Leased premises. The premises shall be used for the operation of an espresso business selling coffee drinks,fruit drinks,cookies,muffins,and related food items and for no other purpose without the prior written consent of lessor. The conduct and appearance of lessee and all employees shall be conducive to the operation of a family business and lessor shall, in its sole discretion, notify lessee in writing if it believes there has been a breach of this obligation. At no time shall any tobacco or alcohol products of any type be sold by lessee. No animals shall be allowed on the premises other than in vehicles of lessee's customers. Loitering is prohibited. Lessee shall not allow undue noise, vibration, or offensive odor. Lessee shall not allow use of the premises in any way which would violate any certificate of occupancy, make void or voidable any insurance then in force with respect to the premises or make it impossible to obtain such insurance or cause an increase in the premiums therefore, create or continue a public or private nuisance,or use the premises for any illegal purpose. Lessee shall,at lessee's sole cost and expense, promptly comply with all governmental rules, orders, regulations, or requirements relating to the use and occupancy of the premises now in force or which may hereafter be in force. 3. Term. The term of this lease shall be for a period of five(5)years and shall commence on the day of August,2012,and terminate on the 31st day of August,2017,inclusive. 4. Hours of operation. Lessee may open for business at any time, but shall close no later than the time set for closing of Swain's General Store. 5. Rent. Lessee agrees to pay to lessor as the base monthly rent for the premises the sum of Four Hundred Fifty Dollars($450.00)per month, from the commencement of the lease through August 31, 2015. Rent shall increase to Five Hundred Dollars($500.00)per month on September 1,2015. Rent shall be payable in advance on or before the 1st day of each and every month during the term of this lease, without notice or demand, and said rent shall be payable to such place as lessor shall designate in writing. Rent for the initial month shall be prorated from the commencement date. In the event rent is not paid by the fifth day of the month,lessee shall also pay a late charge of$50.00 per month. - lof8- 31. Legal fees.
