Note to File 1304 West 5 Street Nathan West Director In response to a complaint filed with Manager Myers by Tom Davis (477- 8006), I 417 -4751 phoned Mr Davis on June 14 to discuss his concerns. Mr Davis currently resides immediately west of 1304 West 5 Street, He used to live m the "front unit" at said Sue Roberds residence He arrived m Port Angeles from Victoria, B C to rent the unit after Planning Manager viewing the unit on owner Terry Mills' website ezpa.net. The web site identifies two 417-4750 very attractive duplex units at 1304 West 5 Street in the RS -7 zone The structure Scott Johns originally was a neighborhood market with a residence in the rear The structure was Associate Planner remodeled without permits mid 1900's Terry purchased the property in 2004 417 -4752 Shortly after moving into the duplex unit Mr Davis realized that the wiring was not Roberta Korcz up to Code He observed black mold and heavy moisture. Floonng was uneven and C> Assistant Planner it became clear to him that the units were not being honestly represented as completed 417 -4804 duplex units when property owner Terry told him not to allow the Tax Assessor view Jim Lierly the interior of the structure for any reason, indeed, he was told not to answer the door Building Inspector on the day the Assessor was to visit. Mr Davis complied with the property owner's 417 -4816 wishes in every respect. I did note upon review of County records that the site is listed as a duplex. Linda Pangrle lS"1 Permit Technician Mr Davis was able to get out of a two year lease when he discovered that the State of 417-4815 Washington does not permit more than a single year lease for residential purposes. Patrick Bartholick When the following renter moved into the unit and quickly became ill, he believes Compliance Officer because of the mold issue, she (Fran Dodson) was unable to break a single year lease. Building Inspector A dehumidifier was collecting 10 gallons of water a week from unit 1 Ms. Dodson is 417 -4712 currently not living in the unit. Derek Beery As a helpful, neighboring property owner, Mr Davis assisted property owner Terry Archaeologist Mills in replacing a window in the laundry room and noted heavy black mold 417 -4704 permeating the dry wall. He said he noted the mold to Terry but was told to Just Fax: 360 417 -4711 cover it with plastic. Tie did. Mr Davis is a 30 year retired electrical contractor and is concerned with health issues such as black mold, insulation, electrical wiring; and the permissibility of a duplex in the RS -7 zone He phoned the City to report these issues only once during a time period when Patrick Bartholnck, Code Compliance Officer, was away from the office. Patrick did not have an opportunity to call him back prior to his complaint to the City Manager Action. Contacted Terry Mills by phone on 6/14/10 Reminded him that although the structure was "bootlegged" into a quad plex sometime in the early 90's and has three electrical meters, City records are clear that it is not a multiple family structure. Records mdicate that the electrical meters were allowed to remain when Mr Mills purchased the structure to avoid expensive re wiring but the structure is a single family residence with a storage unit at the rear The structure was ongmally a market with an apartment at the rear (south) However, following a fire in 2001, it remained vacant between 2002 and 2004, and when Mr Mills purchased it nonconforming opportunities had expired. Terry was leaving on vacation and asked if he could rent the front umt and leave the rear vacant until he could deal with the issues upon his retum from vacation. I told him it could remain a single residential structure with a storage unit as long as he wished, or he could apply for an accessory residential umt CUP and follow that process that would require a reduction of one of the units by one half. The Uniform Code for the Abatement of Dangerous Buildings as adopted by Port Angeles Municipal Code 14.03.010 defines conditions or defects which constitute a dangerous building. All buildings which are determined by the Building Official to be dangerous are declared to be a public nuisance and shall be abated by repair, rehabilitation or demolition. All of the buildings at the above-referenced locations have been determined to be a dangerous building perthe 1994 Uniform Code for the Abatement of Dangerous Buildings, Section 302 Items 8, 16 and 17. Item: 8. Whenever the building or structure, or any portion thereof, because of dilapidation, deterioration or decay is likely to partially or completely collapse. 16. Whenever any building or structure, because of obsolesence, dilapidated condition, deterioration, damage, inadequate exits, lack of sufficient fire-resistive construction, faulty electric wiring, gas connections or heating apparatus, or other cause, is determined by the Fire Marshall to be a fire hazard. 17. Whenever any building or structure is in such a condition as to constitute a public nuisance known to the common law or in equity jurisprudence. The Building Official has determined that the dangerous building shall be abated by demolition, within thirty (30)days of the receipt of this notice. This decision may be appealed to the Construction Code Board of Appeals within thirty (30) days from the date ofthis notice, as defined in the Uniform Code for Abatement of Dangerous Buildings. This appeal shall be made in writing and filed with the City Clerk in the manner as set forth in PAMC 14.01.090. Failure of any' person to file an appeal in accordance with those provisions shall constitute a waiver of the right to hearing before said board. The appeal shall be accompanied by a filing fee of $75 and shall contain: 1. A heading in the words: "Before the Construction Code Board of Appeals of the City of Port Angeles"; 2. A caption reading: "Appeal of _", giving the names of all appellants participating in the appeal; ., 3.
