This amendment is entered into this of ro 2014 by and between the
City of Port Angeles CCity") and Capacity Provisioning, Inc. (hereinafter "Grantee").
For and in consideration of the mutual benefits to be derived herefrom, the Parties
recite, covenant, and agree as follows:
WHEREAS, the Parties entered into a Right of Way License Renewal No. 2 on
March 19, 2013. That license renewal is incorporated by this reference and may hereafter
be referred to as "the Agreement."
IN CONSIDERATION of the above representations and the agreements set forth
herein, the parties hereby agree as follows:
Section 1. The phrase "Institution Network Services" or "I-Net Services" used
throughout the Agreement, is hereby amended to "Metropolitan Area Network" or
Section 2. The first line of Section 15.2(a) of the Agreement is amended to read:
If to the City: Craig Fulton, Public Works and Utilities Director.
Section 3. In all other respects, the Agreement is confirmed and ratified.
This Agreement shall take effect upon execution by the following duly authorized
representatives of the parties.
