Ms. Riggs, In response to your legal action request(dated 8/4/2017), please note the Attorney for the City of Port Angeles, Mr. Bill Bloor, has the statutory responsibility to prepare any ballot title or explanatory statement regarding a "Change in City's Form of Government." See RCW 29A.36.071; RCW 29A.32.241(d). In connection with the contemplated proposition, please use the following ballot title that was submitted by the City of Port Angeles for the upcoming 2017 General Election: CITY OF PORT ANGELES PROPOSITION NO. I CHANGE IN CITY'S FORM OF GOVERNMENT After receiving a citizen petition from Our Water-Our Choice, the City Council for the City of Port Angeles adopted Resolution No. 11-17, concerning a change In the form of the City's government. If approved, the City of Port Angeles, a non-charter code city, will change from the current council-manager for-in of government under RCW 35A to the council-manager form of government under RCW 35 in a second class city in order to elect a full new city council. Should this proposition be approved? Yes .... 0 No ..... 0 The ballot title above appears to meet the legal requirements of RCW 29A.36.071,29A.72.050. Additionally, and in connection with the aforementioned ballot title, please use the following explanatory statement that was submitted by the City of Port Angeles for the upcoming 2017 General Election: Ms. Shoona Riggs re Ballot Title/Explanatory Statement for City of Port Angeles August 8,2017 Page 2 EXPLANATORY STATEMENT A citizens' group,Our Water-Our Choice, wrote and circulated a petition to hold "an election so the voters of the City of Port Angeles can decide whether to change from the current council-manager form of government under RCW 35A to the council- manager form of government under RCW 35 in a second class city in order to elect a full new City Council." The Clallarn County Auditor issued a Certificate of Sufficiency certifying that the "petition substantially complies with the requirements of RCW 35A.01.040 and RCS' 35A.06.040." The Proposition No. I is presented to the City of Port Angeles voters at the 2017 municipal general election. Ms. Riggs, In response to your legal action request(dated 814/2017), please note that the Attorney for the City of Port Angeles,, Mr. Bill Bloor, has the statutory responsibility to prepare any ballot title or explanatory statement for an advisory vote regarding the possible fluoridation of the municipalities water supply. See RCW 29A.36.071; RCW 29A.32.241(d). In connection with the contemplated advisory vote, please use the following ballot title that was submitted by the City of Port Angeles for the upcoming 2017 General Election: CITY OF PORT ANGELES PROPOSITION NO. 2 FLUORIDATOIN OF MUNICIPAL WATER SUPPLY The City Council for the City of Port Angeles adopted Resolution No. 12-17, concerning fluoridation of its municipal water supply. This is an advisory ballot,and is not binding on the City Council. However, the Council will be guided by the results of this ballot in deciding whether to resume fluoridation. There has been much debate as to whether the City should fluoridate its municipal water supply. In August 2016, the City Council suspended the practice of fluoridation until the voters of the City, at a municipal general election, can express their opinion regarding fluoridation. This is an advisory ballot,and is not binding on the City Council. However,the Council will be guided by the results of this ballot in deciding whether to resume fluoridation. This statement was prepared by William Bloor, City Attorney for Port Angeles; 321 E.Fifth Street,Second Floor, Port Angeles, WA 98362;(360)417-4536. The explanatory statement above appears to comply with the requirements contained in the Clallam County Auditor's Administrative Rules for Voter Pamphlets §6.63.
