Carr, Dan VanHemert, Louise Frost, Andy Rose, Gary Braun APPROVAL OF MINUTES Mr. Brewer moved to approve the minutes of the November 24th meeting as submitted. Mr. Ranta seconded the motion, which passed 5 - 0, with Mr. Bennett abstaining. IV HEARINGS PLANNED RESIDENTIAL DEVELOPMENT HEARING - KEY. Re- quest to consider a proposed Planned Residential Development on approximately 25 acres. Location: South of Campbell Avenue: east of Mount Angeles Road; bordering White Creek on the east. (Continued from November 10, 198'1.) Mr. Carr reviewed the Commission1s prior discussion ing the setback maps submitted; and revised setback were distributed. Discussion of the PRD followed. man Anderson opened the public hearing. regard- maps Chair- Johnie Key said that the revised setbacks constituted the final requirements. Chairman Anderson closed the public hearing. Mr. Downie moved to continue this matter until January 13, 1982. Mr. Ranta seconded the motion, which passed unani- mously. Planning Commission December 9, 1981 Page 2 . REZONE REQUEST - HOPPER. Request to rezone 19.43 acres from RS-9 (Single-Family Residential) to RMF (Residential Multi-Family). Location: An L- shaped parcel with the northerly portion between l4th and 16th Streets, approximately 820 feet west of "N" Street and immediately east of Kedter Noods; and the southerly portion between 16th and 18th Streets, approximately 535 feet east of "0" Street and approximately 208 feet west of "N" Street. (Continued from November 10, 1981.) Mr. Carr reviewed the Department Report. Mrs. Thompson asked how many units were proposed for the southerly por- tion of the rezone, and Mr. Carr said no proposal had been submitted at this time. Chairman Anderson opened the public hearing. . Scott Hopper stated that affordable housing for the aver- age person is not available at this time. He will cove- nant the southerly portion to assure the same density proposed for the present PRD. He distributed material explaining the 74 unit PRO project proposed for the north portion of the rezone area. Originally the project in- cluded approximately 15 acres to the south and east of his property, but has since been reduced in size. The project will be for young people as well as senior citi- zens. The units will be sold as condos and maintenance will be controlled by a homeowners' agreement. In reply to a question, Mr. Hopper said a fence and vegetation will provide seclusion and a visual screen. A similar project will be proposed for the southern portion. Louie Torres, Clark & Associates, stated the reason for the rezone was to construct the planned residential de- velopment, consistent with the Zoning Ordinance; and then exhibited approximately 25 slides of the rezone area and of the PRD model. Mr. Carr requested Mr. Torres to pro- vide the Department with photographic copies of the slides exhibited with identification statements for each one. Mr. Torres said the proposed development will conserve resources by using common walls. . Jack Olson, Clark & Associates, referred to mitigating measures to improve streets and utilities affected by the proposal which have been developed with the City and which the applicant will do. In addition, energy-efficient electrical features and low-use water fixtures will be installed. The interior streets will remain in private ownership, but a maintenance easement will be provided for City water. Planning Commission December 9, 1981 Page 3 . Mr. Torres distributed copies of the Department Report on which he had made comments. Glen Peters, Vern Bennett, Bot Ketchum and C. E. Nelson of the audience expressed concern for the reduction in value of their single-family properties if the condominium development were constructed. Traffic concerns, the capa- city of the streets, and the safety of small children were expressed by Harold Soderquist, Maureen Shriver and Bob Elliott. r1essrs. Torres and Hopper responded to some of the comments. Chairman Anderson closed the public hearing. In response to a question, Andy Rose, City Engineer, said that most of the problems have been worked out between the developer and City Staff. Mr. Bennett observed that afford- able housing will become more difficult to find in the future. Nr.' Downie asked for explanation of the difference in numbers presented by the Department and the developer; and Mr. Carr explained that the Department's totals are based on the Zoning Code. Mr. Ranta observed that this type of housing might be needed, but he has concern about the oppo- sition. . Mr. Bennett mentioned that many people feel this type of housing is needed, provided it is not in their neighborhood. He would be more amenable to considering recommending the rezone if it were only for the area proposed for the PRD. Mr. Downie asked if the Commission could recommend the rezone of a smaller area; and Mr. Carr said yes. Mr. Bennett requested information concerning the possibility of condi- tioning the rezone to this particular proposal. Mr. Bennett moved to continue this matter until January 13, 1982, to obtain an opinion from the City Attorney on mak- ing the rezone contingent upon development as proposed. Mr. Downie seconded this motion, and suggested that it be amended to have the Department investigate some of the con- cerns expressed; i.e., the water pressure, the adequacy of the utility systems, and the proposed storm water retention. Mr. Bennett amended his motion; Mr. Brewer seconded the amended motion, which was passed unanimously. . PLANNED RESIDENTIAL DEVELOPMENT HEARING - HOPPER. Request to consider a proposed Planned Residential Development on approximately 4.84 acres. Location: Between 14th and 16th Streets, approximately 820 feet west of "N" Street and immediately east of Kedter Woods. . (Continuedfro-m November 10, 1981.) Mr. Downie moved to continue consideration of this Planned Residential Development until January 13, 1982. Mr. Bennett seconded this motion, which passed unanimously. . . . Request to rezone 2l,OOO square feet from RS-7 (Single-Family Residential) to OC (Office Commercial). Loca- tion: 208 South Chambers Street. (Continued from November 10, 1981.) Mr. VanHernert reviewed the Department Report. Mr. Ranta asked to be excused on the appearance of fairness and left the hearing room. Mr. Bennett asked if any conditions had changed in the area since denial of the previous applica- tion; and Mr. VanHemert said none had occurred. Mr. Bennett then noted that commercial property is available for the uses allowed in the OC District. Chairman Anderson opened the public hearing. Douglas Baker said that the area proposed for rezone is un- desirable for residential purposes because of nearby commer- cial uses. His office needs additional floor space. New construction costs are high and land is too expensive. The rezone is a logical extension of the First/Front com- mercial strip and complies with the Office Commercial Chap- ter of the Zoning Ordinance. Martha Schmidt, 210 South Francis, said that the residential neighborhood is threatened by the commercial uses being pro- posed in the area. It is a good location for a residential neighborhood. Chairman Anderson closed the public hearing. Mr. Downie moved to recommend denial of the application, citing the following findings: 1. The rezone is not a natural extension of the First/ Front commercial strip and so does not comply with Commercial Policy No.2. 2. The rezone is not in compliance with Commercial policies Nos. 6, 7 and 18, because the types of uses permitted in the OC Zone would not be occurring in areas proposed by these Policies. 3. The rezone may be considered a spot rezone. 4. The uses permitted in the OC District would not be functionally related to the established residential development of the immediate area. 5. Introducing an office commercial and residential use district between two residential use districts could introduce adverse influences, rather than minimize them. . . .
