Dear Mrs. Grasser:
I am sending you this letter as an official follow up to your letter requesting a minor
deviation of a side yard setback in order to construct the remainder of a deck and a set of
stairs at 1023 East 8th Street. Following my site investigation in August, 2004, the Building
Inspector was instructed to continue with his inspection under your original permit (#04-
00000551) to complete the deck. I do not believe you need a minor deviation, and although
I am not convinced that you technically are in observance ofthe required 7' side yard setback
for your deck, I do not believe that making an issue of it at this time would serve a useful
purpose.
I believe that the situation resulted from a combination of misinformation that was supplied
with your building permit application, i.e., the wrong lot size on the site plan, and distances
to the fence and am glad that the situation was so easily resolved with a site visit.
I hope that you are now enjoying your new deck and that the dust has settled, so to speak.

Following much confusion over a 240 sq.ft. deck construction at the above address, I did a
site visit to ascertain what the real issue was. We received a minor deviation request from
Kristy Grasser asking for a minor deviation of a setback in order to construct a set of stairs
within a setback area and to complete a partially built deck. During the site investigation, I
noted that the deck (permitted under permit 04-551) had been only partially constructed as
was permitted and the steps ended at a fence, which was very awkward. Ms. Grasser had
instructed the contractor to redo the stairs so that they didn't terminate at the fence and to
construct the remaining Yz width of the deck as it was only 3' wide as built but had been
permitted to be 6' wide - thus she thought she had to ask for the minor deviation because she
believed she could only have a 3' wide deck, which was not accurate.
All in all, she didn't need a minor deviation as the whole issue seemed to have resulted from
the contractor not identifying the actual property lines, the distances from the setbacks to the
deck, or the property size.
I am filing the paperwork with the building permit and am not completing a minor deviation
because I don't believe there is an issue with this situation that needs a minor deviation.

VALUATION OF CONSTRUCTION: In all cases, a valuation amount must be entered by the applicant. This figure will be reviewed

PLAN CHECK FEE: IF a plan check fee is due it must be submitted at the time the building permit application and construction plans are

17.94.155 Use of Residential Streets. Subject to any otherregulation ofthe use of streets under
this Code, no owner or occupant ofland abutting a public street, which land or street is in a residential
zone or is the boundary of a residential zone, may use such street for the habitual or overnight parking
or storage of commercial motor vehicles or trailers. Excepted from this prohibition is the parking on
the street of one commercially used vehicle which is driven to and from the work place by the owner
or occupant of the dwelling unit. (Ord. 2862, 4/14/95)
17.94.170 Exception to Height Requirement. The height restrictions in this Title shall not apply
to church spires, monuments, chimneys, antennas, water towers, elevator towers, mechanical equipment,
and other similar rooftop appurtenances usually required to be placed above the roof level and not
intended for human occupancy or the provision of additional habitable space; provided that mechanical
equipment rooms and screening are set back at least ten feet from the edge of the roof and do not exceed
twenty feet in height. (Ord. 2861 91 (part), 3/17/95)
17.94.180 - Minor Deviations
A. A minor deviation from front, side, and rear yard setbacks, lot coverage, and height
requirements established in this title may be granted by the Planning Director in accordance with the
provisions of this section.
B. A minor deviation may be granted ifall of the following findings are made:
1. The granting ofthe minor deviation is consistent with the purpose ofthe zone in
which the property is located and the project is otherwise consistent with the requirements of said zone.
2. Because of special circumstance, the strict application of the zoning ordinance
results in an undue hardship upon the applicant.
3. The minor deviation will not be materially detrimental to the public welfare or
injurious to property or improvements in the vicinity and zone in which the subject property is located;
and
4. The minor deviation is not greater than 10% of the requirement being deviated
from.
5. The site has been posted and adj acent property owners notified fifteen (15) days
prior to approval of the minor deviation.
C. Any applications that are not granted a minor deviation by the Planning Director pursuant
to this section must obtain a variance through the City's normal variance procedure as set forth in
Chapter 2.52 P AMC. (Ord. 2956 94, 4/25/97)
