Boxl491 Port Angeles, W A 98362 RE: retaining wall at 519 East Park Ave Dear Larry: This letter is in regards to your request to construct a retaining wall within the Vashon / Park Street alley north of 519 East Park Ave. As you are aware, there is a sanitary sewer main in the center of the unimproved 20' (foot) platted alley. Upon review of the site, it appears that 0\ a retaining wall could be constructed no closer than within 5' ofthe sanitary sewer main -- without limiting the City access to the sewer main. ~ You have indicated that the alley is vacated by statute and as such is reflected in your title lI'l search. If the alley were to be formally vacated through quit title'action or by City council action, the <;:ity would require an easement for maintenance of the existing utility. It is our position that the presence of the existing utility allows the city to access and maintain the -- sanitary sewer. f\'" ,. Upon review ofthe site, it appears that a retaining wall could be constructed no closer than within 5' of the sanitary sewer main without limiting the City access to the sewer main. You have indicated that the alley is vacated by statute and as such is reflected in your title search. Ifthe alley were to be formally vacated through quit title'action or by City council action, the <;:ity would require an easement for maintenance of the existing utility, It is our position that the presence of the existing utility allows the city to access and maintain the sanitary sewer.
