Request for a Conditional Use Permit to allow a phase fill of property to exist in the ACD, Arterial Commercial District. 2. STREET VACATION: STV 86(12)6, ARTHUR HILL, 1626 East Fifth Street. Request to vacate a portion of the 5/6 alley between Penn Street and Woolcott Street. 3. STREET VACATION: STV 86(12)7, PORT OF PORT ANGELES, Sixth '_and, Seventh. Street. Request to vacate a portion of the 6/7 alley ea~t of the Truck Route. 4~ STREET VACATION: STV 86(12)8, WARREN SCHILKE, Lincoln Street. PLANNING COMMISSION Port Angeles, Washington December 10, 1986 I CALL TO ORDER Chairman Glass called the meeting to order at 7:03 P.M. II ROLL CALL Members Present: Mike Lemon, Ted Puckett, Jim Hulett, Gary Cissel, Donna Davison, Jerry Glass. Members Absent: None - one vacancy. Staff Present: Paul D. Carr, Dan VanHemert, Jeff Abram. III APPROVAL OF MINUTES Ms. Davison moved to approve the minutes of the November 25, 1986, meeting, as written. Mr. Hulett seconded the motion, which passed 5 - 0, with Mr. Cissel abstaining. IV PUBLIC HEARINGS CONDITIONAL USE HEARING - JONES/PRIEST. Request for a Condi tional Use Permit to allow a phased fill of property to exist in the ACD, Arterial Commercial District. Location: 1122 East First Street. (Continued from November 4, 1986.) Mr. VanHemert reviewed the Department Report. Glass opened the public hearing. Chairman John Ward of the Olympic Outdoor Sportsmens Club opposed any new man-made barriers being installed in White Creek. The Club has been working with the Department of Fisheries to restore salmon runs in local creeks. Roy Jones reviewed the history of their proposal and explained that existing City Departments and State agencies would be involved in protect- ing the public safety. He stated that the phased fill would be a good dump site for in-town projects and for material excavated from the Landfill. He suggested the Commission let the Engineering and Building Divisions of Public Works and the State Fisheries Department regulate the fill. (Mr. Cissel left the room on the appearance of fairness doctrine.) Roy Jones acknowledged they may not receive a hydraulics permit from the Fisheries Department. The Fisheries Depart- ment does not consider the stream good for salmon rearing but it is for trout and steelhead. Chairman Glass closed the public hearing. PLANNING COMMISSION December 10, 1986 Page 2 . The Commission discussed the proposal, observing that there are some systems that can be approved by the State, such as the one used at the Baker Street/Ennis Creek by-pass, not- ing, however, that culverting and filling of ravines is not generally compatible with the environment. Following further discussion, Ms. Davison moved to recommend denial of the Conditional Use Permit, citing the following findings: 1. Filling of the Ravine will encourage the intensive development of an area with severe physical constraints, contrary to Open Space Policy No.2. 2. The Ravine and Creek should be preserved as a unique environmental and topographic feature, in compliance with Open Space Policy No. 3 and Land Use Objective No. 3. . 3. White Creek Ravine is a unique environmental feature and natural resource which should be preserved to maintain its hydraulic function in the drainage basin and to preserve the existing wildlife habitat, in accordance with Open Space Policy No.3. 4. The proposed culvert may cause environmental damage to White Creek and abutting properties downstream from the site. 5. Given the natural beauty of the site and availability of commercial land within the District, retaining this segment of White Creek Ravine furthers Land Use Objec- tives Nos. 1 and 3. Mr. Puckett seconded the motion, which passed 4 - 1, with Mr. Lemon voting "No" because there are alternative methods for protecting the environment, and the Departments of Fisheries and Ecology have the ability to come up with those alternatives, and initiating action is premature. Mr. Cissel returned to the hearing room. STREET VACATION - ARTHUR HILL. Request to vacate a portion of the 5/6 alley between Penn Street and Woolcott Street. Location: 1626 East Fifth Street. Mr. VanHeffiert reviewed the Department Report. Glass opened the public hearing. Chairman . Eleanor Caugheron, property owner to the south, opposes vacation, because it would eliminate the practical access to her property. Chairman Glass closed the public hearing. PLANNING COMMISSION December 10, 1986 Page 3 . In response to a question from the Planning Commission, Arthur Hill stated that he was withdrawing the petition for vacation. Ms. Davison moved to accept the withdrawal. Mr. Lemon seconded the motion, which passed unanimously. STREET VACATION - PORT OF PORT ANGELES. Request to vacate a portion of the 6/7 alley east of the Truck Route. Location: Sixth and Seventh Streets. Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. Ken Sweeney of the Port of Port Angeles explained that the vacation would enable the installation\ of a private weight scale platform to replace the one that had been located near the main Port terminals. The Port concurred with the Planning Department's recommendation for vacation. Chairman Glass closed the public hearing. Mr. Lemon moved to recommend approval of the vacation of that portion of the right-of-way abutting Lots 9 and 12, citing the following findings: A. Vacation will not affect circulation of vehicles and pedestrians in the area. . B. Vacation may facilitate further development of the abutting property. Mr. Cissel seconded the motion, which passed unanimously. STREET VACATION - WARREN SCHILKE. Request to vacate a portion of Lincoln Street between Orcas Street and San Juan Avenue. Location: Lincoln Street. Mr. VanHemert reviewed the Department Report. Glass opened the public hearing. Chairman Warren Schilke explained that a house straddles the line between Lots 19 and 20 and vacation of the subject right-of- way, together with a boundary line adjustment, would enable him to create a new buildable lot. He prefers vacation of 12 feet of right-of-way, but would be happy with vacating only 10 feet. Chairman Glass closed the public hearing. Mr. Lemon moved to recommend vacating the west 10 feet of Lincoln Street, with the condition that a utility easement be retained, and citing the following findings: . A. The vacation will not result in an adverse impact upon traffic patterns and circulation within the vicinity. . . . PLANNING COMMISSION December 10, 1986 Page 4 B. With the retention of a utility easement, the vacation will not be detrimental to utilities in the area. c. The vacation will not have a negative effect on the public health, safety and welfare of the general public. Mr. Hulett seconded the motion, which passed unanimously. STREET VACATION - HOWARD CUNNINGHAM. Request to vacate a portion of Vine Street between Orcas and Orcas/Lopez alley. Location: Vine Street. Mr. Lemon left the hearing room on the appearance of fair- ness doctrine. Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. Howard Cunningham explained that they have owned the house which occupies the right-of-way for approximately ten years. They petitioned for vacation to clear title to the property in order to refinance the house. Chairman Glass closed the public hearing. Mr. Hulett moved to recommend vacating the subject right-of- way, citing the following findings: A. Vacation will not affect any circulation patterns, development patterns, or public safety, because the subject right-of-way contains a house that has been there for a number of years and Vine Street in this area is fully improved. B. The subject right-of-way has been consideredJused and taxed as private property since at least the mid-60's: thus it is doubtful if the City has any claim to it. C. Vacation would remove any question as to ownership of the subject right-of-way. Mr. Cissel seconded the motion, which passed 5 - O. Mr. Lemon returned to the hearing room. PLANNING COMMISSION December 10, 1986 Page 5 . SHORELINE MANAGEMENT HEARING - THUNDERBIRD #2. Request to construct a retail sportfishing tackle and supply store in association with a sportfishing charter boat service, located just east of M & R Timber and west of the Port Angeles Boathaven, on Marine Drive, property legally described as Block 117, Townsite of Port Angeles. Mr. VanHemert reviewed the Department Report. Glass opened the public hearing. Chairman . Bob Winters, representing the applicants, explained that locating a charter boat service and bait and tackle shop next to a marina was a logical land use decision. Ken Sweeney, representing the Port of Port Angeles, stated that the Port has agreed to lease the property to the applicants because such a business is good for the local economy and is related to the Marina. Mr. Carr explained that there is a variance application before the City and the Shoreline Permit site plan shows two possible locations, one with the variance and one without. John Ward stated that during the summertime there is very little available parking near the Marina and suggested the building be relocated south of Marine Drive. Don Frizzell stated that the applicants have an agreement with the Port that if additional parking is needed as a result of their project, they will work with the Port to install parking south of Marine Drive. Chairman Glass closed the pubic hearing. Following discussion among the Commissioners, Mr. Lemon moved to recommend approval of the Shoreline Substantial Development Permit, subject to the condition that there be six improved off-street parking spaces adj acent to the structure, and citing the following findings: 1. The proposed tackle shop and charter service is a water- and shoreline-dependent use, in accordance with Use Activity Policy F.l.a and General Regulation C.1. 2. The development will locate in an already developed shoreline, in compliance with General Regulation C.l and C.4. 3. The Boat Haven area is also developed in commercial uses; therefore, the proposed development complies with Use Activity Policy F.l.b. 4. Pursuant to General Regulation C. 5, the proposed development will not significantly alter or irrevers- ibly convert a natural shoreline. . . . . PLANNING COMMISSION December 10, 1986 Page 6 5 . The proposed structure will not reduce the physical or visual access of the general public to the shoreline, in compliance with General Regulation C.2 and Land Use Element D.2. Mr. Cissel seconded the motion, which passed 5 - 1, with Mr. Puckett voting "No". The Planning Commission then recommended that the Port investigate improving the parking situation around the Marina.
