The property is located atop a steep slope that drops north and east. Smith Subdivision SEPA: A Determination of NonSignificance (#972) has been issued for the proposal. DECISION: Approval with the following conditions: Conditions: 1. The side yard setback abutting Francis Street shall be no closer than 20' from the top of the Francis Street slope. Thc marine bluff(north) setback shall be no less than 45' south of the top of the marine bluffslope unless an engineered foundation is approved by the City. The west side yard setback shall be a minimum of 7', and the south setback from Caroline Street shall be no less than 20'. The Francis Street and marine bluff setbacks are based on the gcotechnical reports prepared for the subject property by Northwestern Tendtories, Inc. and dated September, 1997, and updated in May, 1999, and on January 24, 2002. The interior side and Caroline setbacks are per the Port Angeles Zoning Ordinance for RS-7 properties. 2. Compliance with all other recommendations of the geotechnical reports prepared and updated by Northwestern Tc~itories as of January 24, 2002, is required which includes: (1) Surface runoff from roofs, driveways and other impervious surfaces must bc collected and discharged to the municipal storm sewer system and/or tightlined to an approved discharge point at thc bottom of the bluff; (2) A 10-foot wide (minimum) natural vegetative buffer should be maintained along the top edge of the marine bluff and thc Francis Street slope. 3. A hold harmless agreement approved by the City shall be filed prior to issuance of a building permit or any site preparation on the subject property. ESA 02-01 - Bloom Page 2 Findings: 1. An application for review under Chapter 15.20 PAMC (Environmentally Sensitive Areas) was received on January 2g, 2002, from Robert and Nancy Bloom which proposed the construction of a single family dwelling on a property containing a geologic hazard area and a marine bluff. The proposal indicates a 46-foot setback from the top of the marine bluff and a variable 1 lfoot to 23 foot setback from the steep slope located along the east side of thc property. The interior side setback is proposed at 15 feet and the proposed setback off Caroline Street is 89.9 feet'. No disturbance of the bluff face is intended. 2. The subject property consists of Lots 1 and 2, Block 33, Normal R. Smith Subdivision to the Townsite of Port Angeles located at 727 Caroline Street. The site contains a marine bluff (north side) and a steep slope (east side). The upland portion of the site is basically level. The marine bluff is described as "grossly stable" (Northwestern Territories geoteclmical report) and is covered with dense brush and trees with an approximate 45 ° slope. No erosive wave action at the toe of the bank is possible as the area is protected by the development of the City's Waterfront Trail which includes protective shoreline rip rap. A dense growth of blackberry bushes covers the east slope which extends east at an approximate 40° slope to the Francis Street grade below. 3. The subject site is zoned RS-7, Residential Single Family. Standard setbacks for properties in the RS-7 zone that do not contain environmentally sensitive areas are 20 feet front and rear with a 7-foot interior side yard and a 13-foot comer side yard. Thirty (30%) percent lot coverage is permissible. 4. Soils are described as predominantly glacial till overlain by 10 to 15 feet of fine to medium sand. No signs of springs or seeps were observed on the bluff face during theJanuary, 2002, engineer's site visit. No recent evidence of significant slide activity was observed which is significant in view of extensive slide activity in this region during December, 1996, and January, 1997. 5. The September, 1997, geotechnical report prepared by Northwestern Territories, Inc., recommended that a 35 to 45 foot marine (north) setback could be justified for a conventional foundation. The January 24, 2002, update recommends that a 45 foot setback be observed for a conventional foundation system with a reduction to 35 feet for an engineered foundation. The applicant has proposed a 46 foot setback with a conventional foundation. Similarly, the September, 1997 report recommended a 20 to 25 foot setback from Francis Street (east) with the January 2002, report recommending a 20 foot setback from the top of the Francis Street slope. The applicant's original site plan shows a varying east side yard, given the meander of the slope, from between 11 feet and 23 feet on the Francis Street side. 6. The subject property meets the definitions of a marine bluff and a landslide hazard area as defined by PAMC 15.20 (Environmentally Sensitive Areas Ordinance). The purpose of the Chapter is to protect environmentally sensitive areas in accordance with the Growth Management Act. The intent of the Chapter is to use a function and values approach and ESt 02-01 - Bloom Page 3 establish minimum standards for properties containing envirenmentall sensitive features in order to protect the public health, safety and welfare which includes: a J avoiding disturbance of these areas, b) mitigating such impacts, c) protecting the public from personal injury, loss of life or property damage due to erosion and landslides, etc., and d) protecting against publicly financed expenditures from misuse of environmentally sensitive areas. 7. An environmentally sensitive area includes landslide hazard areas which are def'med as an area potentially subject to risk of mass movement due to a combination of geologic, topographic, and hydrologic factors. Areas with a combination of slopes of 15% or steeper with impermeable soils (typically silt and clay) frequently interbedded with granular soils (predominantly sand and gravel) are considered landslide hazard areas. 8. Marine bluffs are coastal features resulting from wave erosion undercutting uplands located adjacent to the shoreline, creating vertical cliffs that are an important source of sediment for coastal drift processes and/or the landforms created by these processes. 9. Marine buffers may be reduced per 15.20.070(B)(4) PAMC when expert verification and environmental information demonstrate to the satisfaction of the Community Development Director that the proposed construction method will: a.) Not adversely impact the stability of ravine sidewalls and bluffs; b.) Not increase erosion and mass movement potential of ravine sidewalls and bluffs; c.) Use construction techniques which minimize disruption of the existing topography and vegetation; and cl.)Include measures to overcome any geological, soils and hydrological constraints of the site. 10. Areas containing or adjacent to geological hazard areas shall be altered only when the Community Development Director concludes, based on environmental information, that: a.) The land clearing, grading or filling activities will adhere to best management practices; b.) Vegetation in erosion hazard areas will be preserved or replaced; c) There will be no increase in surface water discharge or sedimentation to adjacent properties; d.)There will be no decrease in slope stability on adjacent properties; and that there is no hazard as proven by evidence of no landslide activity in the past in the vicinity of the proposed development and a quantitative analysis of slope stability indicates no significant risk to the development proposal and adjacent properties. 11. All development proposals in environmentally sensitive areas shall comply with the requirements and provisions of Chapter 15.20 PAMC. The responsibility for administration and enforcement of the provisions of the Chapter shall rest with the Community Development Director or his designee. 12. The application included an environmental checklist as required under RCW 43.21C and PAMC 15.04. The checklist and supporting geotechnical data indicated that there were no potential environmental impacts such as unstable slopes or erosion. 13. The subject property has been totally cleared previously and overgrown with blackbemy bushes. ESA 02-01 - Bloom Page 4 14. As proposed, the foot print of the building will need to be adjusted to accommodate the required 20-foot east side yard setback per the recommendations of Northwestern Territories, Inc. The proposed building would encumber approximately 12% of the upland area 15. ADetermination of Nonsignificance (//972) was issued on March 5, 2002, by the City's SEPA Responsible Official in compliance with RCW 43.21C and WAC 197-11. Conclusions: 1. As conditioned, the proposal is consistent with the requirements for development within a previously disturbed area as defined in PAMC 15.20.080(A)(3), and for development that is defined as a reasonable use exception under PAMC 15.20.080(A)(I). 2. As conditioned, the proposal will result in the least impact to the sensitive area and take into consideration site constraints associated with the subject property. 3. The Commtmity Development Director concluded that the applicant's environmental information satisfies the requirements of PAMC Sections 15.20.070(B)(4) and 15.20.070(C). 4. The geotechnical reports submitted as a part of the environmentally sensitive areas application provide a basis for conditioning the building activity such that it will be in the public interest, safety, and welfare. 5. The subject property is considered a previously altered area as defined by Chapter 15.20.080(3) PAMC. Development within such areas may be developed subject to criteria (a)-(f) as specified in the Chapter. 6. As conditioned, the proposal is consistent with the Port Angeles Comprehensive Plan and the City's Zoning, and Environmentally Sensitive Areas Ordinances. It is understood that you plan to construct a four bedroom single family residence on the property as shown on the site plan provided to us by your builder Terhune Homes, LLC (Figure A): This update geotechnical inspection consisted of a visual inspection of the property to determine if there had been any new slide activity since the odginai report. Since the earlier report, improvements have been made to the Francis Street Park east of the subject property, l'he only recent activff¥ noticed since the last report is a smadt area o[ minor Shallow sloughing near the toe of the slope that del:x~ited a small amount of debris onto the new access, stairs leading from the park to the wate~m3nt trail. No springs or seeps were noliced on the slopes. Trees on the slope have curved trunks, which suggest she{{ow sk3pe creep of the surface soils. RegresentatJves of Terhune Homes placed stakes on the property al the corners of the proposed house. Using Figure 1 from the original repo~ and Figure A from this report, rough meast~rements were made in the field of the approx'~mate location of the top of the bluff, and measurements were made from the stakes to the top edge of the bluff. The approximate top of bluff was then drawn on Figure A of this report_ Based on Ihese measurements, the proposed house (not including decks) will sit between 48' and 50' from the marine bluff and between 11' at the northeast comer and 33' at the southeast corner from the Francis Street slope (Figure A)- From the above measurements, it is apparent that the location of the top edge of the Francis Street slope is vedable and that the upland portion ofrhe lot decreases in width in the area of the proposed house. The 4.8' to 50' setback from the rnarine bluff is consistent with the recommendations of the original report and is acceptable. However, the northeast comer of the proposed house is too close to the Francis Street slope, it Js recommended that the location Of the proposed house bo moved soulh, or a combination of west and south, such that the house is no closer than 20' from the top of the Francis S',reet slope, Except as mentioned above, the slopes appear to continue lo be grossly stable and thus the conclusions and ~ecommendations of the o¢lginal report are still valid~ The ~rollowing recommendations should also be considered with regards to .(tevelopment of the subjec~ property: 1. Heavy irrigation or other activities that would contribule large quantities of water to ~e soil should be avoided. One cause of landslides is the presence of excessive groundwater in the soil near the bluff. 2. Bare soils are subject to erosion, thus ground cover should be encouraged and maintained on the slopes as well as on the upland. Native vegetation · that requires litf~e or no irriga~on would be most beneficial. Also, the existing established trees and brush on the slopes provide stabilization and should be le~t in a relatively natural state. Sele~ve thinning and pruning that does not damage the vegetation can be utilized to inlprove the view. 3. Any drainage control devices should be maintained in good working order and inspected at least once a year. 4. Silt fences or other sediment control devices may need to be utilized in order to prevent sedimentation to adjacent properties during construction. The focus of this report is the north facing Marine Bluff' along the northerly boundary and the slope along the wast side o1' Francis Street. The purpose of this report is to provide a preliminary evaluation of the stability of the Marine Bluff and the Francis Stree~ slope together with recommendations for development of a single family home on the site. Trail below. It has an average slope of 45° based on the profile mapeed by t~ald su~ey near the westedy Ix~ lirm (See Fiojure 1 ~. The face of the bluff was inspected by the unders~ on September 16. 1997 and again on Ma~ 25, 1999. Except for'~e weste~ty cleared ar~a wh~re the p~or~ was taken, the bluff is heavily vegetated wilh brush and trees. It is not a01:~'enl whether this is the result of a recent surrmial slide or was manually cleared. Based on soil togs at the Olympic Memorial-Hospital to the .east. the bluff face is dominanlly glacial till or,lain by 10 to 15 feet of ~ to medium sand. No sigas ef springs or seeps were observed on the bluff face. No evidence of mcan! significant slide activity was obsewed. This is significant in view of the extensive slide ac~ivit~ in this region dudng December 1996 and January 1997. The toe of the bluff is protected f~om erosive wave actioa by the rock rip rap along the Waterfront Trail which was formedy a roilmad bed. In addition, a small ditch between the toe of Ihe blulf ~nd the Waterfront Trai~ prmddes dra~tage along the base of the b~uff. The subject Marine Bluff appears to be ~grossiy stable" and is certainly more stable than other sections to the west thai have slumped due to excessive ground water surfacing at the face of the bluff and/or other causes. FRANCI~ STREET ~LO,~E The top edge of the Francis Street slope is approximately 20 feet west of the easter~ ~ line leaving about 70 feel of generally level ground fronting Caroline Street. This alope is covered by a seiki mass of blackhe~y vires vddch alk~ed very limitad obse~ratio~ of the face o1 this slope. However, based on observations of the Ma~qe g~uff from which ~ Francis Street"cut" slope was created, it could be concluded that ~ slope is as stable as the Marine Bluff. A~ shown in Profile B (See Figure 1) Ibis slope has a sheer drop of about 10 feet verltcally from the to~ edge ~ the~ e~ (aidy uniformly at about 40° to the Fm~c~s Street gra~te below, if should be noted that the height of this slope varies since the subject property along Ute top is neady level and the Francis Street road/trail descends unifomtly to a point just. above the WBterfmnt Trail SETBACK CONSIDERATIONS Standard front (20 feet) and side yard (7 feet) seltmcks per City of'Port Angeles planning a~l building codes would apply for Caroline ~treet f~o~tage and the westerly side yard. Therefore. only the setbacks from the top edge of the Ma~ine Bluff and the Francis Street "cut' slope are subject to fudher evaluation. MARINE BLUFF SETBACKS The final Setback will be a compromise of space available, view potential and risk. ~he maximum setback available tot a 40 foot by 60 foot home with a 20 foot front setback is about 70 feet. The house to the west is abo~ 55 feet back frorn the top edge of Ule Marine Bluff. Although curranUy stable at 45°, a b/pical long term angle of repose of 35' would establish a setback of appmximataty 45 feet for a standard foundation system. A c~oser sea)ack could be justified with an engineered foundation system.
