I spoke with the contractor that did the demo work and he made claim that the retaining wall was part of the existing structure The foundation is now being used as a retaining wall and the structural components have changed . it will be required by the 2012 IBC to be designed by an engineer. The retaining wall is required to be engineered if any unbalanced soils and their surcharge exceed more than (2)two feet in height, measured from the footing to the top of the wall. I am sure an Engineer will be able to look at this and help you resolve it with multiple options.At this point it is a safety concern and I am afraid that I cannot approve or transfer the responsibility of the code requirement into another entities hands. it you have any further questions please feel free to contact me at anytime. Since we are the contractor with the insurance bond he is willing to take this on and clear the City of any future responsibility. We would of addressed this in the very beginning, prior to the permit being issued if the question of concern would of come to the table. I sure appreciate your help on this.
