Vashon Avenue Port Angeles, WA 98362 RE: Additional living unit 533 E. Vashon Avenue • Dear Mr. Kildall: Several months ago we spoke about some remodel work you were doing at your residence at 533 E. Vashon Avenue in the City's RS-7 Residential Single Family zone. You indicated that you were not creating another separate living unit in your residence but that you were sharing the upstairs kitchen with another person who lived with you and creating some "additional shared area above the garage." It was acknowledged that the downstairs unit had `' been used as a nonconforming accessory living space for some time. My concern and the reason for my call to you was because it appeared you were constructing another separate living unit in the upstairs area. We ended our conversation with you saying that the upstairs was a single shared living space and you were simply creating additional area for yourself and someone who shared that space with you. This understanding now seems flawed per the attached information from Craig's List regarding the"newly expanded separate living area in my house that provides complete privacy." It is important for you to understand that, while the City's zoning ordinance does permit accessory residential dwelling units(ARUs)to be established in residential zones, only one such unit can be permitted such that occupancy is no more than one full unit and one ''A unit in a single family zone. With the pre existing downstairs apartment unit,you already have that occupancy and are not eligible to establish another separate living area in your residence. Rental of the area of your home depicted in the Craig's List ad in addition to the pre existing } downstairs apartment structure is a violation of the City's Zoning Ordinance as is codified in Title 17 of the Port Angeles Municipal Code. Your attention to this matter is appreciated. Please let this Department know how you intend to proceed.
