A. ® DEPARTMENT OF COMMUNITY & ECONOMIC DEVELOPMENT TO: Planning Commission FROM: Sue Roberds, Planning Manager DATE: October 26, 2011 RE: Conditional Use Permit- CUP 11-02 APPLICANT: Betsy Schultz OWNER: SAME LOCATION: 1108 South Oak Street REQUEST: A respite residential use in the RS-7 Residential Single Family zone PROPOSAL: The proposed use is a non profit residential retreat where guests will be provided accommodation for a short period of time (5 days) to deal with a life changing event. The residence will be dedicated to be used strictly for this residential activity. Guests will be the families of fallen service men and women who will be provided a place to relax in a quiet atmosphere. The 4993 square foot single family residence can support a maximum of 16 people although it is unlikely that full occupancy will occur on a regular basis. The residence will be occupied by either the property owner or a caretaker on a full time basis with additional personnel who will wort: in shifts, one attendant at all times, when guests are in residence. The activity will provide door to door service to grieving family members who will be picked up and transported back to the airport for departure following their stay. A van with a driver will be used for transportation purposes during-visits. Only employees and two residential vans will be parked on-site. Visitors will arrive on Sunday afternoon and leave on Friday afternoon. NEIGHBORHOOD CHARACTERISTICS: The subject site is situated in the City's Central Planning Area. The site address is 1108 South Oak Street. The neighborhood is a well-established, completely developed single family neighborhood that supports a variety of community support uses. The neighborhood is known as "Cherry Hill" and includes the well established Queen of Angels Church and convent/school located two blocks immediately north of the subject site. Jefferson Elementary School is located three blocks east of the site at the corner of 13"' and Lincoln Streets. Commercial uses are ,�-q r M r^"' :T j i Mir ' Page 2 "`Conditional Use Permit-CUP I 1-02 October 26,2011 located north of the area along 81h Street and south at Lauridsen Boulevard, and a group home use is located immediately south of the subject property across the 11/12 alley. The area has long supported a variety of owner occupied and rental property use without much incident. PUBLIC COMMENT: Public notification of the proposed action was mailed to property owners within 300 feet of the subject site and posted on the property on October 6, 2011. Notification was placed in the Peninsula Daily News on October 10, 2011, with written comment accepted by October 25, 2011. No written comments have been received. CITY DEPARTMENT REVIEW: The City's Public Works and Utilities Department reviewed the proposal but did not have comments. The Fire Department had no objections but will require that, if the residence does not already have smoke detectors located in all sleeping rooms with at least one per floor level, and a 2AIOBC fire extinguisher mounted on each floor level,that such shall be installed prior to the proposed occupancy. DEPARTMENT OF COMMUNITY DEVELOPMENT ANALYSIS: Good planning identifies and supports the values shared as a community. The City's Comprehensive Plan identifies residential, land use, and social policies that are intended to guide planning decisions that enable diversity while retaining a sense of security and place in individual neighborhoods with the overall good of the community and its citizens as the primary goal. The goals,policies, and objectives of the City's Comprehensive Plan are used as the basis for development within the City. The Zoning Ordinance provides the tools that enable the goals, policies, and objectives of the Comprehensive Plan to be put into place throughout the community. The City's Comprehensive Plan was reviewed in its entirety in consideration of this proposal. Citations found to be most appropriate to the subject proposal are listed in Attaclunent`B"to this staff report. Each zone within the City includes a definition of its specific purpose and intent to further the goals of the City's Comprehensive Plan. Activities that are permitted in each zone are listed as well as conditional uses that have been determined to be permutable when approved through the conditional use permit process. Such conditional uses shall not conflict with the purpose and intent of each zone and must be compatible with the purpose of the underlying zone. The site is located in the City's RS-7 Residential Single Family zone. The purpose and intent of the RS-7 Residential Single Family zone (Section 17.10.010 of the Port Angeles Municipal Code [PAMC]) reads "... a low density residential zone intended to create and preserve urban single family residential neighborhoods consisting ofpredominantly single family homes on standard Townsite-size lots. Uses which are compatible with and functionally related to a single family residential environment may also be located in this zone. Because of land use impacts associated with nonresidential uses,few nonresidential uses are allowed in this zone and then only conditionally... " Conditional Use Permit- CUP 1.1-02 Page 3 October 26,2011 A "Conditional Use Permit" is defined in Section 17.08.020(G)PANIC as "... a limited permission to locate a particular use at a particular location, and ivhich limited permission is required to modify the controls stipulated by these Regulations inn such degree as to assure that the particular use shall not prove detrimental to sin rounding properties, shall not be in conflict with the Comprehensive Plan, and shall not be contrary to the public interest." Section 17.08.020(H)PAMC reads "Conditional Use - a use permitted in a zone but which requires a special degree of control to make, such use consistent and compatible with other existing or permissibie uses in the same zone. " Section 17.1.0.040(R) PANIC provides that "Other uses compatible with the intent of this Chapter"may be allowed by conditional use permit. The proposal is to continue to occupy the well kept, large residential structure in a manner similar to its previously long standing use as a bed and breakfast. Because full meals and transportation service will be provided guest occupancy will not be subordinate to the single family residential use of the structure, the use does not qualify as a bed and breakfast use. However, outwardly, the structure will appear no different than it historically has been viewed by passers by and neighbors, but occupants will be short term guests fully supported by.personnel. The site will be maintained by the property owner or her designee and personnel who will also work as caretakers to the structure and grounds. Guests will be provided a supportive, hospitality atmosphere that is less active than would be typical of a resort or hotel environment. Guests are seeking a quiet, residential, atmosphere where they are not bombarded with commercial activities, and where they will be able to relax in an anonymously for a short while. The use differs from a residential care facility where residents are sometimes infirmed, and because of the short term nature of the visits, but the use is similarly supportive with less impact specially and operationally than such a use which is conditionally permitted in the RS-7 zone. The overall character of the neighborhood will not be impacted by the use. The site is comprised of two Townsite lots that extend from 1 I"' Street to the 11/12 Alley, west of Oak Street. The well recognized residence will continue to be superbly maintained adding to the ambiance of the neighborhood. Signage will consist of a small (maximum 10 sq.ft.) site identification placard. No commercial signage is permitted in residential zones. A van and driver will be provided for transportation purposes while visiting. While there are likely a variety of retreat uses in the country, the use as proposed, serving the families of fallen service personnel, may be the first of its kind in the United States and will likely be a model for those to follow. The owner is aware that the primary use of a single family zoned property is for residential occupancy and that other uses permitted in such a zone must not conflict with that intent. She, or a caretaker will be responsible to ensure that residential occupancy of the structure is maintained between guest visits. As proposed, 5 off-street parking spaces will be required: (3) for the residence caretakers/employees and 2 residential vans. As a former bed and breakfast, the site can accommodate up to 12 off street parking spaces on that portion of the property located at the northwest corner of l 1t" and Oak Street originally developed and screened as an off-street parking area. On October 4, 2011, Betsy Schultz applied to the City of Port Angeles Department of Community & Economic Development(DCED) to allow her single family residence to be converted to a home where families of fallen service personnel are afforded a short hospitality stay. The residence has supported a bed and breakfast use since 1983. 2. The site location is 1108 South Oak Street in the City's RS-7 Residential Single Family zone. Ms. Schultz owns the subject property that would become a non profit trust ownership as proposed. 3. The 4993 square foot residence can provide lodging for up.to 16 people, however, it would not be usual for full occupancy to occur. Three (3) to 6 personnel would work in shifts as caretakers in the residence at all times with only 1 caretaker employee working on site at any one time. Transport during visits will be by van. Only employee vehicles and two activity vans will be parked on location. 5. Operational hours will be from Sunday afternoon until Friday afternoon. The property owner or a caretaker will be on site when visitors are not on location. 6. Section 17.10.010 of the Port Angeles Municipal Code describes the RS-7 Residential Single Family zone as a "...low densit)�residential zone intended to create and preserve urban single family residential neighborhoods consisting ofpredorninantly single family homes on standard Townsite sized lots. Uses which are compatible with and functionally related to a single family residential environment may also be located in this zone. " 7. A Conditional Use Permit is defined in Section 1.7.08.020(G) of the Port Angeles Municipal Code as "... a limited permission to locate a particular use at a particular location, and which limited permission is required to modify the controls stipulated by these Regulations in such degree as to assure that the particular use shall not prove detrimental to surrounding properties, shall not be in conflict with the Comprehensive Plan, and shall not be contrary to the public interest. " Section 17.08.020(H) PAM.0 defines a Conditional Use as "... a use permitted in a zone but which requires a special degree of control to make such use consistent and compatible with other existing or permissible uses in the same zone. " The purpose of a Conditional Use Permit is further defined in Section 17.96.050 PAMC as "... to assure that the maximum degree of compatibility between uses shall be attained. The purpose of these regulations shall be maintained with respect to the particular use of the particular site and in consideration of other existing and potential uses within the general area in which such use is to be located. " 8. While the RS-7 Residential Single Family zone does not specifically list the proposed use as being either permitted or permitted conditionally, Section 17.10.040(R) PANIC provides that"Other uses compatible with the Chapter" may be approved through the conditional use permit process. Conditional uses that are identified as being permittable in the RS-7 zone include bed and breakfast uses, assisted living facilities, residential care facilities, and child day care. The proposed use differs from bed and breakfast use in that all meals and transportation are included during a visit while only one meal and snacks are provided as a bed and breakfast use, and guest occupancy would not be subordinate to the primary single family residential use of the.structure, which is required in bed and breakfast occupancies. All stays are scheduled in advance with no drop ins. 8. Section 17.96.050(A) of the Port Angeles Municipal Code provides that "The Planning Commission shall consider applications for conditional use permits for uses specified in the applicable Chapter-of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, are consistent with the Comprehensive Plan, and not contrary to the public use and interest. The Planning Commission may refuse to issue a conditional use permit if the characteristics of the intended use as related to the specific proposed site are such as would defeat the purpose of these Zoning Regulations by introducing incompatible, detrimental, or hazardous conditions. Section 17.96.050 (B)PANIC reads Conditional UsePermit- CUP 11-02 Page 7 October 26;2011 "In each application, the Planning C077777iSS7'on may impose i.vhatever restrictions or conditions they consider essential to protect the public health, safety, and welfare, and to prevent depreciation ofneighboringpropert);. " 9. The Planning Commission's decision is final unless appealed to the City Council. Appeals of decisions of the Planning Commission in Conditional Use Permit actions are provided per Section 17.96.070(A) PAMC. 10. The proposed site is situated in the City's Central Planning Area and is served by all municipal emergency services. Reviewing City departments had no concerns regarding the proposed activity. Occupancy as proposed will be per Building and Fire Code requirements for such a use. 1 l. The site is within a well established, single family neighborhood comprised of single family residences mixed with a number of social and educational uses. The area is commonly referred to as "Cherry Hill"and is identified by the location of the Queen of Angels Church and convent/elementary school (two blocks immediately north of the property), St. Matthew's Lutheran Church and daycare, and Jefferson Elementary School (three blocks east of the site). Peninsula Mental Health operates an assisted residence adjacent to the site across the 1.1/12 Alley. The City's main fire hall is located seven blocks immediately north of the site. 12. The proposed structure is located on two Townsite lots developed as a five bedroom residential structure. As a bed and breakfast use, site development provides off-street parking for at 12 vehicles. Two residential vans and parkinzn g for employees can easily be provided in the screened parking area. As proposed,the use will need 5 off street parking stalls. 13. The Port Angeles Comprehensive Plan was reviewed it in its entirety in analysis of this application. The goals, policies, and objectives listed in Attachment B to this staff report were found to be the most applicable to the proposed use. 14. Public notification was mailed to property owners within 300 feet of the subject site and posted on the property on October 6, 2011. Notification was placed in the Peninsula Dailv Neivs on October 10, 2011, with written comment accepted by October 25, 2011. No written comments were received during the written public comment period. 15. A Determination of NonSignificance was issued for the proposed action on October 25, 2011, per WAC 197-11-3». This action satisfies the City's responsibility under the Washington State Environmental Policy Act(SEPA). Conclusions.- Based onclusions:Based on the information provided in the Department of Community Development Staff Report for CUP 11-02, including all of the information in the public record file, comments, and testimony presented during the public hearing,the Planning Commission's discussion and deliberation, and the above listed conditions of approval and listed findings, the City of Port Angeles Planning Commission hereby concludes that: A. B. The structure will continue to be maintained in the existing residential manner that will not include commercial signage or an excess of vehicles. The site is heavily landscaped and provides screening of on site activities to the general neighborhood. The proposed use is not out of character with other uses that are conditionally permitted in the RS-7 zone. As conditioned, the maximum degree of compatibility between uses in the neighborhood is ensured, and the use is in therefore in compliance with Section 17.96.050 PANIC. C. The conditional use permit was processed in accordance with Section 17.96 PAMC. Appeal of the Planning Commission's decision is final unless appealed to the City Council. D. CONDITIONAL USE PERMIT EXTENSION REQUEST— CUP 11-02 SCHULTZ—"Captain Joseph House" - 1108 South Oak Street: Request to EXTEND a conditional use permit approval that allows the conversion of a single family residence to establish a short term respite care use serving families of fallen service personnel. The site is located in the RS-7 Residential Single Family zone. Planning Manager Sue Roberds presented the Department Report recommending extension of the conditional use permit as requested. Ms. Betsy Schultz thanked Commissioners for their consideration of the extension request and . stated that she had finally obtained the necessary 501(c)(3) certification needed to operate the use as proposed. She can now begin to address financial hurdles of operation. She has reserved the Queen of Angeles gymnasium in order to conduct a neighborhood outreach informing neighbors more formally of her plans for operation of the use and to allow the neighbors to review changes planned for the site. A soft opening is planned for Memorial Day 2013. Funding is from non profit agencies and will be an ongoing endeavor. In response to Commissioner Morris, she indicated that on site parking is available for two vans and employee vehicles. Use of the site as is proposed should not negatively impact neighborhood parking opportunities and should in fact be less impactive than the previous bed and breakfast because visitors will not arrive in their own vehicles but will be transported by van to the site. Ms. Schultz indicated that, in the future, if changes are planned, she will communicate that possibility to the City staff and, if necessary, would seek to amend the conditional use permit. Section 17.96.070(E) PAMC reads "Extensions of approved conditional use permits shall be considered in accordance with the same procedures as for the original permit application, and may be granted for a period of one to five years, provided that the following minimum criteria are met: 1. The use complies with the permit conditions. 2. There have been no significant, adverse changes in circumstances. Upon written request for an extension submitted to the Department of Community and Economic Development prior to the expiration of the conditional use permit, said conditional use permit shall be automatically extended for 90 days to allow the City adequate time to review the extension request." 4. An extension request was received by the applicant on September 28, 2012. The request was considered to be complete on October 4, 2012. Documentation was submitted with the request indicating steps the applicant has taken over the past year to obtain legal status to conduct the proposed activity and that additional time is needed to complete those steps prior to operation. Chair Reiss read the qualifying questions for Commissioners regarding Appearance of Fairness matters. All Commissioners responded for the record that they had no Appearance of Fairness issues to report. The Chair then reviewed the quasi judicial public hearing procedures for audience members. No issues of concern were noted. Planning Manager Site Roberds reviewed the Department Report recommending approval of the conditional use permit with conditions. Chair Reiss opened the public hearing. Betsy Schultz, 1108 South Oak Street, provided additional background on the intended use and explained how the respite use would be funded and operated. One (1) to three (3) families will be served at a time. The structure will appear to function as a residential home or similarly to a bed and breakfast use and will continue to contribute to the established neighborhood environment in a positive manner. Bill Hannan, 101 Texas Valley Road, Sequim is employed by Peninsula Community Mental Health and spoke in approval of the conditional use permit. As a Vietnam veteran, he wished such facilities had been available to his era of service personnel. He asked that the permit be approved as recommended by staff. There being no further testimony, Chair Reiss closed the public hearing. Commissioner Boyle moved to approve the conditional use permit with the following conditions supported by the following findings and conclusions: Conditions: 1. The conditional use permit is approved for an initial one year period for Betsy Schultz to operate a non profit residential respite use (the Captain Joseph House) in the RS-7 Residential Zone at 1108 South Oak Street (Lots 1 and 2, Block 345, TPA) per application identified as Conditional Use Permit CUP 11-02. Any change in the operation of the residence from that described in the application shall require prior review by the Planning Commission or this approval shall be deemed invalidated. 2. The residential structure will be occupied by either the property owner or a caretaker when guests are present, and occupancy will be per Building and Fire Code standards for the use. 3. The residence will continue to be maintained in the current manner such that it complements other residences in the neighborhood in appearance and character. The off street parking area at the north portion of the residence will remain available for residential and employee parking and landscape screening shall be maintained around the off-street parking area as well as the significant residential site landscaping that currently exists to be in concert with other established neighborhood residences. Planning Commission Minutes October 26,2011 Page 3 Findings: Based on the information provided in the Community Development Staff Report for CUP 11-02 dated October 26, 2011, including all information in the public record file, comments and testimony presented during the public hearing, the Planning Commission discussion and deliberation, and the above listed conditions of approval, the City of Port Angeles Planning Commission hereby finds that: 1. On October 4, 2011, Betsy Schultz applied to the City of Port Angeles Department of Community & Economic Development (DCED) to allow her single family residence to be converted to a home where families of fallen service personnel are afforded a short hospitality stay. The residence has supported a bed and breakfast use since 1983. 2. The site location is 1108 South Oak Street in the City's RS-7 Residential Single Family zone. Ms. Schultz owns the subject property that would become a non profit trust ownership as proposed. 3. The 4993 square foot residence can provide lodging for up to 16 people, however, it would not be usual for full occupancy to occur. Three (3) to 6 personnel would work in shifts as caretakers in the residence at all times with only 1 caretaker employee working on site at any one time. 4. Door to door transportation will be provided from the Airport. Guests will not arrive in personal vehicles. Transport during visits will be by van. Only employee vehicles and two activity vans will be parked on location. 5. Operational hours will be from Sunday afternoon until Friday afternoon. The property owner or a caretaker will be on site when visitors are not on location. 6. Section 17.10.010 of the Port Angeles Municipal Code describes the RS-7 Residential Single Family zone as a "...low density residential zone intended to create and preserve urban single family residential neighborhoods consisting ofpredominantly single family homes on standard Townsite sized lots. Uses which are compatible with and functionally related to a single family residential environment may also be located in this zone. " 7. A Conditional Use Permit is defined in Section 17.08.020(G) of the Port Angeles Municipal Code as "... a limited permission to locate a particular use at a particular location, and which limited permission is required to modify the controls stipulated by these Regulations in such degree as to assure that the particular use shall not prove detrimental to surrounding properties, shall not be in conflict with the Comprehensive Plan, and shall not be contrary to the public interest. " Section 17.08.020(H) PANIC defines a Conditional Use as "... a use permitted in a zone but which requires a special degree of control to make such use consistent and compatible with other existing or permissible uses in the same zone. " The purpose of a Conditional Use Permit is further defined in Section 17.96.050 PANIC as "... to assure that the maximum degree of compatibility between uses shall be attained. The purpose of these regulations shall be maintained with respect to the particular use of the particular site and in consideration of other existing and potential uses within the general area in which such use is to be located. " 8. While the RS-7 Residential Single Family zone does not specifically list the proposed use as being either permitted or permitted conditionally, Section 17.10.040(R) PANIC Planning Commission Minutes October 26,2011 Page 4 provides that "Other uses compatible with the Chapter" may be approved through the conditional use permit process. Conditional uses that are identified as being permittable in the RS-7 zone include bed and breakfast uses, assisted living facilities, residential care facilities, and child day care. The proposed use differs from bed and breakfast use in that all meals and transportation are included during a visit while only one meal and snacks are provided as a bed and breakfast use, and guest occupancy would not be subordinate to the primary single family residential use of the structure, which is required in bed and breakfast occupancies. All stays are scheduled in advance with no drop ins. 9. Section 17.96.050(A) of the Port Angeles Municipal Code provides that "The Planning Commission shall consider applications for conditional use permits for uses specified in the applicable Chapter of the Zoning Regulations. The Planning Commission may grant said permits which are consistent and compatible with the purpose of the zone in which the use is located, are consistent with the Comprehensive Plan, and not contrary to the public use and interest. The area is commonly referred to as "Cherry Hill" and is identified by the location of the Queen of Angels Church and convent/elementary school (two blocks immediately north of the property), St. Matthew's Lutheran Church and daycare, and Jefferson Elementary School (three blocks east of the site). Peninsula Mental Health operates an assisted residence adjacent to the site across the 11/12 Alley. The City's main fire hall is located seven blocks immediately north of the site. 13. The proposed structure is located on two Townsite lots developed as a five bedroom residential structure. As a bed and breakfast use, site development provides off-street parking for at 12 vehicles. Two residential vans and parking for employees can easily be provided in the screened parking area. As proposed, the use will need 5 off street parking stalls. 14. The Port Angeles Comprehensive Plan was reviewed it in its entirety in analysis of this application. The 4993 square foot single family residence can support a maximum of 16 people although it is unlikely that full occupancy will occur on a regular basis. The residence will be occupied by either the property owner or a caretaker on a full time basis with additional personnel who will work in shifts, one attendant at all times, when guests are in residence. The activity will provide door to door service to grieving family members who will be picked up and transported back to the airport for departure following their stay. A van with a driver will be used for transportation purposes during visits. Only employees and two residential vans will be parked on-site. Visitors will arrive on Sunday afternoon and leave on Friday afternoon. NEIGHBORHOOD CHARACTERISTICS: The subject site is situated in the City's Central Planning Area. The site address is 1108 South Oak Street. The neighborhood is a well-established, completely developed single family neighborhood that supports a variety of community support uses. The neighborhood is known as "Cherry Hill"and includes the well established Queen of Angels Church and convent/school located two blocks immediately north of the subject site. Jefferson Elementary School is located three blocks east of the site at the corner of 13°i and Lincoln Streets. PUBLIC COMMENT: Public notification of the proposed action was mailed to property owners within 300 feet of the subject site and posted on the property on October 6, 2011. Notification was placed in the Peninsula Daily News on October 10, 2011, with written comment accepted by October 25, 2011. No written comments have been received. CITY DEPARTMENT REVIEW: The City's Public Works and Utilities Department reviewed the proposal but did not have comments. . The Fire Department had no objections but will require that, if the residence does not already have smoke detectors located in all sleeping rooms with at least one per floor level, and a 2AlOBC fire extinguisher mounted on each floor level, that such shall be installed prior to the proposed occupancy. Guests will be provided a supportive, hospitality atmosphere that is less active than would be typical of a resort or hotel environment. Guests are seeking a quiet, residential, atmosphere where they are not bombarded with commercial activities, and where they will be able to relax in an anonymously for a short while. The use differs from a residential care facility where residents are sometimes infirmed, and because of the short term nature of the visits, but the use is similarly supportive with less impact specially and operationally than such a use which is conditionally permitted in the RS-7 zone. The overall character of the neighborhood will not be impacted by the use. The site is comprised of two Townsite lots that extend from l lt" Street to the 11/12 Alley, west of Oak Street. The well recognized residence will continue to be superbly maintained adding to the ambiance of the neighborhood. Signage will consist of a small (maximum 10 sq.ft.) site identification placard. No commercial signage is permitted in residential zones. A van and driver will be provided for transportation purposes while visiting. While there are likely a variety of retreat uses in the country, the use as proposed, serving the families of fallen service personnel, may be the first of its kind in the United States and will likely be a model for those to follow. She, or a caretaker will be responsible to ensure that residential occupancy of the structure is maintained between guest visits. Each of the following conclusions listed below must be made and supported by facts stated as findings: 1. That such variance is necessary, because of special circumstances relating to the size, shape, topography, location, or surroundings of the subject property, to provide it with use rights and privileges permitted to other properties in the vicinity and zone in which the subjectproperty is located. 2. The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the property on behalf of which the application was filed is located. 3. That the granting of such variance shall not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the subject property is situated.
