To facilitate such installation in compliance with the Nationwide Programmatic Agreement for the Collocation of Wireless Antennas executed by The Federal Communication Commission (TF='), the National Conference of State Historic Preservation Officers and the Advisory Council On Historic Preservation(the'Programmatic Agreement'),Landlord acknowledges the following: 1. The Tower was constructed before March 16,2001. 2. The mounting of the proposed antenna and/or other equipment will not result in substantial increase in the size of the tower as defined in Stipulation 1.0 of the Programmatic Agreement, 3. To the best of Landlord's knowledge,Landlord has not received notification that the FCC has determined that the Tower has an effect on one or more historic properties, or if such an effect has been found,such effect has been found to be not adverse through a conditional no adverse effect determination,a Memorandum of Agreement,a programmatic agreement,or the tower is otherwise in compliance with Section 106 and Subpart B of 36 CFR Part 800. 4. To the best of Landlord's knowledge, the Tower is not the subject of a pending environmental review or related proceeding before the FCC involving compliance with Section 106 of the National Historic Preservation Act. 5. To the best of Landlord's knowledge, Landlord has not received notification that the FCC is in receipt of a complaint from a member of the public, a State Historic Preservation Office, or the Advisory Council On Historic Preservation that the Tower has or wilt have an adverse effect on one or more historic properties.
