HomeMy WebLinkAbout001064 Amendment 1 001064 AMENDMENT NO. 1 TC) THE AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE CITY OF PORT ANGELES AND LAYNE CHRISTENSEN OCA 2016-18 THIS AMENDMENT NO. I is made and entered as of the date of the last signature affixed below, by and between the City of Port Angeles, a non-charter code city and municipal corporation of the State of Washington, (hereinafter called the "CITY") and Layne Christensen Inc, a Delaware corporation authorized to do business in the State of Washington (hereinafter called the"CONSULTANT"). NOW, THEREFORE, in consideration of the representations and the terms, conditions, covenants and agreements set forth in the original AGREEMENT' and this AMENDMENT, the parties hereto agree as follows: SECTION I The CITY entered into the existing AGREEMENT with the CONSUU17ANT on May 5, 2016 (the AGREEMENT). SECTION 2 1 TIME OF PERFORMANCE Section IV of the Agreement is amended in its entirety to read: The CONSULTANT may begin work upon execution of this agreement by both parties and written direction to proceed from the CITY. The duration of the Agreement shall extend through December 31,2017. The schedule for each specific task is in Exhibit B attached to this agreement, 11 MAXIMUM COMPENSATION Section VI of the Agreement is amended in its entirety to read: Unless otherwise agreed to in writing by both parties, the CONSULTANT'S total compensation and reimbursement are stated in the attached Exhibit C to Amendment 2. The maximum compensation amount, referenced in Section VI of the Agreement, is amended from $15,000 to $30,000, and increase of $15,000. The budget for each task is as set forth in the attached Exhibit C. The budget for any Task may be further adjusted by mutual agreement without an amendment to OCA 2016-18 Amendment 1,Page 1 2/2/2012 the Agreement, as long as the maximum compensation amount of$30,000 is not exceeded. 11 REVISED EXHIBITS Section XVII is amended to strike Exhibit A attached to the Agreement and replace it with Exhibit A attached to this Amendment. All references to Exhibit A in the Agreement shall refer to the Exhibit A attached to this Amendment. Section XVII is amended to strike Exhibit B attached to the Agreement and replace it with Exhibit B attached to this Amendment. All references to Exhibit B in the Agreement shall refer to the Exhibit B attached to this Amendment. SECTION 3 RATIFICATION Except as modified herein, the original AGREEMENT is confirmed and ratified. Bloor, City Attorney OCA 2016 18 Amendment 1,Page 2 2/2/2012 EXHIBIT A Professional Services Agreement SCOPE OF SERVICES BACKGROUND The Consultant is to assist the City with the performance testing and continued long-term monitoring program of the City's Ranney Collector Well. A reduction in infiltration/recharge to the aquifer may impact the performance of the Ranney collector well, as might the continued presence of the main channel of the river, and majority of flow within the river, toward the opposite river bank from where the well is located. The Scope of Work shall include professional services to evaluate the Ranney Well performance which shall encompass the following professional services: Task 1: Ranney Well Performance Testing Activities: Performance tests of the Ranney Well will be completed by City staff every six months (April and October). The performance tests should be consistent with previous testing for comparison purposes. The performance tests should include a 6-hour variable- rate step-drawdown test conducted at the following rates and durations: Step Pumping Rate Duration, hours 1 4000 gpm 2 2 5000 gpm 2 3 6500 gpm 2 These are the same rates and durations as previous testing completed in 2013, 2014, 2015 and 2016. Following recovery from the step-drawdown test, City staff shall perform a constant-rate test at a rate of 4000 gpm for a period of at least 30 hours. Assumptions: • City staff will perform the step-drawdown and constant-rate testing similar to that recently completed. The City shall provide the water level data to the Consultant for evaluation. • The tests of the Ranney Well shall be conducted in April and October 2017. Task 2: Reporting Activities: The consultant shall provide the City with a report developed from the data that presents the current status of the well. These reports shall include the following: Professional Services Agreement Amendment 1 Page 1 of 4 1. Results of the Ranney Well performance tests shall be analyzed to evaluate the efficiency of the Ranney Well and to make projections of yield and anticipated operating conditions. 2. Review of long-term operational data for the Ranney Well provided by the City. 3. Outline potential remedial measures to enable the Ranney Well to continue to meet City water demands. 4. Graphical and tabular displays of the current data for the Ranney Well. 5. All pertinent data collected during the project that shall be useful to facilitate future comparisons of the condition of the Ranney Well. Deliverables: 1. Draft Report 2. Final Report. Return to Luck} ' CI'RzCTzfiiATort COMMENTS: Layne Christensen, Inc., has been assisting the City with professional engineering services to evaluate the operating performance of the City Ranney well and the recharge to the aquifcr, City Counil approved a contract arnendrnent to extend Layne Christensen„ Inc., technical and engineering services through 2017. The arnendnient will allow the City to continue to monitor and evaluate the infiltration/recharge to the aquifer and any impacts on the performance of the Ranney well. To accomplish this,Layne Christensen will assist with the following tasks: Task 1:Ranney Well Performance Testing Task 2:Reporting Funding for the contract extension is available in the 2017 Water Utility Operations budget,,line item 402-7380-534-4150. The professional service agreement,PSA 2016-18,with Layne Christensen,Inc.,has been accepted by City Council in an amount not to exceed S 15,0001,increasing the total contract amount to $30,0010.
