During the "Public Comment"portion of the meeting,individuals may speak to agenda items,except those scheduled for a Public Hearing. The City Council desires to allow the opportunity for Public Comment.However,the business of the City must proceed in an orderly, timely manner. At any time,the presiding officer,in the presiding officer's sole discretion,may set such reasonable limits as are necessary to prevent disruption of other necessary business. At its most restrictive,Public Comment shall be limited to a total of 15 minutes for the first Public Comment period and shall be concluded not later than 9:45 for the second Public Comment period. Individuals may speak for three(3)minutes or less,depending on the number of people wishing to speak. If more than 20 people are signed up to speak each speaker may be allocated two(2)minutes. Individuals who are residents of the City or own businesses within the City will be called to speak first,with preference given to those who wish to speak to an item on the meeting's agenda.If time remains,the presiding officer will call other individuals wishing to speak,generally in the order in which they have signed.If time is available,the presiding officer may call for additional unsigned speakers. City Council may set a public hearing in order to receive public input prior to making decisions which impact citizens.Certain matters may be controversial and City Council may choose to seek public opinion through the public hearing process. September 15,2020 Port Angeles City Council Meeting Page 2 OF PO���R�TgNCF r / a PROCLAMATION In Recognition of Constitution Week September 17-23, 2020 WHEREAS, on September 17, 1787, the Constitution of the United States of America was signed, and WHEREAS, our forefathers upheld a belief that remains at the heart of America today, that men and women of free will have the capacity to shape their own destinies, and WHEREAS, this Constitution enshrines our enduring faith in the notion that being a citizen is not about circumstances of birth, but that we are bound together by our beliefs, our unalienable rights, and the idea that we must accept certain obligations to one another and to future generations, and WHEREAS, the Constitution,together with its amendments, is the supreme law of our land where we see a reflection of our Founding Fathers' insistence that the task of perfecting our Union is never finished and that we must constantly take up the critical work of bettering ourselves and our society. NOW, THEREFORE, I Kate Dexter, Mayor, ON BEHALF OF THE CITY COUNCIL OF PORT ANGELES, do hereby proclaim the week of September 17th through the 23rd, as CONSTITUTION WEEK. With time, courage, and the participation of our citizenry, we can pay tribute to those who shaped the land we love today while working to secure everlasting peace, prosperity, and opportunity for all who call the United States of America home. 71, Doxloi f':?rti p k ,r11IO I,'Ad ��..1..., September 14, 2020 Kate Dexter, Mayor CITY COUNCIL MEETING Port Angeles, Washington September 1, 2020 CALL TO ORDER-REGULAR MEETING Mayor Dexter called the regular meeting of the Port Angeles City Council to order at 6:00 p.m. ROLL CALL Members Present: Mayor Dexter, Deputy Mayor Carr, Council members French, Meyer, McCaughan, Schromen- Wawrin and Suggs(joined the meeting at 6:11 p.m.). Members Absent: None Staff Present: City Manager West,Attorney Bloor,Clerk Martinez-Bailey,C.Delikat,K.Dubuc,B. Smith, A.Brekke,T.Hunter,and S. Carrizosa. PLEDGE OF ALLEGIANCE Mayor Dexter led the Pledge of Allegiance to the Flag. PUBLIC COMMENT Therese Stokan, Neah Bay resident, spoke about an incident she witnessed involving an individual and the Port Angeles Police Department. Susan Hillgren,residing outside City limits,spoke about the needs of the local homeless community. Patty Pastore,city resident,spoke about a local volunteer cleanup group and past public comments. Pam Blakely, on a pre-recorded line, city resident, spoke in opposition of making changes to the Public Safety Advisory Committee. Michael Carter, on a pre-recorded line, city resident, spoke in opposition of making changes to the Public Safety Advisory Committee. September 15, 2020 E - 1 PORT ANGELES CITY COUNCIL MEETING— September 1, 2020 Carolyn Wilcox,on a pre-recorded line,city resident,spoke in favor of making changes to the Public Safety Advisory Committee code. Susan Rodman, on a pre-recorded line, city resident, spoke in opposition of making changes to the Public Safety Advisory Committee. Matt Rosener, on a pre-recorded line, city resident, spoke about a conversation with Police Chief Brian Smith and about the need for a diverse Public Safety Advisory Board. LATE ITEMS TO BE PLACED ON THIS OR FUTURE AGENDAS City Manager Nathan West added Stage 2 Water Declaration as item L-2 on Information. CONSENT AGENDA By consensus of the Council,Mayor Dexter moved item J-1 to the Consent Agenda. It was moved by Meyer and seconded by French to approve the Consent Agenda to include: 1. City Council Minutes of August 18,2020/Approve 2. Expenditure Report:From August 8, 2020 to August 21, 2020 in the amount of$863,429.16/Approve 3. Regional Law Enforcement Training Facility Expenditure l Approve the City Manager to authorize the expenditure for an automated target system in the amount not to exceed$33,184 with Action Target and to make minor modifications as necessary. 4. 2020 Cultural Resource Services,Professional Services Agreement PSA-2020-23/Approve and authorize the City Manager to sign the Professional Services Agreement with Cardno Inc.,for a maximum amount not to exceed$63,302, and to make minor modifications to the contract, if necessary. 5. ADA Transition Plan Professional Services Agreement PSA-2020-50/Approve and award a Professional Services Agreement to Transpo Group Inc.for the ADA Transition Plan in the not to exceed amount of $97,497.15 and authorize the City Manager to sign a contract with Transpo Group and to make minor modifications as necessary. 6. Ranney Well and Support Building Re-Roof,Project No.WT-01-18 Final Acceptance/Accept the Ranney Well and Support Building Re-Roof Project No. WT-01-18 as complete, and authorize staff to proceed with project closeout, and release the 5% retainage in the amount of$2,775.00 upon receipt of all required clearances. 7. Computer Aided Dispatch(CAD) Upgrade and Nutanix Expenditure l Authorize the City Manager to sign an agreement with Nutanix for CAD physical server, hardware and license needs in an amount not to exceed $240,000 and to make minor modifications as needed. The Mayor asked if there was unanimous consent,hearing no opposition,the motion carried 7-0. ORDINANCES NOT REQUIRING COUNCIL PUBLIC HEARINGS 1. Public Safety Advisory Board Ordinance Council member Schromen-Wawrin stated he would be recusing himself from discussion of the agenda item and left the virtual meeting. City Manager Nathan West introduced the proposed ordinance and spoke about the development which included Council's request to increase Tribal representation from one,to two members. City Attorney William Bloor spoke about the process of selection of Tribal representatives and offered selection of alternatives for discussion on the process for recruitment and appointment. Council discussion followed. Mayor Dexter conducted a first reading of the ordinance by title,entitled, ORDINANCE NO. AN ORDINANCE of the City of Port Angeles,Washington amending the Public Safety Advisory Board Chapter 2.26 of the Port Angeles Municipal Code. Page 2 of 4 September 15, 2020 E - 2 PORT ANGELES CITY COUNCIL MEETING— September 1, 2020 Council discussion followed. By consensus,the Council agreed to add the language"Any enrolled member in good standing of a legally recognized tribe may be appointed to the Board.For seats to be filled by enrolled tribal members, City Council shall consult with the Lower Elwha Tribal Council"to section 2.26.030. The Mayor continued the matter to the September 15 meeting. The Mayor recessed the meeting for a break at 7:31 p.m. The meeting reconvened at 7:36 p.m. Council member Schromen-Wawrin returned to the virtual meeting after the break. OTHER CONSIDERATIONS 1. Port Angeles Municipal Code Update—Initial Meeting with Madrona&MAKERS Manager West introduced the agenda item and shared that those in attendance were there to talk about the process and receive input from Council on the Municipal code audit work.Attorney Bloor introduced Ann Marie Soto and Rachel Turpin of Madrona Law Group who conducted an audit kick-off presentation and explained an overview of the process. Bob Bengord and Scott Bonjukian from Makers Architecture shared a presentation on their role in the code audit process relative to zoning.Madrona Law Group went over a list of previously provided Council priorities. These items included matters Council hoped to cover during the code audit process. Council discussion followed. The Mayor recessed the meeting for a break at 9:14 p.m.The meeting reconvened at 9:19 p.m. ORDINANCES NOT REQUIRING COUNCIL PUBLIC HEARINGS CONTINUED 1. Adjust Plat Alterations and Vacations Director of Community and Economic Development Allyson Brekke provided background on the agenda item and shared the proposed ordinance creates procedures for vacating plats. Mayor Dexter conducted a first reading of the ordinance by title,entitled, ORDINANCE NO. AN ORDINANCE of the City of Port Angeles,Washington amending Hearing Examiner Chapter 2.18 of the Port Angeles Municipal Code. The Mayor continued the matter to the September 15 meeting. CITY COUNCIL REPORTS Council member Meyer spoke about a recent Clallam Transit System meeting and spoke about a visit to the Port Angeles Farmers Market. Council member McCaughan spoke about meetings he had attended and shared he would be absent at the September 15 meeting and thanked Port Angeles volunteers for their work. Council member Suggs spoke about her attendance at AWC budget meetings, spoke about upcoming trainings she would be attending,and spoke about the new Shore Aquatic Center and various other meetings she attended. Council member Schromen-Wawrin spoke about reasons he recused himself from the Public Safety Advisory Board discussion and spoke about racial and ethnicity issues relative to our State and across the nation. Council member French shared he appreciated Council attendance, spoke about a recent Homelessness Task Force and Chamber of Commerce Meetings. Page 3 of 4 September 15, 2020 E - 3 PORT ANGELES CITY COUNCIL MEETING— September 1, 2020 Mayor Dexter made a motion to extend the meeting to 10:10 p.m. It moved by French and seconded by McCaughan to: Extend the meeting to 10:10 p.m. The Mayor asked if there was unanimous consent,hearing no opposition,the motion carried 7-0. Deputy Mayor Carr spoke about a Broadband subcommittee meeting and spoke about community broadband needs. Mayor Dexter spoke about the school year, thanked the City Boards, Commissions, and Committee volunteers and spoke about a recent event in her neighborhood. No other reports were given. INFORMATION Manager West spoke regarding the reports included in the packet and spoke about the Stage 2 Water Shortage Declaration,reminded Council of an upcoming work session, and an October 13,2020 Jurassic Parliament training. Chief Smith provided a brief update on code compliance SECOND PUBLIC COMMENT There was no public comment received. At the meeting, Council identified changes to be made. Those changes now have been incorporated into the ordinance language. In addition,to promote clarity, the changes are now presented in two ordinances, one for the changes to Title 2, and a separate ordinance for the addition to Title 16. Funding: The proposed amendments were produced by staff with no additional cost beyond staff time. Recommendation: 1) Conduct the second reading and 2) adopt the attached two ordinances. Background/Analysis: RCW 58.17.212 and 215 specify the criteria and procedures for plat vacations and alterations respectively. The Port Angeles Municipal Code does not currently contain any provisions regarding vacations and alterations. One ordinance here proposed would add a new chapter to the end of Title 16 titled"Plat Vacations and Alterations." The proposed amendments differentiate the process for plat alterations versus vacations consistent with RCW 58.17. In addition to establishing criteria and procedures for vacations and alterations, the ordinance differentiates plat alterations into two categories, minor or major. Major alterations are designated based on criteria reflecting the effects of the changes on approved land uses, density, traffic, open space, environmental impacts, or substantial changes to required mitigation or improvements. Major alterations are also characterized when a person receiving notice requests a public hearing. State law requires that all plat vacations have a public hearing. A public hearing for plat alterations may or may not be required, depending on the circumstances of the individual application. Since Port Angeles has adopted the hearing examiner system,all required public hearings are directed to the hearing examiner. This is accomplished in the second ordinance. It amends Chapter 2.18 PANIC to add authority for the hearing examiner to hear and decide applications for plat vacations and major plat alterations. Additionally, the ordinance amends PANIC 2.18.065, which defines the authorizations of the Director of Community and Economic Development,to include approval of minor plat alterations.Both processes would require public notice before action is taken on an application. There are a few scrivener error corrections that staff proposes to the terminology used in PANIC 2.18.060(A)(3) and 2.18.065(A)(4)that reflect appropriate terms for short subdivision plats and binding site plans. Lastly, there is a change to PANIC 2.18.060(B) to ensure the appeal procedure of the Hearing Examiner reflects RCW 36.70 requirement of 21 days. Any person may submit for city review and approval an application to vacate a subdivision or short subdivision plat, or portion thereof, or any area designated for public use. B. The application shall include, at the minimum, the following; 1. The application shall state the reasons for the proposed vacation and shall contain the signatures of all parties that have an ownership interest in the portion of the subdivision to be vacated; 2. If the proposed vacation would affect any covenants or would alter the terms and conditions of plat approval, an agreement signed by all parties shall be submitted documenting agreement to the proposed termination or alteration of the covenants and conditions of approval, 3. A statement of facts demonstrating that the proposed vacation will not adversely affect the public health or safety, and is in the public interest; 4. A statement of facts demonstrating that the proposed vacation will comply with the provisions of state law, including but not limited to RCW 35.79.030, 35.79.035, and 36.87.130, and with PAMC 17.94.050; and 5. The application must in all respects comply with the requirements of Chapter 58.17 RCW. C. When the vacation application is specifically for a city street, the procedures for street vacation in RCW 35.79 will be used. When the aplication is for the vacation of the plat together with streets, the procedure for vacation in this chapter will be used, but vacations of streets may not be made that are prohibited under RCW 35.79.030. D. Except as provided in this Chapter, Applications for plat vacations shall be processed as provided in RCW 5.8.17.212. September 15, 2020 G - 6 16.14.020 Plat Alterations A. Any person may submit for city review and approval an application to alter a subdivision or short subdivision plat, or portion thereof, or any area designated for public use. B. Alterations shall be classified as major or minor. 1. Proposed alterations shall be considered major if the alteration would result in: i. A change of the approved land use(s), ii. An increase in the number of dwelling units, nits, iii.A change in the location or design of approved streets, driveways, or parking areas that affects traffic flows, iv.A reduction in the approved parks or open space, v. Any change that requires a new or supplemental environmental assessment; vi.Substantive changes to required mitigation measures or proposed improvements,or vii. a public hearing is requested pursuant to RCW58.17.215. 2. A proposed alteration that is not described in subsection 2 immediately above shall be considered a minor alteration. C. The application shall include, at the minimum, the following 1. The aplication shall state the reasons for the proposed alteration and shall contain the signatures of a majority of parties that have an ownership interest in the portion of the subdivision to be altered, 2. If the proposed alteration would affect any covenants or would alter the terms and conditions of plat approval, an agreement signed by all parties shall be submitted documentin& agreement to the proposed termination or alteration of the covenants and conditions of approval, and 3. A statement of facts demonstrating that the proposed alteration will not adversely affect the public health or safety, and is in the public interest. D. Process for Plat Alterations Major alterations shall be heard, considered, and determined by the Hearing Examiner, in accordance with the provisions of Section 2.18.060. Minor alterations shall be considered and determined by the Director of Community and Economic Development, in accordance with the provisions of Section 2.18.065. E. Except as provided in this Chapter, applications for alterations shall be processed as provided in RCW 58,17,215. 16.14.030. The city may approve an alteration or vacation of a subdivision or short subdivision plat, based on a finding that the proposal: 1. Complies with the provisions of this title; 2. Is in the public interest; and 3. Does not adversely affect the public health, safety, and welfare. A first reading of the amended ordinance was conducted on September 1, 2020, and several minor modifications were suggested. The modified ordinance is attached. Funding: N/A: Recommendation: 1.) Conduct a second reading of the ordinance amending Chapter 2.26 of the Port Angeles Municipal Code relating to the Public Safety Advisory Board 2.) Adopt the ordinance as read. Background / Analysis: On August 4, 2020 City Council held a discussion regarding the Public Safety Advisory Board. During the meeting details, the board make up and history were presented by City staff. Following staff presentations and Council discussion, a motion was passed by Council with a vote of 6 in favor and 1 opposed to instruct staff to prepare an ordinance to: • Add two positions to the Public Safety Advisory Board for an enrolled Tribal member • Add a position to the Public Safety Advisory Board for a resident who has experienced homelessness or a chemical use disorder, or someone who has worked with people that have experienced homelessness or a chemical use disorder • Codify the process for appointing future Public Safety Advisory Board members, including potential term limits • Require future Public Safety Advisory Board voting members not be City employees • Require that future Public Safety Advisory Board terms be staggered As follow through to that motion, staff has proposed amendments to Ordinance 2724 and Chapter 2.26 of the PAMC. Smith,Police Chief Ken Dubuc,Fire Chief Subject: 911 Center/EOC/Westside Fire Station Project Update Summary: This is an ongoing project from the 2019-2021 Strategic Plan — the potential development of a combined Emergency Operations Center (EOC), 9-1-1 dispatch center and westside fire station. Funding: The City and County will have both expended$48,500 at the completion of this stage of the project for pre-engineering design. Additional funding details relative to the Council approved Capital Facilities Plan are noted in the Funding section below. Recommendation: Presentation. No action requested at this time. Project Overview: The Police Department (PenCom), the Fire Department and the Clallam County Sheriff (Division of Emergency Management) are working together to develop a proposed combination EOC, 9-1-1 dispatch center (PenCom) and westside fire station. We are in the final stages of completing pre-design work with a contract engineering firm (OAC Services). Forward progress on the project has been directed through action of City Council and the County Commission. The City and County issued a joint RFQ in November of 2019 for pre-design work. OAC was selected as the most qualified respondent and Council approved a contract with OAC on February 18, 2020,to move forward with due diligence. OAC was tasked to determine the suitability and projected costs for a long-term lease of a Port of Port Angeles building located at the Fairchild Airport. The project has been somewhat delayed due to COVID 19. The purpose of this pre-design review is to determine if the Port 1010 building or a similar location would be suitable for this joint facility and to estimate the projected long-term costs. The Port of Port Angeles originally offered 15,000 square feet of the 1010 building on a 50-year lease with options to renew beyond 50 years. City and County staff had reviewed other alternatives and determined that a location at or near the airport met the requirements of Fire,Police(PenCom) and Clallam County. Current locations for the County EOC and PenCom are not suitable and have been determined to be not survivable in an expected earthquake. The Fire Department has a known response time gap on the west side of Port Angeles and has had a long-term CFP project to place an engine, medic unit and two personnel on the west side in a satellite station. Response times directly impact the cost of housing since residences outside of adequate response times require fire sprinkler systems and are subject to higher insurance rates. It was determined that sharing these three functions in one site could create opportunities for grants and create an September 15, 2020 1 - 1 economy of scale that could make the project affordable. As requested by Council, detailed financial evaluations are also being prepared, including details on operating and maintenance cost expectations. OAC engineers were asked to determine if this building would be suitable to meet the requirements for an emergency operations center, 911 center and westside fire station. Requirements include meeting earthquake standards, National Fire Protection Association standards and FEMA standards for these facilities. The OAC study has determined that the 1010 Building (also inside the William Fairchild Airport campus) is not a suitable location for this project. Major structural requirements would be needed, there is insufficient space for all three functions (EOC/911 and Fire), costs to retrofit are greater than new construction and there is poor access for emergency vehicles. If the location is to be utilized and meet FEMA and NFPA standards, the most suitable alternative is the complete demolition of the 1010 building. A nearby Port-owned property located at 19'h and O Street has been determined by OAC in their pre-engineering design study to be a highly suitable location for the joint facility. This location is inside the Port of Port Angeles property at the William Fairchild Airport. It has water, sewer, electric and other improvements to the site. It is part of the existing Airport stormwater infrastructure It has parking and improved road access. It has been determined by the OAC engineer to need only "pro-forma" site preparation to be usable. This location has an existing pad from a previous building, has adequate existing space for the proposed design, has excellent access to public roads and the Airport, has no known environmental impairments and will require minimal permitting. The additional stormwater compliance cost is estimated to be $40,000. The Port has offered this property at 5 cents per square foot and a 50-year lease. The total lease cost is approximately $35,000 per year. After receiving the OAC final report, staff will be completing a comparison and cost analysis on an undeveloped City-owned property that is near the 191h and O Street location. What is known about this location is that it will require substantial improvements to be brought up to a condition comparable the 19'h and O Street location. A NPDES permit, a 15% engineer's study, the design and approval plan to bring water/sewer and electric to the site (and bringing water/sewer/electric to the site), stormwater compliance to include a stormwater overflow pond and water quality mitigation and additional to be determined measures and regulatory compliance will be required to make this City owned property usable for this project. What we know right now is that there will be significant additional costs and additional time needed for site preparation and regulatory compliance . We believe the additional time needed would range between 1 to 2 years. Staff has not yet completed a full cost analysis on what it will take to bring the location up to usable status comparable to what exists at the 19'h and O Street location right now. Funding: City Council has approved the 2021-2026 Capital Facilities Plan which includes project FD0219 for the EOC/911Dispatch/Westside Fire Station buildings. The total project cost is estimated at$8.0 million. The 2020 Budget includes $97,000 for the Engineer contracted to assist the City and the County in determining the best location for this building,which is the City's share September 15, 2020 1 - 2 of this expense. The City expenditure is $48,500 with additional $48,500 paid for by Clallam County. The remaining $7.9 million City share of the project is currently unfunded. Total project cost of$12.2 million would be shared by the City's PenCom, General Fund and Medic 1 funds and Clallam County. The City and County intend to seek multiple grant opportunities to assist with the funding of this project. Undersheriff Cameron reports that Clallam County has recently submitted a significant grant pre-application. Regardless, a portion of the PenCom capital funding held at the County for such purposes is also intended for use on this project. Clallam County has proposed a 2021 County appropriation and additional County appropriations made possible by federal and state grant funds. Clallam County has also proposed a project schedule and alternative pro]ect schedules, should the pro]ect be approved by the County Commission and City Council. Based on current CFP allocations City participation will be dependent on successful grant funding. Background / Analysis: Seven substations distribute power throughout the City. Five of these substations are nearing or at the end of their life. Based on age and critical to electrical reliability and periodic inspection results, the F Street Substation was identified as the substation in most need of immediate replacement. F Street Substation was shut down for inspection. As a result of the inspection,it was determined the current bus structure and switchgear housing is in very good condition and the upgrade scope will be limited to the breaker replacement,with enhanced safety features. On January 21,2020, City Council approved a similar switchgear upgrade for the Laurel Street Substation. That upgrade has experienced manufacturing interruptions and product delivery delays due to COVID-19. The project is now on track for equipment delivery and install in early 2021. Background / Analysis: The PAWTP uses filtration and disinfection to treat potable water. Disinfection is achieved by the addition of sodium hypochlorite which can either be purchased in a concentrated solution or generated onsite using a salt brine solution and electrolysis. Onsite generation is less expensive, safer for operations, and allows for a large storage capacity. The original Sodium Hypochlorite Generation System installed in 2012 has failed. This system is oversized,requires acid cleaning of the electrolyzer cell,is expensive to maintain,requires costly cell replacements and lacks local product support. A new modular system with inexpensive, easy to replace, electrolyzer cells was specified for the replacement. The new system has Puget Sound area service representatives and is appropriately sized. Notice of the bid opportunity was advertised through the MRSC on August 21, 2020 and posted to the City website. One bid was received on September 3,2020.
