EXISTING CONDITIONS IN AREA: The site is located at 112 East Eighth Street which is on the southeast corner of the intersection of Eighth/Laurel Streets. The general area is heavily developed with commercial and business office uses fronting on Eighth Street, which is a major arterial street. The subject site consists of an off-street parking area directly adjacent to Laurel Street with the structure located approximately 100 feet east of Laurel Street with access from 81h Street. The area of the immediate property adjacent to Laurel Street that is developed as off- street parking is partially developed. The developed area is part of the subject site whereas the undeveloped area that is also for off street parking is owned by the abutting property owner west of Laurel Street(Laurel Lanes Bowling). The lot immediately east of the structure (approximately 150 feet east of Laurel Street) is fully developed for off-street parking as part of the Peninsula Community Mental Health(PCMH) building site immediately east of the subject location. The subject site and adjacent building site are owned by Peninsula Community Mental Health. Off street parking on both sides of the subject structure is available for the proposed use through a parking agreement with the property owner. DEPARTMENT COMMENTS: Reviewing City Departments had no concerns with the proposal. The Fire Department and Building Division will perform life/safety inspections prior to occupancy. Any remodel will require proper permitting. Publication appeared in the Peninsula Daily News on November 29, 2010. Two written comments were received from neighboring property owners. Mrs. Christina Williams, 111 East 9th Street, whose home is directly south of the subject site across the 8/9 alley expressed long standing issues in the neighborhood with the subject property owner. Issues of property management are not the subject of this conditional use permit. Liability issues are also property ownership not operational issues. Staff discussed with Mrs. Williams that operation by conditional use permit(CUP) does provide a certain amount of accountability that would not be the norm without the CUP process. If operational issues negatively impact the neighborhood,they can be dealt with through enforcement of City ordinances. Mrs. Theresa Schmid, 114 East 9th Street, noted that the use should not be permitted to spill parking impacts into the residential nelghborhoo nor cause undue noise. ANALYSIS: The Fraternal Order of Eagles (Club) intends to conduct a club/lodge use in the Community Shopping District, per Section 17.22.160 PAMC. The Club has operated from a location elsewhere in the City for many years. Their property was recently purchased, and they will be displaced in early 2011. The application indicates that the location would be the Club's new meeting location during the time it takes to find a suitable permanent club location. While application information indicates a one year use, it is possible that the activity could be for less time, or more time than one year, as it is permitted by conditional use permit in the CSD. Therefore, the use is being reviewed as if it were permanent. The subject site is owned by Peninsula Community Mental Health (PCMH) that operates their main office use in the same block separated from the subject structure by a 50 space parking lot. The structure contains 6,800 square feet of area supported by 14 on-site, off-street parking spaces. The application site plan indicates that approximately 2,500 square feet of the 6,800 square foot structure will be available for open club use with the remaining 4,300 square feet dedicated to office and storage use. Seating within the open club area will require 1 off street parking space for each 50 square feet for non fixed seating for a total requirement of 50 spaces. Seating for the remaining office/storage area will require 4 additional spaces (storage area is not counted in this ratio) for a total of 64 off-street parking spaces for the use as proposed. As the site contains only 14 off-street parking spaces, it cannot support the Eagles use alone. A parking agreement for use of the larger PCMH parking lot accompanied the application providing the 50 off street parking spaces for Club use after 5 PM and during evening and weekend hours. Furthermore, the subject lot contains 12 undeveloped graveled spaces that are owned by Laurel Lanes Bowling. The applicant is working with that property owner for use of those 12 spaces during peals hours on off hours for the bowling alley use as well as seeking cooperation from other commercial uses in the neighborhood (First Federal and Rite Aid ownership) for use of other parking lots after hours if the need should arise for additional parking. Given both parking areas owned by PCMH (east of and on the subject site),the Eagles use will minimally have 64 off street parking spaces available at peak hours. Uses in the neighborhood include professional office and retail use along Eighth Street with residential use south of the 8/9 Alley. A mix of off street parking is provided with some uses having nonconforming parking situations that result in the need for on street parking for patrons usually during business daytime hours. As the area is located within a major transportation corridor on its north boundary and abuts residential development to the south, so it is important that the Club be operated such that parking impact to neighboring uses does not occur. CUP I0-05—FOE 1 December 8,2010 1 Page 3 Other than the parking impact, the use should go largely unnoticed. Communication with the Eagles' representative indicated that Club activities will be scheduled with neighborhood impacts in mind and will be scaled down to accommodate the more restricted area. Club members will be able to utilize the Club area during the day with office personnel and staff supported by the on site parking spaces. Happy Hour begins at 5 PM. The increased parking need can be supplied from PCMH parking available after 5 PM M-F and Saturday and Sundays. STATE ENVIRONMENTAL POLICY ACT (SEPA) REVIEW: A Determination of NonSignificance (DNS)was issued for the proposed action on December 6, 2010 per WAC 197-11-355. This satisfies the City's responsibility under the State Environmental Policy Act-(SEPA). - - Attachments: A-Conditions,Findings, and Conclusions B -Application C-Zoning Ordinance,Comprehensive Plan,and Other Municipal Code CUP 10-05—FOE December 8,2010 Page 4 ATTACHMENT "A" RECOMMENDED CONDITIONS, FINDINGS, AND CONCLUSIONS Conditions: 1. Adequate off-street parking is critical to Club use. At minimum, the parking agreement submitted as part of the application with Peninsula Community Mental Health will remain active for the duration of the occupancy. Club activities will be scheduled to ensure that activities will not result in more parking demand than available off-street parking can provide. Club use between the hours of 10 AM and 5 PM M-F will be restricted to those uses that will not impact daily use of on street parking activities and at no time will parki1.ng 1.be permitted to spill over onto the nearby-residential-neighbor-hoods. Club members shall be made aware of the importance of using available off street parking. 2. Permits necessary for planned improvements, such as plumbing and/or electrical, will be obtained prior to commencement of those activities. 3. Inspection by the City's Fire Department is required prior to occupancy. Findings: 1. An application for a conditional use permit was submitted by the Fraternal Order of Eagles organization on November 9, 2010,to establish an interim use site for a lodge/club use in the Community Shopping District. The proposed site location is 112 East 8th Street. Application materials indicate the use is intended to be for at least one year until a suitable new location can be found for the Club use at the discretion of Club members. 2. Section 17.22.160(A) PAMC provides that"clubs and lodges"may be permitted in the Community Shopping District by conditional use permit. 3. Per 17.96.050 PAMC,the Planning Commission shall consider applications for conditional use permits as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits that are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. The Planning Commission may refuse to issue a conditional use permit if the characteristics of the intended use as related to the specific proposed site are such as would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental, or hazardous conditions. In each application the Planning Commission may impose whatever restrictions or conditions they consider essential to protect the public health, safety, and welfare, and to prevent depreciation of neighboring property. 4. Per Section 17.96.070 PAMC, notice of conditional use permit application shall be given per Section 17.96.140 PAMC with a public hearing scheduled before the Planning Commission. The Planning Commission's decision shall be final unless appealed to the City Council within 14-days of approval. 5. The site was posted for notice of land use action with notice sent to surrounding property owners on November 16, 2010. Publication appeared in the Peninsula Daily News on. November 29, 2010. Two written comments were received from neighboring property owners. Mrs. Williams expressed long standing issues with the subject property owner CUP 10-05—FOE December 8,2010 1 Page 5 and previous use of the site. No specific issues relative to the proposed occupancy were noted. Mrs. Schmid was concerned that parking for the use may spill over to the residential neighborhood, and potential noise from Club activities. 6. Section 17.01.020(J) PAMC defines the purpose and intent of the CSD Zone as "... a commercial zone oriented primarily to those businesses serving the daily needs of the surrounding residential neighborhoods but is slightly less restrictive than the CN zone and as such provides a transition area from the most restrictive commercial zones to those of lesser restrictions. Businesses in this zone may occur on sites of varying sizes and shall be located at the intersections of arterial streets of sufficient size to satisfy traffic demand and at the boundaries of neighborhoods so that more than one neighborhood may be served... " y - 7. The Comprehensive Plan designates the site as Commercial being located in the City's Central Planning Area. Development in the surrounding area is in conformance with Comprehensive Plan designations and includes a wide variety of commercial uses including business offices with single family residential development south of the adjacent 8/9 alley. 8. The City's Comprehensive Plan was reviewed for consistency with the proposal. Land Use Map Goal A, Policies 1 & 2 were found to be relevant to the proposal (See Attached for full text). The use is more a social use than those uses generally referred to in the text of the Comprehensive Plan. 9. The proposed site contains a 6,800 square foot structure. The site plan indicates that approximately 2,500 square feet of the 6,800 square foot structure will be available for open club use with the remaining 4,300 square feet dedicated to office and storage use. Per Section 14.40 (Parking) PAMC, seating within the open club area requires 1 off street parking space for each 50 square feet for non fixed seating for a total requirement of 50 spaces. Seating for the remaining office/storage area will require 4 additional spaces (storage area is not counted in this ratio) for a total of 64 off-street parking spaces for the use as proposed. 10. The site provides 14 off street, improved parking spaces. A parking agreement accompanied the application that provides 50 off-street parking spaces on the adjacent property owned by Peninsula Community Mental Health. The additional parking is available after 5 PM M-F and all day Saturday and Sunday. The applicant is pursuing additional parking opportunities for evening and peak time use. 11. Application materials and discussion with the applicant's representative Gordon Stoddard indicated that Club functions will be scheduled at times when adequate off street parking is available to avoid conflicts with neighborhood uses. Traditional uses such as bingo and events open to the public will be limited to accommodate parking restrictions of the proposed location. Club functions will still include gaming activities, and a bar is available to members and guests, but those functions will be restricted to after 5 PM when parking is available. Club management is aware of the limitations of use given limited parking during office hours until adjacent off-street parking is provided. 12. Uses in the area along Eighth Street largely operate 8 AM to 5 PM, M-F and include banks, Peninsula Community Mental Health, professional offices, a retail gun shop, an active bowling alley and a church. Residential uses exist south of the 8/9 Alley. Most area businesses are adequately supported by off-street parking with the exception of the CUP 10-05—FOE December 8,2010 ) Page 6 J bowling alley use and retail use across Eighth Street that largely rely on on-street parking. 13. Public notice of the conditional use permit proposal was placed in the Peninsula Daily News on November 19, 2010, with notice mailed to surrounding property owners and the site posted on November 16, 2010. No written comments were received during the written public notice period. 14. A Determination of NonSignificance was issued for the proposal on December 4, 2010, following the public notification review period as required by WAC 197-11-355. This satisfies the City's responsibility under the State Environmental Policy Act. Conclusions: A. The proposal is consistent_with_provisions of the Port Angeles Municipal Code, specifically with the expectations of development identified for the Community Shopping District(Section 17.22 PAMC). B. Normal, daily use by Club members will be supported by on site parking. As conditioned, to avoid negative impact to the abutting major arterial and abutting businesses, additional parking will be available when activities increase (between 5 PM and 9 PM daily)through a parking agreement with the adjacent property owner (Peninsula Community Mental Health). C. The conditional use permit was processed in accordance with Section 17.96.050 PAMC that provides standards for processing conditional use permit applications within the City of Port Angeles. D. As conditioned,the use will not impact public health, safety, or welfare, and will not result in a depreciation of neighboring property CUP 10-05—FOE December 8,2010 7 Page 7 ATTACHMENT C COMPREHENSIVE PLAN GOALS POLICIES AND OBJECTIVES Land Use Map, Goals, Policies, and Objectives Goal A. To guide current and future development within the City in a manner that provides certainty to its citizens about future land use and the flexibility necessary to meet the challenges and opportunities of the future. Policies 1. The Comprehensive Plan Land Use Map should be used as a conceptual guide for determining current and long-range-zoning-and-other landusedecisions. The map's land use designations are intended to show areas where general land use types are allowed. The area between land use designations should be considered an imprecise margin in order to provide flexibility in determining the boundary of such areas. When determining appropriate zoning designations for an area near a margin,the goals, policies and objectives of the Land Use Element should take precedence. 2. All land use decisions and approvals made by the City Council and/or any of its appointed Commissions, Boards or Committees should be consistent with the Comprehensive Plan and its land use map. The property and its parking lot would be used for after-hours meetings and possibly other functions, the parameters of which are unclear. As a homeowner/resident whose property is directly across the alley from the building, I emphatically object to the proposal. While I commend Mental Health's dedication as a vital services provider in the region, my experience is that it has historically demonstrated a general disregard for the surrounding neighborhood. This attitude began with the surreptitious purchase of its 9�' Street residence,and continues with ongoing property oversight and"grey area"usage issues.Mental Health is fairly responsive when problems are brought to its attention,but many are ongoing. It is not the neighborhood's responsibility to monitor or remedy that which Mental Health repeatedly neglects. Its mission of"helping"appears not to include anticipating what it takes to be a good neighbor. Perhaps this is an administrative issue. In any case,Mental Health has demonstrated that it is currently ill-suited to be a landlord. The eagerness of Mental Health and the Eagles to enter into this lease agreement seems focused on their own mutual benefit. This plan will not benefit our neighborhood. Rather it would subject us to risk from everything such as minor nuisance problems(noise, traffic, etc.)to serious legal matters. What about usage precedence? At what point does "provisional use"become a gateway to re-zoning?What about liability? This concerns me greatly, based on an experience I had regarding the very building in question. Years ago,when the property was owned and used by St. Vincent De Paul, an arsonist set fire to the outside storage area, in the early hours of the morning. My son was awakened by the light of a fire-truck across the alley. He woke me up,and said, "We have to go, Mom,now!" From a sidewalk,we watched the fire-fighters battle flames that jumped the alley to my neighbor's non-permitted addition. The fire spread to my garage,which was damaged before the flames could be extinguished. When I asked St.Vincent's manager about their insurance coverage, she replied, without apology,that their"non-profit" status exempted them from liability. I'm sorry to say that I was glad to see St. Vincent's go. This lease issue has many facets. The most obvious are practical and legal,but there are also humanitarian considerations. That said, I wish the Eagles well in finding a venue elsewhere and I implore Mental Health to re-think its relationship with the neighborhood. a EC EN E � D December 1, 2010 DEC e 2 2010 CITY OF PORT ANGELES Dept.of Community Development Dear City Planning Commission, I am writing in regards to the conditional use permit for the Eagles Club. My family has livedon 9&1street for the past twenty years. MY parents and also my grandparents have lived in the Cherry Hill area for the past seventy five years. Being part of this neighborhood for this long has helped me be aware and watchful for the changes that occur. I have basic concerns for our neighborhood no matter what the situation is on Stn Street and the impact it has on 9th Street. One concern I have is about parking. If the Eagles are granted a conditional use permit,will they be renting their venue to other users? If so is there sufficient parking to host the event?Ninth Street from Cherry to Peabody is a residential neighborhood;patrons attending an event happening on 8th street would not be permitted to park on 9th street. Behind Peninsula Mental Health there is a small park. Patrons of Mental Health have been using this park to park there cars. This is a place where neighbor children play and picnic, sled and meet. The "park" is not a parking lot. The area on the North side of 9th Street from valley to valley is in fact all residences with the exception of business on Lincoln, Peabody and Race Streets. Are we going to start encroaching on 9th Street? Another concern I have about the Eagles residing in that building is the amount of noise and traffic that events can generate. Again I am concerned about encroachment in any way into our neighborhood. Is there a need to subject residents to unknown factors when there are other places that are in the business and industrial corridors of this town? As the population in our town shrinks we continue to have many empty buildings in the downtown area. Why would we have encroachments into one of the oldest neighborhoods in the city if we don't need to? Please consider my comments when making this decision. She understood the Department Report conditions and said that the Eagles' new building is under construction in the County and should be done before the requested September 30, 2012 extension date. There should not be a need for further extension. Mrs. Morris said that it is not normal for many Club members to be at the subject site until after 5 PM during the week, however, some administrative staff may be there during the afternoon. The Eagles is a members only club with very few members at this time; they have not heard of any complaints regarding the past year's operation at the subject location. No changes are planned in Club activities at this location. In noting the new agreement with the property owner and neighboring business, Peninsula Community Mental Health(PCMH), Chair Reiss asked if any parking conflict is perceived. Mrs. Morris responded that she does not believe there will be any conflicts with the use of Eagles designated parking during the day for PCMH given that most of the Eagles activities occur after PCMH business hours. The Club is aware of the constraints of parking in the area and of the neighborhood concerns. Christina Williams, 111 E. 91h Street is a direct neighborhood south of the alley to the subject property. She said that, for the most part, there have been no problems with the Eagles use of the site. She asked that Club members be aware that they cannot use the alley for parking and that Club members do not smoke in the area given the danger of fire. In response to Chair Reiss, Mrs. Morris responded that no smoking can occur within the Club structure and members do go outside to smoke but she believes they do not smoke in the alley area. Club members will be mindful of the stated concerns and strive to be good neighbors as well. She reiterated that she had not heard of any complaints that need to be addressed in this matter. Conditional Use Permit CUP 10-05 for the Fraternal Order of Eagles to conduct a social club activity at 112 East 81h Street is hereby extended until September 30, 2012. If further extension is desired beyond that time period, a request must be received by the Community & Economic Development Department prior to expiration of the permit. 2. Adequate off-street parking is critical to Club use. The joint use parking agreement on file with Peninsula Community Mental Health shall remain active for the duration of the extended occupancy. Club activities will be scheduled to ensure that activities will not result in more parking demand than available off-street parking can provide. Club use between the hours of 10 AM and 5 PM M-F will be restricted to those uses that will not impact established on street parking activities and at no time will parking be allowed to intrude into nearby residential streets. The Club management have stated that members shall be made aware of the importance of using available off street parking. Findings: 1. Conditional Use Permit CUP 10-05 was approved for the Fraternal Order of Eagles on December 8, 2010, to conduct an interim lodge/club use in the Community Shopping District at 112 East 8th Street. A one year period was requested to allow a site search and construction of a permanent structure. The CUP was approved until December 8, 2011 with 6 conditions. 2. A letter was received from the Eagles on December 9, 2011 requesting extension of the CUP until September 30, 2012, to allow for construction of a new site in another area of the County. 3. Per 17.96.050(A) and (B) PAMC, the Planning Commission shall consider applications for conditional use permits as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits that are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. The Planning Commission may refuse to issue a conditional use permit if the.characteristics of the intended use as related to the specific proposed site are such as would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental, or hazardous conditions. In each application the Planning Commission may impose whatever restrictions or conditions they consider essential to protect the public health, safety, and welfare, and to prevent depreciation of neighboring property. 4. A one year time period was initially approved due to the applicant's request and to address concerns of the adjacent neighborhood regarding on street parking and perceived club operation. 5. 17.96.070 (E) PAMC Extensions of Approved Conditional Use Permits - Extensions of approved conditional use permits shall be considered in accordance with the same procedures as for the original permit application, and may be granted for a period of one to five years, provided that the following minimum criteria are met: CUP 10-05—FOE Extension • January 25,2012 • Page 4 1. The use complies with the permit conditions. 2. There have been no significant, adverse changes in circumstances. Upon written request for an extension submitted to the Department of Community and Economic Development prior to the expiration of the conditional use permit, said conditional use permit shall be automatically extended for ninety days to allow the City adequate time to review the extension request. Section 17.96.070 PAMC requires that notice of conditional use permit application shall be given per Section 17.96.140 PAMC with a public hearing scheduled before the Planning Commission. The Planning Commission's decision shall be final unless appealed to the City Council within 14-days of approval. 7. The site was posted for notice of land use action with notice sent to surrounding property owners on December 23, 2011. Publication appeared in the Peninsula Daily News on December 28, 2011. No written comments were received during the written public comment period which expired on January 20, 2012. Staff has not been made aware of any infractions of permit conditions during the past year of operation nor have any Police reports been filed. 8. Section 17.01.020(J) PAMC defines the purpose and intent of the CSD Zone as "... a commercial zone oriented primarily to those businesses serving the daily needs of the surrounding residential neighborhoods but is slightly less restrictive than the CN zone and as such provides a transition area from the most restrictive commercial zones to those of lesser restrictions. Businesses in this zone may occur on sites of varying sizes and shall be located at the intersections of arterial streets of sufficient size to satisfy traffic demand and at the boundaries of neighborhoods so that more than one neighborhood may be served... " 9. The Comprehensive Plan designates the site as Commercial being located in the City's Central Planning Area. Development in neighboring areas is in conformance with Comprehensive Plan designations and includes a wide variety of commercial uses including business offices with single family residential development south of the adjacent 8/9 alley. 10. The City's Comprehensive Plan was reviewed for consistency with the proposal. Land Use Map Goal A, Policies 1 & 2 were found to be relevant to the proposal. The club use is a more social use than those uses generally referred to in the text of the Comprehensive Plan. 11. The specific site provides 14 improved off street parking spaces. A parking agreement with the parent property owner, Peninsula Community Mental Health provides an additional 50 off-street parking spaces for use on the adjacent property on weekdays after 5 PM M-F and all day Saturday and Sunday. Staff is not aware of any parking concerns that have occurred during the past year of operation. 12. Previous testimony by Club membership indicated that larger club functions will be scheduled during times when adequate off street parking is available to avoid conflicts CUP 10-05—FOE Extension January 25,2012 Page 5 with established neighborhood uses. Traditional uses such as bingo and events open to the public are limited to accommodate parking restrictions of the constrained location. 13. A Determination of NonSignificance was issued for the proposal on December 4, 2010. This satisfies the City's responsibility under the State Environmental Policy Act (SEPA). Further SEPA review is not required as no changes are planned. 14. Staff review indicated that conditions of permit approval have been met and no changes are proposed. Conclusions: A. The proposal is consistent with provisions of the Port Angeles Municipal Code, specifically with the expectations of development identified for the Community Shopping District(Section 17.22 PAMC) and with the procedures for processing conditional use permits and extensions found in 17.96.070 (E) PAMC . B. The past year of operation has not resulted in conflict with any conditions of approval. No change of use is planned. There have been no significant, adverse changes in circumstances. C. As conditioned, continued Club activities are supported by adequate on site parking as is required by Chapter 14 (Parking) PAMC. D. As conditioned, the use will not impact public health, safety, or welfare, and will not result in a negative impact or depreciation of neighboring properties. She indicated that the remaining spaces (7) should be sufficient for their use during our business hours. However, they have Bingo on Wednesday and it may be necessary for us to work around that complication, if it's needed. It's true that our agency vehicles and St. Vincent's trucks were still on the German property on Friday. PCMHC was closed on Wednesday and Thursday because of the weather, but I want you to know that we are trying to resolve the parking issue. It's unfortunate that the 9th St. residents don't have anything more to do with their time than harass your office about our agency parking. My staff have been instructed to park at Horizon Center (though I'm still waiting for Joel WInborn to get back to me regarding our having full use of the 17 spaces), on the few spots on the east side of our building (opposite UPS), on 8th St. and across the street at the car wash. My Maintenance guys will relocate our agency vehicles today to the southwest parking spaces on the west side of the St. Vincent's building and I have informed Barbara Townsend of St. Vincent De Paul that she needs to move.her trucks. I have managed to speak to the District Manager of Rite Aide about renting 20 spots either by and around the care wash on 8th St. or by their store on Lincoln St. He believes that we can work something out, but he hasn't gotten back to me with a definitive answer. I have also had talks with the Baumwells and my Board about purchasing their property. These latter options will take time. PCMHC has even intention of complying with the city's decisions. Know that I am trying to rectify the parking as soon as I can. Thanks. Planning Manager Sue Roberds reviewed the Department Report recommending approval of the application with conditions. Chair Matthews qualified the Commissioners regarding appearance of fairness matters. All Commissioners responded for the record that they had no appearance of fairness or conflict of interest issues with regard to the pending application. The Chair then reviewed the quasi judicial public hearing procedures for audience members and opened the public hearing. Ken McDaniels, 539 Spring Road,Port Angeles, WA 98362 introduced himself as representative for the Fraternal Order of Eagles (FOE), and was prepared to respond to questions. Commissioner Bruch asked what operating hours are planned. Mr. McDaniels responded that operating hours are intended to be 10 AM to 10 PM for general business purposes and the FOE have 7— 8 regular employees. Special events will include Wednesday 6 PM to 10 PM meeting; Thursday—bingo 6 PM to 8 PM; and Tuesday—poker night—6 PM to 10 PM. Activities will not include bands, loud music, or general public activities that have been the norm in the past. The lodge use will largely be for members and their guests during an interim period while FOE members search for a permanent new location. Gatherings are anticipated to contain approximately 30 to 40 members. Mr. McDaniels added that 14 off street parking sites are available on site with 50 additional spaces available after 5 PM on adjacent property to the east owned by Peninsula Community Mental Health. Activities will be scheduled such that parking conflict does not exist in that it is known that Laurel Lanes league bowlers often use the parking lot being leased to FOE. The FOE membership committee has suggested that windshield stickers be used to identify FOE authorized members and if it is determined that those persons are parking in inappropriate areas, they will be notified to remove their vehicles. In response to Commissioner Reiss, Mr. McDaniels noted that the FOE has been notifying people who are used to using the larger club facility of the reduced operation until a new club site has been chosen. They realize the operational restrictions of the site and will work within them. Theresa Schmid, 114 East 9th Street said that 17 children reside in the neighborhood block immediately south of the subject site. The FOE serves alcohol and people will use Ninth Street to exit the site. Cristina Williams, 111 East 9th Street was seriously concerned with the liability of the tenants (FOE) as she was concerned with previous actions of the property owner(Peninsula Community Mental Health) in managing their operations. Earl Richardson, 819 South Laurel noted that vehicles are jammed all along the street at present, in fact, he has had at least one of his vehicles that was parked on the street hit recently. There is nowhere to park on the street and the alley is in deplorable condition. He applauded the FOE for trying to find a temporary location but believed there is way too much happening at this location for such a large activity to even temporarily locate. Mr. McDaniels responded that the FOE has searched all over the City and other locations are not available largely due to cost. They mainly need to use the area for office and storage use in this interim period. They would like to continue use of a social area within the building for approximately 25 club members at a time. On site parking is available, and members will diligently use the available parking so as to not impact established neighborhood uses, and will schedule activities such that conflicts do not occur with nearby business uses. There being no further testimony, Chair Matthews closed the public hearing. Commission members discussed details of the application and testimony that had been presented. Following discussion of various conditions that would address issues of concern that had been raised and ensure the least impact to neighbors and surrounding businesses, Commissioner Powers moved to approve the conditional use permit with the following 5 PP P g conditions, citing 17 findings, and 4 conclusions in support of the action: Conditions: 1. Adequate off-street parking is critical to Club use. At minimum, the parking agreement submitted as part of the application with Peninsula Community Mental Health will remain active for the duration of the occupancy. Club activities will be scheduled to ensure that activities will not result in more parking demand than available off-street parking can provide. Club use between the hours of 10 AM and 5 PM M-F will be restricted to those uses that will not impact daily use of on street parking activities and at no time will parking be permitted to spill over onto the nearby residential neighborhoods. Club members shall be made aware of the importance of using available off street parking. 2. Permits necessary for planned improvements, such as plumbing and/or electrical, will be obtained prior to commencement of those activities. 3. Inspection by the City's Fire Department is required prior to occupancy. 4. Activities shall be restricted to FOE member use. No third party rentals will be scheduled. 5. The permit is issued for an initial one year time period. Extension of the permit shall be per PAMC 17.96. if desired and shall be dependent on compliance the with conditions of approval. Findings: 1. An application for a conditional use permit was submitted by the Fraternal Order of Eagles organization on November 9, 2010, to establish an interim use site for a lodge/club use in the Community Shopping District. The proposed site location is 112 East 8th Street. Application materials indicate the use is intended to be for at least one year until a suitable new location can be found for the Club use at the discretion of Club members., 2. Section 17.22.160(A) PAMC provides that"clubs and lodges" may be permitted in the Community Shopping District by conditional use permit. 3. Per 17.96.050 PAMC, the Planning Commission shall consider applications for conditional use permits as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits that are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. Per Section 17.96.070 PAMC, notice of conditional use permit application shall be given per Section 17.96.140 PAMC with a public hearing scheduled before the Planning Commission. No specific issues relative to the proposed occupancy were noted. Mrs. Schmid was concerned that parking for the use may spill over to the residential neighborhood, and potential noise from Club activities. 6. Section 17.01.020(J) PAMC defines the purpose and intent of the CSD Zone as "... a commercial zone oriented primarily to those businesses serving the daily needs of the surrounding residential neighborhoods but is slightly less restrictive than the CN zone and as such provides a transition area from the most restrictive commercial zones to those of lesser restrictions. Businesses in this zone may occur on sites of varying sizes and shall be located at the intersections of arterial streets of sufficient size to satisfy traffic demand and at the boundaries of neighborhoods so that more than one neighborhood may be served... 7. The Comprehensive Plan designates the site as Commercial being located in the City's Central Planning Area. Development in the surrounding area is in conformance with Comprehensive Plan designations and includes a wide variety of commercial uses including business offices with single family residential development south of the adjacent 8/9 alley. 8. The City's Comprehensive Plan was reviewed for consistency with the proposal. Land Use Map Goal A, Policies 1 & 2 were found to be relevant to the proposal (See Attached for full text). The use is more a social use than those uses generally referred to in the text of the Comprehensive Plan. 9. The proposed site contains a 6,800 square foot structure. The site plan indicates that approximately 2,500 square feet of the 6,800 square foot structure will be available for open club use with the remaining 4,300 square feet dedicated to office and storage use. Per Section 14.40 (Parking) PAMC, seating within the open club area requires 1 off street parking space for each 50 square feet for non fixed seating for a total requirement of 50 spaces. Seating for the remaining office/storage area will require 4 additional spaces (storage area is not counted in this ratio) for a total of 64 off-street parking spaces for the use as proposed. 10. The site provides 14 off street, improved parking spaces. A parking agreement accompanied the application that provides 50 off-street parking spaces on the adjacent property owned by Peninsula Community Mental Health. The applicant is pursuing additional parking opportunities for evening and peak time use. 11. Application materials and discussion with the applicant's representative Gordon Stoddard indicated that Club functions will be scheduled at times when adequate off street parking is available to avoid conflicts with neighborhood uses. Traditional uses such as bingo and events open to the public will be limited to accommodate parking restrictions of the proposed location. Club functions will still include gaming activities, and a bar is available to members and guests, but those functions will be restricted to after 5 PM when parking is available. Club management is aware of the limitations of use given limited parking during office hours until adjacent off-street parking is provided. 12. Uses in the area along Eighth Street largely operate 8 AM to 5 PM, M-F and include banks, Peninsula Community Mental Health, professional offices, a retail gun shop, an active bowling alley and a church. Residential uses exist south of the 8/9 Alley. Most area businesses are adequately supported by off-street parking with the exception of the bowling alley use and retail use across Eighth Street that largely rely on on-street parking. 13. Public notice of the conditional use permit proposal was placed in the Peninsula Daily News on November 19, 2010, with notice mailed to surrounding property owners and the site posted on November 16, 2010. No written comments were received during the written public notice period. 14. A Determination of NonSignificance was issued for the proposal on December 4, 2010, following the public notification review period as required by WAC 197-11-355. This satisfies the City's responsibility under the State Environmental Policy Act. 15. Testimony received during the December 8, 2010, public hearing identified that business parking conflicts may occur due to normal business activities relative to the Peninsula Community Mental Health (PCMH) use on the adjacent property that provides the bulk of off street parking for the intended use. Testimony was received from neighbors who have observed that employees work several days a week later than 5 PM which may result in fewer off street parking spaces being available than are offered through the Parking Agreement with PCMH that accompanied the subject application. Operation of the lodge use is dependent on adequate off-street parking for the use that will not impact established uses or neighboring properties. 16. Testimony from proponents indicated that use of the building would be voluntarily restricted to FOE members and guests only. No outside activities will occur. 17. The Planning Commission conducted a public hearing on December 8, 2010, and received testimony from neighbors Mrs. Teresa Schmid, Ms. Cristina Williams, and Mr. Earl Richardson who expressed concerns regarding traffic and parking impacts. Conclusions: A. The proposal is consistent with provisions of the Port Angeles Municipal Code, specifically with the expectations of development identified for the Community Shopping District(Section 17.22 PAMC). The subject site consists of an off-street parking area directly adjacent to Laurel Street with the structure located approximately 100 feet east of Laurel Street with access from 8th Street. The area of the immediate property adjacent to Laurel Street that is developed as off- street parking is partially developed. The developed area is part of the subject site whereas the undeveloped area that is also for off street parking is owned by the abutting property owner west of Laurel Street (Laurel Lanes Bowling). The lot immediately east of the structure (approximately 150 feet east of Laurel Street) is fully developed for off-street parking as part of the Peninsula Community Mental Health(PCMH) building site immediately east of the subject location. The subject site and adjacent building site are owned by Peninsula Community Mental Health. Off street parking on both sides of the subject structure is available for the proposed use through a parking agreement with the property owner. DEPARTMENT COMMENTS: Reviewing City Departments had no concerns with the proposal. The Fire Department and Building Division will perform life/safety inspections prior to occupancy. Any remodel will require proper permitting. Issues of property management are not the subject of this conditional use permit. Liability issues are also property ownership not operational issues. Staff discussed with Mrs. Williams that operation by conditional use permit (CUP) does provide a certain amount of accountability that would not be the norm without the CUP process. If operational issues negatively impact the neighborhood,they can be dealt with through enforcement of City ordinances. Mrs. Theresa Schmid, 114 East 9th Street, noted that the use should not be permitted to spill parking impacts into the residential neighborhood nor cause undue noise. ANALYSIS: The Fraternal Order of Eagles (Club) intends to conduct a club/lodge use in the Community Shopping District, per Section 17.22.160 PAMC. The Club has operated from a location elsewhere in the City for many years. Their property was recently purchased, and they will be displaced in early 2011. The application indicates that the location would be the Club's new meeting location during the time it takes to find a suitable permanent club location. While application information indicates a one year use, it is possible that the activity could be for less time, or more time than one year, as it is permitted by conditional use permit in the CSD. Therefore, the use is being reviewed as if it were permanent. The subject site is owned by Peninsula Community Mental Health (PCMH) that operates their main office use in the same block separated from the subject structure by a 50 space parking lot. The structure contains 6,800 square feet of area supported by 14 on-site, off-street parking spaces. The application site plan indicates that approximately 2,500 square feet of the 6,800 square foot structure will be available for open club use with the remaining 4,300 square feet dedicated to office and storage use. Seating within the open club area will require 1 off street parking space for each 50 square feet for non fixed seating for a total requirement of 50 spaces. As the site contains only 14 off-street parking spaces, it cannot support the Eagles use alone. A parking agreement for use of the larger PCMH parking lot accompanied the application providing the 50 off street parking spaces for Club use after 5 PM and during evening and weekend hours. Furthermore, the subject lot contains 12 undeveloped graveled spaces that are owned by Laurel Lanes Bowling. The applicant is working with that property owner for use of those 12 spaces during peak hours on off hours for the bowling alley use as well as seeking cooperation from other commercial uses in the neighborhood (First Federal and Rite Aid ownership) for use of other parking lots after hours if the need should arise for additional parking. Given both parking areas owned by PCMH (east of and on the subject site), the Eagles use will minimally have 64 off street parking spaces available at peak hours. Uses in the neighborhood include professional office and retail use along Eighth Street with residential use south of the 8/9 Alley. A mix of off street parking is provided with some uses having nonconforming parking situations that result in the need for on street parking for patrons usually during business daytime hours. As the area is located within a major transportation corridor on its north boundary and abuts residential development to the south so it is important that the Club be operated such that parking impact to neighboring uses does not occur. Communication with the Eagles' representative indicated that Club activities will be scheduled with neighborhood impacts in mind and will be scaled down to accommodate the more restricted area. The increased parking need can be supplied from PCMH parking available after 5 PM M-F and Saturday and Sundays. Public notice of the conditional use permit proposal was placed in the Peninsula Daily News on November 19, 2010, with notice mailed to surrounding property owners and the site posted on November 16, 2010. The property and its parking lot would be used for after-hours meetings and possibly other functions, the parameters of which are unclear. As a homeowner/resident whose property is directly across the alley from the building, I emphatically object to the proposal. While I commend Mental Health's dedication as a vital services provider in the region, my experience is that it has historically demonstrated a general disregard for the surrounding neighborhood. This attitude began with the surreptitious purchase of its 9`h Street residence,and continues with ongoing property oversight and"grey area"usage issues. Mental Health is fairly responsive when problems are brought to its attention, but many are ongoing. It is not the neighborhood's responsibility to monitor or remedy that which Mental Health repeatedly neglects. Its mission of"helping"appears not to include anticipating what it takes to be a good neighbor. Perhaps this is an administrative issue. In any case,Mental Health has demonstrated that it is currently ill-suited to be a landlord. The eagerness of Mental Health and the Eagles to enter into this lease agreement seems focused on their own mutual benefit. This plan will not benefit our neighborhood. Rather it would subject us to risk from everything such as minor nuisance problems(noise, traffic, etc.)to serious legal matters. What about usage precedence? At what point does "provisional use"become a gateway to re-zoning?What about liability?This concerns me greatly,based on an experience I had regarding the very building in question. Years ago,when the property was owned and used by St. Vincent De Paul, an arsonist set fire to the outside storage area, in the early hours of the morning. My son was awakened by the light of a fire-truck across the alley. He woke me up, and said,"We have to go, Mom,now!" From a sidewalk,we watched the fire-fighters battle flames that jumped the alley to my neighbor's non-permitted addition. The fire spread to my garage, which was damaged before the flames could be extinguished. When I asked St. Vincent's manager about their insurance coverage, she replied, without apology,that their"non-profit"status exempted them from liability. I'm sorry to say that I was glad to see St. Vincent's go. This lease issue has many facets. The most obvious are practical and legal, but there are also humanitarian considerations. That said, I wish the Eagles well in finding a venue elsewhere and I implore Mental Health to re-think its relationship with the neighborhood. My family has lived on 9th street for the past twenty years. My parents and also my grandparents have lived in the Cherry Hill area for the past seventy five years. Being part of this neighborhood for this long has helped me be aware and watchful for the changes that occur. I have basic concerns for our neighborhood no matter what the situation is on 8th Street and the impact it has on 9th Street. One concern I have is about parking. If the Eagles are granted a conditional use permit, will they be renting their venue to other users? If so is there sufficient parking to host the event?Ninth Street from Cherry to Peabody is a residential neighborhood;patrons attending an event happening on 8th street would not be permitted to park on 9th street. Behind Peninsula Mental Health there is a small park. Patrons of Mental Health have been using this park to park there cars. This is a place where neighbor children play and picnic, sled and meet. The "park"is not a parking lot. The area on the North side of 9th Street from valley to valley is in fact all residences with the exception of business on Lincoln, Peabody and Race Streets. Are we going to start encroaching on 9th Street? Another concern I have about the Eagles residing in that building is the amount of noise and traffic that events can generate. Again I am concerned about encroachment in any way into our neighborhood. Is there a need to subject residents to unknown factors when there are other places that are in the business and industrial corridors of this town? As the population in our town shrinks we continue to have many empty buildings in the downtown area. Why would we have encroachments into one of the oldest neighborhoods in the city if we don't need to? Please consider my comments when making this decision. It took some time to contact the municipalities you referenced during our meeting regarding similar crisis centers and to do some research as to how these uses are being handled zoning wise throughout the state. I phoned each municipality on your list as well as did some further research on my own. It would appear that this type of use is being handled as a professional office rather than as a rehab center given its short term nature for users. As proposed, the crisis center use you described would be considered a professional office in the City's Community Shopping District. According to the information provided by you during our meeting and by e-mail, such a service will assist persons experiencing a mental health or addiction related crisis to help avoid hospitalization or incarceration. The use is not intended to provide beds for longer than it takes to stabilize an individual. As such, staff has determined that such a use would be permitted outright as a professional office in the Community Shopping District (CSD). I believe your other questions (e-mail of May 7)were answered during our meeting. But to recap - an off street parking area requires a conditional use permit in the CSD; a crisis stabilization center/professional office would be a permitted use in the Community Shopping District (CSD) and group homes are conditional uses in the CSD. Given the separation of the alley in this location, from other neighborhood residential uses, a residential use on the second floor of the warehouse structure would meet the intent of the CSD zone while providing more separation from existing neighborhood residences than being immediately adjacent or across the residential street. (157) LOS —5 hours Admitted - 85 Discharged—716 Transferred— 59 Security Required - 265 The typical ER crisis person lives on the streets, uses drugs and alcohol and has exhausted the resources that might be extended to them. They usually have alcohol on hand, perhaps also drugs, and sleep on the sidewalk, the park bench, the side of the hill or in the ally. The public calls the police or the EMS about a"drunk", a"man down", someone who has wandered into their yard or their property. Upon the arrival of law enforcement, they are met with a person who is intoxicated or sleeping off the Ethanol Alcohol (ETON). More often than not,the person is just wandering and does not want to come to the ER. Law enforcement must "do something" with the person they received a call about. They bring them to the ER usually having reported the case as needing an ITA (Involuntary Treatment Act) to rule out dangerousness to self or for APC (Adult Protective Care) because they were walking in the street. In reality, the person they picked up just needs a place to sleep off the effects of the alcohol they consumed. When the person sleeps it off in the ER, high priced nursing care (1-1) must be utilized, which takes them away from patients with fractures, chest pains, etc and raises costs to consumers. The DMP (Designated Mental Health Professional) cannot even see a patient until the blood ETOH is below a .01 level, which takes 10-14 hours for most of these patients. Some are mentally ill clients who are psychotic or pre-psychotic and have not been taking their medications, or who have gone off their medications while consuming "street drugs" and alcohol. Crisis Intervention Services, Designated Mental Health Professionals Clallam County Jail 80% to 90% of the offenders arriving at the Jail are under the influence of Alcohol and/or Drugs. Surveys reveal that the majority of Jail inmates were under the effects of some substance at the time of their crime. 22% (23 inmates) of the current Jail population are Mentally Ill Offenders 19 male (20.6%), 4 female (28.6%) 10 ages 20— 30 2 ages 30—40 7 ages 40— 50 2 ages 50 —60 2ages 60 - 70 "The typical Mentally Ill Offender seen at the jail is a male between the ages 25 and 45, of Caucasian ancestry, who is Schizophrenic or Bi-Polar with Poly Substance Abuse. Generally, he is staff intensive, hard to house with other inmates and non - compliant with Psychiatric meds when out of custody." Medical Department PROGRAM PURPOSE Assist residents experiencing either a psychiatric or chemically induced crisis to avoid hospitalization, incarceration, medical emergency or homelessness ADMISSIONS CRITERIA Experiencing a mental health and or addiction related crisis Resident of Clallam County or Jefferson County (if beds are made available to them) 18-60 years of age Medically stable and not requiring skilled nursing Able and willing to: • voluntarily participate in an unlocked, neighborhood-based program, without seclusion or restraints • comply with a written no self-harm/harm to others contract • take oral medications, if prescribed, with minimal supervision SERVICES PROVIDED Mental Health Crisis Intervention/Stabilization and Sub Acute Detoxification 24/7 observation and monitoring of client safety and/or need for further immediate psychiatric intervention Routine Health Assessment Counseling, Milieu Therapy, Medication Prescription and Monitoring Assistance with housing and social services needs Linkage and referral for ongoing or more intensive treatment services Education about illness, medication and healthy living strategies for recovery and reintegration into the community STAFFING 11 FTE's • 3 shifts, 7 days a week and relief • 2 person minimum per shift during day and evening Day: one being a CDP, MA (Medical Assistant) or BA Evening: AA or BA and MA or LPN • AA/BA Aides/Case Mangers every shift • ARNP for a couple hours a week, possibly for days/eves.
