II ROLL CALL Members Present: Ted Puckett, Jerry Glass, Jim Hulett, Lorraine Ross, Jerry Cornell, Freeman Rice Members Absent: Gary Cissel Staff Present: Paul D. Carr, Dan VanHemert, Gary Braun. III APPROVAL OF MINUTES Mr. Cornell moved to approve the minutes of the November 28, 1984, meeting as submitted. Mr. Glass seconded the motion which passed 5 - 0 (Mr. Rice arrived shortly thereafter). IV PUBLIC HEARINGS SHORELINE PERMIT HEARING - ITT RAYONIER. Application for a Substantial Development Permit to replace wood pilings and floor under existing warehouse with fill, rip-rap and concrete floor. Location: Site of existing Mill. Mr. Carr noted that ITT Rayonier was requesting a continuance of this hearing until the February, 1985, meeting. Mr. Hulett moved to continue this item to the first meeting in February. Mr. Puckett seconded the motion, which passed unanimously. CONDITIONAL USE PERMIT - CLYDE BUGHER. A request for a Conditional Use Permit to allow a duplex in the RS-7, Single-Family District. Location: 1022 West Fourth Street. Mr. VanHemert reviewed the Department Report. Following questions by the Commission to staff, Chairman Ross opened the public hearing. Mr. Bugher provided a brief history of how the existing house metamorphosed into a duplex. Mrs. Bugher stated that she felt the 1976 building permit authorized a duplex. Harold Elmer, 1015 West Fifth Street, spoke, submitting a petition signed by nearby residents opposing the dupl~x. .' . . PLANNING COMMISSION December 12, 1984 Page 2 Carl Love, 1011 West Fifth Street, also opposed the duplex. Craig Miller, representing the neighbors in the area, stated that the site was not appropriate for a duplex because only 7,000 square feet of the parcel is usable, where 10,500 square feet is required; the lot is only 50 feet wide, rather than the required 75 feet wide; the only access is a narrow alley, without curbs or sidewalks, causing detrimental traffic impacts; and a duplex would increase the density in the area. Denny McCart, 1006 West Sixth, stated his opposition. Ken Stephan, 1020 West Fourth Street, expressed concern about future tenants. Following additional testimony, Chairman Ross closed the public hearing. Following additional discussion among the Commission, Mr. Puckett moved to recommend approving the Conditional Use permi t provided that it was to the Bughers only. This motion died for lack of a second. Mr. Cornell then moved to recommend to deny the Conditional Use Permit application for a duplex, citing the following findings: 1. Because the bluff bisects the subject parcel and neigh- boring lots, rendering over one-half of the parcel unusable, a duplex will significantly increase struc- tural overcrowding and population concentration. 2. The pattern of land ownership on the north side of the 4/5 alley may encourage the conversion of existing homes and the construction of new duplexes on nearby properties, thereby significantly increasing traffic in the alley and demand on utilities. Mr. Rice seconded the motion. On call for the question, the vote was 3 - 3. TEMPORARY USE PERMIT - HARVI AND LINDA KI I SKI. A request for a Temporary Use Permit to allow a mobile home to be located on the property, in the RS-9, Single-Family District, for a period of 5 years. Location: 712 Viewcrest. Mr. VanHemert reviewed the Department Report. Chairman Ross opened the public hearing. Mr. Kiiski explained that he anticipates construction of the house in two years. Chairman Ross closed the public hearing. Mr. Glass moved to recommend granting a Temporary Use Permit for two years, subject to the following conditions: . . . PLANNING COMMISSION December 12, 1984 Page 3 1. The applicant make application for a building permit within that two-year period. 2. The roadway to the proposed building and existing trailer be widened to accommodate a fire truck. Mr. Cornell seconded the motion, which passed unanimously. CONDITIONAL USE PERMIT - VALERIE GALLACCI. A request for a Conditional Use Permit to allow a daycare center in the ACD, Arterial Commercial District. Location: 1010 East Front Street. Mr. Carr reviewed the Department Report. Chairman Ross opened the public hearing. Ms. Gallacci explained that there would be 60 children in the daycare center, with most of them arriving near 9 AM in the morning. The proposed play area is exposed to sunlight. There will be a 2,000 square-foot addition to the north. She also distributed a revised site plan. Following addi tional discussion, Chairman Ross closed the public hearing. Mr. Hulett moved to recommend granting the Conditional Use permi t for a daycare center subject to the following conditions: 1. The parking and access be developed per Public Works Department requirements. 2. The proposed play area be fenced. 3. The requirements of the Fire Department be complied with. Mr. Puckett seconded the motion, which passed unanimously. V COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS INTERPRETATION: Request for an interpretatiuon allowing a self-service auto laundry in the CSD-Cl, Community Shopping District. Mr. Carr reviewed the Department Report. Tim Haley des- cribed the proposed use. Following additional discussion, Mr. Cornell moved to interpret the CSD-C1 Zone as disallow- ing auto laundries, because construing self-service auto . . . PLANNING COMMISSION December 12, 1984 Page 4 laundries to be a self-service laundry, is beyond the normal interpretation of the Zoning Code. Mr. Glass seconded the motion, which passed unanimously. Mr. Hulett then moved to direct the staff to investigate a Code amendment to allow self-service car washes in the Cl Commercial District. Mr. Glass seconded the motion, which passed unanimously. VII REPORTS OF COMMISSIONERS Mr. Glass read into the record a letter requesting investigation of a bed and breakfast in a neighborhood. Staff will investigate. Mr. Hulett asked about the possibility of a crosswalk at the bowling alley on Eighth Street, for safety reasons. VIII ADJOURNMENT The meeting adjourned at 10:10 P.M. d~~.~~ Paul D.
