COMMUNICATIONS FROM THE PUBLIC John Ralston, PO Box 898 Mr. Ralston wanted staff and the Planning Commission to start a conversation about short term rentals. He has been in contact with a lot of short term rental owners and felt that there should be an educational meeting for the Commissioners on VRBO. APPROVAL OF MINUTES: Commissioner Hopkins asked for a correction at the bottom of page two, his name was placed in the stead of Commissioner Amoroso. Commissioner Amoroso agreed. Staff noted the needed change. Commissioner Hopkins moved to approve the May 24, 2017 minutes with the change. Commissioner Powell seconded, all were in favor. PUBLIC HEARINGS/ACTION ITEMS 1. Façade and Sign Grant Application: No. 17-04 The Answer For Youth (TAFY) Chair Morris recused himself because he is a current board member for TAFY Assistant Planner Ben Braudrick gave a presentation on the façade grant application for TAFY. The application requests a grant award amount of $9,499.36 toward the installation of new windows and awnings, and repainting of the building exterior valued at $18,998.72. Commissioner Bailey asked how staff defined the “façade”, noting that the project include large portions of the entire building. He felt that the definition would mean the front of the building. Assistant Planner Braudrick responded that historically the façade grant has evolved. The way it is currently defined is the way the façade is contributing to the street frontage. The TAFY building has large parking lots to the east and west, which make those sides of the building highly visible. This is why the whole building is being considered under the grant. Planning Manager Allyson Brekke added that Staff relies on the criteria that is built into the grant Planning Commission Minutes June 28, 2017 Page 2 program. Public visibility is a criteria of the grant and the sides of a building could still be visible from a street. Commissioner Amoroso asked if a paint estimate had been received, noting that there was a high labor charge. Assistant Planner Braudrick replied that the Federal Prevailing Wage Rate would have to be used because the labor amount was over the $2000.00 minimum. What is in the packet is what staff received in the application. Commissioner Hopkins asked if the grant required the work be bid. Planning Manager Allyson Brekke responded that she was uncertain of the need for bid work, but that the federal rates and wages are essential for anything above $2000.00. The City’s legal team ensures through the contract that the amount provided is correct and the invoicing that is provided for reimbursement is correct and meets all federal standards. Commissioner Bailey asked if the receipts provided for reimbursement needed to include all work and materials to be fully reimbursed. Planning Manager Brekke responded that the City only reimburses 50% of what is given. The work has to be complete. The City cannot provide reimbursement for work if the project has not been completed in its entirety. Commissioner Bailey asked if volunteer work was provided, would that bring equal match. Assistant Planner Braudrick added that the City was only going to be reimbursing 50% of what was provide via invoice. He didn’t know if there was any in-kind work associated with this work. Commissioner Hopkins asked if grant funding had been used for window replacement. Assistant Planner Braudrick replied that it had on many occasions. Ms. Susan Hilgren, owner of TAFY, was asked by the Vice Chair if she had anything to add to Staff’s presentation. Ms. Hilgren reviewed the work that had already been done on the project, and also what TAFY’s Business Objectives and purpose was. She stated that last year they had assisted 726 members of the community in 11,000 visits. Commissioner Bailey commented that at first he felt the colors were a little bright, but they had grown on him as fitting for the buildings architecture and use. He was happy to see this work done. Commissioner Bailey moved to award Façade Grant 17-04 for the full amount of $9,499.32 towards the installation of a new windows, awnings, and repainting of the building valued at $18,998.64. Commissioner Hopkins seconded and there was no additional discussion. A ll were in favor. STAFF UPDATES Planning Manager Allyson Brekke updated the Commissioners on a recent sign code workshop that she had attended concerning recent Supreme Court decisions and the affect it has on and sign message and temporary signage. Commissioner Bailey commented that his initial reaction to the presentation was asking “what will it look like” to change our sign code, especially with the myriad different organizations and Planning Commission Minutes June 28, 2017 Page 3 stakeholders in the City. Planning Manager Brekke responded that the extent of the changes would be based on what kind of community we want to be. There are many different things that could be changed in our commercial corridors. Signage is just a small part of a person’s experience in traveling down those corridors. Planning Manager Brekke provided a response to the earlier public comment. She stated that DCED has begun the process of reviewing and inventorying short term rentals within the community. The City is aware of both the creative types of short term rentals that are popping up, as well as the issues the City is having with housing availability. She reminded the Commission that a short course on Planning Practice was available in Bainbridge Island on the 29th of June. OTHER CONSIDERATIONS None. COMMUNICATIONS FROM THE PUBLIC John Ralston, PO Box 898 Mr. Ralston asked the planning department to be cautious of finding the addresses of all short term rentals, because they may run into the responsibility to enforce the regulations and interpretations they have previously made in respect to the standards for those uses. He let the Commission know that he hoped staff would forward an article about Idaho’s short term rental situation. REPORTS OF COMMISSION MEMBERS Chair Morris spoke about his recent trip to England, and how there were no signs on major highways. COMMUNICATIONS FROM THE PUBLIC John Ralston, PO Box 898 Mr. Ralston informed the Planning Commission of the Planning Division team participating in the Big Hurt the previous weekend and remarked that he was proud of the Big Hurt participants. He mentioned the need for the City to begin code amendments regarding short term and extended stay housing. The current code interpretation of allowance of these uses in the multi- family residential zones concerned him because of a lack of available multi-family housing zoning. He felt that the interpretation is not currently enforced and may or may not be grandfathered in, should code change. He feels short term rentals should be allowed in all zones. APPROVAL OF MINUTES: Chair Morris tabled the approval of the June 28, 2017 minutes at the next regular meeting. PUBLIC HEARINGS/ACTION ITEMS 1. Façade and Sign Grant Application: No. 17-05 Poser Yoga & Cageworx MMA Assistant Planner Ben Braudrick gave a presentation on the façade grant application for Poser Yoga and Cageworx MMA. The application requests $3,522.29 the installation of new windows, awnings, garage doors, flower boxes and the repainting of a portion of the building exterior valued at $7,066.57. Commissioner Bailey disclosed that he had provided the applicant with an estimate for a sign that could possibly be applied for a future sign grant, although the estimate had not yet been chosen. Director Nathan West reiterated that the sign was not a part of this current application. Planning Commission Minutes Septenmber 27,, 2017 Page 2 Commissioner Hopkins asked the applicants what was currently behind the garage doors. Mr. Houston used an image from the presentation to walk the Commissioners through each of the spaces in the building. There are currently weight and workout equipment in the space behind the garage doors. Commissioner Hopkins asked about current parking availability. He asked about the plans for the northern face of the building. Ms. Houston responded that there are currently no lines within the parking area. They plan to stripe the parking lot and hope that the awnings and planters will keep vehicles from parking on the north side of the building. She also stated that they have an unofficial parking agreement with Moose Lodge that they will be formalizing. Commissioner Bailey stated that he was happy to hear that because the current parking situation can create a blind spot for vehicles turning. Commissioner Schwab moved to award Façade Grant 17-05 for the full amount of $3,533.28 towards the installation of a new garage doors, awnings, garbage enclosure, flower boxes, and repainting of the building valued at $7,066.57. Commissioner Bailey seconded. Discussion: Commissioner Hopkins encouraged the applicants to do what they could to discourage parking on the north side of the building. All Commissioners were in favor. STAFF UPDATES Assistant Planner Braudrick updated the Commissioners on the Race Street project. The public Open House went well and the survey was allowed to remain open for two weeks after the meeting. Overall there were just about 250 people who commented and Alta Planning + Design will be taking all the information and creating a report on the results. The City will have an open house for the Waterfront and Olympic Discovery Trail on October 11th and there is already a webpage and survey dedicated to educating the public and asking for public comment. Director West wanted to let the Commission know about the signage and wayfinding program. An RFQ has been posted and a list of finalists has been selected and Staff would let the Commission know who was finally chosen as a consultant for that project. The seventh seat on Planning Commission is in the process of being filled. There were 6 applicants originally, and three had filled out the supplemental questionnaire. An adhoc committee has been appointed by the City Council to appoint the final candidate. The October 11th meeting would be a special Planning Commission meeting for the Olympic Discovery Trail Public Open House and the Commission may have to have a regular meeting either before or after the meeting to hear another Façade Grant Application. Planning Commission Minutes Septenmber 27,, 2017 Page 3 Director West addressed Mr. Ralston’s comments concerning short term rentals. He stated that he understood that Staff is behind on addressing some the concerns that had been made by the public on AirBNB and VRBO’s. Staff Committed to City Council that short term rentals would be addressed within a two year period of the code changes that had been enacted in the previous year. It will likely be a part of the Planning Division’s 2018 work plan. OTHER CONSIDERATIONS None. REPORTS OF COMMISSION MEMBERS Commissioner Bailey wanted to know what happened to those businesses that had received façade grants but were no longer in business. Is there a process in place when that happens because the façade is supposed to remain for 5 years. Director West stated that it was dependent on if any payment or reimbursement had been made. Chair Morris brought up an issue that he had seen growing around town. It bothers him that advertisements for cigarettes have become ubiquitous around the commercial corridors in the city. He felt that the advertisements, although currently legal, should in the future have more restrictions placed on them to reduce the size and prevalence, or even advertising on the outside of buildings. PROJECT SUMMARY The building at 134 West Front Street has a great deal of history in the community. Initially built as the City’s Civic Center, City Hall moved to its current location in 1987, leaving the building at 134 West Front Street to become a different type of fixture in Port Angeles’ downtown. A series of restaurants, lounges, pubs and even a brewery have occupied the space since the 1980’s. The Soho Asian Bistro closed its doors in 2015, but the ownership of the property and business has not changed since that time. The proposed changes to the façade (see Figure 1) will allow Soho Hibachi Steakhouse to visually separate itself from the previous restaurant’s exterior character while still maintaining the Soho forename. Proposed changes to the exterior are extensive and include painting the majority of the exterior black; weathered steel metal accents between the threshold and parapet; barrel stave sculptural sconces on each column, potted evergreens, a barrel-ring chandelier at the west entrance, and a projecting sign made from the end pieces of a large steel drum etched with the Soho business name, lit with white rope light. Soho Hibachi Steakhouse No. 17-06 October 11, 2017 Page 2 STAFF ANALYSIS Staff reviewed the grant criteria for the Community Facade and Sign Improvement Program as included in the grant application materials and summarized in this analysis The Program will provide a grant for funding of façade improvements that will enhance the physical appearance, accessibility, and overall value of individual buildings as well as surrounding areas. In evaluating proposals for funding under the Program, the following factors shall be considered: 1. Present condition of existing façade: The existing façade is not currently in disrepair and much of the exterior remains in its original state. The construction of this new façade will not be destroying the existing façade, but instead be secured and enveloped what can be considered the original façade. 2. The buildings overall public visibility: The building is part of three highly visible structures at the corner of Oak and Front Streets separated by a City owned parking lot Figure 1: Soho Hibachi Steakhouse proposed changes and material identification Soho Hibachi Steakhouse No. 17-06 October 11, 2017 Page 3 3. Expected increase in assessed value of improvement: The improvements will update the façade in a timeless fashion that both the applicant’s representative and Staff believe will increase the assessed value of structure 4. Ability to proceed with project: The applicant is ready to begin purchasing materials and working on the construction of the façade as soon as they are approved for the Façade Improvement Grant FINDINGS, CONDITIONS & CONCLUSIONS Findings 1. A Façade and Signage Grant application was submitted by Jeanine Kawal to the Department of Community and Economic Development on September 28, 2017. 2. The location of the proposal is 134 West Front Street. 3. The project site is located within the Central Business District (CBD) zone. 4. The grant request includes exterior painting, concrete wrapping of columns, the addition of custom exterior lighting, metal and wood accents, and evergreen plants, as well as the replacement of an exterior projecting sign. 5. The project is part of a effort to redevelop this property by the business owners. 6. The application was reviewed by Planning Division Staff and found to meet the application criteria. 7. The applicant is requesting $11,000.00 toward the the addition of custom exterior lighting, metal and wood accents, and evergreen plants, and repainting of the total façade as well as the replacement of an exterior projecting sign valued at $32,000.00. 8. The request will be heard by the Planning Commission at the regularly scheduled meeting on October 11, 2017. Conditions 1. Upon the date of approval, the applicant may proceed with the expenditures detailed in the application and approved by the Planning Commission. 2. The applicant shall sign a grant contract with the City of Port Angeles for the reimbursement of a maximum amount of 10,000.00 for façade improvements and $1,000.00 for sign improvements. The applicant will be given 180 days to submit reimbursement of expenditures associated with the approved grant proposal as of October 11, 2017. If progress on the project can be demonstrated, the applicant may request one 180 day extension of the contract. 3. The applicant shall submit invoices for reimbursement with a coversheet detailing each invoice number, amount, and type of payment. Reimbursement by the City equaling 50 percent of submitted invoice totals will occur within 30 days of submission. 4. Any labor performed in association with the grant proposal over $2000.00 must meet federal prevailing wage standards. Conclusions Soho Hibachi Steakhouse No. 17-06 October 11, 2017 Page 4 1.
