PROJECT 06 -01 RELATING TO: COMBINED SEWER OVERFLOW PROJECTS J z fik THIS AMENDMENT NO. 5 is made and entered into this day of NAB 2009, by and between THE CITY OF PORT ANGELES, a non charter code city of the State of Washington, (hereinafter called the "CITY and Brown and Caldwell, Inc., a California Corporation (hereinafter called the "CONSULTANT WHEREAS, the CITY entered in to an AGREEMENT with the CONSULTANT on July 5, 2006, (the AGREEMENT) and WHEREAS, the CITY and CONSULTANT amended the AGREEMENT on February 21, 2007, and May 9, 2007 and March 20, 2008, and September 15, 2009 (the AMENDMENTS); and WHEREAS, the CITY desires to amend the AGREEMENT again to amend the Scope of Work, Budget, and Time of Performance. NOW, THEREFORE, in consideration of the representations and the terms, conditions, covenants and agreements set forth in the original AGREEMENT and this AMENDMENT, the parties hereto agree as follows: I REVISED SCOPE OF WORK The amended scope of professional services to be performed and the results to be achieved by the CONSULTANT pursuant to the AGREEMENT shall be amended to read as shown in the attached Exhibit A to Amendment 5. The Scope of Work shall include all services and material necessary to accomplish the work. II TIME OF PERFORMANCE The work for Task 16 shall be completed within 4 weeks from receipt of the Notice to Proceed. III MAXIMUM COMPENSATION The CONSULTANT'S total compensation and reimbursement are stated in the attached Exhibit B to Amendment 5. Current billing rates are reflected in Exhibit C to Amendment 4. The maximum compensation amount, referenced in Section VI of the Agreement, is amended from $2,997,649 in Amendment 4, to $3,021,649 in Amendment 5, an increase of $24,000. The budget for any Task may be further adjusted by mutual agreement without an amendment Amendment No. 5 to Brown and Caldwell Agreement, 06 -01 Page C of 2 to the Agreement, as long as the maximum compensation amount of $3,021,649 is not exceeded. CITY OF PORT ANGELES: MAYOR CONSULTANT: VICE PR SIDENT APPROVED AS TO FORM: I CI ATTORNEY ATTEST: r Sg dur-getW6.201 Amendment No 5 to Brown and Caldwell Agreement, 06-0 l Page 2 of 2 EX.HIB A To Amendment 5 PROFESSIONAL SERVICES A.GR:EEME:NT NO. 06 -01 SCOPE OF SERVICES RELATED TO PHASE 1 DESIGN SERVICES FOR THE PORT ANGELES CSO IMPROVEMENT PROGRAM Task 16's Scope of Work for engineering services to be provided by Brown and Caldwell (BC) is for the development of to constructing storage to mitigate Tribe wastewater flows during City CSO events. This task is further described as follows: Task 16 (Evaluation of Alternatives): BC will develop proposed projects for diversion of storm flows frorn connected areas within the. City of Port Angeles that will produce comparable effect as the proposed Elwha storage tank. We will also estimate the cost to implement those projects. The BC effort will include collaboration with the City to identify candidate areas and estimate the impact of their disconnectionfrom the City's combined sewers in terms of the approved. CSO control program through modeling. The system model that developed the CSO compliance strategy will be used to determine the volume that has to be removed from the system (based on the City and Tribe agreement that overflow volume and frequency will not be increased) and to measure the effect of removing specific surface areas draining into the CSO system. Essentially, the surface area that has to be removed will be the storage volume divided by the rainfall depth of CSO compliance- critical rain events identified from the modeling. Working with the City and their GIS databases, we will identify and compute the surface areas that could be removed by intercepting given, catch basins. The identified catch basins will be evaluated for collection and discharge to an available and acceptable storm water conveyance feature for discharge, We have not included any field time in Port Angeles but have assumed the City will confirm and help qualify estimated connected areas draining to selected catch, basins. Preliminary sizing of new gravity conveyance piping will be laid out and estimates of construction and project costs will be estimated for completing the disconnection of as many as 4 separate areas. A technical memorandum will be produced describing the methodology, findings and results including diagrams of proposed flow reduction /area disconnection projects. BC will begin work within 2 weeks of notice to proceed and completing the identification of flow reduction projects within 4 weeks (assuming timely input from the City).
