncon- forming single-family residence on a substandard lot of record. Location: 1317 West Fifth Street. . Mr. VanHemert reviewed the Department Report; and mentioned the letter received by the Department from an adjoining property owner, copies of which the Board had just re- ceived. Chairman Lacey opened the public hearing. Board of Adjustment December 7, 1981 Page 2 . Mrs. Downing said the house has been rented for a number of years. The addition is proposed to enlarge a bedroom. A porch had originally extended across the front of the house, but had been removed several years ago because of termite damage. The adjoining houses all have porches, some of which are enclosed. Chairman Lacey closed the public hearing. Chairman Lacey acknowledged receipt of the letter from Ms. Sybil Morgan. Mr. Rexroat moved to grant the requested variances, cit- ~ng the following findings: 1. Inadequate lot width and size are special circum- stances related to the lot which deny full use rights. 2. This lot is distinguished from others in the RS-7 Zone and most lots in this neighborhood by its lack of width and sizej therefore, the variances are not a grant of special privilege. . 3. The variances will not cause sight-distance diffi- culties, be closer to other structures, or have any other materially detrimental impacts on nearby properties and the general public. Mr. Pazon seconded this motion, which passed unanimously. V-81(12)23 - RICHARD N. McLEAN. Request for vari- ance to reduce the rear (alley) yard setback from 25' to II': to construct an addition to an exist- ing single-family residence. Location: 2507 South Peabody Street. Mr. VanHemert reviewed the Department Reportj Chairman Lacey opened the public hearing. Dick McLean said he would answer any questions. His neigh- bors do not object to the proposed spa structure inside the rear yard setback. The portion of the alley that is in has been put in by the adjoining property owners at their ex- pense. Chairman Lacey closed the public hearing. Mr. Rexroat moved to grant the variance, citing the follow- ing findings: . 1. The slope of the lot and lack of an adequate loca- tion for a spa structure are special circumstances of the parcel, denying use rights common to other residential lots. . . . Board of Adjustment December 7, 1981 Page 3 2. A spa structure is a low-intensive private recreation use similar to others, such as swimming pools, decks, patios and hot tubs, common in rear yards. Addi- tionally, this lot has a greater slope than most others in the vicinity. Therefore, the variance will not grant a special privilege. 3. The structure will not cause a sight vision problem, view obstruction, or otherwise be materially detri- mental to nearby properties, improvements and the general public. Mr. Pazon seconded the motion, which passed unanimously. VI STAFF REPORTS None VII REPORTS OF BOARD MEMBERS Chairman Lacey: Asked if the City Attorney's visit was still scheduled for the January Board meeting and was told yes. Chairman Lacey then suggested that all of the Board members look at the site proposed by Mr. Lamb for a single-family structure before the next meeting.
