HomeMy WebLinkAboutMinutes 10/22/2014 MINUTES PLANNING COMMISSION Port Angeles, Washington 98362 October 22, 2014 6:00 p.m. ROLL CALL Members Present: Nancy Powers, Duane Morris, David Miller, Scott Headrick, George Reimlinger Members Excused/Absent: Brian Hunter, One vacancy Staff Present: Sue Roberds, Scott Johns Public Present: Bill Dawson, Tami Smith PLEDGE OF ALLEGIANCE Chair Headrick opened the regular meeting at 6:00 p.m. and led the Pledge of Allegiance. APPROVAL OF MINUTES Commissioner Miller moved to approve the October 8, 2014 regular meeting minutes with a correction to the motion identifying Commissioner Reimlinger as seconding the motion to approve the September 24 minutes not Commissioner Headrick. The motion was seconded by Commissioner Reimlinger and passed 5 -0. Chair Headrick reviewed the qualifying questions for quasi judicial proceedings with Commissioners. All Commissioners responded that they had no Appearance of Fairness of Conflict of Interest issues to report. The Chair then reviewed the quasi judicial public hearing procedures for audience members. No concerns were voiced from anyone present. Chair Headrick opened the public hearing. SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT—SMA 14-03 1902 Marine Drive: Relocation and construction of a new (total of 2) truck scale in the Industrial Heavy zone. Bill Dawson, 1902 Marine Drive, represented the applicant and noted that the public recreational pathway will be somewhat reduced to 10 feet in the area of the new construction due to topographical constraints. Planner Scott Johns noted that an increase in width for the walking path of 2 feet or so may significantly impact trees planted along the Trail area. A gravel apron would likely serve to widen the area adequately for pedestrians/bicycle users and may be appropriate as it would not so significantly impact the roots area of vegetation along the Trail. Commissioner Miller hoped that the Trail width in this area be left as wide as is possible to avoid congestion for users and conflict with employees on the site. I 4 Planning CO77n77issi0Y7 Minutes October 22,2014 Page 2 Tami Smith, 1902 Marine Drive, represented the applicant and asked if the ultimate Trail development specifies could be part of a landscape plan rather than as an additional condition of approval. She responded to questions from Commissioner Morris regarding the expected the size of replacement trees along the streetscape in this area that they will be one for one and similar in development. There being no further questions, Chair Headrick closed the public hearing. Following brief discussion, Commissioner Miller moved to approve the Shoreline Substantial Development Permit with the following conditions, supported by the following findings and conclusions: Conditions: 1. The applicant is responsible for obtaining all necessary permits from local, state, and federal agencies prior to construction. Verification of permit issuance shall be supplied to the city prior to beginning any site alteration or construction. 2. The subject site shall be inventoried, evaluated, and reviewed to the satisfaction of a cultural review team, which shall include a professional archaeologist, a representative of the Lower Elwha Klallam Tribe, a representative of the site owner, and the Port Angeles Department of Community and Economic Development. This team, in consultation with the DAHP if required by law, shall determine the extent of additional archaeological studies that may include ground disturbance monitoring for the project and/or application for an excavation permit during this permit review process. Any reports generated under this condition shall be submitted to the City. In the event archaeological artifacts, features or human remains are discovered on the property, the permittee will immediately notify the City of Port Angeles Community & Economic Development Department [(360) 417-4750] as well as the Lower Elwha Klallam Tribal Archaeologist. The City, in turn will immediately notify the State Department of Archaeology and Historic Preservation, as required in RCW 27.44 and RCW 27.53. 3. Relocation of the Waterfront Trail shall be completed on the north side of Marine Drive so that pedestrian use of the trail is not interrupted as a result of the project. The trail must be useable prior to commencement of construction of the proposed scale. Appropriate signage and/or marking of the Waterfront Trail to direct pedestrian and bicycle traffic through the mill site in a comfortable and safe manner is required. City staff will assist in identifying appropriate signage and/or marking. 4. Upon completion of the truck scales redevelopment/construction, the site shall be re landscaped including the replacement of all trees removed or damaged as a result of the project. A landscaping plan shall be approved by City staff prior to site development. The number of replacement trees shall be equal to the number of trees removed. I 4 1 Planning Commission Minutes October 22,2014 Page 3 Findings: Based on the information provided in the October 22, 2014, Staff Report for SMA 14-03 including all of its attachments, comments and information presented during the public hearing, and the Planning Commission's discussion and deliberation, the City of Port Angeles Planning Commission hereby finds that: 1. An application for a shoreline substantial development permit was submitted by Nippon Paper Industries USA, on September 5, 2014, to relocate an existing truck scale and construction of a new truck scale within the mill site located at 1902 Marine Drive. 2. A Determination of Non-Significance (#1347) was issued by the City of Port Angeles SEPA Responsible Official for the proposal on October 20, 2014. 3. The Port Angeles Shoreline Master Program, Comprehensive Plan, Zoning Ordinance, critical areas and flood plain ordinances have been reviewed with respect to this application. 4. The site is zoned Industrial Heavy (IH) on the City's Zoning Map. Section 17.34.020 of the Port Angeles Municipal Code identifies manufacturing such as "sawmills, paper mills, pulp mills" as permitted uses in the IH zone. Truck scales are considered as an appurtenant or accessory use to the existing industrial use of the site. 5. The subject area is designated Industrial on the City's Comprehensive Plan Land Use Map, and Urban-Harbor in the City's Shoreline Master Program and Map. 6. The proposed truck scale sites is located in an area designated as having a high likelihood for discovery of archaeological artifacts or cultural resources on the City's Archaeology Predictive Model. 7. The City's Comprehensive Plan and Map was reviewed for consistency with the proposal. The following Comprehensive Plan policies were found to be most relevant to the proposed project: Comprehensive Plan Land Use Element Policies A-2, and G-1; Economic Development Element Policies A-2, 3, & 4; the City's Shoreline Master Program's Urban-Harbor designation Chapter S, Policies D-1 and 2, and all Management Policies. 8. The City's public Waterfront Trail passes along the length of the project and will be relocated as part of the project. Previous permitting conditions for development in this shoreline area required development and maintenance of this public trail. Continued development in the area should ensure that previous conditions are maintained. 9. A row of shore pine trees will be removed to accommodate the inbound scales. Chapter 6, Section C, Regulation 4 of the City's Shoreline Master Program provides that "The City may ... prescribe operation intensity and screening standards as deemed appropriate... special considerations for landscaping and buffer areas shall also be subject to review. " The genus and species of replacement trees shall be approved by the City. 10. The site was posted on September 5, 2014, and notice of the project was published in the Peninsula Daily News on September 10, 2014. One public comment was received by the Department of Community and Economic Development during the written public comment period that ended on October 10, 2014. The comment did not state an objection Planning Commission Minifies October 22,2014 Page 4 to the proposed development but noted concerns regarding use and development of the public trail in this location. 11. The site is located in an area designated as "C, Areas of Minimal Flooding" on the National Flood Insurance Program Flood Insurance Rate Map (Panel #530023 0002C). The specific site is identified with Reference Mark RM4 and shown to have an elevation of 9.33 FT. NGVD. In accordance with Section 15.12.240 PANIC, the Shoreline Substantial Development acts as the necessary floodplain permit for this project. Conclusions: Based on the information provided in the October 22, 2014 Staff Report for SMA 14-03 including all of its attachments, comments and information presented during the public hearing, the Planning Commission's discussion and deliberation, and the above listed findings, the City of Port Angeles Planning Commission hereby concludes that: A. As conditioned, the proposed development is consistent with the City's Comprehensive Plan, Zoning Ordinance, and Shoreline Master Program. B. The project will not be detrimental to the shoreline. C. As conditioned, the project will not interfere with public use of lands or waters. Commissioner Powers seconded the motion that passed 5 - 0. COMMUNICATIONS FROM THE PUBLIC None STAFF REPORTS Scott Johns reported that the City Council adopted the new Shoreline Master Program with one small correction to confirm development within a marina. REPORTS OF COMMISSION MEMBERS Commissioners Reimlinger and Morris attended recent Planners Forum held at City Hall and found it to be interesting. (For the record, Commissioner Hunter also attended.)
