February 25, 2016 Traci Boe 1435 E 2nd St Port Angeles, WA 98362 Re: Remodel of detached garage for Home Occupation Dear Traci Boe: The location of the garage on your property came into question during the building department review of work to be done as part of a Home Occupation Permit. It is important that the purpose and intent of Code be examined as part of its application. In this instance two specific circumstances stand out as being relevant to the Building Permit decision. 1. The subject structure appears to have been constructed prior to January 4th 1971 (Assessor construction date of 1947). In accordance with Section 17.95.020 permits that use to remain but not to be expanded. As proposed in the building permit there is no expansion of the structure proposed and most of the construction consists of minor repairs. Section 17.95.030 C. allows minor repairs to a legal nonconforming building or structure that maintain the building in a safe condition. The proposed re- roof ensures long term structural safety of the building and the proposed new doors and windows enable improved ingress and egress which is a primary consideration for structure safety. The proposed bathroom does extend beyond minor repairs, however that improvement is within the permissible building area of the lot and complies with all required setbacks. 2. The subject building is located in the RS-7 Residential Single Family Zone where the predominate side setback is 7'. In circumstances where the side abuts a street the setback is 13' and the side setback from alleys is 10 feet. In this instance the side yard abuts Alder Street in a location where there is no opportunity for through improvements to the street corridor. In this location Alder Street's only function is to serve one single family resident, but, more importantly to serve as the 3rd/4th Alley. Considering this reality the Alley setback of 10' is most applicable. This interpretation of code supports the applicant's needs and simultaneously honors the Home Occupation Permit decision. It should be noted that these same considerations may not apply to new construction on the property. As such it is the determination of the Director of the Community and Economic Development Department that the remodel work and Home Occupation use be allow to go forward.
