I represent the Estate of Mark Todd Holm regarding the listing and shle of the property. The Estate has accepted an offer to purchase the property, which is set to close on. December 18,2015. As a condition of the purchase,the Estate agreed to repair a deck on the west side of the home, which appears to be in violation of the thirteen foot side yard setback requirement. My research indicates that this deck and single family residence were constructed in 1968 pursuant to a building permit issued by the City of Port Angeles. The deck has not been modified or enlarged. It is accessed from a sliding glass door off the second story kitchen, or from stairs outside the residence. Due to rot in some of the stringers and support posts which rendered the deck unsafe,the contractor recommended that they be replaced, requiring a total disassembly of the deck. The stair assembly will be reattached to the deck. On behalf of the Estate of Mark Todd Holm, we are requesting that the City of Port Angeles issue a building permit for the repair and reassembly of the deck, based on the following provisions of the Port Angeles Municipal Code: • The residence/deck constitute a "legal nonconforming building or structure" pursuant to PANIC 17.08.065 C. The residence and deck were legally constructed in 1968 prior to the adoption of current side yard requirements for the RHD Zone set forth in PANIC 17.15.050 C. • The repair and reassembly of the deck meet the requirements for repair or restoration of a legal nonforming structure pursuant to PANIC 17.95.030 B.I., i.e.the repair"does not exceed 75 percent of the existing assessed value of the building or structure for tax purposes". In addition: • There is a sidewalk and row of trees between the deck and Porter Street; • The deck does not interfere or obstruct vehicle or pedestrian traffic on Porter Street; • The grant of the building permit is consistent with the purpose of the RHD zone and the residence is otherwise consistent with the zoning requirements of the RHD zone; • Repairing the deck is not materially detrimental to the public welfare or injurious to property or improvements in the neighborhood; • "Resizing"the deck to meet the 13 foot side yard requirement would result in an undue hardship on the Estate; • To my knowledge, there have not been any complaints by neighbors or other members of the public regarding the deck; • Repair of the deck eliminates a safety hazard for the purchasers of the property,their guests and invitees.
