PROJECT 06 -01 RELATING TO: COMBINED SEWER OVERFLOW PROJECTS THIS AMENDMENT NO. 1 is made and entered into this day of 2007, by and between THE CITY OF PORT ANGELES, a non charter code city of the St Washington, (hereinafter called the "CITY and Brown and Caldwell, Inc., a California Corporation (hereinafter called the "CONSULTANT WHEREAS, the CITY entered in to an AGREEMENT with the CONSULTANT on July 5, 2006, (the AGREEMENT) and WHEREAS, the CITY desires to amend the AGREEMENT to amend the Scope of Work, Budget, and Time of Performance. NOW, THEREFORE, in consideration of the representations and the terms, conditions, covenants and agreements set forth in the original AGREEMENT and this AMENDMENT, the parties hereto agree as follows: I REVISED SCOPE OF WORK The amended scope of professional services to be performed and the results to be achieved by the CONSULTANT pursuant to the AGREEMENT shall be amended to read as shown in the attached Exhibit A. The Scope of Work shall include all services and material necessary to accomplish the work. II TIME OF PERFORMANCE The work for all Tasks shall be completed by March 31, 2007. III MAXIMUM COMPENSATION The CONSULTANT'S total compensation and reimbursement are stated in the attached Exhibit A. The budget for any Task may be further adjusted by mutual agreement without an amendment to the Agreement, as long as the maximum compensation amount of $424,941 is not exceeded. SCOPE OF CONSULTING SERVICES EXHIBIT A The original Scope of Services dated July, 2006 provided for a preliminary design evaluation for three alternative configurations of the Francis Street Diversion. On November 1, 2006, four alternative configurations were presented to the City. Based on the presentation, the City suggested three additional alternatives to evaluate that are described as follows: Alternative 5 an upland diversion flow through a gravity sewer and inverted siphon routed under Caroline Street and cross country to the treatment plant headworks. This alternative is intended to create a better performing system with reduced excavation on the lowland, where cultural materials are more likely to be encountered. Alternative 6 This alternative is similar in concept to Alternative 5 except that the deep gravity sewer on Caroline Street is replaced with a new pump station in Francis Street Park and a new force main that would carry the combined PS 4 and Francis Street flows to the inverted siphon for crossing under Ennis Creek. Alternative 7 The third new alternative retains a lowland alignment for the PS 4 and Francis Street pipelines along the toe of marine bluff but avoids cultural resources by placing the pipeline on the ground surface and covering it with a berm. In addition, Alternative 7 would route the flows over rather than under Ennis Creek. The CSO Plan provides for transferring all service area flows to the treatment plant by increasing the capacity of conveyance systems. After the conveyance projects are completed, the flow arriving at the plant will frequently exceed the current treatment plant rated capacity of 13.4 million gallons per day (mgd) during wet weather. The CSO Plan describes two options for managing the excess flows: 1. provide for storage of excess flow in an existing industrial storage tank adjacent to the plant and; 2. provide additional wet weather treatment capacity with a new connection to the existing industrial outfall. Option 1 was proposed in the Plan. Analysis, based on updated flow data, completed as part of the Francis Street project shows that the industrial storage tank volume will be exceeded once or more per year. In addition to evaluating three new alternatives, the following scope of work also provides for the refinement of the flow management concept and initial development of required system components sufficient to describe system performance and cost. Additional archaeological services are also included. AMENDMENT NO. 1 TO SCOPE OF WORK FOR AGREEMENT NO. 06 01 Page 1 of 4 The information developed through these additional elements will be incorporated into the Engineering Report. The Scope of Services in the Agreement is hereby amended to provide: Task 3. Preliminary Cultural Resources Assessment This task is amended to provide for monitoring of geotechnical explorations by Northwest Archaeological Associates to determine whether any cultural resources are encountered. Task 8. Evaluate Three Additional Alternatives This new task provides for the development and evaluation of the three additional alternatives described. The scope for this work includes: Characterization, evaluation, and probable construction cost estimates of each alternative hsted for the Francis Street CSO Project to a comparable level of detail as completed for the initial alternatives. Preparation and presentation of the additional alternative to the City on November 30, 1006. Documentation of each of the additional alternatives in the engineering report to include a complete description, their performance, cost, and requirements for implementation. Task 9. Plant Flow Management System Refinement This new task provides for the development and evaluation of the three additional alternatives described. The scope for this work includes: Evaluate treatment plant hydraulic capacity, plant process effluent performance impacts that may impose hmits on the various hydraulic elements and plant flow through rates. This subtask builds upon the hydrauhc analysis developed in the Plant Re- rating Analysis. The primary constraint to accepting the total flow from City service areas is treatment plant capacity. The plant flow through capacity is dependent on numerous features or hydraulic elements within the plant (such as weirs, pumps, and piping) and the outfall. This information will provide the basis for a determination of what improvements would be required to incrementally increase the flow through capacity of the plant beyond the 13.4 mgd. This work will identify the most feasible capacity that can be achieved for the existing plant processes and increase flow management effectiveness of the industrial storage tank. Evaluate the hydraulic capacity of existing plant outfall and the existing industrial outfall to determine the system configuration requirements that will allow discharge of flows delivered to the treatment plant by the new conveyance systems of these outfalls. The existing City outfall imposes a limit on plant flow- through rates. This constraint varies with tide elevations. An existing industrial outfall, when ownership is transferred to the City, will be available for incorporation into the City plant discharge system. Develop requirements and a system operating strategy for integration of the two outfalls. AMENDMENT NO. 1 TO SCOPE OF WORK FOR AGREEMENT NO. 06 01 Page 2 of 4 Evaluate the industrial storage tank for its performance within the CSO compliance requirements. At a minimum it is expected that plant flow management will include increased flow through the plant and diversion to storage. Depending on frequency of tank overflow, the storage tank may need to achieve some degree of treatment. This subtask provides for refinement of the CSO Plan element of flow management at the treatment plant. Initial sizing estimates of diversion facilities (diversion structure with screens and diversion pumps and piping), return flow system (piping, flow control and pumps), and tank improvements (including treatment features if needed and overflow control) will be made to provide for updating the Plan with projects and costs. To provide a more complete analysis of tank overflow potential, the existing models for the sewer system will be upgraded to include better projection of conditions in November 2005 (missing rainfall period) and this most recent November's record rainfall. Rainfall missing from November 2005 will be gathered from nearby ram gauges. Rainfall for 2006 will be furnished by the City. Projections of total flow will be updated, and the system optimized to reduce overflows at existing locations as well as the tank to less than once per year by enhancing treatment plant throughput. Flow statistics for plant operation will be developed. This work is expected to provide a basis future NPDES permit revisions and updating the Agreed Order with Ecology. Preparation of a financial review will provide the basis for updating the current CSO program packaging, schedule, and costs. The review will identify revenue requirements and provide for updating the program schedule using current data City fund status information and assumptions on future alternative funding sources. A description of a comprehensive flow management system, integrating plant process elements, existing City and industrial outfalls, and the industrial storage tank will be incorporated into the engineering report. The final engineering report is expected to provide the basis for discussions with Ecology. Task 10. State Required Archaeological Survey This new task provides for an archaeological survey of the proposed project in accordance with the requirements of state funding programs. This work will be performed by Northwest Archaeological Associates. II. SCHEDULE Consultant is authorized to proceed with the modified Scope of Services effective on the date of this Amendment. The modified Scope of Services shall be completed by March 15, 2007. III. The estimated com- pensation for the services performed under this Amendment is $85,963.00 which increases the total estimated compensation under the Agreement to $424,940.98.
