After several meetings and site visits to the Christopher Residence, Sue had clearly told the Christophers that they could not proceed with a deck/sunroom enclosure. After discussing their options to repair that portion of their house with Building Official Leu Haehnien, the Christophers and their contractor decided to proceed ahead with the enclosure, which Sue had advised them that they could not do without a variance. The Christophers now say that they were told by Leu that they could do the enclosure without a building permit and in violation of the Zoning Code setback. Sue contacted Leu, and he said that he did not tell them that they could make the enclosure without a building permit and in violation of the Zoning Code setback. Because Sue does not believe Leu, she is reluctant to enforce the City's Municipal Code. While some repair ofthe deck/roof areas on the back ofthe Christopher's home was necessary, other repair options that were not in violation of the Building and Zoning Codes should have been reviewed, and one permitted through a building permit. That was not done, and now we are faced with the fact that we have an illegal and perhaps unsafe addition, which the property owners were specifically told could not be done without a variance. The very close proximity of the house to the north of the subject house makes it very unlikely, as Sue suggests, that a variance would be granted, since actions by the property owners, such as building structures which later become nonconforming, do not constitute a valid reason for granting a variance. If nonconforming structures were a valid reason for a variance, then all nonconforming structures would be permitted to expand contrary to the intent of the Zoning Code. Please advise the Community Development Department on how enforcement should proceed in this case. Sue believes there are dozens of similar cases where people claim that Leu told them to go ahead without any documentation or confusing permits such as the Flaming-Van Oss garage. We returned home on Friday and were stunned in reading your letter to us. It was our understanding that we had received approval from the city building official to repair the back of our house. As we discussed, the process had been long in determining how to solve the water problem. Already, the North side of our home had considerable water damage and the standing water on the flat roofing would soon cause more serious problems as well as present health issues. The process to apply for a permit revealed issues of variances. Our home was built in 1896. In 1956, the house to the north of our property was built much too close to our existing structure. This would be 119 1/2 E. 2nd Street. Several from your office had come over or were already familiar with the odd lot. With fall and wet weather certain, we were concerned. We needed to find an answer before encountering more damage to our house. It seemed like one dead end after another. You had suggested that we come down and speak to the building official in person. Our contractor and Paul went together. The building official advised us that applying for a variance would be costly and could take a very long time. They asked hun what we should do. He told Paul that we had an excellent contractor and to just put the sunroom on. Our contractor and Paul discussed this in the hall and the building official came out to ask if there was a problem. They asked again, "Is this really OK?" He told them yes and to get started. As your letter recalled, there was a possibility that we could purchase 119 1/2. Our neighbor at 121 had offered the property to us. We contacted WAMU in January and had begun working on the process. The neighbor delayed, asking us to wait. Eventually, he no longer "needed" to sell it. We decided to use our funds to continue repairs. (Cement & roofing to further remedy water problems that were harmful to our foundation.) In May, we began working with Alternative Technologies to get a permit for the cement work. Roger was asked to come for an inspection and he seemed very grumpy. At the time, we did not have a clue what was bothering him. Noel suggested that it could be the changes in the building department. When the next inspection was needed, we were asked about the North side of the house, to which we explained that we had received permission to install the enclosure from the building official. We have lived here for a couple years and Paul was impressed with the building department. He believed that the building official understood our situation and made an executive decision when faced with an extremely uncommon situation. We did not question his authority in this. Naturally, we assumed that the building department was in agreement with his position. It would not have made sense for the city to prevent us from protecting our home. In reviewing your letter to us, it should be noted that there is not a sliding dqor. It is our understanding that you have been to our property and discovered that there are windows that open with screens. The "sunroom" is clearly an enclosed/covered porch. It is unfinished and continues to have outdoor furniture. Most of what we have done here is repairs and improvements to solve serious water problems. Again, our money was spent to complete the cement work. We really do not have funds to remove the enclosure. Our mess seems to have begun with trusting the directions we received from a man who no longer works for the city. Please review the letter from our contractor which further communicates what has occurred. We hope there is some reasonable way to make things right. We returned home on Friday and were stunned in reading your letter to us. It was our understanding that we had received approval from the city building official to repair the back of our house. As we discussed, the process had been long in determining how to solve the water problem. Already, the North side of our home had considerable water damage and the standing water on the flat roofing would soon cause more serious problems as well as present health issues. The process to apply for a permit revealed issues of variances. Our home was built in 1896. In 1956, the house to the north of our property was built much too close to our existing structure. This would be 119 1/2 E. 2nd Street. Several from your office had come over or were already familiar with the odd lot. With fall and wet weather certain, we were concerned. We needed to find an answer before encountering more damage to our house. It seemed like one dead end after another. You had suggested that we come down and speak to the building official in person. Our contractor and Paul went together. The building official advised us that applying for a variance would be costly and could take a very long time. They asked him what we should do. He told Paul that we had an excellent contractor and to just put the sunroom on. Our contractor and Paul discussed this in the hall and the building official came out to ask if there was a problem. They asked again, "Is this really OK?" He told them yes and to get started. As your letter recalled, there was a possibility that we could purchase 119 1/2. Our neighbor at 121 had offered the property to us. We contacted WAMU in January and had begun working on the process. Ihe neighbor delayed, asking us to wait. Eventually, he no longer "needed" to sell it. We decided to use our funds to continue repairs. (Cement & roofing to further remedy water problems that were harmful to our foundation.) In May, we began working with Alternative Technologies to get a permit for the cement work. Roger was asked to come for an inspection and he seemed very grumpy. At the time, we did not have a clue what was bothering him. Noel suggested that it could be the changes in the building department. When the next inspection was needed, we were asked about the North side of the house, to which we explained that we had received permission to install the enclosure from the building official. We have lived here for a couple years and Paul was impressed with the building department. He believed that the building official understood our situation and made an executive decision when faced with an extremely uncommon situation. We did not question his authority in this. Naturally, we assumed that the building department was in agreement with his position. It would not have made sense for the city to prevent us from protecting our home. In reviewing your letter to us, it should be noted that there is not a stiding door. It is our understanding that you have been to our property and discovered that there are windows that open with screens. The "sunroom" is clearly an enclosed/covered porch. It is unfinished and continues to have outdoor furniture. Most of what we have done here is repairs and improvements to solve serious water problems. Again, our money was spent to complete the cement work. We really do not have funds to remove the enclosure. Our mess seems to have begun with trusting the directions we received from a man who no longer works for the city.
