HomeMy WebLinkAbout001249 Original Contract The City of Port Angeles Record # 001249 AGREEMENT TO PAY DELINQUENT UTILITY BILLS This Agreement is made between the City of Port Angeles (hereinafter referred to as the "City' and Cherie Smith, a single woman who resides at 608 S Cherry St in the City of Port Angeles. In consideration for the benefits to be derived from compliance with this Agreement, the parties recite and covenant as follows: 1. Recitals. A. The City claims that as of July 6, 2017, Cherie Smith owes back utility bills in the amount of $1158.78, not including interest and penalties. Because of this past due amount, the City has placed a limiting device on Ms. Smith's electric meter that allows her to power her medical device but not her entire home. B. Cherie Smith acknowledges that she is delinquent in payment to the City for utility services it has humished to her and under both state law and city ordinance, the City could now disconnect utility services 608 S Cherry St. 2. Agreement to pay past due amounts. A. For the purposes of satisfying the delinquent utility charges owed by Cherie Smith, she agrees to pay $400 a month. This will first be applied to any current utility charges, and the remainder will be applied to the past due balance until the balance is paid in full. The first payment will be paid by July 14, 2017. Each subsequent monthly payment will be paid by the due date on the previous month's bill. The payments may be made in installments, but the full $400 must be paid by the due date on each monthly bill. For example, the August 2017 $,400 payment must be paid in full on or before the due date on the July 2017 bill, Once the outstanding balance is paid in full,the minimum $400 payment will cease. There will be no penalty for prepaying the past due balance. B. The City will remove the electric meter limiting device upon receipt of the first$400 payment. C. So long as the payments required by paragraph A are timely made in full, the City agrees it shall not disconnect utility services to Ms. Smith residence at 608 S Cherry St. D. The City agrees that it shall accept, as full and complete compromise and satisfaction of the delinquent utility payments now accrued, the installment payments described in paragraph A above, As long as the payments are made in a timely manner, and the sum of$1158.78 is fully paid,then the City will forgive any interest and. E. So long as Cherie Smith remains in good standing with the terms of this Agreement,no additional interest and penalties will accrue, F. In the event Cherie Smith fails to timely and fully make any payment required by paragraphs A, the City may declare this agreement to be terminated. In that event, the full amount of interest and penalties, calculated as if this Agreement had not been made, shall immediately become due and payable; and the City may disconnect utility services, re- install the electric meter limiting device, and pursue its legal remedies to collect the sums due. 3. Entire Agreement. This Agreement constitutes the entire agreement between the City and Cherie Smith and it supersedes all prior communications and proposals, whether electronic, oral, or written between the City and Cherie Smith with respect to the delinquency covered by this Agreement, IN WITNESS WHEREOF, the City and Cherie Smith have executed this Agreement as of the date and year last written below.
