AN ORDINANCE of the City of Port Angeles, Washington amending Chapters 2.18 Hearing Examiner, 2.36 Planning Commission and repealing Ordinance 1796, Chapter 2.52, Board of Adjustment of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO HEREBY ORDAIN AS FOLLOWS: Section 1. Ordinance 3536 as amended, and Chapter 2.18 of the Port Angeles Municipal Code relating to Hearing Examiner are hereby amended to read as follows: 2.18.060- Functions, issues and jurisdiction of the Hearing Examiner. Substantial Development Permits -All applications except those deemed administrative actions pursuant to subsection 2.18.065(35). b. Conditional Use Permits. C. Variances. 54. Variances-.- a. ariances:a. Standard rc 6. Appeal Bldg. Official determination. 1 7-5 Preliminary overlays-zones: a. Planned Residential Developmerit Gvef-4ay Zone(PRD)-. b. Planned Low impact Development Overlay ;zone (PLID). e. iaccd Gvisicrcicl Ovefra�,(MCO). d. Approval of uses not expressly ermitted in a specific zone in light of the zonin intentions and consistent with the Comprehensive Man. B. Appeal Procedure As to all of the foregoing issues and matters, the decision of the Hearing Examiner shall be the final decision of the City. The decision of the bearing Examiner in these cases may be appealed to Superior Court. Appeals must be filed within 15 days of the notice of decision. 2.l 8.065 - Functions, issues and jurisdiction of the Director of Community and Economic Development. A. Appeal Procedure As to all of the foregoing issues and matters, the decision of the Director shall be an administrative decision. Such decision may be appealed to the Hearing Examiner, provided that the appeal must be filed with the City within 15 days after the :Director issues the decision, provided that if longer appeal period is established by state law,the longer period shall control. Section 3. Chapter 2.52 of PAMC and(.ordinance 1.796 is repealed in its entirety. CHAPTER 2.52 BOARD OF ADjUSTMENT 2.52.010 Establislunent Member-ship. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of the scrivener's/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Section 5-Severability. If any provisions of this Ordinance,or its application to any person or circumstances„ are held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 6 - Effective Date. This Ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum. This ordinance shall take effect five(5)days after passage and publication of an approved summary thereof consisting of the title. These ordinances are not subject to referendum and shall be in force and take effect 5 days after publication according to law.
