SUBJECT Fence height, trees over property hne and color schemes.
The Department of Commumty Economic Development has reviewed your request
concerning fence height. The fence height at the property line shall be a maximum of 6' -0"
measured from inside the property that it is located on. An 8' -0" max height fence shall be
allowed at the set back lme and a permit is required for such construction.
Your question regarding trees and shrubs overhanging a property line is a common concern from
the public. The City of Port Angeles policy is that this concern is a civil matter between two
neighbors and the city does not get involved m this matter
The requirement of 6' -0" height concermng hedges was removed from the City of Port Angeles
municipal code (see attached) 17 08 45 (H) dated 9 -2007 This may have been removed pnor to
this date. Contact the planning department if a more accurate date is required.
Your concern about color schemes does not apply to the City of Port Angeles municipal code.
The only time a color choice would be enforced is if the CC &R's or a historical ordinance would
be implemented.

first floor of the building, may extend not more than six (6) feet into the front yard setback, eight
(8) feet into the rear yard setback and three (3) feet into the side yard setback. Open railing or
grillwork in conformance with the International Building Code may be constructed around any such

C Planting boxes or masonry planters not exceeding thirty (30) inches in height may
extend a maximum of three (3) feet into any required front yard.

F Detached accessory buildings within the rear one third of a lot are permitted not

17.94.150 Storage of Merchandise or Vehicles in Yards and Rights- of -Wav
A In residential and commercial zones, the storage of merchandise, appliances or
vehicles in front or side yards shall be prohibited, provided, however, that car dealerships, boat
sales, lumber yards, nurseries, and car rental services shall be exempt from this requirement.
B In no zone shall the storage of any articles or vehicles be permitted to extend into

VALUATION OF CONSTRUCTION In all cases, a valuation amount must be entered by the applicant. This figure will be reviewed
and may be revised by the Building Division to comply with current fee schedules. Contact the Permit Coordinator at 417 -4815 for assistance.
PLAN CHECK FEE IF a plan check fee is due it must be submitted at the time the building permit application and construction plans are
submitted. All other permit fees are due at the time of permit issuance.
EXPIRATION OF PLAN REVIEW If no permit is issued within 180 days of the date of application, the application will expire. The
Building Official can extend the time for action by the applicant up to 180 days upon written request by the applicant (see Section 107 4 of
the Uniform Building Code, current edition) No application can be extended snore than once.

Approval with the following conditions:
Conditions:
1. A separate SEP A checklist, ESA application, and geotechnical report must be submitted for
any future proposed development within the 50-foot marine bluff buffer.
2. The tight line from the down spout located at the west end ofthe deck shall be buried per the
current building code requirements. Specifics shall be added to the building permit when
issued.
3. A Building Permit for the structure shall be applied for and must be obtained from the City's
Building Division. The structure shall meet all current building standards, including (but not
limited) to wind load requirements.
4. The applicant shall submit a signed hold harmless agreement per the City's form for a
building located within the ESA buffer area.

1. An application for review under Chapter 15.20 PAMC (Environmentally Sensitive Areas)
was received and determined to be complete on July 1, 2004, from Vince DeBenedette for
the approval of the construction of a roof covering over an existing deck within the required
50-foot marine bluff buffer.
2. The subject property consists of one parcel, located at 914 Milwaukee Drive.
3. The deck cover was constructed prior to submission of permit applications, and measures 10'
x 20'. Only the northeast corner of the deck cover extends into the required setback from the
top of the bluff. The closest point of the deck cover to the top of the marine bluff is 48',
while the northwest corner is 53' from the top of the bluff.
4. Portions of the deck and stairs extend closer to the top of the bluff than the roof cover. The
deck existed prior to the construction ofthe roof cover and is a permitted use, not requiring
a building permit, because it is below 30" in height.
5. The subject site is zoned RS-9, Residential Single Family.
6. A July 1, 2004, letter prepared by Northwest Territories, Inc identified the rate of bluff
erosion on the site to be approximately 2 inches per year. An earlier letter dated June 18,
2004 indicated that the roof as constructed would have no effect on the stability of the bluff.
7. The site is separated from the neighbor to the west by a privacy fence and laurel hedge, both
approximately 6 feet in height. The existing fence and hedge disrupt the view from the
neighboring property's first floor windows. The neighbors second story windows overlook
the subject roof. The wall constructed on the subject site would create a loss of view angle
of approximately 80 if the fence and hedge were not currently blocking the view. Aerial
photographs and an on-site inspection were used to make this analysis.
8. The new roof area is constructed with gutters and down spouts which the applicant states
are connected by a tight line into the existing on site storm drain system and transported to
the City storm water system.
9. Portions of the subject property meets the definitions of an environmentally sensitive area
as defined by PAMC 15.20 (Environmentally Sensitive Areas Ordinance). The purpose of
the Chapter is to protect environmentally sensitive areas in accordance with the Growth
Management Act. The intent of the Chapter is to use a function and values approach and
establish minimum standards for properties containing environmentally sensitive features in
order to protect the public health, safety and welfare which includes: a) avoiding disturbance
of these areas, b) mitigating such impacts, c) protecting the public from personal injury, loss
of life or property damage due to erosion and landslides, etc., and d) protecting against
publicly financed expenditures from misuse of environmentally sensitive areas.
10. All development proposals in environmentally sensitive areas shall comply with the
requirements and provisions of Chapter 15.20 P AMC. The responsibility for administration
and enforcement of the provisions of the Chapter shall rest with the Community Development

Director or his designee. The subject site and neighboring properties have landscaped yards
nearly to the edge of the bluff. These yards are previously altered Environmentally Sensitive
Areas.
11. The application included an environmental checklist as required under RCW 43.21 C and
PAMC 15.04. A Mitigated Determination of Non significance (#1077) was issued on July
16,2004,2004, by the City's SEP A Responsible Official in compliance with RCW 43.21C
and WAC 197-11.
12. The application was posted on the property on June 28,2004, published in the Peninsula Daily
News on June 30, 2004, and notice was mailed to property owners within 300 feet of the
subject property on June 28, 2004. Three letters were received regarding the application by
July 15,2004, the stated deadline for public comment. Two letters expressed support for the
project and one letter questioned the structure's wind load engineering and whether the setback
was adequate based upon a recommended setback for an adjacent property.
Conclusions:
1. As conditioned, the proposal is consistent with the requirements for development adjacent
to a marine bluff, which is an Environmentally Sensitive Area as defined in P AMC
15.20.030(N).
2. As conditioned, the proposal will result in the least impact to the sensitive area and take into
consideration site constraints associated with the subject property.
3. The Community Development Director concluded that the applicant's environmental
information satisfies the requirements ofP AMC Sections 15.20. 040(E). To show the location
of the boundary of an environmentally sensitive area. Since the applicant is constructing
within this boundary, approval is conditioned upon a qualified geotechnical report and
subject to the applicant holding the City harmless for such construction.
4. The letters submitted by a Geotechnical Engineer provide a basis for approving the requested
construction such that it will be in the public interest, safety, and welfare.
5. As conditioned, the proposal is consistent with the Port Angeles Comprehensive Plan and
the City's Zoning, and Environmentally Sensitive Areas Ordinances.
6. The additional impervious surface will not create adverse stormwater impacts on the marine
bluff.
