Park Avenue Dear Mr. Lawson: Staff have reviewed the paperwork that you provided regarding the intent to create an individual building site for the residence identified as 1004 E. Park Avenue. The site is located in the City's RS -9 Residential Single Family zone. The submitted information included a 1960's preliminary survey that was not filed_ a 1963 quit claim deed, and the 2006 survey filed by the abutting property owner. While the early documentation indicates the intent to create an independent building site, a survey was not recorded to formalize such an action. The property was annexed into the City in 1961. The previously referenced quit claim deed was filed in 1963. While the City did not adopt formal subdivision regulations until 1967, land use regulations for lot areas of less than 5 acres were in place state wide prior to that time. The City's regulations dictate minimum lot dimensions and area for new building sites and requires surveys to be filed to create new building sites. Although a survey was not filed with the 1963 quit claim deed, the building site contains the required minimum lot area to be approved under the City's development standards as a building site but the lot width does not meet the development standards for the RS -9 zone. Structures on the site are conforming to RS -9 development standards but lot width will remain nonconforming. A preponderance of evidence indicates that the quit claim deed intended to transfer ownership of the area identified by the quit claim deed as an independent building site prior to adoption of formal subdivision regulations by the City is present. Given this evidence, the City will acknowledge the nonconforming building site with the following condition: Condition: L A survey shall he tiled that depicts the lot created by the Statutory Warranty Deed tiled by Tony and Hazel Sofie on October 25, 1963. The survey should contain a reference to the 1963 quit claim action that it supports to establish validity of the action for future reference. Phone: 350- 417 -1750.
