Johns, AICP DATE: December 11, 2013 RE: Conditional Use Permit-CUP 13-02 APPLICANT: Cynthia Malane OWNER: Bob Whitcomb LOCATION: 127 E. First St. #4W Port Angeles REQUEST: Create a "Micro Craft Distillery" in the CBD zone. RECOMMENDATION: The Planning Division recommends that the Planning Commission approve CUP 13-02 with 1 condition,citing 15 findings and 3 conclusions in support of that action as listed in Attachment A. EXISTING CONDITIONS IN AREA: The subject property is located in the Falls Mall Building at 127 E. First Street. Lots in the block measure 50 by 140 feet(7,000 square feet) in size. Surrounding uses include a variety of commercial uses,offices, and eateries typical to the Downtown area. The property is developed with a commercial structure that has been divided into several suites for commercial uses. The building covers the entire site property line to property line with a central corridor dividing the units that is accessed from First Street. General parking for businesses within the City's Downtown area is provided through the Parking Business Improvement Area(PBIA). However, the property has some parking located underneath the structure that is accessed from the First/Front alley. First Street is a major one- way arterial street through the Downtown Central Business District. The application and site maps are attached as Attachment B. DEPARTMENT COMMENTS: City Departments reviewed the proposal and provided the following comments: The Fire Department reviewed this application and had no specific conditions that will need to be applied to this use. However, 1)the business will be limited to no more than CUF 13-02 Malane Page 2 Planning Commission December 11,2013 120 gallons of product in storage on site; and 2)two fire extinguishers rated at no less than 2A-l OBC will be required to be installed within the structure in locations that will be specified by the Fire Department. The applicant will need to advise the Fire Department prior to any changes in the size or type of process that is proposed. The Public Works and Utilities Department had no special conditions but the applicant will be required to complete an Industrial Pretreatment Questionnaire for the activity. This information has been provided to the applicant by Wastewater personnel. No other comments received. The Building Division of DCD will require building permits for structural/remodel changes. PUBLIC COMMENT: Notification of the proposed action was placed in the Peninsula Daily News on November 24, 2013,posted on site on November 21, 2013, and mailed to property owners within 300 feet of the subject property on November 21, 2013. No comments were received within the public comment period which ended on December 9, 2013. STATE ENVIRONMENTAL POLICY ACT (SEPA) REVIEW: A Determination of NonSignificance was issued for this proposed action by the City's SEPA Responsible Official on December 10, 2013 per WAC 197-11-355. This action satisfies the City's responsibility under the State Environmental Policy Act(SEPA). FLOODPLAIN REVIEW: The site is not located within a floodplain per FIRM Panel 530023 0003 C Dated September 28, 1990. DEPARTMENT OF COMMUNITY DEVELOPMENT ANALYSIS: The entire Comprehensive Plan and Port Angeles Municipal Code were reviewed with regard to the proposal, and the references listed in Attachment C were found to be the most relevant to the proposal. In addition to the Comprehensive Plan goals and policies, development regulations in the CBD zone are also included in Attachment B to this staff report. The City's Comprehensive Plan and Land Use Map identify the area as being partially located in the North Central Planning Area and partially in the Harbor Planning Area. The site is designated as Commercial on the Land Use Map. The site is zoned Central Business District. Microbreweries are allowed by conditional use permit in the CBD zone per PAMC 17.24.160(D). A"Craft Distillery" is not specifically listed as a permitted, conditional, or prohibited use in 17.24 PAMC. The Washington State Liquor Control Board defines breweries and distilleries as being different in several specific ways, however, there are also close similarities so this action is being considered as a conditional use. Limits on production amounts (60,000 gallons or less per year) and direct on-site sales of spirits(no more than two liters per day per customer,not to be consumed on premise) are contained in State licensing requirements. Due to the strict licensing requirements and similarities to microbreweries, a craft distillery is considered to be an "other use(s)compatible with the intent of this Chapter"[17.24,160(H) PAMC]. The use will also be required to meet Clallam County Health Department requirements. A craft distillery is restricted by State . CUP 13-02 Malane Page 3 Planning Commission December 11,2013 licensing as to on-site retail sales of product, thereby imparting fewer potential impacts on the surrounding businesses than would a microbrewery. Application materials and personal communications with the applicant indicate that on-site inventory will be limited to 30 gallons of finished product or less. No physical change to the site or exterior of the structure is being proposed. Application materials indicate that a tasting room is being proposed. The tasting room will be used by prospective buyers by appointment only between the hours of 8 a.m. and 5 p.m. No public walk-in sales will take place. Because the site is located within the Parking and Business Improvement Area(PBIA),no new parking is required for the use. Per Section 17.96.050(B)PAMC, in consideration of a conditional use permit application,the Planning Commission may impose whatever restrictions or conditions are considered to be essential to protect the public health, safety, and welfare, and to prevent depreciation of neighboring property. Uses developed by conditional use permit must remain in continual compliance with the conditions of approval or the use may be revoked. Consideration is also given to the impacts on traffic patterns, the physical circumstances of the subject property, other uses in the neighborhood, schools, and needed public improvements. The Planning Division recommends the Planning Commission approve Conditional Use Permit CUP 13-02 subject to 1 condition supported by the 14,findings and 3 conclusions listed in Attachment A to this staff report: > Attachments: A-Conditions,Findings,and Conclusions B-Application C-Zoning Ordinance,Comprehensive Plan,and Other Municipal Code References w CUP 13-02 Malane Page 4 Planning Commission December 11,2013 ATTACHMENT A CONDITIONS,FINDINGS,AND CONCLUSIONS IN SUPPORT OF CUP 11-01 Conditions: 1. The applicant shall obtain all necessary permits to conduct a craft distillery including but not limited to the City's Building Division, County Health Department, and the State of Washington required for the activities proposed. Findings: Based on information provided in the Community Development Staff Report for CUP 13-02 dated December 11, 2013, including all information in the public record file, comments and testimony presented during the public hearing, the Planning Commission's discussion and deliberation, and the above listed conditions of approval,the City of Port Angeles Planning Commission hereby finds that: 1. Cynthia Malane submitted Conditional Use Permit application CUP 13-02 to allow the operation of a Craft Distillery on November 19, 2013. 2. The proposed site is located at 127 E. First Street, Port Angeles. 3. The site is zoned Central Business District(CBD). Surrounding zoning is also CBD. 4. The site is located partially in the City's North Central Planning Area and partially in the Harbor Planning Area. The Comprehensive Plan designates the site as Commercial. Adjacent designations are also designated Commercial and development in the area includes a variety of commercial uses. 5. Microbreweries are listed as a conditional use Chapter 17.24(Central Business District (CBD) of the Port Angeles Municipal Code(PAMC). A"craft distillery" is similar in operation to a microbrewery in that a product is produced for on site consumption. In the case of a craft distillery, on-site consumption is tasting only and is limited to amount per customer. Alternatively, microbreweries produce but serve at much larger quantities for consumption per customer than a craft distillery. The business will cater to customers by appointment only. 6. Craft distillery operations are regulated per RCW 66.24.145. A distillery licensee (State license)may provide up to one half ounce samples of spirits of its own production to persons on the premises of the distillery. The proposed business will cater to customers by appointment only and will need to be licensed and operate per RCW 66.24.145. 7. Per 17.96.050 PAMC, the Planning Commission shall consider applications for conditional use permit uses as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. In each application the Planning Commission may impose whatever restrictions or conditions are considered essential to protect the public health, safety, welfare, and to prevent depreciation of neighboring property. The Planning Commission may refuse to issue a conditional use permit if the characteristics of the intended use would defeat the purpose of the City's zoning regulations. A development that is approved through the conditional use permit process must remain in continual compliance with specific conditions of approval or may be revoked. 9. The City's Comprehensive Plan was reviewed for consistency with the proposal. Land Use Element Policy A.2; Land Use Element Goal D, and Policy D.1; Transportation Element Policy B.14 and B.16; were found to be most relevant to the proposal. These Plan provisions were included as Attachment C to the December 11, 2013, staff report. 10. PAMC Chapter 14.40.040 establishes the Parking and Business Improvement Area (PBIA). The proposed business is in located within the PBIA. Although every business within the Central Business District is required to join the PBIA and pay yearly dues, no additional parking will be required. Parking for businesses within the PBIA is provided through membership in the PBIA. The site also provides some parking within the basement area with access from the First/Front alley. 11. Reviewing City Departmental comments were considered in the review of this application. Any changes to the working area will require further building or Fire Department review. The applicant will work with the City's Wastewater Treatment personnel to determine discharge provisions. 12. Notification of the proposed action and conditional use permit application was placed in the Peninsula Daily News on November 24,2013,posted on the site on November 21, 2013, and mailed to property owners within 300 feet of the subject property on November 21, 2013. 13. A Determination of Non-Significance was issued for this proposed action on December 10, 2013. 14. The site is not located within a floodplain area. 15. The Planning Commission opened a public hearing on the proposal at the December 11, 2013, regular meeting. Conclusions: Based on the information provided in the Department of Community Development Staff Report for CUP 13-02 December 11, 2013, including all of the information in the public record file, comments, and testimony presented during the public hearing,the Planning Commission's discussion and deliberation, and the above listed conditions of approval and listed findings,the City of Port Angeles Planning Commission hereby concludes that: 1. The proposed use can be permitted by conditional use permit as is provided in Section 17.24.160(D)PAMC. The conditional use permit application was processed in accordance with PANIC 17.96.050 and is therefore in compliance with provisions of the City's Zoning Ordinance regarding such activities. 2. As conditioned, the proposed activity is in compliance with the City's Comprehensive Plan as it will further economic development and be in the public interest by providing an opportunity for a start up business in accordance with Comprehensive Plan provisions. 3. As conditioned, appropriate State and Health Department licensing is required. Therefore, the use is in the public interest as the activity will be appropriately monitored and will serve to provide an opportunity to expand economic development and public enjoyment opportunities in a commercial location. CUP 13-02 Malane Page 6 Planning Commission December 11,2013 ATTACHMENT B COMPREHENSIVE PLAN GOALS,POLICIES,AND OBJECTIVES THAT SUPPORT THE USE AS A CRAFT DISTILLERY BY CONDITIONAL USE PERMIT IN THE CBD ZONE: Comprehensive Plan The City's Comprehensive Plan establishes the long range goals and policies of the City. Any project proposed in the City must be consistent with the goals and policies of the Comprehensive Plan. The site is located in the City's North Central Planning Area. The Comprehensive Plan was reviewed in its entirety with regard to the proposed application and several goals and policies were found to be relevant to the proposal. An analysis of compliance with those policies is as follows: Land Use Element Policy A.2- "All land use decisions and approvals made by the City Council and/or any of its appointed Commissions,Boards or Committees should be consistent with the Comprehensive Plan and its land use map." Land Use Element Commercial Goal D: To create and maintain a healthy and diverse commercial sector for a balanced and stable local economy. Policy D.1- The City should encourage the recruitment of new and the retention of existing commercial developments and businesses, which are consistent with the goals and policies of this Comprehensive Plan. Transportation Element Policy B.14 - "Off-street parking should be sufficient and accessible within business and residential areas to ensure that the traffic flow of the street is not impaired. Transportation Element Policy B.16 Parking requirements should make allowances for shared parking facilities. Zoning Ordinance The Zoning Ordinance is the primary implementing ordinance for the Comprehensive Plan. The Ordinance establishes what types of uses are permitted and where they may be located in the City. It also establishes definitions and minimum design standards for such uses. Any project proposed in the City must be consistent with specific regulations of the zone in which it is located. The Zoning Map identifies the subject property and adjacent properties as Central Business District CBD. The purpose and intent of this zone is:"This is a commercial zone intended to strengthen and preserve the area commonly known as the Downtown for major retail buildings,service,financial, and other commercial operations that serve the entire community, the regional market, and tourists. It is further the purpose of this zone to establish standards to improve pedestrian access and amenities and to increase public enjoyment of the shoreline. Commercial uses that are largely devoid of any impacts detrimental to the environment are allowed. Gasoline service islands and marine fueling stations are conditionally permitted uses. This zone provides the basic urban land use patternfor commercial, mixed use and,pedestrian oriented uses located in the center of the City with direct access to mass transit services, design standards for compatible commercial development, and support for public parking and business improvements." Conditional Use is defined as: "a use permitted in a zone but which requires a special degree of control to make such use consistent and compatible with other existing or permissible uses in the same zone'. The purpose of a conditional use permit is defined as "A Conditional Use Permit shall be to assure that the maximum degree of compatibility between uses shall be attained. The purpose of these regulations shall be maintained with respect to the particular use of the particular site and in consideration of other existing and potential uses within the general area in which such use is to be located." CUP 13-02 Malane Page 7 Planning Commission December 11,2013 PAMC 17.96.050 specifies procedures for the review and processing of conditional use applications,as follows: 17.96.050 Conditional Use Permit A. The Planning Commission shall consider applications for Conditional Use Permits of uses as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. The Planning Commission may refuse to issue a Conditional Use Permit if the characteristics of the intended use as related to the specific proposed site are such as would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental, or hazardous conditions. B. In each application, the Planning Commission may impose whatever restrictions or conditions they consider essential to protect the public health, safety, and welfare, and to prevent depreciation of neighboring property. PARKING ORDINANCE 14.40.040-Parking space requirements for uses in a City approved parking and business improvement area. For any land uses located in a City approved Parking and Business Improvement Area(PBIA), there shall be established and maintained permanent off-street parking spaces, either on the zoning lot of the use or within 1,200 feet of the property boundaries(including public streets and alleys) of the zoning lot. The City encourages the formation of PBIAs throughout the City. A"craft distillery" is similar in operation to a microbrewery in that a product is produced for on site consumption. In the case of a craft distillery, on-site consumption is tasting only and is limited to amount per customer. Alternatively, microbreweries produce but serve at much larger quantities for consumption per customer than a craft distillery. The business will cater to customers by appointment only. A distillery licensee (State license) may provide up to one half ounce samples of spirits of its own production to persons on the premises of the distillery. The proposed business will cater to customers by appointment only and will need to be licensed and operate per RCW 66.24.145. 7. Per 17.96.050 PAMC, the Planning Commission shall consider applications for conditional use permit uses as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. In each application the Planning Commission may impose whatever restrictions or conditions are considered essential to protect the public health, safety, welfare, and to prevent depreciation of neighboring property. The Planning Commission may refuse to issue a conditional use permit if the characteristics of the intended use would defeat the purpose of the City's zoning regulations. 8. A development that is approved through the conditional use permit process must remain in continual compliance with specific conditions of approval or may be revoked. 9. The City's Comprehensive Plan was reviewed for consistency with the proposal. Land Use Element Policy A.2; Land Use Element Goal D, and Policy D.1; Transportation Element Policy B.14 and B.16; were found to be most relevant to the proposal. These Plan provisions were included as Attachment C to the December 11, 2013, staff report. 10. PAMC Chapter 14.40.040 establishes the Parking and Business Improvement Area (PBIA). The proposed business is in located within the PBIA. Although every business within the Central Business District is required to join the PBIA and pay yearly dues, no additional parking will be required. Parking for businesses within the PBIA is provided through membership in the PBIA. The site also provides some parking within the basement area with access from the First/Front alley. 11. Reviewing City Departmental comments were considered in the review of this application. Any changes to the working area will require further building or Fire Department review. The applicant will work with the City's Wastewater Treatment personnel to determine discharge provisions. 12. Notification of the proposed action and conditional use permit application was placed in the Peninsula Daily News on November 24, 2013,posted on the site on November 21, 2013, and mailed to property owners within 300 feet of the subject property on November 21, 2013. 13. To provide some insight, I'm attaching two files for reference. We've done a considerable amount of research and visited distilleries in both Washington and Oregon to see how this new industry works best. We're very cognizant of the limits within the fire code, and I've attached a PowerPoint that shows the limits. Without sprinklers, the maximum liquor in on-site production is 120 gallons for a "closed" system, which is what we will be using. Frankly, we don't see more than 30 gallons in production and bottling at any time because the production capacity of the intended still is quite limited and producing any more than that doesn't make economic sense. A 26-gallon still would produce in the range of 6-8 gallons of spirits. The only way production would increase is if sales beat projections by a considerable margin, which would result in a new location anyway. A larger still would need a larger, sprinklered location. I've also attached a photo of one of my favorite (and amongst the "largest") distilleries in Yakima. His "Apple Pie Moonshine" product is award-winning and very professional. Looking at it on the store shelf,you'd never believe it was produced in about 250sf of space (see photo). The still we would be using is similar, but not as tall. He uses local apples, which is our intention (along with other local fruit). Production will include a fruit-flavored spirit (vodka style) as well as extracts for culinary use, including lavender and vanilla extract. Gin is another possibility, using local botanicals (juniper), etc. with barley from Washington growers. If you have any further questions, please don't hesitate to call.
