The City will pay any fees associated with the building permit. During the settlement agreement discussion we were all in agreement that the fees needed to be paid and not waived. With that being said the City will pay the $860.44.This will be paid as an in house liability claim, 1 rill submit a memo with the invoice to Customer Service with appropriate account number and description so that Finance knows which department to reconcile the charges to. Please let me know if you have any questions regarding any other fees associated with Ciaciuch's settlement agreement. I am not certain if this is clearly indicated in the settlement record, but, if it is not I would recommend that we pay the associated building permit fee amount from our insurance deductible account. Total fees for the garage building permit are$860.44. Dan McKeen has verified verbally, that the Building permit fees were intended to be part of the settlement. I want to make sure we have a complete record as part of issuing the building permit. I have another full day of meetings today so I really need your assistance in resolving this issue. I am willing to review and consider other options, but, right now I feel the most immediate solution would be a letter from your engineer that verifies the foundation meets code requirements as constructed. This letter should be on the engineering firms letter head and be stamped by the engineer. During our meeting you had indicated that such a letter had already been provided to Jim Lierly. I found no such letter in the file, but, did find an email from Scott Headrick. The email was speculative in nature and instead needs to affirm that as constructed the structure meets the building code. It would not be fair to expect Jim Lierly or any other City inspector to sign off on something that they did not have an opportunity to see or visually inspect. If you feel that our Building Inspector can draw conclusions from the pictures, I would suggest that the engineer who designed the structure should be even more equipped to review the photographs and draw conclusions. If for any reason your engineer cannot provide that documentation then I am open to receiving a similar letter from R another licensed engineer of your choosing or an individual with appropriate credentials to verify the structure is constructed in a manner compliant with code. I will also note that I am open to testing options that can verify concrete quality, bolts and rebar in the southeast corner of the building. I appreciate you taking time to meet with me on this issue last week and I look forward to getting it resolved.
