On, January.. 18 , 2017, the City's, Hearing. Examiner approved with conditions your request for a
Conditional Use Permit to allow the operation of a craft distillery and tasting room..on August 18, it
'F was broughtlo our attention that.unpe'rmitted signs have,been erected on the building and there
Y may have:been.interior improvements that may have required permitting as well. Therefore; it has
been identified that you have,not fully complied with the conditions of your, Conditional Use Permit.
We would like to help by identifying,those actions required of you in,this letter. As a reminder, your
' Conditional Use Permit application was approved with the following seven conditions:
1. The proposed use shall remain in.substantial conformance to the application as submitted.
2. The applicant shall obtain:alC necessary permits from local and state.agencies including but
r not:limited to;the Washington State Liquor and Cannabis.Board,the Clallam County Health
Department and`the City of Port Angeles.
3. The applicant shall complete and submit for.review and'approval'an Industrial Pre-Treatment
Wastewater Questionnaire and Disclosure form to determine the need for a wastewater
discharge permit from the Port Angeles Wastewater Division.
4. The applicant shall submit for review and approval a cooperative parking.agreement to the
Director of•Communityand Economic Development.
5. .The proposed use shall remain-in compliance all.City of Port Angeles codes, including-but not

limited to,the parking and sign.codes and design and landscaping regulations.
6. The proposed use shall remain in strict compliance with all requirements imposed by the
International Building and Fire codes as adopted'by the City.
7. If any unanticipated adverse impacts are identified,the Hearing Examiner,may impose
additional conditions at that time.
Relating to your project, we have received the following• summarized department comments
regarding the operation of the craft distillery and tasting room.
City-of Port Angeles Department:of Community and Economic Development — The applicant
shall apply for the following:
A. A Building Permit for tenant improvement and finish out is required, which will include
two complete sets of building plans, which shall include by are not limited to plans and
{? specifications on the space and equipment being used and their classification. Adjacent rooms
above and around this space need to be reviewed for conformity to the separation and fire

Protection requirements for IBC, NEC and IFC. Building Permit plans will need to be routed to
Fire Department and the Public Works and Utilities Waste Water and Electrical Divisions.
B. An Electrical Permit will need to be secured after,plans have been submitted and the
classification can be determined.
C. A sign ha's been erected on the building without a permit.A Sign Permit shall be submitted and
acquired for the signs that have been erected on the building, or the signs will-need to be
removed.
D. A Cooperative Parking Agreement needs to be submitted to the Director of Community and
Economic Development for review and approval.
E. A Certificate of Occupancy shall be applied for and acquired prior to the operation of the .
business. .

City of Port Angeles Public Works & Utilities Department — The applicant has submitted the
Industrial Wastewater Pretreatment Questionnaire. and Disclosure Form and the property has
received an inspection., However,,a second inspection will be required at the time that the
business is operating for sampling and testing. Please contact David Freed, Wastewater

Clallam County Environmental_Health Services—The applicant has not submitted an application
and needs to obtain a permit from the Clallam County Environmental Health Services. Please
contact the Clallam County Environmental Health Services for more information at (360)417-
2418.
Please apply for the appropriate Building Permits, Electrical Permits,Sign.Permit, Cooperative Parking
Agreement, and Certificate of Occupancy as soon as possible to ensure that you are in compliance
with City of Port Angeles Municipal Code requirements and the conditions of approval for your
permit. Additionally, please contact Clallam County Environmental Health Services to acquire the
appropriate County level permits. If you do not meet the conditions of approval prior to the
operation of your business your permit may be revoked by the Director of Community and Economic
Development,per PAMC 17.96.070(D).
As you move forward with developing the craft distillery and tasting room;please.make sure that you
are complying with the conditions of approval for your permit to avoid delays in the process of

The application for a conditional use permit to operate a craft distillery and tasting room
in a Community Shopping District is APPROVED, subject to conditions.
SUMMARY OF RECORD
Request:
The applicant is proposing to establish and operate a craft distillery and tasting room in a
Community Shopping District.
Hearing Date:
On January 11,2017,a public hearing on the application was conducted before Lauren
Erickson, City of Port Angeles Hearing Examiner.
Testimony:
At the open record hearing the following individuals presented testimony under oath:

Having reviewed the record in full, including the above referenced exhibits and the
testimony of the witnesses, the Hearing Examiner enters the following Findings of Fact
and Conclusions of Law:
FINDINGS OF FACT
1. Theapplicant is seekingto establish and operate a craft distillery and tasting

2. The subject property is located at 125 Motor Avenue, Port Angeles,Washington,
in the Lauridsen Neighborhood District. The property is zoned as Community
Shopping District(hereafter, CSD). The subject property is a single lot parcel,
with 94 foot lot depth and 80 foot lot width, and is approximately 7520 square
feet in area.
3. The property is developed with two structures; one structure is a three story, two
unit residential building. The second structure, and the proposed location for the
business operation, is a two story,office/storage building.
4. The surrounding area is zoned CSD and RS-7, Residential Single Family. The
properties located in the CSD zone contain a restaurant,retail and automotive
services and legal non-conforming residences. The abutting property to the north
is a vacant parcel,to the west is a legal non-conforming residence, and to the east
is a family style restaurant.
5. The properties across Motor Avenue to the south and southwest are residential
single family homes.
6. The purpose of the CSD zone is to provide a commercial zone oriented primarily
to those businesses serving the daily needs of the surrounding residential zone but
is slightly less restrictive than the CN zone and as such provides a transition form
the most restrictive commercial zone to those of lesser restriction. Commercial
uses largely devoid of any impacts detrimental to the environment are allowed.
7. Examples of uses allowed outright in the CSD zone include art galleries and
museums, food item retail stores, specialty shops such as gift stores and florists,
medical/dental offices and clinics and laboratories, food and beverage
establishments such as restaurants,cocktail lounges and taverns.
8. Examples of uses requiring a conditional use permit in the CSD zone include
hotels and motels, clubs and lodges,microbreweries and other uses compatible
with this chapter.

9. The applicant proposes to operate and manufacture spirits from 8:00 am to 5:00
pm,Monday through Friday. The proposed tasting room will be open on Saturday
and Sunday from 11:00 am to 7:00 pm. The business operation will employ one
person.
10. Pursuant to City of Port Angeles code,the business operation will require four
parking spaces,including one that will meet the American with Disabilities Act
standards. In order to meet this requirement,the applicant intends to enter into a
Cooperative Parking Agreement with the restaurant located to the east of the
subject property.
11. The applicant states that the business will not produce any noxious odors, or
noise.
12. On January 4,2017,a Determination of Non-Significance was issued for the
project.
13. On December 20, 2016,notice of the application and public hearing was
published in the Peninsula Daily News. On December 20,2016,notice of the
application and public hearing was posted on the subject property and at City
Hall. On December 20, 2016,notice of the application and public hearing was
mailed to property owners located within 300 feet of the subject property.
14. A copy of the application was circulated to City Departments and the Washington
State Department of Ecology and the Olympic Region Clean Air Agency.
15. The Police Department had no comment. The Public Works and Utilities
Department commented that the applicant needs to complete and submit an
Industrial Wastewater Pretreatment Questionnaire and Disclosure Form.
16. The Washington State Department of Ecology recommended that City staff
contact the Olympic Region Clean Air Agency to determine if a notice of
construction application is needed for craft distilling operations.
17. The Olympic Region Clean Air Agency stated that based upon the application as
submitted,the project will not require a permit from that agency.
18. The Port Angeles Fire Department commented that it is important to recognize
that the alcohol produced in the distilling process is considered a Flammable 1 B
liquid and approval to operate will be contingent upon review of the requirements
set forth in the International Fire and Building codes relating to process and
storage below Maximum Allowable Quantities and process and storage Above
Maximum Allowable Quantities.

The Fire Marshall indicated that he/she had spoken to the applicant on several
occasions regarding the applicant's intended level of manufacturing and intended
quantities to be produced.
19.Two written comments were received from the public and one member of the
public spoke at the hearing. Issues raise included lack of parking, odors and loss
of view. The primary concern was the risk of fire/explosion in a residential
neighborhood. City staff and the applicant responded to the concerns raised at
hearing and in the Staff report.
CONCLUSIONS OF LAW
1. The Hearing Examiner has jurisdiction to hear this matter.
2. Notices of the application and public hearing were properly given.
3. Pursuant to PAMC 17.96.050, conditional use permits may granted if consistent
and compatible with the purpose of the zone in which the use is located,
consistent with the Comprehensive Plan and not contrary to the public use and
interest.
4. The undersigned hearing examiner concludes the proposal is consistent and
compatible with the purpose of the zone in which it is located. The purpose'of the
CSD is to serve the daily needs of the surrounding residential zones but is slightly
less restrictive than the CN zone and as such provides a transition from the most
restrictive commercial zones to those of lesser restrictions. The proposed use may
not be what is generally thought of as a"daily need"; however, other uses allowed
outright in the CSD zone include activities such as cocktail lounges and taverns
(with some restrictions),museums and art galleries, specialty shops, and
commercial recreational activities such as bowling alleys and arcades. It would
seem that in this context,the term"daily need"is an expansive one and not
limited to activities that people/shoppers would find to be essential. Moreover,
the proposed use is the kind of commercial activity that helps support a shopping
district as a whole.
Conditional uses allowed in the CSD include microbreweries,hotels and motels,
and clubs and lodges, and other uses consistent with this chapter. In terms of the
amount of traffic to be generated and the type of business being proposed, this
proposed distillery and tasting room is not much different from a microbrewery or
cocktail lounge. In terms of the potential fire hazard,this will be addressed and
controlled by strict adherence to the International Fire and Building codes.
5. The undersigned hearing examiner concludes the proposal is consistent with the
Comprehensive Plan. One of the goals of the Comprehensive Plan is"to create

and maintain a healthy and diverse commercial sector for a balanced and stable
local economy."The proposal herein supports this goal. The proposed use is a
fresh type of business that helps create diversity of among the City's commercial
enterprises.
6. The undersigned hearing examiner concludes there is nothing to indicate the
proposal is in any way contrary to the public use and interest. Here again, in
terms of the potential fire hazard, this will be addressed and controlled by strict
adherence to the International Fire and Building codes. With regard to traffic, it
does not appear that this proposal will generate more traffic than any of the
allowed outright uses in this zone would. With regard to parking, such
considerations are controlled by City code and it appears here that the applicant
has met those requirements.
7. In applying the law to the facts of the application,the undersigned hearing
examiner concludes that as conditioned,the proposal is consistent with City of
Port Angeles conditional use permit requirements and should be approved.
DECISION
Based upon the foregoing Findings of Fact and Conclusions of Law,the application for a
conditional use permit is APPROVED, subject to the following conditions:

Hello, I am writing concerning the above application for a variance to operate a whiskey distillery and tasting room.
There is a back story to the property involved that I feel should be brought up. We used to own a home on Motor Ave.,
we had a beautiful water view as did our neighbors,when the property in question was built, it was built by a then
planning commissioner. He built in a fashion that took away all our water views! Everyone lost thousands and thousands
of dollars in property value.The planning dept told us we had no recourse because there was no zoning protecting a
properties views. I found that hard to believe, because many, many communities have zoning protecting views. I was
told the planning commission could not decide on what a view was!!! He built 2 multi story buildings,the 2"d,the one
he wants to turn into a tasting room/distillery was ONLY allowed to be used for storage,that is what the planning dept
told me.At the time I told them,that I thought there was an appearance of fairness issue and I was outraged that a
planning commissioner would choose to build in a way that harmed the neighborhood! I wrote him and he was very
rude!!And he was not a good neighbor! In addition I told the planning commission that I thought he had a long term
plan for that 2nd building and I felt his overall intention was not to use that building for"storage"only. Well now I see he
has applied for a variance to operate a whiskey distillery and tasting room in predominantly residential neighborhood!
Really,this is crazy.The city just almost was downgraded for fire insurance and I do not see how you guys can ethically
allow this. I am sure a distillery in a residential neighborhood will do wonders for your insurance rating.There is a reason
that whiskey distilleries are located away from residential neighborhoods, because no matter how careful he is there is
always the risk of explosion!!! And if you have ever smelled how awlful distilling whiskey smells you would never,ever
put it in a residential neighborhood.This is terrible and I really feel saddened that my former neighbors who we are still
friendly with will have to suffer another decrease in their property values on the back of this individual,who I feel
intends to use his former(I am not sure if he is still on the planning commission) to pass this variance.Shame on him! I
really feel that if you allow this distillery in the neighborhood,the neighborhood would be ruined! And I believe you will
be setting the city up for litigation,especially if there is an explosion,you guys will be liable! And as well you should be if
you allow this clearly inappropriate use of property in a mostly residential neighborhood.We no longer live in Port
Angeles, but just as I was outraged when he so callously built those multi story units,destroying our views and property
values, I am outraged that he now wants to further destroy this neighborhood by operating a distillery. Please your job is
help protect the property rights and property values in Port Angeles, not destroy them. I will be at the meeting on Jan

The Distillery will be located at 125 Motor Ave.
Building is 19'x60'on the exterior 11'-3" ceiling height build to current commercial codes
All exterior doors are steel with steel jams.
The door connecting the upstairs is a 2 hr. fire rated door
The distilling area is separate from the storage area as outlined in the conditional permit
application. With fire rated sheet rock on ceiling and walls.

Open to the atmosphere type
30-1/2"wide
84"tall
99% copper
Heating elements: (to heat the still)
5500W 220V
This element is the same as a WW heater element only Stainless Steel.
With this type of still we would be able to produce about 5 gallons in a single run.
Distilled spirits from the still will be 30 gallons or less and dedicated to the distilling area
at one time.
All distilled products will be proofed to 120 proof or less and stored in l Ogal wood
barrels in the dedicated storage area not to exceed 1000 gallons at maximum production
with an average to be 250 gallons.
The storage racks will be solid steel stored 5 high
All proofed and bottled product will be stored in 750ml bottles

RECOMMENDATION:
Planning Division Staff recommends that the Hearing Examiner adopt the attached Findings of Fact and
Conclusions (the Findings),and based on the Findings,approve Conditional Use Permit HTE 16-36 with
three recommended conditions of approval.
PROCEDURE:
On November 7,2016,the applicant,Mike Caudill,filed an application for a Conditional Use Permit,which
was determined complete on December 6,2016.The purpose of the permit is to authorize the operation of
a craft distillery and tasting room in a Community Shopping District (CSD) Zone at 125 Motor Avenue.
Notice of the application and public hearing was provided to the public on the following dates and in the
following manner:

Public notice included a statement that the application is anticipated to receive a Determination of Non-
Significance(DNS)per the optional DNS process WAC 197-11-355,and would have no additional public
comment period.
The public comment period was 16 days, closing on January 4, 2017 at 5:00 p.m. The planning staff
conducted an investigation of the facts and circumstances relevant to the application. In addition, the
planning staff received two written comments from citizens, and written comment from the Washington
Department of Ecology, Olympic Region Clean Air Agency, the Building Division,Fire Department, and
the Public Works and Utilities Department.
Pursuant to the city code relating to conditional use permits,the duty to determine whether the permit should
or should not be granted is vested in the City's Hearing Examiner.
FACTS RELEVANT TO THE APPLLICATION:
Existing Conditions in Area:
The subject property is located at 125 Motor Avenue,between Oak Street and Laurel Street in the
Lauridsen Neighborhood District.The subject property is zoned as Community Shopping District
(CSD).The subject property is a single lot parcel,with 94 foot lot depth and 80 foot lot width,and
is approximately 7,520 square feet in area. This lot size meets the minimum standards for CSD
Zone requirements and is considered a legal.conforming site.
The parcel is occupied by two structures.The property was developed and the structure constructed
in 2011.The proposed craft distillery and tasting would be located in the two-story,office/storage
building, addressed as 125 Motor Avenue. The second level of 125 motor avenue is used as an
office. The second structure is a three-story, two-unit, residential building, addressed as 129 and
131 Motor Avenue(See Appendix Q.
See Table 1.1,on page 3,for relevant building statistics and information. The application,project
narrative, site plan,vicinity maps, site visit photo, and public comment are attached as Appendix
C.
The surrounding area is zoned CSD and RS-7, Residential Single-Family. The properties across
Motor Avenue, to the south and southwest, are residential, single family homes and the area is
designated as residential per the City Comprehensive Plan's Land Use Map.The properties in the
surrounding area,which are within the Community Shopping District Zone, includes a restaurant,
retail,automobile services,and legal nonconforming residences.The abutting property to the north
is a vacant parcel,to the west is a legal nonconforming residence,and to the east is a family style
restaurant. The subject property is not located on a designated school walking route and the area
does not have existing sidewalks.

City departments reviewed the application and provided the following comments:
The Washington State Department of Ecology
The Department of Ecology provided comment on January 3, 2017, in which it
recommended that City Staff contact the Olympic Region Clear Air Agency to determine
if a notice of construction application is needed for craft distilling operations.
Olympic Region Clean Air Agency
The Olympic Region Clean Air Agency(ORCAA)provided comment on January 3,2017,
stating that ORCAA Staff has reviewed the application and determined that the applicant
does not require a permit with ORCAA based on current application materials.
The Fire Department&Building Division—City of Port Angeles
On January 4, 2017, the Fire Department and Building Division submitted the following
joint written comment:
"The City Building and Fire departments have reviewed the proposed craft distillery
application and submit the following comments for consideration at the upcoming hearing
on January 11,2017.
Since the time of application,I have spoken with Mike Caudill on a few occasions and he
has provided additional information to consider with this application. During our last
conversation,Mr.Caudill expressed an interest in reducing the original proposed quantities
to below the Maximum Allowable Quantities(MAQ's)as outlined in the IFC[International
Fire Code] and IBC [International Building Code]. Mr. Caudill, however, would like
further clarification on what the requirements would be if the operations were to expand to
a level that exceeded the MAQ's.
In review of this application,it is important to recognize that the Alcohol produced in the
distilling process is considered a Flammable 113 liquid. Approval to operate will be
contingent upon review of items listed below as well as all other code provisions within
the IFC and IBC.

The Police Department—City of Port Angeles
The Police Department made no comment regarding this development application.
The Public Works and Utilities Department—City of Port Angeles
On January 3, 2017, the Public Works and Utilities Department made the following
comment: "The applicant [needs] to complete and submit an Industrial Wastewater
Pretreatment Questionnaire and Disclosure Form to the Public Works and Utilities
Department."

On January 4, 2017, Planning Staff received two written comments opposing the development
application expressing concern regarding the proposed craft distillery and tasting room at 125
Motor Avenue (See Appendix C for the full written comment). The concerns have been
summarized into the following five topics:
1. Dangers associated with fire and explosion due to the distilling process;
2. Negative impacts on property value and neighborhood characteristics due to potential noise
and smell;
3. Negative effects on pedestrian traffic from added traffic and poorly lit streets;
4. Added dangers and negative impacts associated with parking due to backing out of spots
directly onto the street, headlights directed towards residential zoning, added on-street
parking congesting causing blocked mailboxes;
5. Questions related to the distillation of alcohol and operation of tasting room are as follows;
a. What prevention, precaution, and infrastructure will be in place to mitigate the
potential dangers of fire or explosion?
b. What are the working conditions,employee hours,attention and plans for distilling
alcohol and maintaining a safe workplace?
c. Does the operation of a craft distillery,or byproducts,pose a threat to public health
in the surrounding area?
d. What levels of operation will occur in the tasting room? Specifically, will the
operation be allowed to have outdoor parties,music,or serving that exceeds tasting
room limitations?
e. What signage will be permitted on the proposed use?
The citizens' first concerns are related to the potential dangers associated with the operation of a
craft distillery in close proximity to a residential area.The Fire Department and Building Division
are working together to develop and require fire protection measures and building plans that adhere
to the 113C and IFC for such uses.Regulations on the proposed development shall be to the level as
to mitigate the potential threat to public health, safety, and welfare. The above mentioned safety
requirements will be implemented when the Applicant applies for permits and a certificate of
occupancy.
The applicant must adhere to all standards of the Clallam County Health Department in order to
ensure that there are no health risks associated with the production or final product of distilled
spirits.
Per the application narrative, the operation is scheduled to operate and manufacture spirits from
8:00 a.m.to 5:00 p.m.Monday through Friday.The tasting room would be open 11:00 a.m.to 7:00
p.m.on Saturday and Sunday,and by appointment.The operation would employ one employee.
In regards to traffic safety and congestion,the proposed use has provided the required number of
parking spaces for the proposed use per City code.The cooperative parking agreement is intended
to alleviate the need for additional imperious surface in the area. The blocking of an on-street
mailbox is not illegal under the Port Angeles Municipal Code.It is recommended that owners with
this problem contact the United States Postal Service or a legal professional for further investigation
into the matter.

Per the Washington State Liquor Control Board, a craft distillery and tasting room are limited in
the amount of spirits they are allowed to serve a customer. Servings are limited to less than 1/2 oz.,
with a maximum of 2 oz. of samples per person,per day. The consumption of alcohol,other than
the 2 oz. tasting maximum, on premises is not permitted through the use of the property as a craft
distillery and tasting room. Every person who participates in the service of samples must obtain a
Class 12 Alcohol Server Permit. A craft distillery may apply for a special permit to conduct an
event not open to the general public for the purpose of tasting and selling spirits of its own
production,in which the permit must be posted in a conspicuous place 10 days prior and during the
event.
Any signs located on the premises will be according to Section 14.36.070(C) of the Port Angeles
Municipal Codes.In addition to these rules and regulations.The applicant shall submit a sign permit
before erecting or installing signs for review,conditions of approval,and approval by City Staff.
The City's Comprehensive Plan's Land Use Map identifies the area that includes the proposed
location of the craft distillery and tasting room as commercial and the zoning map reflects this fact.
The area is intended for commercial development,which would include the production and sale of
artisan crafted spirits. .
APPLICABLE CODE PROVISIONS
Zoning
The conditional use permit application is being considered under the conditional use title, "Other
uses compatible with the intent of this chapter," per Port Angeles Municipal Code (PAMC)
17.22.160(K), because craft distilleries are not explicitly listed in the PAMC. A similar use,
microbreweries,are also allowed in the Community Shopping District zone as a conditional use.
The Area and Dimensional requirements for the CSD Zone, per 17.22.200 of the PAMC, can be
seen in Table 1.3 on page 8.
The applicable Design and Landscaping requirements for the CSD Zone are as follows,per Section
17.22.230 of the PAMC:
A.All outdoor storage areas,except City mechanized refuse collection system containers,
shall be screened from view from public rights-of-way and abutting property by a sight-
obscuring fence six feet in height;
B. All lighting on the site shall be so directed as to reflect away from adjoining non-
commercial property and public rights-of-way;
C. A six-foot sidewalk accompanied by a minimum four-foot landscape strip shall be
required within the right-of-way adjacent to the front property line as well as adjoining
arterial corridors;
E. Unused space that is over 24 square feet and that results from the design of parking
space arrangements or accessory structures shall be landscaped;

F. All required parking areas shall include landscaping of at least one tree for each group
of six or fewer parking spaces with a minimum of two trees;
Due to the existing driveway and impervious surface at the front of the property,the development
would be exempt from being required to provide four-foot landscaping strip (requirement C) and
the parking lot tree requirement(requirement F).
Parking
Table 1.2 lists the relevant uses for required parking associated with the application,per Parking
Requirements Table A of Chapter 14.40 of the PANIC.

Per Section 14.40.030(D)(2),"Parking requirements may be reduced by ten percent if a bus stop or
other mass transit facility is located within 500 feet of the project site."
Section 14.40.070 of the PANIC states that, `Parking facilities may be cooperatively used by
different land uses, when the times of the use of such parking spaces by each use are not
simultaneous. A cooperative parking agreement signed by all parties who share the parking
facilities and approved by the Community Development Director shall be required that binds the
parking facilities and the parties until the agreement is dissolved by all parties and approved by the
Community Development Director."
State Environmental Policy Act
The City of Port Angeles,as the State Environmental Policy Act(SEPA)lead agency is required
to review development applications that are not categorically exempt. As part of the conditional
use permit application, the applicant completed a SEPA checklist which was reviewed and
annotated by staff. The Department of Ecology provided comments on the application,which are
detailed in "Departmental Comment" section on page 3 of this report. Based on the minimal
impacts to the environment, as evidenced in the SEPA checklist, a Determination of Non-
Significance#1384 was issued on January 4,2017.

ANALYSIS
This application meets all the requirements for granting a Conditional Use Permit.
Area and Dimensional Requirements
As indicated in Table 1.3, the subject property conforms to current Area and Dimensional
requirements of the Community Shopping District Zone.
Parking Requirements
The proposed use and application meet the parking requirements under the current conditions of
the application and the proposed cooperative parking agreement.
The building has existing office space on the second floor,which occupies about 675 square feet.
Therefore there are two parking spaces required by the upstairs office.
The craft distillery and tasting room are not a specified use in the Parking Requirements Table.
Based on the unspecified use requirement in Table 1.2, the Director of the Department of
Community and Economic Development has determined that the most similar use is,"Restaurants,
taverns, and any other establishments for the sale and consumption of food, alcoholic beverages,
or refreshments."The tasting room is 250 square feet and therefore requires two parking spaces.
The total number of required parking spaces is four
There is a bus stop located approximately 450-500 feet from the subject property. Therefore, the
required number of parking spaces is reduced to 3.6,which still requires 4 full parking spaces.
The applicant has area available for three parking spaces on-site, including one Americans with
Disabilities Act (ADA) accessible parking space. There are an additional six parking spaces
available in the parking lot adjacent to the site,located at 122 W.Lauridsen Boulevard.Additional
spaces, as needed to meet PAMC parking requirements, will be obtained through a cooperative
parking agreement,per PAMC Section 14.40.070.
State Environmental Policy Act
A Determination of Non-Significance has been issued for this development application.

Consistency
The proposal is consistent with the relevant sections of the Port Angeles Municipal Code,Zoning
Map,and the Comprehensive Plan(See Appendix B).
CONCLUSION:
The application for a Conditional Use Permit, HTE 16-36, should be granted, subject to the following
conditions of approval:
1. The Applicant shall obtain all necessary permits and certifications from local and state agencies,
including, but not limited to, the Washington State Liquor and Cannabis Board, Clallam County
Health Department and City of Port Angeles for the proposed use.
2. The Applicant must complete and submit to the City Public Works and Utilities Department an
Industrial Wastewater Pretreatment Questionnaire and Disclosure Form.
3. A cooperative parking agreement must be submitted for review and approval to the Director of
Community and Economic Development.
4. If unanticipated, adverse impacts are identified, the Hearing Examiner may apply additional
conditions at that time.

Appendix"A"
CONDITIONS, FINDINGS,AND CONCLUSIONS
PROCEDURE:
The Applicant submitted a Conditional Use Permit (CUP) application on November 7, 2016, and it was
determined complete by Planning Staff on December 6,2016.
On December 20, 2016, notice of development application and public hearing was posted on-site and at
city hall,published in the Peninsula Daily News circulatory,and mailed to property owners within 300 feet
of the subject property.
On December 20, 2016, the notice of development application and application materials were sent for
review and comment to the Washington State Department of Ecology and the City of Port Angeles Public
Works and Utilities Department,Police Department,Fire Department,and the Building Division.
The noticing and public comment period was 16 days,from December 20,2016 to January 4,2017.
The State Environmental Policy Act(SEPA)Determination of Non-Significance(DNS)#1384 was issued
January 4,2017,through the optional DNS process per WAC 197-11-355.
A public hearing,conducted by the Hearing Examiner,is scheduled for January 11,2017,at 1:00 p.m.,in
the Council Chambers at City Hall,321 E.5'Street,Port Angeles.
FINDINGS:
Based on the information provided in the Community and Economic Development Staff Report for the
CUP application HTE 16-36, including all information in the public record file and the conditions of
approval,the City of Port Angeles Community and Economic Development hereby finds that:
1. The applicant,Mike Caudill,submitted a CUP application for the operation of a craft distillery and
tasting room in a Community Shopping District(CSD)Zone on November 7,2016;
2. The proposed site is legally described as Fogarty&Dolan's Addition SP V6P97 Lot 1 Survey V32
P53,or parcel number 0630095290100000,or 125 Motor Avenue,Port Angeles,WA 98362;
3. The proposed site is zoned as CSD;
4. The surrounding area is zoned CSD and RS-7,Residential Single Family.
5. A "distillery" is not explicitly listed as a conditional use in the CSD Zone,but is being considered
under the classification,"Other uses compatible with the intent of this Chapter";
6. The development of the site as a craft distillery and tasting room includes no structural changes or
expansion of exterior structures or impervious surfaces. Interior modifications are to include the
installation of materials to meet safety regulations,installation of distilling equipment and storage
facilities,and the construction of a tasting room features;
7. The total number of required off-street parking spaces for the proposed use is nine, one of which
must be Americans with Disabilities Act(ADA)compatible.Per Chapter 14.40 of the Port Angeles
Municipal Code(PAMC),off-street parking for manufacturing uses is calculated as,"One parking
space for each three employees with a minimum of ten spaces,"with a ten percent reduction granted
for proximity to a transit stop. In order to meet the requirements, the applicant has submitted a
proposal to establish a cooperative parking agreement per Section 147.40.070 of the PAMC;

8. A Determination of Non-Significance#1384 has been issued for this proposed use by City's State
Environmental Policy Act responsible official on January 4, 2017, per WAC 197-11-355. This
satisfies the City's responsibility under SEPA;
9. Per Section 2.18.060 of the PAMC, the Hearing Examiner is authorized and directed to hear and
decide on general conditional use permits. The Hearing Examiner may grant CUPs that are
consistent with the comprehensive Plan,compatible with the intent of the zone in which the use is
located,and are not contrary to the public use,welfare,and interest.In each application the Hearing
Examiner may impose whatever restrictions or conditions are considered to be essential to protect
public health,safety.,welfare,and to prevent the depreciation of neighboring property.The Hearing
Examiner may refuse to issue.a conditional use permit if the characteristics of the proposed use
would defeat the purpose of the City's zoning requirements.
10. Per Section 17.96.070(D) of the PAMC,a CUP may become void after one year from the date of
the permit being granted if the use of the land or building or applying for necessary building permits
has not taken place in accordance with the provision in granting said requests except in
circumstances where the applicant has submitted a written communication indicating need of
additional time to satisfy conditional of approval. If unanticipated adverse impacts are identified
following the commencement of the use,the Hearing Examiner may apply mitigation at that time.
A development that is approved through the CUP process must remain in continual compliance
with specific conditions of approval or be revoked.
11. City Staff reviewed the City's Comprehensive Plan and the Port Angeles Municipal Code for
consistency with this proposal. (See Appendix B)
CONDITIONS OF APPROVAL:
The application for a Conditional Use Permit HTE 16-36 is subject to the following conditions of approval:
1. The Applicant shall obtain all necessary permits and certifications from local and state agencies,
including,but not limited to, the Washington State Liquor and Cannabis Board, Clallam County
Health Department and City of Port Angeles for the proposed use.
2. The Applicant must complete and submit to the City Public Works and Utilities Department an
Industrial Wastewater Pretreatment Questionnaire and Disclosure Form.
3. A cooperative parking agreement must be submitted for review and approval to the Director of
Community and Economic Development.
4. If unanticipated, adverse impacts are identified, the Hearing Examiner may apply additional
conditions at that time.
CONCLUSIONS:
Based on the information provided in the Department of Community and Economic Development Staff
Report for Conditional Use Permit HTE 16-36,dated Friday,January 06,2017,including all the information
in the public record file,public comments,and staff concludes that:
1. As conditioned,the proposal is consistent with the intent of the Comprehensive Plan,specifically:
Land Use Element—Goal A, Policy A.2, Goal D, Policy D.1; Transportation Element—Goal B,
Policy B.13,Policy B.15; and Economic Development Element—Goal A,Policy A.3.

2. As conditioned, the proposal will meet the Area and Dimensional requirements, as well as the
Design and Landscaping requirements of the Community Shopping District Zone.
3. The application was processed in a way that is consistent with requirements for processing a
conditional use permit, as specified in the Port Angeles Municipal Code Sections 2.18.060,
17.96.050,and Chapter 18.02.
4. The activity is not similar to other existing uses in the area, but is similar to other compatible,
conditional uses permitted in the CSD Zone.
5. As conditioned, the proposal is consistent with parking requirements specified in Table A in
Chapter 14.40 and Sections 14.40.030 and 14.40.070 of the Port Angeles Municipal Code.
6. The City's responsibility under the State Environmental Policy Act in review of the proposal has
been satisfied by the issuance of Determination of Non-Significance#1384 on January 4,2017.

Title 14—Building and Construction(Off-Street Parking)
PANIC Section 14.40.030(A)states that"the number of required spaces shall be determined either
by reference to the number of required parking spaces per Table A..."
PAMC Section 14.40.030(1))(2)states that"Parking requirements may be reduced by ten percent if
a bus stop or other mass transit facility is located within 500 feet of the project site."
PAMC Chapter 14.40 Table A states that manufacturing uses have the following off-street
parking requirements, "One parking space for each three employees with a minimum of ten
spaces."
PANIC Section 14.40.070 allows for cooperative parking agreements under the following
requirements,"Parking facilities may be cooperatively used by different land uses,when the times
of the use of such parking spaces by each use are not simultaneous. A cooperative parking
agreement signed by all parties who share the parking facilities and approved by the Community
Development Director shall be required that binds the parking facilities and the parties until the
agreement is dissolved by all parties and approved by the Community Development Director."
Title 17-Zoning
The Zoning Ordinance is the primary implementing ordinance for the Comprehensive Plan. It establishes
what types of uses are permitted and where they may be located in the City. It also establishes definitions
of uses,and minimum design standards for such uses. Like the Comprehensive Plan,any project proposed
in the City must be consistent with the regulations of the zone in which it is located. The Zoning Map
identifies the subject property as Community Shopping District Zone.
PANIC Section 17.22.010 states that the purpose of the Community Shopping District zone as
"This is a commercial zone oriented primarily to those businesses serving the daily needs of the
surrounding residential zones but is slightly less restrictive than the CN Zone and as such provides
a transition area from the most restrictive commercial zones to those of lesser restrictions.
Businesses in this zone may occur on sites of varying sizes and shall be located at the intersections
of arterial streets of sufficient size to satisfy traffic demand and at the boundaries of neighborhoods
so that more than one neighborhood may be served.Commercial uses that are largely devoid of any
impacts detrimental to the environment are allowed. Service stations with petroleum products are
permitted uses.This zone provides the basic urban land use pattern for large lot,commercial uses
serving much of the City with direct access on an arterial street and design standards for greater
automobile and truck traffic."
PAMC Section 17.22.160 lists "Other uses compatible with the intent of this chapter," as a
conditional use. Similar uses to a craft distillery and tasting room include "Microbreweries" and
"restaurants with cocktail lounges."

PANIC Section 17.22.230 requires that"All lighting on the site shall be so directed as to reflect
away from adjoining non-commercial property and public rights-of-way." and that "All required
parking areas shall include landscaping of at least one tree for each group of six or fewer parking spaces
with a minimum of two trees, exclusive of any required perimeter landscaping," and that"A six-foot
sidewalk accompanied by a minimum four-foot landscape strip shall be required within the right-of-
way adjacent to the front property line as well as adjoining arterial corridors."
PANIC Section 17.96.050 states that "A. The Hearing Examiner shall consider applications for
conditional use permits of uses as specified in the applicable chapter of the zoning regulations.The
Hearing Examiner may grant said permits that are consistent and compatible with the purpose of
the zone in which the use is located, consistent with the Comprehensive Plan,and not contrary to
the public use and interest. The Hearing Examiner may refuse to issue a conditional use permit if
the characteristics of the intended use as related to the specific proposed site are such as would
defeat the purpose of these zoning regulations by introducing incompatible, detrimental or
hazardous conditions," and that `B. In each application the Hearing Examiner may impose
whatever restrictions or conditions they consider essential to protect the public health, safety and
welfare,and to prevent depreciation of neighboring property."
PAMC Section 17.96.050(C)states that the purpose of the conditional use permit is"to assure that
the maximum degree of compatibility between uses shall be attained. The purpose of these
regulations shall be maintained with respect to the particular use of the particular site and in
consideration of other existing and potential uses within the general area in which such use is to be
located."
PAMC Section 17.96.070(D)states that"All conditional or unclassified use permits shall become
void one year from the date of granting such permits if use of the land or buildings or applying for
necessary building permits(s)has not taken place in accordance with the provisions in granting said
requests."

Hello City Planners,
I am Mike Caudill a lifetime Clallam county resident.
My family has a long back ground in distilled spirits.Jim Caudill my father was the 3'licensed distillery in
Washington State(Golden Distillery)winning many awards from here to Tennessee.
He operated it until his passing last year using a 60 gallon still.Ironically it was sold to to people from Kentucky.
They then moved the operations there changing the name.Golden Distillery produced about 10,000 bottles
annually.This is about the maximum amount that you can yield with a 60 gallon still that produces about 5
gallons a day per 50 gallons of product ran through the still.You might think that this is a lot but it is a very
small amount.They produced there batches in about 3/the space that I'm proposing with room to spare.
The still That we will put on order once the conditional use permit is approved will be the same size 60 gallon
still.A still needs to be on order to submit a TTB federal distillery application.There not cheap.
A state liquor license has been applied for.
We will use over 90%Washington raw materials and supplies.Washington has the best by far.
The distillery:
Making whiskey,the primary product that will be distilled is as simple as making 50 gallons of beer.Letting it
ferment till it reaches around 9%alcohol level,Run it through the still.Put it in an oak barrel to age,remove it
from the barrel when ready,dilute it to the desired proof,and bottle it.
This process is very easy.The hard part is getting a good receipt and duplicating it over and over.
Close to 0 noise will result from making it.
The Tasting room:
Per Federal guide lines in a tasting room like this one you can only give your customer%i oz total to taste.Then
you hope they like it and sale them a bottle.You can not mix it in any way.That would make you a bar selling
mixed drinks.I do not have any desire in that at all. So very little will be consumed on the premises.
The tasting room would be open on Saturday and Sunday 11 am to 7pm and by appointment.
The distillery would manufacture Monday to Friday 8am to 5pm
I have included a building print with the distillery area,storage area,and the tasting room area with Sq.footage.
I have 3 parking spots proposed in a parking plan 1)ADA and 2)general with 6 more general that would be
shared with Togas Soup house restaurant directly to the East and outlined in the parking plan.
A 10%parking credit is giving to us for a bus stop with in 500'.
This new Business would employ one person.The distiller and a clerk for the tasting room.
Toga and I have spoken about a shared parking plan and one can be submitted on condition of the approval of
this application.

Hello, I am writing concerning the above application for a variance to operate a whiskey distillery and tasting room.
There is a back story to the property involved that I feel should be brought up. We used to own a home on Motor Ave.,
we had a beautiful water view as did our neighbors,when the property in question was built,it was built by a then
planning commissioner. He built in a fashion that took away all our water views! Everyone lost thousands and thousands
of dollars in property value.The planning dept told us we had no recourse because there was no zoning protecting a
properties views.I found that hard to believe, because many, many communities have zoning protecting views. I was
told the planning commission could not decide on what a view was!!! He built 2 multi story buildings,the 2nd,the one
he wants to turn into a tasting room/distillery was ONLY allowed to be used for storage,that is what the planning dept
told me.At the time I told them,that I thought there was an appearance of fairness issue and I was outraged that a
planning commissioner would choose to build in a way that harmed the neighborhood! I wrote him and he was very
rude!!And he was not a good neighbor! In addition I told the planning commission that I thought he had a long term
plan for that 2"d building and I felt his overall intention was not to use that building for"storage"only.Well now I see he
has applied for a variance to operate a whiskey distillery and tasting room in predominantly residential neighborhood!
Really,this is crazy.The city just almost was downgraded for fire insurance and I do not see how you guys can ethically
allow this. I am sure a distillery in a residential neighborhood will do wonders for your insurance rating.There is a reason
that whiskey distilleries are located away from residential neighborhoods, because no matter how careful he is there is
always the risk of explosion!!!And if you have ever smelled how awlful distilling whiskey smells you would never,ever
put it in a residential neighborhood.This is terrible and I really feel saddened that my former neighbors who we are still
friendly with will have to suffer another decrease in their property values on the back of this individual,who I feel
intends to use his former(I am not sure if he is still on the planning commission) to pass this variance.Shame on him! I
really feel that if you allow this distillery in the neighborhood,the neighborhood would be ruined! And I believe you will
be setting the city up for litigation,especially if there is an explosion,you guys will be liable!And as well you should be if
you allow this clearly inappropriate use of property in a mostly residential neighborhood.We no longer live in Port
Angeles,but just as I was outraged when he so callously built those multi story units,destroying our views and property
values, I am outraged that he now wants to further destroy this neighborhood by operating a distillery. Please your job is
help protect the property rights and property values in Port Angeles, not destroy them. I will be at the meeting on Jan

Comments reguarding the proposed distillery and tasting room on otos Ave.
Effects on pedestrian traffic

Motor Ave.was originally put in as a residential street and,as such,it is relatively
narrow. When there are vehicles parked parallel and oppisite to each other the space left
available for driving is diminished to the point that vehicles meeting one another have
barely enough room to safely pass.
But for a vary short strech in front of the appartment building and thegarage next to it
ithere are no sidewalks on Motor Ave.that are available to any foot traffic coming to or
from the closest bus stop,the grade school,the high school,the library and local
churches.
Except at the eastern and western intersections there are no streetlights on Motor Ave. It
is a very dark street at night.
Persons attempting to back out of any of the three parking spaces in front of the building
will find that they have very limited visibility to see possible oncoming vehicles in either
direction. This is because of the garage behind Toga's restraunt to the east and the
garage and tree on the next property to the west.
I belive that adding more traffic to Motor Ave.will present a signficant and unnecessary
increase in danger to pedestrians.

Other effects
i
Because of the dangerous parking situation(see above)people familiar with the place
regularly back into the parking spaces for better visibility when they pull back onto the
street.Frequently my driveway is used as the place to get turned around to line up for
backing into the parking spaces. When this occurs after dark people's headlights shine
directly into my home; illuminating 2 bedrooms and the Iiving room with very bright
light.
People living in the apartment building across the street from me often park on the south
side of Motor Ave.;in front of my and the neighboring homes. It makes sense because it
is the shortest distance to walk to their doors. I expect that this will happen with the cars
of customers to the tasting room. This is fine when there is space available. However,
when there isn't enough room to legally park,people sometimes park anyway. Usually
this means encroaching on my driveway and/or blocking my mailbox or the boxes of
other homes on the street. It is a federal offense to block a mailbox. When a mailbox is
blocked the mail is not delivered.

Unanswered Questions Reguarding the distillery
How large of a volume of alcohol will be stored on site? Is there fire suppression
equipment on site that is up to the job if a serious fire breaks out?
Where are barrels going to be dried and fired? Where will the barrels be stored for
aging? All three represent potential fire hazzards.
How will mash be disposed of? If it is to be hauled away—how often? How and where
will it be stored in the interim? Are there foul oders associated with the mash if it is
stored while awaiting disposal?
How will the first part of each run,which is contaminated with methanol,be disposed of?
What happens if,when in the middle of a run,the power goes down? Obviously exhaust
fans will stop. Is there a potential for an explosive atmosphere developing? Would this
increase fire danger?
Is the building now,or will it be made,explosion proof?
How many employees will there be and where do they park?
What type of fire supression training will be given to employees?
What type of alarms(eg. Fire/CO2/Temperture/Methane concentration)are going to be
installed? Will they be tested regularly with records kept?
Will employees be present at all times when the still is in operation?
Will employees have dutys that may take them out of the distillery while the still is in
operation?
Will people be allowed to drink in the establishment outside of operating hours when the
doors are closed?In the summer months the owners have thrown partys in the driveway
of the building. Will they now move those partys inside? Can a BYOB party get around
serving limits when the establishment is closed?
Any exhaust plume from the still will envelop the rental building next door and possibly
any of the nearby residences. Is this safe?
What is going to be done to prevent damage to buildings in the area from what is
commonly refered to as whiskey mold? The health effects of long term exposure to
whiskey mold have not yet been determined. Because my lungs are compromised due to
an industrial accident this is of particular concern to me personally.

foresquare against the project.
On a purely personal level;I do not feel that establishments serving distilled spirits
should be located directly adjacent to a residential neighborhood.

The city Building and Fire departments have reviewed the proposed distillery application and submit the following
comments for consideration at the upcoming hearing on January 11, 2017.
Since the time of application, I have spoken with Mike Caudill on a few occasions and he has provided additional
information to consider with this application. During our last conversation, Mr.Caudill expressed an interest in reducing
the original proposed quantities to below the Maximum Allowable Quantities(MAQ's)as outlined in the IFC and
IBC. Mr.Caudill, however,would like further clarification on what the requirements would be if the operations were to
expand to a level that exceeded the MAQ's.
In review of this application, it is important to recognize that the Alcohol produced in the distilling process is considered
a Flammable 1B liquid. Approval to operate will be contingent upon review of items listed below as well as all other
code provisions within the IFC and IBC.
Process and storage below Maximum Allowable Quantities as outlined in IFC and IBC:
• Provide a detailed process analysis that includes operating procedures, materials/appliances used,and outlines
provisions to ensure that operations are conducted in a safe manner.
• Occupancy Classification: F1 -Applicable occupancy separations need to be maintained
• Distilling room cannot exceed 30 gallons open product without installation of fire sprinklers

Effects on pedestrian traffic
Motor Ave. was originally put in as a residential street and,as such, it is relatively
narrow. When there are vehicles parked parallel and oppisite to each other the space left
available for driving is diminished to the point that vehicles meeting one another have
barely enough room to safely pass.
But for a vary short strech in front of the appartment building and thegarage next to it
there are no sidewalks on Motor Ave.that are available to any foot traffic coming to or
from the closest bus stop,the grade school,the high school,the library and local
churches.
Except at the eastern and western intersections there are no streetlights on Motor Ave. It
is a very dark street at night.
Persons attempting to back out of any of the three parking spaces in front of the building
will find that they have very limited visibility to see possible oncoming vehicles in either
direction. This is because of the garage behind Toga's restraunt to the east and the
garage and tree on the next property to the west.
I belive that adding more traffic to Motor Ave. will present a signficant and unnecessary
increase in danger to pedestrians.
Other effects
Because of the dangerous parking situation(see above)people familiar with the place
regularly back into the parking spaces for better visibility when they pull back onto the
street. Frequently my driveway is used as the place to get turned around to line up for
backing into the parking spaces. When this occurs after dark people's headlights shine
directly into my home; illuminating 2 bedrooms and the living room with very bright
light.
People living in the apartment building across the street from me often park on the south
side of Motor Ave.; in front of my and the neighboring homes. It makes sense because it
is the shortest distance to walk to their doors. I expect that this will happen with the cars
of customers to the tasting room. This is fine when there is space available. However,
when there isn't enough room to legally park,people sometimes park anyway. Usually
this means encroaching on my driveway and/or blocking my mailbox or the boxes of
other homes on the street. It is a federal offense to block a mailbox. When a mailbox is
blocked the mail is not delivered.

Unanswered Questions Reguarding the distillery
How large of a volume of alcohol will be stored on site? Is there fire suppression
equipment on site that is up to the job if a serious fire breaks out?
Where are barrels going to be dried and fired? Where will the barrels be stored for
aging? All three represent potential fire hazzards.
How will mash be disposed of? If it is to be hauled away—how often? How and where
will it be stored in the interim? Are there foul oders associated with the mash if it is
stored while awaiting disposal?
How will the first part of each run,which is contaminated with methanol,be disposed of?
What happens if,when in the middle of a run,the power goes down? Obviously exhaust
fans will stop. Is there a potential for an explosive atmosphere developing? Would this
increase fire danger?
Is the building now,or will it be made,explosion proof?
How many employees will there be and where do they park?
What type of fire supression training will be given to employees?
What type of alarms (eg. Fire/CO2/Temperture/Methane concentration)are going to be
installed? Will they be tested regularly with records kept?
Will employees be present at all times when the still is in operation?
Will employees have dutys that may take them out of the distillery while the still is in
operation?
Will people be allowed to drink in the establishment outside of operating hours when the
doors are closed?In the summer months the owners have thrown partys in the driveway
of the building. Will they now move those partys inside? Can a BYOB party get around
serving limits when the establishment is closed?
Any exhaust plume from the still will envelop the rental building next door and possibly
any of the nearby residences. Is this safe?
What is going to be done to prevent damage to buildings in the area from what is
commonly refered to as whiskey mold? The health effects of long term exposure to
whiskey mold have not yet been determined. Because my lungs are compromised due to
an industrial accident this is of particular concern to me personally.
Does anybody involved with the project have extensive experience in the operation of a
distillery?
Will entertainment be offered or allowed? Noise is my concern here.be
What type and size of signage and lighting will be allowed?
How does this project affect the homeowner's insurance for the houses in the area?
Until such time as all of the above concerns and questions have been answered I stand
foresquare against the project.
On a purely personal level; I do not feel that establishments serving distilled spirits
should be located directly adjacent to a residential neighborhood.

Building is 19'x60'on the exterior 11'-3" ceiling height build to current commercial codes
All exterior doors are steel with steel jams.
The door connecting the upstairs is a 2 hr. fire rated door
The distilling area is separate from the storage area as outlined in the conditional permit
application.With fire rated sheet rock on ceiling and walls.

Open to the atmosphere type

Heating elements: (to heat the still)

This element is the same as a WW heater element only Stainless Steel.
With this type of still we would be able to produce about 5 gallons in a single run.
Distilled spirits from the still will be 30 gallons or less and dedicated to the distilling area
at one time.
All distilled products will be proofed to 120 proof or less and stored in l Ogal wood
barrels in the dedicated storage area not to exceed 1000 gallons at maximum production
with an average to be 250 gallons.
The storage racks will be solid steel stored 5 high
All proofed and bottled product will be stored in 750ml bottles

Jeff,
I do not have any objections on approving the conditional use permit for this location. The process of approving a
distillery is much more detailed and I will need more information from the applicant prior to allowing distilling
operations. The applicant should be aware that additional fire safety measures may be required.
The Alcohol produced is considered a flammable liquid and is therefore governed by very specific regulations in the
International Fire Code for use and storage. Unfortunately,there have been some very serious fires involving the
distilling process and I will need more detailed information prior to approving operations.
Some of the items I need additional information on:
1. Provide spec sheets on the distilling machine that include installation,venting, and clearances
2. Quantity of liquid storage at anyone time and how stored,(wooden barrels vs.closed drums)

Hello City Planners,
I am Mike Caudill a lifetime Clallam county resident.
My family has a long back ground in distilled spirits.Jim Caudill my father was the 3`d licensed distillery in
Washington State(Golden Distillery)winning many awards from here to Tennessee.
He operated it until his passing last year using a 60 gallon still. Ironically it was sold to to people from Kentucky.
They then moved the operations there changing the name. Golden Distillery produced about 10,000 bottles
annually.This is about the maximum amount that you can yield with a 60 gallon still that produces about 5
gallons a day per 50 gallons of product ran through the still.You might think that this is a lot but it is a very
small amount.They produced there batches in about '/the space that I'm proposing with room to spare.
The still That we will put on order once the conditional use permit is approved will be the same size 60 gallon
still.A still needs to be on order to submit a TTB federal distillery application.There not cheap.
A state liquor license has been applied for.
We will use over 90%Washington raw materials and supplies.Washington has the best by far.
The distillery:
Making whiskey,the primary product that will be distilled is as simple as making 50 gallons of beer. Letting it
ferment till it reaches around 9%alcohol level,Run it through the still.Put it in an oak barrel to age,remove it
from the barrel when ready,dilute it to the desired proof,and bottle it.
This process is very easy.The hard part is getting a good receipt and duplicating it over and over.
Close to 0 noise will result from making it.
The Tasting room:
Per Federal guide lines in a tasting room like this one you can only give your customer% oz total to taste.Then
you hope they like it and sale them a bottle.You can not mix it in any way.That would make you a bar selling
mixed drinks. I do not have any desire in that at all. So very little will be consumed on the premises.
The tasting room would be open on Saturday and Sunday 11 am to 7pm and by appointment.
The distillery would manufacture Monday to Friday 8am to 5pm
I have included a building print with the distillery area, storage area,and the tasting room area with Sq. footage.
I have 3 parking spots proposed in a parking plan 1)ADA and 2)general with 6 more general that would be
shared with Togas Soup house restaurant directly to the East and outlined in the parking plan.
A 10%parking credit is giving to us for a bus stop with in 500'.
This new Business would employ one person.The distiller and a clerk for the tasting room.
Toga and I have spoken about a shared parking plan and one can be submitted on condition of the approval of
this application.

This checklist was developed to help project proponents and government
agencies identify when a project needs further analysis regarding potential
adverse effects on Endangered Species as required by the Endangered Species
Act (ESA). For our purposes, "ESA listed species" are any species listed as
endangered, threatened, or being considered for listing.
This supplemental checklist is for all development within ESA Potential Impact
Areas, which include the following locations:
• Federal Emergency Management Act (FEMA) designated floodplain
and/or floodway areas;
• Riparian Buffer Zones (RBZ) as described by the Dept of Natural
Resources 2007 stream typing system and WDFW's 1997 stream buffer
guidelines; and/or
• Channel Migration Zones (CMZ) plus 50' as identified according to Dept
of Ecology 2003).
If ESA listed species are present or ever were present within the ESA Potential
Impact Area where your project will be located, your project has the potential for
affecting them, and you must comply with the ESA. The questions in this
section will help determine if your proposed project could have an impact.
The Port Angeles regional watershed is an area where several
endangered species have historically been present. Please answer the
following questions to the best of your knowledge to assist the city in
determining if your project will have adverse impacts to ESA species or
their habitats.
Port Angeles Community and Economic Development Department staff can
provide technical assistance in answering the following questions in this
checklist. If necessary, the Washington Department of Fish and Wildlife

NOTICE OF A DEVELOPMENT APPLICATION IS HEREBY GIVEN that on
November 7, 2016 the CITY OF PORT ANGELES DEPARTMENT OF COMMUNITY &
ECONOMIC DEVELOPMENT received a Conditional Use Permit Application to conduct
the operation of a distillery and tasting room in the Community Shopping District zone. The
Application was determined to be complete on December 6, 2016. Interested parties are
encouraged to provide written comment on the proposal and to attend the public hearing.
Information may be reviewed at the Department of Community & Economic Development in
City Hall. Written comment must be submitted to the Community & Economic Development
Department, 321 East Fifth Street, Port Angeles, WA 98362, no later than January 4, 2017 by
5:00 P.M., to be included in the Staff Report. The Hearing Examiner will conduct a Public
Hearing on January 11, 2017, at 1:00 P.M., in the Council Chambers, City Hall, 321 East Fifth
