PUBLIC WORKS & UTILITIES DEPARTMENT December 2,2002 Wengler Surveying & Mapping James Wengler, PLS 330 East First Street Port Angeles, WA 98362 RE: Covenant consenting to the formation of a Local Improvement District (LID)_ __ Dear Jim: This is in response to your letter concerning the attachment of the LID covenants recorded under Short Plat 88(4)8 to the newly proposed Boundary Line Adjustment (BLA 02-09). Thank you for the copy of the Quit Claim Deed Boundary Line Adjustment (AF#667662) conveyance for that portion of Lot 3, Short Plat 88(4)8. This information helped identify as to how that portion of lot 3. Short Plat 88(4)8 attached to lot D, Short Plat 78-8-21 in that the boundary line adjustment was not formerly presented to the Department of Commdnity Development for review or approval. Through much discussion with the City Attorney and the Department of Community Development, it has been determined that I was in error in my communications with Mr. Osterberg regarding the attachment of the LID covenants from one parcel to another. The original LID covenant agreement would attach to all properties concerned within the present and / or newly created boundary line adjusted lots. The current Public Works. covenant consenting LID form states "for a period of time not to exceed ten (10) years from the date of execution of this covenant". This time line expiration would not be applied to the June 22, 1988 previously signed agreement. My apologies to Mr. Osterberg for giving him with the wrong information.
