Paul D. can::,' otto Miller, Bruce Becker. III APPROVAL OF MINUTES Mr. Cornell moved to approve the minutes of the ~ovember 22, 1988, meeting as written. Mr. Leonard seconded the motion, which passed unanimously. . Location: Ahlvers Road and Peabody street. (Continued from November 9. 1988.) PLANNING COMMISSION December 14, 1988 Page 2 REZONE REQUEST - RZ-88(12)13 - DARREL VINCENT: Request for rezone of property presently designated RS-7, Single-FamilY Residential, to OC, Office Commercial. Location: Lincoln and Laurel Streets. Mr. Miller reviewed the Department Report. opened the public hearing. Chairman Wight Ken Schermer stated the proposed OC zoning was compatible with the nearby RS-7 zoning because it had the same height requirements and the same setbacks. The rezone would upgrade the community by making possible elimination of some older housing. Mary Reimer spoke in opposition to the rezone because there would be more traffic on a residential street and the commercially zoned property immediately north is not fully developed. Darrel vincent spoke briefly on how he had pursued the rezone. Ken Schermer spoke further on the compatabi1ity of the proposed OC zoning with the adjacent commercial districts. Following further discussion, Chairman Wight closed the public hearing. Mr. Leonard expressed concern that some of the affected property owners may not have known about the rezone. Following review of the file, Mr. Carr noted that the Administrative Assistant had sent notices of the hearing to the property owners within the rezone area who had not signed the application. Mr. Philpott moved to rezone the subject property to Office Commercial, citing the following findings: 1. The rezone will make land available for professional offices, or residential uses as permitted in the RMF District, and will be functionally related to the existing uses and zoning districts in the vicinity, in conformance with Commercial Policies Nos. 2 and 3, Residential policies Nos. 15 and 17, and Land Use Objectives Nos. 1 and 2. The Office Commercial zone abutting the subject property to the east will be expanded in a westerly 2. PLANNING COMMISSION December 14, 1988 Page 3 . direction, attaining a functional cluster configuration of zoning districts, in compliance with Commercial POlicy No.2. Ms. Davison-Ness seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - CUP-88(12)21 - JAMES VOGEL: Request for a Conditional Use Permit to allow a carpet, furniture, and general home cleaning service to operate as a Home Occupation in the RS-7, Single-Family Residential District. Location: 2314 So-uth Laurel. street. Mr. Miller reviewed the Department Report. opened the public hearing. Chairman wight . In response to questions from the Planning Commission, Mr. Vogel explained the late night activity was a one-time occurrence. He can comply with the staff conditions. He has one fUll-time employee and a part-time employee who is there occasionally. The three company vehicles are all parked on the property. Following further discussion about some of the activities on the property over the last few years, Chairman wight closed the public hearing. Mr. Cornell moved to recommend approval of the Conditional Use Permit to operate a carpet, furniture and general home cleaning service as a Home Occupation in the RS-7, Single- Family Residential District, for a one-year period, subject to the following conditions: 1. All cleaning and painting services provided by this Home Occupation shall occur at the customers' premises only. 2. All maintenance and servicing or personal use of equipment associated with the Home Occupation which will produce noise or fumes shall be limited to the hours of 8:00 A.M. to 5:00 P.M., Monday through Friday only. 3. A 2AIOBC fire extinguisher shall be provided on the premises, with Fire Department inspection to determine if further fire extinguishers should be provided; . and citing the following findings: . . . PLANNING COMMISSION December 14, 1988 Page 4 A. with the attached conditions, the proposed Home Occupation can comply with the Home Occupations Chapter of the Zoning code, section 17.86.010, .040, and .080. Mr. Hulett seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - CUP-BB (12) 22 - RON ROGERS: Request to allow a duplex in the RS-7, Single-Family Residential District. Location: 3009 South Lincoln street. Mr. Miller reviewed the Department Report. opened the public hearing. Chairman Wight Mr. Rogers explained that he lived in the house in front of the subject lot. The staff noted that while the lot had the minimum 10,500 square feet for a duplex lot, 500 square feet of that was in the panhandle, and the Subdivision Regulations do not count panhandles as part of the lot area. The _ Commission- dlscussed 'the minimum lot area requirements and then discussed boundary line adjustments as a means to solve the square footage problems of the lot. Following further discussion, Chairman Wight closed the public hearing. Mr. Miller provided a copy of the State law on boundary line adjustments. The Commission and staff discussed the law and how it applied to this particular proposal. Mr. Cornell moved to continue this item to the January II, 1989, meeting, and directed staff to work with the attorney to make a determination on a possible boundary line adjustment on this particular short plat and its relationship to the Conditional Use Permit application. Mr. Leonard seconded the motion, which passed unanimously. SHORELINE MANAGEMENT HEARING - SEA FARM OF WASHINGTON: Request for a permit to allow the construction of a 3,200 square foot building with a shop and parking spaces. Location: Railroad and Oak streets. (Applicant has reauested a continuance for one month.) Mr. Cornell moved to continue this item to the January 11, 1989, meeting, at the request of the applicant. Ms. Davison-Ness seconded and the motion passed unanimously. . . . Location: City-wide. Chairman Wight opened the public hearing. There was no one present to comment. Chairman Wight closed the public hearing. Mr. Leonard moved to recommend adoption of the proposed amendment. Mr. Hulett seconded the motion, which passed unanimously. V COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS None. VII REPORTS OF COMMISSIONERS The Commission recommended the city recognize Mr. Carr's contributions to the community. The Commission decided to discuss posting of rezones and other proposals at a long-range meeting. Mr. Leonard noted that the red pick-up truck in the front yard had been removed.
