This letter is to confirm our telephone conversations regarding the structure at 508 1 /2 East Third Street, and its use as a separate residence from the pnmary residence at that location. After much discussion and review of the City's land use development codes, and after reviewing the letters describing past use of the structure, it has been determined that development of the structure as a livmg unit, while not done through the penult process, did establish the use of the structure as a potential separate livmg unit. While the unit has not consistently been occupied as a residence, its mternmttent use as such and mtenor modification identify it as having been used as a small residential unit at some time complete with separate utilities. Termination of those utilities in October, 2006, did not in and of itself qualify as "abandonment" which would be necessary to deteinune that the unit would lose its nonconforming status under Section 17.95.020 Nonconformm2 Uses. Item C Abandonment, which reads If any nonconforming use of land and /or building or structure is abandoned and /or ceases for any reason whatsoever for a period of one (1) year or more, any future use of such land and /or building or structure shall be in conformity to the zone m which it is located as specified by these Regulations. The unit does provide off street parking and, although does not contain a setbacks consistent with the City's development regulations for either accessory or residential uses, its establishment prior to current zoning regulations (January, 1971) constitutes a nonconforming use that may continue until abandonment or destroyed beyond seventy five percent of its assessed valuation. I have been reviewing file information relative to dates that are nnportant for zomng issues, and find the following inform,ation to be relevant to the issue of occupancy of the space above the accessory structure located at the above address. The primary residence was developed with a home office above a detached accessory (garage) structure. Subsequent use of the accessory structure was by either the owner of the property, a relatIVe, or a friend, and the area was apparently incrementally changed from an office environment to a more typical living environment, which is not uncommon. However, I cannot conclude, given the information presented, that the area was ever consistently used by other than a relative or friend ofthe primary use resident. Given the information forwarded by yourself, Mr. Paulsen, the McGuffey brothers,' and Mr. Miller, it appears that, with the exception of the current resident, the structure has been used off and on for ancillary residential activities but has never been a stand alone rental. The earlier determination that the unit had been used as a rental was partly made based on letters from Sean and Jeremiah McGuffey, who stated that they lived "in the apartment located above the garage." This information did not identify that the McGuffeys are your brothers and their mother resided in the primary residential unit. WhIle it is not uncommon for such a structure to be used as extra space for family members, that use does not establish the area as a legal stand alone "apartment". Changes made to the "apartment" were not done by pennit at the time, but were incrementally changed to accommodate the use by family members. Furthermore, it appears that use of the unit by the McGuffey brothers ceased III 2004. In order for the garage unit to be considered as a nonconforming apartment, two things must be proven: (1) tha( the unit was converted prior to 1971 for other than family use; and (2) that the residential use has not ceased for a period of more than one year. Given the second criteria, even if the unit had been converted, if the use ceased for more than one year, that "grandfather" ability would have been lost. Given this information, occupancy of the unit as a stand alone residence may not legally continue, nor can the umt be advertised for independent residential use. I know that this information will be unsettling to you, but given the supporting documentation, I don't see that another analysis is possible. It is likely that your tenant will need some time to find a new housing opportunity. Given the landlord tenant laws and the - probability that it will take a little time for relocation by the individual occupying the unit, I suggestthat one month from receipt of this letter should allow adequate time for that relocation. It has been c ve This property belong to my grandmother and her husband R' y The garage had two floors to it. The bottom was all garage ad car door in the front and the back. Nothing was finish down stairs. There was a toilet only. Upstairs there was a room with a little room connected to it. In the small room there was a sink only. Roy built the upstairs during the war so he could have his war meeting for the civil service. The place was never had anybody live in it. It was not insulated and it did not have any heat up there. Roy passed away in 1988 At that time I turn the water off to the garage and the pipe plug up. They were galvanize pipes and they rusted up. The water was never hook back up. My Grandmother remarried in 1990 and move to another house My sister move into this house and she lived there until 1995. That was when My grandmother passed away. In 1996 the house was sold to my mother-in-law. She moved in with her boys. Her one son tried to live in the garage but my ex-wife and I chase him out of there. It was not safe for anybody to live in it. The power was only single pole wire and it was all exposed except upstairs where there was wood over it. During the time my mother-in-law live there I replace the sewer line for the house. At that time I had some new wires run out to the garage and had 2 outlets put in so we could plug lights in sometime. All the power was disconnected at that time. There was no other wire to the garage that was around 2001 or 2002. In 2004 my ex-wife and I bought the house from my mother-in-law In February 2004 my ex wife and I separated and she move into the house. There was no water and only 2 outlets in the downstairs when she moved in. The whole place was completely unfinished. In 2005 Bill Larue did a house apprais~l. He told me that he went to the city and asks them about making the garage an apartment. He was told that it could not be an apartment. So the property value was lowered for the divorce case. Since the divorce in June of2005 my ex-wife has had the garage converted to an apartment and has someone living in it.
