DATE: September 26, 2008 TO: Wade and JoAnne Powers FROM: Sue Roberds, Planning Manager RE: Boundary Line Adjustment BLA 08-08 Building Permit 08-1109 Attached you will find preliminary approval of the boundary line adjustment application that you submitted to this office. The next step is for you to have the survey completed that moves the existing boundary line to create the new site boundaries for the two lots that you own. Until this is done and filed, the lots have not been changed, and the building permit cannot be issued. An alternate approach is for you to file a Zoning Lot Covenant with the County Auditor's Office which effectively removes the interior lot lines and creates one large lot from your two existing lots. If you then wish to recreate the second lot, you can proceed with the survey that short plats the two lots once agall1. Either method will ensure your two lots; however, if you are in immediate need of a building pennit to begin work, you may wish to do the Zoning Lot Covenant and the re plat later. I'm not sure that anyone fully explained the process to you when you submitted your application materials, so wanted to more completely explain the process herein. Legal Description: BLA 08-08 POWERS Riedel II Subdivision Lot 28 V14 P68 .25A- generally known as 1305 Rook Drive, and Reidel II Subdivision Phase II Lot 23 .46A generally known as 1304 Forest Trail Drive. III. Determination: Approval subject to the following conditions, findings, and conclusions: Conditions: 1. The final drawing shall be entitled "BLA 08-08 Powers" and shall identify Parcel A- as 1305 Rook Drive, and Parcel B as 1304 Forest Trail Drive. . The survey shall identify previously established drainage easements that exist along both sides of Parcels A and B. 2. A final survey shall be prepared by a licensed surveyor and recorded with the County Auditor's Office per Section 16.12.070 PAMC. A copy of the final recorded survey shall be provided to the City Department of Community and Economic Development. 3. In order to ensure that the adjustment does not create additional lots, the following wording shall be included on each deed filed as part of the adjustment and on the mylar: "This conveyance is for the purpose of accomplishing a baundalY line adjustment pursuant to RCW 58. J 7. 040(6). It shall not create any additionallats, tracts, parcels, or division. Rather, the land described herein shall merge ar be integrated inta abutting property presently owned by the grantee(s). " Findings: 1. Approval is based on a boundary line adjustment application submitted and determined to be complete on September 19,2008. The proposal will adjust the boundary line between two existing properties in the RS-9, Residential, Single Family zone to provide additional buildable area to proposed Lot A. Both parcels are owned by the applicants. 2. Lot sizes in the RS-9 zone must be at least 9,000 square feet in area. Before adjustment, Parcel A contains .246 acre (approximately 10,715 [t2), and Parcel B contains .453 acre (approximately 19,750 ft2) for a total of .699 acre. After the adjustment, Lot A will contain .312 acre (approximately 13,600 fe), and Lot B will contain .387 acre (approximately 16,865 ft2). Total lot area will not change. Proposed Parcel A is addressed as 1305 Rook Drive and is developed as a single family residence with access only from Rook Drive. Proposed Parcel B is addressed as 1304 Rook Drive, is undeveloped, is accessed only from Forest Trail Drive. 4. Section 16.12.060 PAMC and 58.17.040 RCW require the Director of Community and Economic Development to determine that no additional/new lots are being created, that all lots created meet minimum lot width and area standards for the zone in which the property is located, that the adjustment does not increase the degree ofnonconfoDnity of structures with respect to zoning standards, and that provisions for adequate access and necessary utility easements are made. 5. Comments from the City's Public Works and Utilities Department, Fire Department, and Building Division have been considered in the decision and addressed in the conditions of preliminary approval. Public services, police and fire, water, electric, telecommunications are available to the site. 6. The proposal has been reviewed with respect to the goals and policies of the City's Comprehensive Plan and Land Use Map. The Plan requires concurrency for streets, water, sanitary sewer, and electrical service. 7. A survey shall be prepared and recorded with the County Auditor's Office per Section 16.12.070 P AMC. Full surveys are not required for boundary line adjustments when a' single property line is involved. The mylar shall contain signatures of all property owners and signature blocks for the Plmming Manager and Public Works and Utilities Director. In order to be considered final, a copy of the recorded survey shall be provided to the Community and Economic Development Department. 8. Section 18.02.020 of the Port Angeles Municipal Code categorically exempts boundary line adjustments from the consolidated development permit process. Concl usi ons: A. The proposal is consistent with provisions of the P01i Angeles Zoning Ordinance, specifically Chapter 17.11 (RS-9, Residential Single Family) of the Port Angeles Municipal Code, and with Chapter 58.17 RCW of the Washington State Subdivision Act. B. The adjustment allows for expansion of a deck located at the n01ih (rear) of the single family home on proposed Parcel A. Existing site development does not allow for the desired expansion due to required setbacks. The minor boundary line adjustment does not affect the density of the neighborhood and ensures that adequate building space remains within proposed Parcel B (1304 Forest Trail Drive) to enable expected development of that building site Boundary Line Adjustment - BLA 08-08 Powers September 25. 2008 Page 3 C.
