HomeMy WebLinkAbout5.788 Amendment (12)RELATING TO: COMBINED SEWER OVERFLOW PROJECTS //tY1� THIS AMENDMENT NO. 12 is made and entered into this oV- day of .k...t 2012, by and between THE CITY OF PORT ANGELES, a non charter code city of t State of Washington, (hereinafter called the "CITY and Brown and Caldwell, Inc., a California Corporation (hereinafter called the "CONSULTANT WHEREAS, the CITY entered in to an AGREEMENT with the CONSULTANT on July 5, 2006, (the AGREEMENT); and WHEREAS, the CITY and CONSULTANT amended the AGREEMENT•on' February 21, 2007, and May 9, 2007 and March 20, 2008, and September 15, 200'9, and November 30, 2009, March 9, 2010, July 27, 2010, November 16, 2011, December 21, 2010, January 4, 2011, September 20, 2011, and has Proposed Amendment 12 (the AMENDMENTS); and WHEREAS, the CITY desires to amend the AGREEMENT again to amend the Scope of Work, Budget, and Time of Performance, NOW, THEREFORE, in consideration of the representations and the terms, conditions, covenants and agreements set forth in this AMENDMENT, the Agreement and the Amendments are hereby amended as follows: I REVISED SCOPE OF WORK AMENDMENT NO. 12 TO THE AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE THE CITY OF PORT ANGELES AND BROWN AND CALDWELL, INC. PROJECT 06 -01 The scope of professional services to be performed and the results to be achieved by the CONSULTANT are hereby amended by adding the tasks identified in the attached Exhibit A to Amendment 12. The CONSULTANT shall provide and furnish all services and material necessary to accomplish the additional work identified in Exhibit A. II TIME OF PERFORMANCE The work for all Tasks shall be completed by March 31, 2012. Exhibit D to this amendment shows the schedule for the new tasks added by this amendment. Amendment No 12 to Brown and Caldwell Agreement, 06 -01 5'. 76-zr III MAXIMUM COMPENSATION The maximum total compensation and reimbursement payable to the CONSULTANT is stated in the attached Exhibit B to Amendment 12. The maximum compensation amount, referenced in Section VI of the Agreement, is amended from $4,193,413 in Amendment 11 to $4,206,611 in Amendment 12, an increase of $13,196. The budget for any Task may be further adjusted by mutual agreement without an amendment to the Agreement, as long as the maximum compensation amount of $4,206,611 is not exceeded. IV RATIFICATION As amended herein, the Agreement and the Amendments are ratified and confirmed. CITY OF PORT ANGELES: CITY MANAG I CONSULTANT: BROWN AND CALDWELL TITLE: Senior Vi Presid APPROVED AS TO FOR CITY ATTORNEY ATTEST: 41 nt Amendment No 12 to Brown and Caldwell Agreement, 06 -01 Amendment 12 provides new scope of design services for extending the new force mains currently terminating at Oak Street and Railroad Avenue to a location closer to Front Street in order to clear the Phase 1 from within the City's proposed Waterfront project. This work will be incorporated into the Phase 1 bidding documents. OAK STREET EXTENSION Task 11.2 Project Mapping EXHIBIT A To Amendment 12 PROFESSIONAL SERVICES AGREEMENT NO. 06-01 SCOPE OF SERVICES RELATED TO PHASE 1 DESIGN SERVICES FOR THE PORT ANGELES CSO IMPROVEMENT PROGRAM Additional base mapping will be developed by Wengler Surveying to supplement the current project mapping. The new mapping will begin at the southerly limits of the mapping completed in 2007 and extend to the flow line of the curbs along Front Street. A visual inspection and minimal topographic data will be gathered to verify the data mapped in 2007. The new data will be integrated into previous mapping to produce a new map including both 2007 data and the 2012 data. A locate request will be performed utilizing 1- 800 424 -5555 one call locate services. All utilities marked on the ground by representatives of said service will be mapped and shown on said survey The survey information shall be provided electronically in AutoCAD format along with two complete stamped and signed hardcopy record sets (scale 1" 20'). Task 11.7 Force Mains Extension to Front Street The force mains, currently terminated at Oak and Railroad, will be extended on Oak to near Front Street. The current design features for intertieing the new force mains with the existing City 21" force main will be deleted (to be accommodated within an Emergency Response Plan prepared under separate task). Activities 1. Expand research of existing Industrial Waterline (IWL) information to include details that may define that pipeline along Oak Street. Incorporate that information into new section details. 2. Review City provided soil boring information and incorporate into design through design notes. 3. Prepare new plan sheet showing the new pipeline extensions and details of construction and termination. Plan to show relevant surface information provided through new base mapping. 4. Develop new detail and section drawings as necessary to clarify work requirements including surface restoration. Amendment No 12 to Brown and Caldwell Agreement, 06 -01 Assumptions: 1. City to provide soil borings and any commentary provided by geotech. 2. Street restoration will conform to methods employed on First Street Storm Separation project if encountering concrete pavement panels. Existing slopes and grades to be retained. 3. Extension design will be incorporated into Phase 1 bidding documents allowing for mapping to be completed and coordination with Emergency Response Plan to be sufficiently complete and accepted by the City Deliverables 1. Draft contract drawings showing pipeline extension including revision to existing drawings 000 -C- 009, 100 -C -001 and 100 -C -002. 2. Final drawings incorporated into final Phase 1 bid documents.
