BACKGROUND/ANALYSIS: The subject property is located at the northeast corner of the intersection of 12`h and "F" Streets on Lots 13 and 14, Block 355, Townsite of Port Angeles. The subject property is 27,977 square feet in area and contains a 2662 square foot single family residence in the western portion of the building site and a detached 1662 square foot accessory in the far east portion of the site. The remainder of the site is largely lawn with lot coverage being 15%. The conditional use permit application is to convert the existing detached 1662 square foot structure to a daycare center for up to 17 children. The applicant intends to provide an early learning opportunity much like a preschool but, because state licensing is for a day care center, the application is being processed accordingly. The activity will function Monday through Friday between the hours of 8:30 AM to 12:30 PM and will offer music, art, yoga, and outdoor play activities for children between the ages of 3 and 5. The property slopes from north to south approximately 12.5%. There are no environmentally sensitive areas on the site. The site and surrounding properties are zoned RS-7, Residential, Single Family with the exception of Stevens Middle School that is located south of 12`h Street in this location. Stevens Middle School is zoned PBP Public Buildings and Parks. Conditional Use Permit—CUP 13-01 F, SSidt Page Zoning Ordinance The Zoning Ordinance is the primary implementing ordinance for the Comprehensive Plan. It establishes what types of uses are permitted in particular zones. The zoning map indicates where specific zones are located within the City. Any project proposed in the City must be consistent with the regulations of the zone in which it is located. The purpose and intent of the Residential Single Family (RS-7) zone is as follows: "This is a low density residential zone intended to create and preserve urban single family residential neighborhoods consisting of predominantly single family homes on standard Townsite-size lots. Uses which are compatible with and functionally related to a single family residential environment may also be located in this zone. " New development is subject to the design and dimensional requirements set forth in 17.10.050 PAMC including minimum setbacks and maximum lot coverage. The setbacks required for the subject property include a 20-foot minimum front and rear yard setbacks and 7- foot side yard setbacks except for detached garages in the rear one third of the lot may have 10- foot rear yard and 3-foot side yard setbacks. Both the primary residence and the detached structure are conforming to setbacks for residential use; however, the detached structure is not located on the same building site as the primary structure. A Zoning Lot Covenant should be filed to join Lots 13 and 14 into one building site in support of the use and associated required off street parking. Fencing is required by state licensing requirements for day care centers. The entire yard between the day care structure to the edge of the orchard east of the residence will be fenced with a four to five foot high fence. Child day-care centers and pre-schools are listed as conditional uses in the RS-7 zone per PAMC 17.10.040(E). A "Child Day-Care Center" is defined in PAMC 17.08.020 - (C) as; "a child day-care center provides for the care of 13 or more children. The child day-care center shall not be located in a private family residence unless the portion of the residence where the children have access is used exclusively for the children during the hours the center is in operation or is separated from the usual living quarters of the family. " Child care and schools are functionally related to residential uses, Section 17.96.050 PAMC specifies procedures for the review and processing of conditional use applications as follows: A. The Planning Commission shall consider applications for Conditional Use Permits of uses as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. The Planning Commission may refuse to issue a Conditional Use Permit if the characteristics of the intended use as related to the specific proposed site are such as would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental, or hazardous conditions. B. In each application the Planning Commission may impose whatever restrictions or conditions they consider essential to protect the public health, safety, and welfare, and to prevent depreciation of neighboring property. Conditional Use Permit—CUP 13-01 Schmidt Pagel 3 C. Purpose of a Conditional Use Permit: The purpose of a Conditional Use Permit shall be to assure that the maximum degree of compatibility between uses shall be attained. The purpose of these regulations shall be maintained with respect to the particular use of the particular site and in consideration of other existing and potential uses within the general area in which such.use is to be located. The recommended conditions reflect the normal requirements for a child day-care center. Comprehensive Plan The Comprehensive Plan establishes the long range goals and policies of the City. Any project proposed in the City must be consistent with the goals and policies of the Comprehensive Plan. The site is located in the City's North West Planning Area. The site and surrounding areas are designated Low Density Residential (LDR) on the City's Comprehensive Plan Land Use Map. The Low Density Residential designation permits up to 7 units per acre. The high majority of residentially designated property in the City will be of this designation. It is intended for the development of single family homes and associated activities. The subject property and surrounding areas are identified on the City's Comprehensive Plan Land Use Map as Low Density Residential (LDR) with the exception of the Stevens Middle School property that is designated as Open Space (OS). Comprehensive Plan policies have been reviewed with regard to the proposed application. The following policies appear to be the most relevant to the proposal. Land Use Element Goal A, Policy No. 2-All land use decisions and approvals made by the City Council and/or any of its appointed Commissions, Boards or Committees should be consistent with the Comprehensive Plan and its land use map. Land Use Element Goal C,Policy No. I -"Residential land should be developed on the district and neighborhood concept. Although such districts maybe composed primarily of residential uses of a uniform density, a healthy, viable district should be composed of residential uses of varying densities which may be augmented by subordinate and compatible uses. Single family and multi family homes,parks and open-spaces, schools, churches, day care and residential services, home occupations, and district shopping areas are all legitimate components of district development and enhancement. A neighborhood should be primarily composed of low, medium, or high density housing. " Land Use Element Goal D,Policy No. I -"The City should encourage new and existing commercial developments and businesses which are consistent with the goals and policies of this Comprehensive Plan. " Utilities and Public Services Goal B,Policy No. 3-As a "supporter,"the City should promote and cooperate in providingprograms and services including: public and private youth,family, and senior services Conditional Use Permit—CUP 13-01 Schmidt Pagel 4 Parking Ordinance PAMC 14.40.030(E) requires one (1)parking space per employee and two (2)parking spaces for loading/unloading of children f9r da -c re centers serving more than 12 children. The proponent anticipates two (2) employees 49 rhe e owner. Therefore,€e»{4}parking spaces will be required for the day care center activity. The owner's vehicle will be parked in the residential parking area elsewhere on the site. The site is situated with an alley passing along the back (north) of the property. Parking will be located adjacent to the improved alley along the 40&and west side of the subject day care structure with access from the alley. The day care center parking has not been developed but will be created with final development of the use and prior to occupancy. Residential parking for the primary dwelling unit(two [2] spaces) is provided at the front of the residence off "F" Street. The application is attached as Attachment B. PUBLIC NOTIFICATION Per Section 17.96.140 PAMC, the site was posted for land use action on April 9, 2013, with legal publication posted in the Peninsula Daily News on April 12, 2013. Letters of notice were mailed to property owners within 300 feet of the subject property by U.S. Mail on April, 9 and April 30, 2013. Several written comments were received within the written public comment period that ended on May 14, 2013, in support of the proposed activity. Copies of those letters are included with this staff report as Attachment B. STATE ENVIRONMENTAL POLICY ACT REVIEW AND COMPLIANCE. A Determination of Non-Significance was issued for the proposed action on May 17, 2013. This action satisfies the City's responsibility under the State Environmental Policy Act. AGENCY COMMENTS: City Departments reviewed the proposal. Reviewing Departments (Fire, Building, and Public Works and Utilities) did not have concerns with the activity as proposed. Remodel of the accessory structure and development of the off street parking area shall be in accordance with the City's development standards. STAFF CONCLUSION: The proposed child day-care center is consistent with the purpose of RS-7 zone as it is compatible with adjacent residential uses which are family oriented. The activity will be conducted in such a manner as to be respectful of surrounding single family residential uses and, given the relatively short time period of activity during the weekdays, the activities should not conflict with other neighborhood activities. Development of the center will be in compliance with established development standards, i.e., setbacks, fencing, off street parking, hours of operation, and can therefore be deemed to be compatible with the intent of the City's development regulations found in the Zoning Code and Comprehensive Plan. Conditional Use Permit—CUP 13-01 Schmidt Pagel S Attachment A RECOMMENDED CONDITIONS, FINDINGS AND CONCLUSIONS for CUP 13-01 The Planning Department recommends the Planning Commission approve Conditional Use Permit CUP 13-01 subject to the following 4 conditions of approval and based on the following 13 findings and 4 conclusions: Conditions: 1. The conditional use permit is approved for Mrs. Bonnie Schmidt to conduct a day care activity at 1235 West 12th Street for up to 17 children per Conditional Use Permit application CUP 13-01. Hours of operation shall be 8:30 AM to 12:30 Monday through Friday. 2. The subject property shall be joined into one building site through a Zoning Lot Covenant. 3. Off street parking shall be provided for the use adjacent to the alley in the area south and west of the subject day care structure. The applicant shall provide a minimum of four(4) off street parking spaces for the use that will include two (2) for the day center visitors and one (1) for each of the two (2) employees. Parking shall be developed to City standards. 4. The use shall obtain and remain licensed for operation by the Washington State Department of Social and Health Services for such a use during operation. Findings: Based on the information provided in the Planning Department Staff Report for CUP 13- 01 dated May 22, 2013, including all information in the public record file, comments and testimony presented during the public hearing, the Planning Commission discussion and deliberation, and the above listed condition of approval, the City of Port Angeles Planning Commission hereby finds that: 1. The applicant Bonnie Schmidt submitted a Conditional Use Permit application to establish a Child Daycare Center on March 25, 2013, in the City's RS-7 Residential Single Family zone. The proposal is to establish a learning center for up to 17 children between the ages of 3 and 5 years of age on two of the four lots owned by the applicant. 2. The subject property is located at the northeast corner of the intersection of 12th and"F" Streets on Lots 11- 14, Block 355, Townsite of Port Angeles. The detached structure will be remodeled to accommodate the day care center per plans submitted with the application along with associated off street parking. 3. The property is zoned RS7 Residential Single Family. Surrounding properties are zoned RS-7 with Stevens Middle School property to the south zoned PBP Public Buildings and Parks. 4. Development in the RS-7 zone is subject to the design and dimensional requirements set forth in 17.10.050 PAMC including minimum setbacks and maximum lot coverage. Section 14.30.030(E) of the Port Angeles Municipal Code requires 1 off street parking space per employee and 2 off street parking spaces for pick-up and drop-off of children for child day-care center serving more than 12 children. The applicant has indicated that there will be 2 employees at the day-care center. Four(4) off street parking for the day care center use will be developed adjacent to the alley at the south and west sides of the day care center structure to City standards prior to commencement of the activity. 10. The Comprehensive Plan Land Use Map designates the site as LDR Low Density Residential. Adjacent designations are LDR and OS Open Space (Stevens Middle School site). The site is found in the City's North West Planning Area. While the Comprehensive Plan was reviewed in its entirety relative to the application the following goals and policies were found to be most relevant to the application: Land Use Element Goal A, Policy No. 2; Land Use Element Goal C, Policy No. 1; Land Use Element Goal D, Policy No. 1; and Utilities and Public Services Goal B, Policy No. 3. 11. A Determination of Non-Significance was issued for this proposed action on May 17, 2013. 12. Reviewing City Departments did not note any concerns relative to the proposed day care activity. Remodel of the accessory structure shall be in accordance with all Building and Fire Code requirements. Development of the site that results in land disturbance will be in accordance with the City's Urban Services and Standards Guidelines. 13. Per Section 17.96.140 PAMC,the site was posted for land use action on April 9, 2013, with legal publication posted in the Peninsula Daily News on April 12, 2013. Letters of notice were mailed to property owners within 300 feet of the subject property by U.S. Mail on April, 9 and April 30, 2013. Conclusions: Based on the information provided in the Department Staff Report for CUP 13-01 dated May 22, 2013, including all of the information in the public record file, comments, and testimony presented during the public hearing,the Planning Commission's discussion and deliberation, and the above listed condition of approval and the above listed findings,the City of Port Angeles Planning Commission hereby concludes that: Conditional Use Permit—CUP 13-01 Schmidt Paged 8 1. The proposal is supported and is consistent with the intent of the City's Comprehensive Plan Land Use goals and policies. 2. As conditioned, the filing of a Zoning Lot Covenant will create a building site to support the Daycare use that will enable the future stand alone use as a daycare or as a single family residential site if future conversion to a single family use is desired. 4. By August, we heard about Peninsula Pre Three Cooperative and Bonnie Schmidt's Music Together Class. We were very excited and signed up for both classes. Therefore, I was lucky enough to meet Bonnie and get to know her as a parent in one class and as the teacher in another. In our Co-op Class, parents interact with kids on the children's level and are to encourage the children to play, learn, and socialize with other toddlers and adults. I have thought of myself as a good mother who strives to do all those things for my daughter,however I was immediately impressed with the mannerisms and ideas I saw from the other Co-op parents around me, none more so than Bonnie. My daughter entered into the"terrible twos" about the same time we began our classes,and I found myself more and more at a loss as to what to do in challenging and frustrating situations with my newly independent daughter. It is silly to say, but during these moments of frustration, I would stop and think, "What would Bonnie do?" A simple reminder of Bonnie's patience,creativity,and compassion when dealing with little ones often helps me be more creative and sensitive myself with my passionate, spirited two-year-old. I first heard about Teacher Bonnie from several friends. I had a newborn and they all had been raving about Bonnie's music class for young kids. Going to Bonnie's class was the first solo trip I made out of the house with my newborn son, and it was well worth it. The atmosphere one of celebration, support, and community; just what I needed as a new mom. I felt so included and comfortable that I signed up for a whole session with her. She gave me special tips on how to include my son in the activities even though he could only just barely sit upright. I really discovered how amazing Bonnie is as a teacher when I went to a different music class. The other class was frustrating for my son and he disengaged because he wasn't having fun. I now really wish my schedule allowed me to still attend Bonnie's classes to see my son engage with music in a way that makes him laugh, dance, stomp his feet, engage with other kids, and overall, just get jazzed up and have fun. We are so excited about Bonnie's day care. Bonnie is exactly the type of person I want my son to be around. She sees through the kids' eyes and communicates clearly and age appropriately. BACKGROUND/ANALYSIS: The subject property is located at the northeast corner of the intersection of 12th and "F" Streets on Lots 13 and 14, Block 355, Townsite of Port Angeles. The subject property is 27,977 square feet in area and contains a 2662 square foot single family residence in the western portion of the property ownership area with a 1662 square foot structure in the far east portion of the site. The remainder of the site is largely lawn with lot coverage being 15%. The conditional use permit application is to convert the existing detached 1662 square foot structure to a daycare center for up to 17 children. The applicant intends to provide an early learning opportunity much like a preschool but, because state licensing is for a day care center, the application is being processed accordingly. The activity will function Monday through Friday between the hours of 8:30 AM to 12:30 PM and will offer music, art, yoga, and outdoor play activities for children between the ages of 3 and 5. The property slopes from north to south approximately 12.5%. There are no environmentally sensitive areas on the site. The site and surrounding properties are zoned RS-7, Residential, Single Family with the exception of Stevens Middle School that is located south of 12th Street in this location. Stevens Middle School is zoned PBP Public Buildings and Parks. Conditional Use Permit—CUP Schmidt Pagel 2 Zoning Ordinance The Zoning Ordinance is the primary implementing ordinance for the Comprehensive Plan. It establishes what types of uses are permitted in particular zones. The zoning map indicates where specific zones are located within the City. Any project proposed in the City must be consistent with the regulations of the zone in which it is located. The purpose and intent of the Residential Single Family (RS-7) zone is as follows: "This is a low density residential zone intended to create and preserve urban single family residential neighborhoods consisting of predominantly single family homes on standard Townsite-size lots. Uses which are compatible with and functionally related to a single family residential environment may also be located in this zone. " New development is subject to the design and dimensional requirements set forth in 17.10.050 PAMC including minimum setbacks and maximum lot coverage. The setbacks required for the subject property include a 20-foot minimum front and rear yard setbacks and 7- foot side yard setbacks except for detached garages in the rear one third of the lot may have 10- foot rear yard and 3-foot side yard setbacks. Both the primary residence and the detached structure are conforming to setbacks for residential use; however, the detached structure is not located on the same building site as the primary structure. A Zoning Lot Covenant should be filed to join Lots 13 and 14 into one building site in support of the use and associated required off street parking. Fencing is required by state licensing requirements for day care centers. The entire yard between the day care structure to the edge of the orchard east of the residence will be fenced with a four to five foot high fence. Child day-care centers and pre-schools are listed as conditional uses in the RS-7 zone per PAMC 17.10.040(E). A"Child Day-Care Center" is defined in PAMC 17.08.020 - (C) as; "a child day-care center provides for the care of 13 or more children. The child day-care center shall not be located in a private family residence unless the portion of the residence where the children have access is used exclusively for the children during the hours the center is in operation or is separated from the usual living quarters of the family. " Child care and schools are functionally related to residential uses, Section 17.96.050 PAMC specifies procedures for the review and processing of conditional use applications as follows: A. The Planning Commission shall consider applications for Conditional Use Permits of uses as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. The Planning Commission may refuse to issue a Conditional Use Permit if the characteristics of the intended use as related to the specific proposed site are such as would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental, or hazardous conditions. B. In each application the Planning Commission may impose whatever restrictions or conditions they consider essential to protect the public health, safety, and welfare, and to prevent depreciation of neighboring property. Conditional Use Permit—CUP • Schmidt Pagel 3 C. Purpose of a Conditional Use Permit: The purpose of a Conditional Use Permit shall be to assure that the maximum degree of compatibility between uses shall be attained. The purpose of these regulations shall be maintained with respect to the particular use of the particular site and in consideration of other existing and potential uses within the general area in which such use is to be located. The recommended conditions reflect the normal requirements for a child day-care center. Comprehensive Plan The Comprehensive Plan establishes the long range goals and policies of the City. Any project proposed in the City must be consistent with the goals and policies of the Comprehensive Plan. The site is located in the City's North West Planning Area. The site and surrounding areas are designated Low Density Residential (LDR) on the City's Comprehensive Plan Land Use Map. The Low Density Residential designation permits up to 7 units per acre. The high majority of residentially designated property in the City will be of this designation. It is intended for the development of single family homes and associated activities. The subject property and surrounding areas are identified on the City's Comprehensive Plan Land Use Map as Low Density Residential (LDR) with the exception of the Stevens Middle School property that is designated as Open Space (OS). Comprehensive Plan policies have been reviewed with regard to the proposed application. The following policies appear to be the most relevant to the proposal. Land Use Element Goal A, Policy No. 2-All land use decisions and approvals made by the City Council and/or any of its appointed Commissions, Boards or Committees should be consistent with the Comprehensive Plan and its land use map. Land Use Element Goal C,Policy No. I -"Residential land should be developed on the district and neighborhood concept. Although such districts may be composed primarily of residential uses of a uniform density, a healthy, viable district should be composed of residential uses of varying densities which may be augmented by subordinate and compatible uses. Single family and multi family homes,parks and open-spaces, schools, churches, day care and residential services, home occupations, and district shopping areas are all legitimate components of district development and enhancement. A neighborhood should be primarily composed of low, medium, or high density housing. " Land Use Element Goal D, Policy No. I -"The City should encourage new and existing commercial developments and businesses which are consistent with the goals and policies of this Comprehensive Plan. The proponent anticipates one (1) non resident employee. Therefore, three (3) parking spaces will be required for the day care center activity. The owner's vehicle will be parked in the residential parking area elsewhere on the site. The site is situated with an alley passing along the back (north) of the property. Parking will be located adjacent to the improved alley along the north and west side of the subject day care structure with access from the alley. The day care center parking has not been developed but will be created with final development of the use and prior to occupancy. Residential parking for the primary dwelling unit(two [2] spaces) is provided at the front of the residence off "F" Street. The application is attached as Attachment B. PUBLIC NOTIFICATION Per Section 17.96.140 PAMC, the site was posted for land use action on April 9, 2013, with legal publication posted in the Peninsula Daily News on April 12, 2013. Letters of notice were mailed to property owners within 300 feet of the subject property by U.S. Mail on April, 9 and April 30, 2013. Several written comments were received within the written public comment period that ended on May 14, 2013, in support of the proposed activity. Copies of those letters are included with this staff report as Attachment B. STATE ENVIRONMENTAL POLICY ACT REVIEW AND COMPLIANCE. A Determination of Non-Significance was issued for the proposed action on May 17, 2013. This action satisfies the City's responsibility under the State Environmental Policy Act. AGENCY COMMENTS: City Departments reviewed the proposal. Reviewing Departments (Fire, Building, and Public Works and Utilities) did not have concerns with the activity as proposed. Remodel of the accessory structure and development of the off street parking area shall be in accordance with the City's development standards. STAFF CONCLUSION: The proposed child day-care center is consistent with the purpose of RS-7 zone as it is compatible with adjacent residential uses which are family oriented. The activity will be conducted in such a manner as to be respectful of surrounding single family residential uses and, given the relatively short time period of activity during the weekdays, the activities should not conflict with other neighborhood activities. Development of the center will be in compliance with established development standards, i.e., setbacks, fencing, off street parking, hours of operation, and can therefore be deemed to be compatible with the intent of the City's development regulations found in the Zoning Code and Comprehensive Plan. The conditional use permit is approved for Mrs. Bonnie Schmidt to conduct a day care activity at 1235 West 12th Street for up to 17 children per Conditional Use Permit application CUP 13-01. Hours of operation shall be 8:30 AM to 12:30 Monday through Friday. 2. The subject property shall be joined into one building site through a Zoning Lot Covenant. 3. Off street parking shall be provided for the use adjacent to the alley in the area south and west of the subject day care structure. The applicant shall provide a minimum of three (3) off street parking spaces for the use that will include two (2) for the day center visitors and one (1) for the non resident employee. Parking shall be developed to City standards. 4. The use shall obtain and remain licensed for operation by the Washington State Department of Social and Health Services for such a use during operation. Findings: Based on the information provided in the Planning Department Staff Report for CUP 13- 01 dated May 22, 2013, including all information in the public record file, comments and testimony presented during the public hearing, the Planning Commission discussion and deliberation, and the above listed condition of approval,the City of Port Angeles Planning Commission hereby finds that: 1. The applicant Bonnie Schmidt submitted a Conditional Use Permit application to establish a Child Daycare Center on March 25, 2013, in the City's RS-7 Residential Single Family zone. The proposal is to establish a learning center for up to 17 children between the ages of 3 and 5 years of age on two of the four lots owned by the applicant. 2. The subject property ownership is located at the northeast corner of the intersection of 12'' and"F" Streets on Lots 11- 14, Block 355, Townsite of Port Angeles. The subject property ownership is 27,977 square feet in area and contains a 2662 square foot single family residence located on Lots 11 and 12 with the subject detached 1662 square foot structure located on Lot 14 in the far east portion of the property ownership. Lot 13 is undeveloped. The detached structure will be remodeled to accommodate the day care center per plans submitted with the application along with associated off street parking. Conditional Use Permit—CUP 101 • Schmidt Pagel 6 undeveloped. The detached structure will be remodeled to accommodate the day care center per plans submitted with the application along with associated off street parking. 3. The property is zoned RS7 Residential Single Family. Surrounding properties are zoned RS-7 with Stevens Middle School property to the south zoned PBP Public Buildings and Parks. 4. Development in the RS-7 zone is subject to the design and dimensional requirements set forth in 17.10.050 PAMC including minimum setbacks and maximum lot coverage. The setbacks required for the subject property include a 20-foot minimum front and rear yard setbacks and 7-foot side yard setbacks except for detached garages in the rear one third of the lot may have 10-foot rear yard and 3-foot side yard setbacks. Both the primary residence and the detached structure are conforming to setback requirements of the RS-7 zone for residential use but they are not located on a single building site. A Zoning Lot Covenant is needed to create the day care use and associated off street parking as one building site. 5. Section 17.17.08.020 (C) of the Port Angeles Municipal Code defines a Child day-care center as "a child day-care center provides for the care of 13 or more children. The child day-care center shall not be located in a private family residence unless the portion of the residence where the children have access is used exclusively for the children during the hours the center is in operation or is separated from the usual living quarters of the family." 6. Daycare Center operations require licensing by the Washington State Department of Social and Health Services. Fencing is required by state licensing requirements. The entire yard between the day care structure to the edge of the orchard east of the residence will be fenced with a four to five foot high fence. 7. Child day-care centers and pre-schools are listed as conditional uses in the RS-7 zone per PAMC 17.10.040(E). A"Child Day-Care Center" is defined in PAMC 17.08.020 - (C) as; "a child day-care center provides for the care of 13 or more children. The child day- care center shall not be located in a private family residence unless the portion of the residence where the children have access is used exclusively for the children during the hours the center is in operation or is separated from the usual living quarters of the family. " Child care and schools are functionally related to residential uses. 8. Section 17.96.050 PAMC specifies procedures for the review and processing of conditional use applications as follows: A. The Planning Commission shall consider applications for Conditional Use Permits of uses as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. The Planning Commission may refuse to issue a Conditional Use Permit if the characteristics of the intended use as Conditional Use Permit—CUPW • Schmidt Pagel 7 B. In each application the Planning Commission may impose whatever restrictions or conditions they consider essential to protect the public health, safety, and welfare, and to prevent depreciation of neighboring property. C. Purpose of a Conditional Use Permit: The purpose of a Conditional Use Permit area in which such use is to shall be to assure that the maximum degree of compatibility between uses shall be attained. The purpose of these regulations shall be maintained with respect to the particular use of the particular site and in consideration of other existing and potential uses within the general be located. 9. Section 14.30.030(E) of the Port Angeles Municipal Code requires 1 off street parking space per employee and 2 off street parking spaces for pick-up and drop-off of children for child day-care center serving more than 12 children. The applicant has indicated that there will be 1 non resident employee at the day-care center. Three (3) off street parking spaces for the day care center use will be developed adjacent to the alley at the north and west sides of the day care center structure to City standards prior to commencement of the activity. 10. The Comprehensive Plan Land Use Map designates the site as LDR Low Density Residential. Adjacent designations are LDR and OS Open Space (Stevens Middle School site). The site is found in the City's North West Planning Area. While the Comprehensive Plan was reviewed in its entirety relative to the application the following goals and policies were found to be most relevant to the application: Land Use Element Goal A, Policy No. 2; Land Use Element Goal C, Policy No. 1; Land Use Element Goal D, Policy No. 1; and Utilities and Public Services Goal B, Policy No. 3. 11. A Determination of Non-Significance was issued for this proposed action on May 17, 2013. 12. Reviewing City Departments did not note any concerns relative to the proposed day care activity. Remodel of the accessory structure shall be in accordance with all Building and Fire Code requirements. Development of the site that results in land disturbance will be in accordance with the City's Urban Services and Standards Guidelines. 13. I have thought of myself as a good mother who strives to do all those things for my daughter, however I was immediately impressed with the mannerisms and ideas I saw from the other Co-op parents around me, none more so than Bonnie. My daughter entered into the "terrible twos" about the same time we began our classes, and I found myself more and more at a loss as to what to do in challenging and frustrating situations with my newly independent daughter. It is silly to say, but during these moments of frustration, I would stop and think, "What would Bonnie do?" A simple reminder of Bonnie's patience, creativity, and compassion when dealing with little ones often helps me be more creative and sensitive myself with my passionate, spirited two-year-old. My admiration of Bonnie has only grown with attending her Music Together Class. Bonnie is a highly talented, creative, and fun teacher. Both my daughter and I love the way Bonnie uses music as a tool to motivate kids of all ages to learn, interact, and explore their own creativity. We are now in our third Co-op Class and our third Music Together Class with Bonnie and her daughter. These classes have added so much to our lives and my daughter's growth in the past eight months. I first heard about Teacher Bonnie from several friends. I had a newborn and they all had been raving about Bonnie's music class for young kids. Going to Bonnie's class was the first solo trip I made out of the house with my newborn son, and it was well worth it. The atmosphere one of celebration, support, and community; just what I needed as a new mom. I felt so included and comfortable that I signed up for a whole session with her. She gave me special tips on how to include my son in the activities even though he could only just barely sit upright. I really discovered how amazing Bonnie is as a teacher when I went to a different music class. The other class was frustrating for my son and he disengaged because he wasn't having fun. I now really wish my schedule allowed me to still attend Bonnie's classes to see my son engage with music in a way that makes him laugh, dance, stomp his feet, engage with other kids, and overall, just get jazzed up and have fun.
