The conditional use permit is approved with the following conditions: Conditions: 1. Development of the commercial recreational use at 310 Jones Street shall be as proposed in conditional use permit application (CUP 02-01) and site plan submitted for Steve and Lynette Dryke. Parking will be established at a minimum of 11 off-street parking spaces and will be reviewed at the end of one year to determine if additional parking is needed. 2. A separation will be constructed such that the 3100 square foot track area will not be accessible to the public and will remain only for use as a track. If changes to the site plan are intended, an amendment must be requested and approved by the Planning Commission prior to such change being implemented. 3. Hours of operation shall be restricted to from 3 p.m. to 9 p.m. Monday through Thursday, ~rom I0 a.m. to 10 p.m. on Friday and Saturday, and from I p.m. to 8 p.m. on Sunday. 4. (j ~ ~ RECOMMENDATION: The Department of Community Development recommends that the Planning Commission approve CUP o2-oi~~ citing 5 conditions, 16 findings, and 7 conclusions identified in Attachment A to this report.~ ~ ~ REOUEST: The applicants have proposed a conditional use permit to establish a privately owned, commercial recreational facility for radio-controlled cars in the Commercial Office zone on a 14,000 square foot building site. The application is included as Attachment B to this report. The activity is proposed to be contained within a 4900 square foot structure with a potential 19 off-street parking spaces provided on-site. Incidental retail sales of radio- controlled car parts will be provided within the structure mainly to those using the facility. It is not intended that the site will become more retail oriented than recreational in use. The retail use is intended mainly to provide a service to those using the track, however, it is assumed that there may be some incidental sales to customers who come specifically to purchase parts during business hours but do not stay. Hours of operation and days of the week are proposed to be from 3 p.m. to 1: 1 p.m. weekdays, 10 p.m. to 11 p.m. on Saturday, and from 1 p.m. to 8 p.m. on Sunday. Three employees are anticipated - one full time and two part time. . The use could be conditioned to ensure that the track area will not be used by patrons which would thereby cause an increased need for parking. No similar uses exist in the City for comparison of parking needs. Zoning Code The purpose of a Conditional Use Permit as stated in Section 17.96.050(C) P AMC " shall be to assure that the maximum degree of compatibility between uses shall be attained. The purpose of these regulations shall be maintained with respect to the particular use of the particular site and in consideration of other existing and potential uses within the general area in which such use is to be located. " The site is designated CO, Commercial Office on the City's Zoning Map. The CO zone (Section 17.20.010 PAMC) is "u. a commercial zone intended for those business, office, administrative or professional uses which do not involve the retail sale of goods, but rather provide a service to clients, the provision of which does not create high traffic volumes, involve extended hours of operation, or contain impacts that would be detrimental to adjacent residential areas. " Section 17.96.050(A) PAMC states that " The Planning Commission shall consider applications for Conditional Use Permits of uses as specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, consIstent with the Comprehensive Plan, and not contrary to the public use and interest. ' The Planning Commission may refuse to issue a Conditional Use Permit if the characteristics of the intended use as related to the specific proposed site are such as would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental, or hazardous conditions. The purpose of a conditional use permit shall be to assure that the maximum degree of compatibility between uses shall be attained. Surrounding land uses are designated as follows: North and west (of Jones Street) South to the GeorgianaIFront Alley East of Jones Commercial Office (CO) Commercial Office (CO) Residential Single Family (RS-7) The site is located one block north of the Front Street commercial corridor which is zoned Commercial Arterial, the City's most intensive commercial zone. The CO Zone (Section 17.20.040 P AMC) permits banks, financial institutions, insurance and real estate service offices, business and professional offices, child day care centers and pre-schools, and medical and dental clinics, offices, and laboratories in the CO zone. Residential uses are permitted per RS-7 zone development standards. Uses allowed by conditional use permit in the CO zone include art galleries and museums, assisted living facilities, beauty shops and barber shops, business colleges, music, art, and dance schools, businesses selling medical supplies, goods, instruments, medicine and similar items, chemical dependency treatment centers, detoxification centers, libraries, nursing and convalescent homes, public parks and recreation facilities, residential care facilities, residential uses that are permitted in the RHD zone, and other uses that are determined to be compatible with the intent of the zone. The subject proposal is being considered under Section 17.20.160 (P) "Other uses compatible with the intent of this Chapter." The most similar listed conditional use activity that compares with the proposal is "public parks and recreation facilities". As the least intensive commercial designation, the CO zone requires that signs not exceed 1 00 square feet in area with no more than 50 square feet of lighted signage placed within 50 feet of an adjacent residential property, and no more than 50 square feet oflighted signage may face residential property located directly across a street. Signs may be lighted but shall not be intermittent or flashing. No freestanding sign shall exceed five (5) feet in height. All nonresidential structures shall be designed to be compatible with the residential environment. Landscaping standards in the CO zone require that sides abutting residentially zoned properties must be landscaped; however, properties located east of Jones Street are adjacent not abutting and therefore no specific landscaping standards apply to the proposal. The applicant's site plan indicates proposed landscaping which would be required if the site plan is approved by the Planning Commission. Comprehensive Plan The site is located in the City's North Central Planning Area and is designated as Commercial on the City's Comprehensive Plan and Land Use Map. The entire Comprehensive Plan was reviewed with respect to the proposal. The following goals and policies were found to be the most relevant: Land Use MaD, Goals and Policies - Goal A Policy 2 To guide current and future development within the City zn a manner that provides certainty to its citizens about future land use and the flexibility necessary to meet the challenges and opportunities of the future. All land use decisions and approvals made by the City Council and/or any of its appointed Commissions, Boards, or Committees should be consistent with the Comprehensive Plan and Its land use map. Residential Goals and Policies Goal B. Goal C. To have a community where resldentzal development and use of the land are done in a manner that is compatible with the environment, the characteristics of the use and the users, and the desired urban design of the City. To have a community of viable districts and neighborhoods with a variety of residential opportunities for personal interaction, fulfillment and enjoyment, attractive to people of all ages, characteristics and interests. Commercial Goals and Policies Goal D Policy 1 Goal E, Policy 3 The City should encourage new and existing commercial developments and businesses which are consistent with the goals and policies of this Comprehensive Plan. Commercial development should buffer its impacts on adjacent residential uses. Where commercial development is adjacent to reSidential uses, the commercial development should incorporate elements in the site design to soften the impacts on the residential uses. TransDortation Element - Goal B Policy 14 Off-street parking should be sufficient and accessible within business and residential areas to ensure that the traffic flow of the street is not impaired. Goal B As a "supporter," the City should promote and cooperate in providing programs and services including: * library programs such as informatlOn and assistance * affordable housing information and referral * economic and business development services * tourism information and services * schools and community learning * fine arts * community recreation * publzc and private youth, family and senior services * telecommunications and * crime prevention programs. Goal E, Policy 6. The City should place special emphasis on the recreational needs of the youth of the community. PUBLIC AND DEPARTMENTAL COMMENTS: The Public Works and Utilities Department noted that the existing sidewalk on Georgiana Street will need some repair. Various areas will require removal of grass at the seams to determine the condition of the sidewalk to determine whether repair or replacement will be required. Entrance driveways shall be constructed to City standards with the driveway on Georgiana Street to be at least 7.5' from the west property line. The parking lot will need to be hard surfaced with designated parking stalls and curb stops. The parking lot and roof leader drainage will require detention, installation of a catch basin with an oil separation "T", and connection to the 8" storm drain main at Georgiana and Jones Streets. The Fire Department has no objection to the conditional use permit, however, the Department will require a detailed set of building plans with specifics on the interior layout of the building, exiting, etc., at time of building permit application. Fire extinguishers will be required and the occupancy will be subject to periodic inspections by the Fire Department for life/safety hazards. The Building Division of DCD noted that the application shows an enclosed building with the use or operation of gas and electric powered remote controlled cars. This type of use will need to meet indoor air quality requirements by providing the proper amount of outside air and ventilation. Ifthe building is a pole design, it will be required to have a State Engineer's stamp. All portions of the building will need to be ADA accessible. These issues would be addressed du$g building permit reVIew. Legal notice was placed in the Peninsula Daily News on January 23,2002. Public notices were mailed to surrounding property owners within 300 feet of the site on January 18,2002. No public comment has been received at the time of this report. ConditIOnal Use Permit - CUP 02-01 . DRYKE Febrnmy 13,2002 Page 6 ENVIRONMENTAL REVIEW The City's State Environmental Policy Act (SEPA) Responsible Official issued a Determination of Non significance for the proposal per WAC 197-11-355 on February 8, 2002. This satisfies the City's requirements under SEP A. STAFF ANALYSIS/SITE DEVELOPMENT The site is comprised of two standard 50' x 140' lots, identified as Lots 17 and 18, Block 11 Puget Sound Cooperative Colony Subdivision, and is located at the northwest comer of Georgiana and Jones Streets. Lot 17 is undeveloped. Lot 18 is developed with a 528 square foot pre-existing, nonconforming, single family residential structure. An informal radio-controlled car activity has occurred on the site in the Commercial Office zone for approximately the past 4-5 years operating regularly but not daily. The use was developed by the applicant on the property which is owned by the applicant. The applicant's proposal would recognize the use as a conditionally permitted activity and allow an increase in operation. The previous operation was not established through a permitting process and is not an outright permitted use in the Commercial Office zone. However, the use is similar to other permitted and conditionally permitted activities found in the CO zone such that it could be considered conditionally. The use shares many ofthe same characteristics of a public park or recreational use or specialty school in the manner that patrons and clients visit and use the site. Therefore, it is recommended that the activity be considered under the "other" category of conditional uses. The activity is intended to provide a family oriented commercial recreational opportunity. The applicant has proposed extended hours of operation for the use. The purpose of the CO zone specifically indicates that uses within the zone will be those that do not create high traffic volumes nor involve extended hours of operation. Traffic generated by the improved use as a daily activity will be considerably greater than what has and is currently being generated by the more sporadic use of the site for radio-controlled car activities. Because the site is not currently enclosed, activity levels are currently restricted by weather conditions. Therefore, the proposed structure would allow for considerably more activity. lfthe hours of operation are limited to those that would not conflict with typical residential activity, such an increase in use should not negatively impact the immediate neighborhood or the residential zone located east of Jones Street. Currently, users of the site park along Georgiana and Jones Streets. The applicant's proposal would provide on-site parking. Jones Street and Georgiana Street are local access streets and are improved to City standards. Clallam Transit services are located along Front Street, a major arterial located one block south of the site. Development ofthe commercial recreational use at 310 Jones Street shall be as proposed in conditional use permit application (CUP 02-01) and site plan submitted for Steve and Lynette Dryke. Parking will be established at a minimum of 11 off-street parking spaces and will be reviewed at the end of one year to determine if additional parking is needed. 2. A separation will be constructed such that the 3100 square foot track area will not be accessible to the public and will remain only for use as a track. If changes to the site plan are intended, an amendment must be requested and approved by the Planning Commission prior to such change being implemented. 3. Hours of operation shall be restricted to from 3 p.m. to 9 p.m. Monday through Thursday, from 10 a.m. to 10 p.m. on Friday and Saturday, and from 1 p.m. to 8 p.m. on Sunday. 4. Findings: Based on the information provided in the Staff Report for CUP 02-01 dated February 13, 2002, including all information in the public record file, comments and testimony presented during the public hearing, and the Planning Commission discussion and deliberation, the City of Port Angeles Planning Commission hereby finds that: 1. Steve and Lynette Dryke submitted a conditional use permit application (CUP 02-01) on January 11, 2002, to allow a commercial radio-controlled car recreational activity in the Commercial Office (CO) zone at 310 Jones Street. The proposal is described as a family oriented activity located on Lots 17 and 18, Block 11 Puget Sound Cooperative Colony Subdivision to the Townsite of Port Angeles. 2. The site is located at the northwest comer of Jones and Georgiana Streets. The 14,000 square foot site is developed with a small residential unit at the northeast comer ofthe site off Jones Street. The nonconforming structure does not comply with any ofthe development standards required in the CO zone, nor does it observe vision triangle setbacks. 3. Business and professional offices, child day care centers, and presch~ols are outright permitted uses in the CO zone. Churches, public parks and recreational facilities, business colleges, music, art, and dance schools, are conditionally permitted uses in the CO zone. Condwonal Use Permit - CUP 02-01 DRYKE February 13, 2002 Page 8 4. Residential uses are permitted in the CO zone with development standards per the City's Residential Single Family (RS-7) zone. Residential uses permitted per the City's Residential High Density (RHD) zone are conditional uses in the CO zone. 5. Eleven (11) off-street parking spaces will be required for the multiple use site per the City's Parking Ordinance requirements. The site plan indicates that 19 off-street parking spaces can be provided. Off-street parking must be improved per the Public Works and Utilities Departments standards. Parking was calculated given the use areas as proposed by the applicant in the site plan submitted January 11,2002. 6. The applicant has operated an outdoor radio-controlled car race track activity on the site for approximately the past 4-5 years. The City has not received any written complaints from neighbors regarding the use. 7. The site was posted and public notices of the application were mailed to property owners within 300 feet of the property on January 18, 2002. Legal publication appeared in the Peninsula Daily News on January 23, 2002. To date, no written comments have been received. 8. The City's State Environmental Policy Act (SEP A) Official issued a determination of nonsignificance on February 8, 2002, per WAC 197-11-355. This satisfies the City's responsibility under the State Environmental Policy Act. 9. The site is served by Jones and Georgiana Streets. Both Jones and Georgiana Streets are fully improved access streets with curb, gutter, and sidewalk. Front Street is located one block south of the site and is served by Clallam Transit. 10. The Comprehensive Plan and Land Use Designation for the subject property is Commercial (C). 11. Zoning ofthe site is CO, Commercial Office. The purpose ofthe CO Zone (Section 17.20.010 P AMC) "... is a commercial zone intended for those business, office, administrative or professional uses which do not involve the retail sale of goods, but rather provide a service to clients, the provision of which does not create high traffic volumes, involve extended hours of operation, or contain impacts that would be detrimental to adjacent residential areas. " The applicant proposed extended hours of operation of 3 p.m. to 11 p.m., Monday through Friday. It is within the purview of the Planning Commission to determine the hours of operation that will be compatible with other activities occurring in the vicinity. 12. The CO Zone does not encourage the retail sale of goods to the public. The applicant has stated that on-site retail activities will serve mainly those persons using ~he track. 13. Construction of the approximately 4900 square foot building will require compliance with the Uniform Building Code, Fire Code, and Electrical Code. 14. II II. . COlldltlonal Use Permll- CUP 02-01 ,. Section 17.96.050 P AMC Conditional Use Permit provides that "The Planning Commission may grant said permits which are consistent and compatible with the purpose ofthe zone in which the use is located, consistent with the Comprehensive Plan, and not contrary to the public use and interest. The Planning Commission may refuse to issue a Conditional Use Permit if the characteristics ofthe intended use as related to the specific proposed site are such as would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental, or hazardous conditions.In each application the Planning Commission may impose whatever restrictions or conditions they consider essential to protect the public health, safety, and welfare, and to prevent depreciation of neighboring property." 17. Conditional uses permitted in the Commercial Office zone per Section 17.20.160 P AMC include art galleries and museums, assisted living facilities, beauty shops and barber shops, business colleges, music, art, and dance schools, businesses selling medical supplies, goods, instruments, medicine and similar items, chemical dependency treatment centers, detoxification centers, libraries, nursing and convalescent homes, public parks and recreation facilities, residential care facilities, residential uses that are permitted in the RHD zone, and other uses that are determined to be compatible with the intent of the zone. Conclusions: A. While the Commercial Office zone does not specifically permit commercial recreational uses, other similar uses are permitted either outright or as conditional uses in the CO zone such as child day care centers, pre-schools, public parks and recreational uses, music, art, and dance schools, which are youth/family oriented. B. The proposed use is conditioned such that no significant impacts to surrounding uses or properties should occur as a result of the conditionally approved activity. C. As conditioned, the use is in the public interest. D. The site is served by adequate public services including but not limited to electric, phone, sewer, and standard City street improvements. E. As conditioned, the proposal is consistent with the intent of the Comprehensive Plan's Commercial Land Use Designation and the goals and policies of the Comprehensive Plan specifically Land Use Element Goal A, and Policy A.2, Residential Goals B and C; Commercial, Policy D.1, and Policy E.3; Transportation Element, Policy B.14; Utilities and Public Services Element Goals A and B, and Policy E.6. F. The Comprehensive Plan allows for subordinate and compatible uses within different zones. It also encourages the City to support the provision of recreational activities for the public. G.
