I apologize for the lack of a response to your August 8 letter regarding your clients referenced abo )le. I did not previously respond since I thought the issue to be moot since the City was not actively involved nor enforcing any action toward your clients. However, to more clearly respond to your letter as you have requested, I will summarize the following points from my interpretation: The City is not and has not been involved in efforts to annoy and harass your clients. We have no stake in the issue between the two parties other than to apply the City regulations in an equitable and responsive manner. Our response to a complaint is to investigate the matter and determine if there is a violation from an enforcement perspective or another concern from the perspective of maintaining "peace" in the neighborhood. The fact that we would photograph property or obtain statements would indicate a thorough investigation to which I would expect that your professional persuasion would find supportive. The City has concluded that the property issue in question regarding the screening by a hedge is not applicable in this particular case If it appears that we are spending an inordinate amount of time in responding to the Miller's complaint; I would urge you to have the perspective that the City is being customer responsive regardless of who makes the complaint. We have responded to complaints from your clients as well. I am not aware of a continuing response since your letter, and would appreciate any such details if my perception is in error. My hope is that these neighbors find a way to talk with each other and respect the rights of each other as they share similar neighborhood values Instead of finding ways to be adversaries, they should put equal effort into finding ways to be neighbors, even if they do not desire to be friends. Planning Specialist 417 -4750 In review of the adopted regulations as they relate to the complaint, I offer the Debra Barnes, following: Associate Planner 417 -4752 Proposed violation of viewshed by planted cedar trees: Lou Haehnlen Under PAMC 17.94.140, walls, fences, and hedges in residential zones, may be Building Official 417 -4816 maintained to a maximum height of 6 -feet within the building setback areas. All vision clearance requirements shall be maintained. Roger Vess Permit Technician/ Under PAMC 17.94.090, a vision clearance shall be maintained by all CSW Coordinator street/alley /driveway intersections. 417 -4815 or 417 -4712 Under PAMC 17.08.045(A), a hedge is defined as the special application of shrubs or other plants that have been planted close together so that they form a thicket and an unbroken line, acting as a space boundary or creating a visual screen. An individual tree cannot be a hedge by itself" Under PAMC 17.94.080, every "required yard and unobstructed space shall be open and unobstructed from the ground to the sky Under PAMC 17.94.120, permitted intrusions into required yards are listed. There is no mention of landscaping /planting restrictions. Ill Memo -B. Collins July 25, 2001 Page 2 Staff conclusion. The cedar trees in question are perhaps 15 feet in height and planted several feet apart from each other, in addition to more than 5 -7 feet from the fence (assumed to be the property line). The lower branches are approximately 2- feet off the ground %with several that protrude laterally through the fence. I didn't measure the spacing between the tree trunks. At the present time, 1 believe that an adult could walk through the trees by temporarily moving the branches aside. Upon continued growth over the next several decades, the tree trunks would allow an adult to walk between them. Thus, the trees are not impenetrable. The zoning code is silent as to any restrictions for the planting of trees and landscaping within required yards beyond what is established for a hedge, and also vision clearances. The subject location of the trees is not near a driveway or street intersection and is therefore, not affected by the vision clearance requirement. Any a tivity such as tree planting along a bluff that may result in negative impacts to the bl ff due to increased weight on the bluff are probably off set by the benefits of wate uptake by the trees, in addition to the stability that often results from the root stru ture. Actions which pose a potential threat to property beyond city regulations, such as the planting of trees, any branches or vegetation that fall or break off due to natural events, such as windstorms, or that crosses property lines are civil disputes that need to be resolved between the parties. It is my opinion that the cedar trees on the east property line of 2501 West 10t Street do not meet the definition of a hedge as defined by the City Zoning Code and no evidence has been presented that constitute them to be a hazard. Thus, the City does not have the authority to require trimming or removal of the cedars at this time. The letter that the City sent advising the property owner that a violation may result in the future is the only action that the City can make. Landscaping near bluff at 2501 West 10' Under PAMC 15.28.030, clearing and grading (which includes removal of vegetation beyond pruning and exposing the soils) in an environmentally sensitive area requires a clearing and grading permit and ESA approval. In review of the file, ESA97 -08, that was approved for the construction of an addition onto the existing dwelling at 2501 W. 10 St., the photos show a few cedars and grass along the bluff but no landscaping near the bluff edge in the location of the recent plantings. The site visit on July 13 revealed that a row of low- growing plants were placed within 1 -foot of the bluff. According to the complaint, a trench was dug for the planting. However, the site visit only revealed the finished planting and not reveal the amount of excavation that was done. Collins July 25, 2001 Page 4 I shaped area to the west of the windmill but it is unknown if the windmill itself is causing this I assume that some type of trench was built to connect the windmill to a power source, or storage un it. Staff conclusion. It is my opinion that the installation of the windmill requires a clearing and grading permit, ESA approval (including geotechnical report) and either a shoreline exemption or substantial development permit, or the structure be removed.. Section 17.94.140 of the City's Municipal Code reads "Walls, Fences, Hedges. -In all Residential and Commercial Zones a wall, fence, or hedge may be maintained to a maximum height of six (6) feet within the building setback areas. All vision clearance requirements shall be maintained." Additionally, a hedge is defined as the "the special application of shrubs or other plants that have been planted close together so that they foi a thicket and an unbroken line [emphasis added], acting as a space boundary or creating a visual screen. An individual tree cannot be a hedge by itself (Ord. 2954 §1, 3/28/97), In an effort to avoid complications in the future, this letter is being written to provide you with a information requiring hedges such that the planting that exists on your east boundary line does not become a zoning violation. You will need to actively maintain the landscape buffer you have created such that it does not grow together to form a solid hedge. This can be done by pruning both the height of the landscaping materials and by ensunng that they do not grow together to form a solid hedge. If you have any questions as to the above information, please don't hesitate to contact this department. Following if information in that regard. 417 -4750 Debra Barnes, The trees are planted such that they grow together. However, they appear to be Associate Planner planted west of the Miller fence line which would place them outside of the required 417 -4752 setback area. While I agree it may not prudent to disturb vegetation along a marine bank, it may be a smoking gun issue unless it is an intrusion into an ESA required buffer. In that case the City's ESA ordinance would apply. The Younkin's residential use would fall into the previously altered category and predates the City's ESA ordinance. The City's residential zones allow for accessory structures to be established in association with residential uses. The use of materials is not restricted to wood. The structure that has been described fits the definition of an accessory structure and has been placed in the location prescribed for such uses 3' from a property line in the rear one -third of a lot. In that Mary and I have talked with you about these trees and the other referenced issues a number of times, I will remain brief. As planted, we believe that the trees are in violation of the City's land -use regulations, and we are certain that the City wants to apply the land -use regulations consistently. With the trees planted the way they are, Mary and I are concerned about the increased potential for damage to our home by having so many eventually very large trees packed in so close to our house. We are also uncomfortable living exposed to an unnecessarily dangerous situation to our personal safety during the windstorms, which are so common in this area. As you've said, your interpretation of the City's definition of a hedge is in agreement with ours and this concentration of trees along the property line is a hedge. As we all know, our neighbor concentrated these trees along the property line primarily in order to block our view to the West. The nearly twenty foot tall wooden screens placed in amongst the trees, along with the wispy condition of the trees from being watered and fertilized year round, in an effort to make them grow as fast as possible, bear out the intent to block our view to the West. Having our neighbor purposely take away our view to the West by creating a tall visual barrier is an unfortunate loss for us and our loss should be prevented if the barrier is in violation of a city ordinance. More important, we all know that our properties along the shoreline are impacted from full marine exposure, which leaves our homes with absolutely no protection during windstorms. The City made us acutely aware of the fact that we will be impacted from windstorms by the high wind load projections that required engineered tie downs throughout our house as part of our building permit. The reason that I bring up the fact that we are unprotected from the wind is that the prevailing wind blows these trees directly toward our house. We are certain our neighbor is not concerned about the potentially dangerous situation he has created for us and further that he is determined to let the danger grow as the trees grow larger and more hazardous. Additionally, his effort to push these trees to grow at an extreme rate by constantly watering and fertilizing the trees has weakened the trees. The branches of the trees are overly long, twisted and wispy. Further, the trunks of the trees are narrow and are twisted in response to receiving more nutrients than the trees are able to tolerate. Therefore, in that these trees are in a weakened state and with the prevailing wind blowing them directly at our house, Mary and I can not feel comfortable unless this hedge of trees is held to the height limitations for a hedge as required by the zoning code. Alternatively, the City could provide us with appropriate protection from damage by calculating the expected average breadth of the trees at maturity and reducing the number of trees so that the trees cannot later grow together and once again form a hedge. From our discussions with local nurseries, we have found that in order for the trees to not ultimately grow together the separation between each tree will need to be approximately thirty -five feet. The appropriate separation between the trees is important so that Mary and I will receive the level of protection that we have the right to receive and so that we will not later have to go back to the City with the same issue of the trees growing together to form an overheight hedge. The alternate solution described above will still leave Mary and I exposed to a level of danger from a tree being blown over onto our home during a windstorm. However, with the trees reduced in number such that the trees cannot again form a hedge, the number of trees to potentially strike our home will be substantially reduced. Also, if these trees are not forced to grow so closely together then the trees will likely grow in a more natural and healthy state, which should then leave the trees less likely to be blown over in a windstorm. Mary and I are aware that by choosing to live in this area that we are obligated to except living with an appropriate level of danger from trees during a windstorm. However, we are also aware that we should be provided with an appropriate level of protection from damage because the number or the height of the trees can be limited through enforcement of the City's current zoning regulations. Mary and I should not be placed under any greater danger from our neighbors actions than the level of danger we are exposed to when his actions are regulated by the enforcement of the City's zoning regulations. Another concern that we have spoken with you about is our neighbor has removed the sod layer in a continual two -foot wide strip just behind the edge of the bluff to create a planting trench. As you are aware, the bluffs are as often as not undercut, and particular to our location, the only protection to prevent erosion at the top of the bluff is provided by the intact sod layer that grows right up to the lip of the bluff. Additionally, the removal of a continual strip of sod so near the lip of the bluff leaves the last few feet of sod along the very lip of the bluff disconnected from the remaining sod layer. Also, the planting trench cut into the bluff will add insult to injury by increasing water infiltration along the lip of the bluff in the very location in which the sod layer is left unattached. Moreover. unless our neighbor chemically kills the grass covering the very lip of the bluff, the sod remaining beyond the trench will still need to be mowed in the very location in which he has substantially decreased the stability of the undercut bluff. If our neighbor can't see the problem he's created, then surely you can see the safety issue he's created and I'm sure that you can also see the adverse impact he's caused to the bluff by digging a trench parallel to the lip of the bluff. Further, when his bluff erodes, it will leave our adjacent bluff exposed to erosion and will ultimately cause erosion all along the bluff at a pace more rapid than would otherwise occur. Therefore, please see that the continual layer of sod at the lip of the bluff is re- established in order to protect the bluffs in general and more important to protect us from the loss of our property due to an increased rate of erosion. As I have said before, the Shoreline Master Program must address protection of the marine bluffs. I am also certain that there must be Goals and Policies in place in the Comprehensive Plan for preventing adverse impacts to the bluffs. After all, the protection of our shorelines is so important that the State of Washington sees the protection of our shorelines to be of statewide significance. Therefore, I am confident that the City's Shoreline Master Program or the other land -use regulations must somehow implement the Comprehensive Plans Goals and Policies to protect the bluffs from the adverse impacts of property owners. However, if you find that there is nothing that you can do, through enforcement of the City's regulations, to protect us from the potential damages described above, please write us, and explain to us why these actions which increase the danger to our home and adversely impact the bluffs cannot be regulated. After all, our house is located in the area of the City which is most exposed to damage during a windstorm as evidenced by the City requiring construction of our house to be provided with the greatest protection form wind load for residential construction in the City. The last zoning issue that I would like to point out to you is the fairly large temporary plastic structure shaped like a Quonset Hut located on the neighbor's property. The plastic Quonset Hut has been on his property for a couple years. Does our zoning district allow temporary plastic buildings to be placed on the property for years? If temporary plastic structures are not allowed, why has the plastic Quonset Hut been allowed to remain on his property for the last few years? If removal of temporary plastic structures requires a written complaint. then we are with this letter registering our written complaint. In closing, we have two consistency issues that we would like to keep you informed about from our perspective. First, as you have said, "The City won't do anything without a letter" and so I have written this letter to you. However, as you might understand, we do not want this letter go into private hands. For example, Mary and I have received letters from the City stating that the City has received complaints concerning our property. The City's letters threatened that if we do not take care of the complaints, within the brief time specified, then the City's crew would make the corrections to our property in order to satisfy the complaints. The letter further stated that if we did not then pay the City for the City crews work to make the corrections that the City would then place a lean on our property in order to receive payment for bringing our property into compliance with the City's ordinances. When Mary and I asked the City who had complained we were told that City policy would not allow us to know who had complained, or to see the letter of complaint. Mary and I assume they too had to first write a letter in order to receive action from the City. Therefore, please see that our anonymity receives equal protection. Second, when Mary and I were having our house built, I was living and working in Eastern Washington. One day while Mary was out at the house the City's inspector came out and told her; "I am not here to inspect your house, I am here because your neighbor has complained about your fence being too tall. I am here to tell you to lower your fence to six feet In that Mary was alone, she had to lower the fence to six feet on her own. Collins July 25, 2001 Page 2 Sta ff conclusion The cedar trees in question are perhaps 15 feet in height and planted seve feet apart from each other, in addition to more than 5 -7 feet from the fence (assu hed to be the property line). The lower branches are approximately 2- feet off the w ground/with several that protrude laterally through the fence. I didn't measure the spacing between the tree trunks. At the present time, I believe that an adult could walk through the trees by temporarily moving the branches aside. Upon continued growth over the next several decades, the tree trunks would allow an adult to walk between them. Thus, the trees are not impenetrable. The zoning code is silent as to any restrictions for the planting of trees and landscaping within required yards beyond what is established for a hedge, and also vision clearances. The subject location of the trees is not near a driveway or street intersection and is therefore, not affected by the vision clearance requirement. Any a tivity such as tree planting along a bluff that may result in negative impacts to the bl ff due to increased weight on the bluff are probably off set by the benefits of wate uptake by the trees, in addition to the stability that often results from the root stru ture. Actions which pose a potential threat to property beyond city regulations, such as the planting of trees, any branches or vegetation that fall or break off due to natural events, such as windstorms, or that crosses property lines are civil disputes that need to be resolved between the parties. It is my opinion that the cedar trees on the east property line of 2501 West 10` Street do not meet the definition of a hedge as defined by the City Zoning Code and no evidence has been presented that constitute them to be a hazard. Thus, the City does not have the authority to require trimming or removal of the cedars at this time. The letter that the City sent advising the property owner that a violation may result in the future is the only action that the City can make. Landscaping near bluff at 2501 West 10"' Under PAMC 15.28.030, clearing and grading (which includes removal of vegetation beyond pruning and exposing the soils) in an environmentally sensitive area requires a clearing and grading permit and ESA approval. In review of the file, ESA97 -08, that was approved for the construction of an addition onto the existing dwelling at 2501 W. 10 St., the photos show a few cedars and grass along the bluff but no landscaping near the bluff edge in the location of the recent plantings. The site visit on July 13 revealed that a row of low- growing plants were placed within 1 -foot of the bluff. According to the complaint, a trench was dug for the planting. However, the site visit only revealed the finished planting and not reveal the amount of excavation that was done. Section 17.94.140 of the City's Municipal Code' reads "Walls, Fences, Hedges. In all Residential and Commercial Zones a wall, fence, or hedge may be maintained to a maximum height of six (6) feet within the building setback areas. All vision clearance requirements shall be maintained." Additionally, a hedge is defined as the "the special application of shrubs or other plants that have been planted close together so that they foi a thicket and an unbroken line [emphasis added], acting as a space boundary or creating a visual screen. An individual tree cannot be a hedge by itself (Ord. 2954 §1, 3/28/97)" In an effort to avoid complications in the future, this letter is being written to provide you with information requiring hedges such that the planting that exists on your east boundary line does not become a zoning violation. You will need to actively maintain the landscape buffer you have created such that it does not grow together to form a solid hedge. This can be done by pruning both the height of the landscaping materials and by ensuring that they do not grow together to form a solid hedge. Following if information in that regard. 417 -4750 Debra Barnes, The trees are planted such that they grow together. However, they appear to be Associate Planner planted west of the Miller fence line which would place them outside of the required 417 -4752 setback area. At that location the trees would not be a concern unless they exceed 30' in height. Some longer branches protrude into the setback area but they would not Lou Haehnlen singularly cause a problem. Building Official 417 -4816 The city cannot regulate what type of vegetation a property owner plants, only that it Roger Vess may not form a vegetative barrier in a setback area over 6' in height. The City does Permit Technician not have a view ordinance in place or have the ability to predict that a future storm C SW Coordinator will cause debris to damage neighboring property, that is a civil matter. Care of 417 -4712 vegetation that is not in violation of a setback regulation or of a concern as an Ed Eastwood imminent public risk does not fall under the City's purview. The removal of sod from Building Intern the marine bluff/buffer area could be a concern IF it can be proven that an erosion 417 -4815 problem is occurring as a result. While I agree it may not prudent to disturb vegetation along a marine bank, it may be a smoking gun issue unless it is an intrusion into an ESA required buffer. In that case the City's ESA ordinance would apply. The Younkin's residential use would fall into the previously altered category and predates the City's ESA ordinance. The City's residential zones allow for accessory structures to be established in association with residential uses. The use of materials is not restricted to wood. The structure that has been described fits the definition of an accessory structure and has been placed in the location prescribed for such uses 3' from a property line in the rear one -third of a lot. Dear Brad: As you've requested, I am writing this letter to you concerning the densely planted trees located next to the property line near our house and about other associated land -use issues. In that Mary and I have talked with you about these trees and the other referenced issues a number of times, I will remain brief. As planted, we believe that the trees are in violation of the City's land -use regulations, and we are certain that the City wants to apply the land -use regulations consistently. With the trees planted the way they are, Mary and I are concerned about the increased potential for damage to our home by having so many eventually very large trees packed in so close to our house. We are also uncomfortable living exposed to an unnecessarily dangerous situation to our personal safety during the windstorms, which are so common in this area. As you've said, your interpretation of the City's definition of a hedge is in agreement with ours and this concentration of trees along the property line is a hedge. As we all know, our neighbor concentrated these trees along the property line primarily in order to block our view to the West. The nearly twenty foot tall wooden screens placed in amongst the trees, along with the wispy condition of the trees from being watered and fertilized year round, in an effort to make them grow as fast as possible, bear out the intent to block our view to the West. Having our neighbor purposely take away our view to the West by creating a tall visual barrier is an unfortunate loss for us and our loss should be prevented if the barrier is in violation of a city ordinance. More important, we all know that our properties along the shoreline are impacted from full marine exposure, which leaves our homes with absolutely no protection during windstorms. The City made us acutely aware of the fact that we will be impacted from windstorms by the high wind load projections that required engineered tie downs throughout our house as part of our building permit. The reason that I bring up the fact that we are unprotected from the wind is that the prevailing wind blows these trees directly toward our house. We are certain our neighbor is not concerned about the potentially dangerous situation he has created for us and further that he is determined to let the danger grow as the trees grow larger and more hazardous. Additionally, his effort to push these trees to grow at an extreme rate by constantly watering and fertilizing the trees has weakened the trees. The branches of the trees are overly long, twisted and wispy. Further, the trunks of the trees are narrow and are twisted in response to receiving more nutrients than the trees are able to tolerate. Therefore, in that these trees are in a weakened state and with the prevailing wind blowing them directly at our house, Mary and I can not feel comfortable unless this hedge of trees is held to the height limitations for a hedge as required by the zoning code. Alternatively, the City could provide us with appropriate protection from damage by calculating the expected average breadth of the trees at maturity and reducing the number of trees so that the trees cannot later grow together and once again form a hedge. From our discussions with local nurseries, we have found that in order for the trees to not ultimately grow together the separation between each tree will need to be approximately thirty -five feet. The appropriate separation between the trees is important so that Mary and I will receive the level of protection that we have the right to receive and so that we will not later have to go back to the City with the same issue of the trees growing together to form an overheight hedge. The alternate solution described above will still leave Mary and I exposed to a level of danger from a tree being blown over onto our home during a windstorm. However, with the trees reduced in number such that the trees cannot again form a hedge, the number of trees to potentially strike our home will be substantially reduced. Also, if these trees are not forced to grow so closely together then the trees will likely grow in a more natural and healthy state, which should then leave the trees less likely to be blown over in a windstorm. Mary and I are aware that by choosing to live in this area that we are obligated to except living with an appropriate level of danger from trees during a windstorm. However, we are also aware that we should be provided with an appropriate level of protection from damage because the number or the height of the trees can be limited through enforcement of the City's current zoning regulations. Mary and I should not be placed under any greater danger from our neighbors actions than the level of danger we are exposed to when his actions are regulated by the enforcement of the City's zoning regulations. Another concern that we have spoken with you about is our neighbor has removed the sod layer in a continual two -foot wide strip just behind the edge of the bluff to create a planting trench. As you are aware, the bluffs are as often as not undercut, and particular to our location, the only protection to prevent erosion at the top of the bluff is provided by the intact sod layer that grows right up to the lip of the bluff. Additionally, the removal of a continual strip of sod so near the lip of the bluff leaves the last few feet of sod along the very lip of the bluff disconnected from the remaining sod layer. Also, the planting trench cut into the bluff will add insult to injury by increasing water infiltration along the lip of the bluff in the very location in which the sod layer is left unattached. Moreover. unless our neighbor chemically kills the grass covering the very lip of the bluff, the sod remaining beyond the trench will still need to be mowed in the very location in which he has substantially decreased the stability of the undercut bluff. If our neighbor can't see the problem he's created, then surely you can see the safety issue he's created and I'm sure that you can also see the adverse impact he's caused to the bluff by digging a trench parallel to the lip of the bluff. Further, when his bluff erodes, it will leave our adjacent bluff exposed to erosion and will ultimately cause erosion all along the bluff at a pace more rapid than would otherwise occur. Therefore, please see that the continual layer of sod at the lip of the bluff is re- established in order to protect the bluffs in general and more important to protect us from the loss of our property due to an increased rate of erosion. As I have said before, the Shoreline Master Program must address protection of the marine bluffs. I am also certain that there must be Goals and Policies in place in the Comprehensive Plan for preventing adverse impacts to the bluffs. After all, the protection of our shorelines is so important that the State of Washington sees the protection of our shorelines to be of statewide significance. Therefore, I am confident that the City's Shoreline Master Program or the other land -use regulations must somehow implement the Comprehensive Plans Goals and Policies to protect the bluffs from the adverse impacts of 1 property owners. However, if you find that there is nothing that you can do, through enforcement of the City's regulations, to protect us from the potential damages described above, please write us, and explain to us why these actions which increase the danger to our home and adversely impact the bluffs cannot be regulated. After all, our house is located in the area of the City which is most exposed to damage during a windstorm as evidenced by the City requiring construction of our house to be provided with the greatest protection form wind load for residential construction in the City. The last zoning issue that I would like to point out to you is the fairly large temporary plastic structure shaped like a Quonset Hut located on the neighbor's property. The plastic Quonset Hut has been on his property for a couple years. Does our zoning district allow temporary plastic buildings to be placed on the property for years? If temporary plastic structures are not allowed, why has the plastic Quonset Hut been allowed to remain on his property for the last few years? If removal of temporary plastic structures requires a written complaint. then we are with this letter registering our written complaint. In closing, we have two consistency issues that we would like to keep you informed about from our perspective. First, as you have said, "The City won't do anything without a letter" and so I have written this letter to you. However, as you might understand, we do not want this letter go into private hands. For example, Mary and I have received letters from the City stating that the City has received complaints concerning our property. The City's letters threatened that if we do not take care of the complaints, within the brief time specified, then the City's crew would make the corrections to our property in order to satisfy the complaints. The letter further stated that if we did not then pay the City for the City crews work to make the corrections that the City would then place a lean on our property in order to receive payment for bringing our property into compliance with the City's ordinances. When Mary and I asked the City who had complained we were told that City policy would not allow us to know who had complained, or to see the letter of complaint. Mary and I assume they too had to first write a letter in order to receive action from the City. Therefore, please see that our anonymity receives equal protection. Second, when Mary and I were having our house built, I was living and working in Eastern Washington. One day while Mary was out at the house the City's inspector came out and told her; "I am not here to inspect your house, I am here because your neighbor has complained about your fence being too tall. I am here to tell you to lower your fence to six feet In that Mary was alone, she had to lower the fence to six feet on her own. Mary did so immediately so as to comply with the City's ordinance #17.94.140 Walls, Fences, Hedges. In that the only fence that we have on our property is next to the neighbors property whose actions I've described above, please see that ordinance #17.94.140 Walls, Fences, Hedges is consistently enforced by the City. It is perplexing to me that while we continue to address pertinent issues that you present, we seem to be somewhat vilified in those attempts. No matter what the response, you don't believe it is done out of a sense of commitment to our citizens or with an honest intent to resolve issues that we can deal with as City employees. Some of us have gone outside of the bounds of work situations to let the Millers know that personality issues will not be dealt with through the City's resources. Of the four issues you discussed in your letter of December 9, 2009, (received on December 16), only one matter is a land use issue that has not been previously addressed. You did get a permit for the privacy screen structure and there is no issue here Lou Haehnlen should not have indicated that the need for the permit was to quiet Otto That was totally unacceptable and unprofessional. A building permit was /is required because the screen height constituted a non exempt structure Non exempt structures require building permits. Likewise, the color of .a fence is not a regulatable matter unless design standards are a matter of local law, or you live in an area where a homeowner's association addresses such an issue. So this is a non issue. I will address the two remaining matters herein. Building Inspector Lierly has viewed the compost bin and does not believe a building violation exists. However, the connection made between the two previously exempt accessory structures constitutes the creation of a non exempt structure Although the resulting structure does not constitute a life safety matter, and is not an uncommon occurrence, the new structure is regulatable and does require a building permit. Mr Miller will be notified of the need for correction. In an effort to avoid complications in the future, this letter is being written to provide you with information requiring hedges such that the planting that exists on your east boundary line does not become a zoning violation.
