HomeMy WebLinkAbout5.788 Amendment (16)## 5.788 AMENDMENT NO. 16 TO THE AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE CITY OF PORT ANGELES AND BROWN AND CALDWELL PROJECT 06 -01 THIS AMENDMENT NO. 16 is made and entered into this 201h day of AA ugust, 2013, by and between the City of Port Angeles, a non - charter code city of the State of Washington, (hereinafter called the "CITY ") and BROWN AND CALDWELL, INC a California Corporation authorized to do business in the State of Washington (hereinafter called the "CONSULTANT "); The CITY entered into the existing AGREEMENT with the CONSULTANT on July 5, 2006, (the AGREEMENT); and WHEREAS, the CITY and CONSULTANT amended the AGREEMENT on February 21, 2007, May 9, 2007, March 20, 2008, September 15, 2009, November 30, 2009, March 9, 2010, July 27, 2010, November 16, 2011, December 21, 2010, January 4, 2011, September 20, 2011, January 9, 2012, February 24, 2012, February 21, 2012, February 26, 2013, and has proposed Amendment 16 (the AMENDMENTS); and WHEREAS, the CITY desires to amend the AGREEMENT again to amend the Scope of Work, Budget, and Time of Performance, NOW, TIIEREFORE, in consideration of the representations and the terms, conditions, covenants and agreements set forth in this AMENDMENT, the Agreement and the Amendments are hereby amended as follows. REVISED SCOPE OF WORK The Scope of professional services to be performed by the CONSULTANT are hereby amended by adding the tasks identified in the Exhibit A attached to Amendment 16. The CONSULTANT shall provide and furnish all services and material necessary to accomplish the additional work identified in the Exhibit A attached to Amendment 16. II TIME OF PERFORMANCE The work for all Tasks shall be completed by January 31, 2014 as shown in the Exhibit C attached to Amendment 16. III MAXIMUM COMPENSATION The maximum total compensation and reimbursement payable to the CONSULTANT is stated in the Exhibit B attached to Amendment 16. The maximum compensation amount, referenced in Section VI of the Agreement, is amended from $7,184,201 in Amendment 15 to $7,299,684 in Amendment 16, an increase of $115,483. The budget for any Task may be further adjusted by mutual agreement without an amendment to the Agreement, as long as the maximum compensation amount of $7,299,684 is not exceeded. IV RATIFICATION As amended herein, the Agreement and the Amendments are ratified and confirmed. Bloor, City Atto ey AND CALDWELL Title: ,5� Amendment 16, Page 2 EXHIBIT A To Amendment 16 SCOPE OF SERVICES RELATED TO PHASE 2 DESIGN SERVICES FOR THE PORT ANGELES CSO IMPROVEMENT PROGRAM Amendment 16 provides a scope of services, and associated budget, for inspection and condition reporting on the Peabody Creek culvert from the origin to outfall, along Lincoln Street. The CITY is concerned about the continuing development of sinkholes in South Lincoln Street, (aka Highway 101, a Washington State Department of Transportation [WSDOT] roadway). The primary objective of the project is to identify the locations and properties of large voids and defects in and around the pipe that can contribute to future sinkholes and to make recommendations to address these defects. The secondary objective of the project is to obtain preliminary data in support of a structural assessment of the culvert itself. The scope of services includes inspection of the 1,100 linear - foot -long culvert that is constructed of 96- inch - diameter corrugated metal pipe and 96 -inch high cast -in -place concrete pipe with a brick floor and an 8 foot by 8 foot box culvert. Condition assessment activities will include closed - circuit television (CCTV) inspection, man - entry, visual inspection, the use of ground - penetrating radar (GPR) /pipe- penetrating radar (PPR) to locate voids outside the culvert, concrete inspection, and reporting of the findings, including rehabilitation alternatives. A more complete description of these services is presented below. The CONSULTANTS covered by this amendment include Brown and Caldwell (principal engineering firm), Bravo Environmental (internal visual inspection subconsultant), and Shannon & Wilson (geotechnical subconsultant). Task 20.1 Internal Visual Inspection Objective Internal visual inspection will be completed to gain an understanding of the condition of the culvert; obtain the highest - quality permanent record of the internal condition of the pipe; ensure that the entire length of the culvert is safe for subsequent man -entry inspections; and aid in the selection of exact locations for additional inspections such as concrete cores. Activities The CONSULTANT will coordinate with the video inspection subconsultant to complete a CCTV inspection of the full length of the culvert. The inspection will be documented per the National Association of Sanitary Sewer Companies (NASSCO) Pipeline Assessment Certification Program (PACP) Standards. Amendment 16, Page 3 Assumptions Task 20.1 will be conducted according to the following assumptions: • No cleaning of the culvert will be conducted. • Inspection will be completed with a manned entry. • No traffic control will be required. Deliverables The following deliverables will be developed under Task 20.1: • CCTV inspection reports • PACP- compliant database — detailed measurements and documentation of the condition of the culvert. • Digital recording of the inspection Task 20.2 Nondestructive Condition Assessment Objective A nondestructive condition assessment will be completed to gain an understanding of the geologic conditions surrounding the culvert. Activities The use of the lower - frequency and high - frequency GPR will be used on the non - ferrous portion of the culvert (i.e. concrete and brick) to determine the concrete wall thickness, identify the presence of reinforcement, and locate voids in the immediate vicinity of the culvert wall (e.g. locations of severe soil migration or locations of decaying timber cribbing). GPR will also be taken from the surface at night to complete the geologic scanning from the surface down the culvert. Surface GPR will be done at night to minimize impacts to traffic as well as to gain a better signal. • The high - frequency signal will give higher- resolution data approximately 2 feet from the sensors. The lower - frequency signal will give lower resolution data but the signal depth will be approximately 7 to 10 feet from the sensors. • Within the culvert, 5 sensor "lines" will be taken longitudinally along the culvert length for each frequency for a total of 10 "lines • Radial scans within the culvert will be taken underneath the roadway every 50 feet and at locations of major defects indentified during the visual inspections or at known past sinkholes locations. • Low frequency GPR will give readings up to 15 feet deep. 4 to 6 sensor "lines" of GPR will be taken on the inner lanes of South Lincoln Street for approximately 600 linear feet. Assumptions Task 20.2 will be conducted according to the following assumptions: • Inspection will be completed with a manned entry. Amendment 16, Page 4 • Traffic control will be required for one night during the surface GPR work, Deliverables The following deliverables will be developed under Task 20.2: • Appendix to Condition Assessment Report (see Task 20.4) Task 20.3 Above -Grade Geotechnical Investigation (Requires City Written Authorization) Objective A geotechnical investigation will be completed to gain an understanding of the geological conditions adjacent to the culvert. Activities Depending on the findings of the GPR investigation, a subsequent .geotechnical investigation is recommended to refine the GPR results as well as obtain the soils information necessary to design the rehabilitation solution, This task can be performed now or as part of any future design effort. Should the CITY authorize the CONSULTANT in writing to proceed with this task, up to six geotechnical borings will be taken to characterize the soils, identify the presence and condition of the former wood formwork, interpret the soil stability and ability of the soils to migrate through defects into the culvert, and provide information necessary for the design of rehabilitation options such as injection of grouting to stabilize the soils. Assumptions Task 20.3 will be conducted according to the following assumptions: • Geotechnical data will be collected using traditional geoprobes. No cores will be taken. • The CITY will assist with obtaining WSDOT permits to conduct work. • Work is to be performed at night. • CONSULTANT will perform all traffic control necessary to support the geotechnical investigation. Deliverables The following deliverables will be developed under Task 20.3: Geotechnical report as an appendix to Condition Assessment Report (see Task 20.4) Task 20.4 Assessment Report The Assessment Report will summarize the individual reports described above and outline proposed rehabilitation methodologies. Amendment 16, Page 5 Activities CONSULTANT will prepare a Draft and Final Assessment Report summarizing the findings of the field investigative activities. Based on the findings, rehabilitation alternative will be developed and presented, along with planning -level cost estimates. Assumptions Task 20.4 will be conducted according to the following assumptions: • Recommendations will be limited to restoring structural integrity to the culvert and soil stabilization to reduce the risk of additional sinkholes. • No hydraulic capacity assessment is included. • No fish passage analysis is included. Deliverables The following deliverables will be developed under Task 20.4: • Draft Assessment Report • final Assessment Report Task 20.5 Project Management Objective Project management activities are needed to provide overall design team leadership and guidance to align the project with CITY objectives and provide project deliverables within budget and time constraints and to coordinate, monitor, and control the project resources to meet the technical, communication, and contractual obligations required for developing and implementing the Peabody Creek Culvert Condition Assessment. Activities CONSULTANT will conduct the following activities under Task 20.5: • Prepare an update of the Project Management Plan to cover Consultant team operations, communication, quality assurance, quality control, and protocols during the project. • Coordinate the activities of Consultant staff, including subconsultants, and the CITY. • Prepare the Health and Safety Plan, which shall be coordinated with subconsultants and shall be provided to all CONSULTANT team members prior to accessing the project area. Deliverables The following deliverables will be developed under Task 20.5: • Five monthly progress reports and monthly invoices • .
