He is working with colored slate now to fit in with the bathroom tile This is tedious and time consuming Charlie usually takes about three days to complete a large project - and - three days is just about all the work he can do in one week Not only has he had a broken neck which still bothers a great deal, his back injuries are certified to use the title of being disabled After he's finished with some project, there are days of unrelenting pain, and of spending days on his recliner This means we just aren't able to finish in the time the city demands of us We try all different methods of relieving pain, but the man can only do so much in a given time It would help so much if he could get the extra time that being disabled merits It grieves me to see a face white with pain but with such spirit Sincerely, Barbara Binney 0 0 0 Yle-`0 kl,% 04-11, Pub /' Iim A_-, ,, 10 .......... W As H ING TO N, U S A COMMUNITY & ECONOMIC DEVELOPMENT Temporary Use Permit- TUP 09-01 1112 E 6t1' Street APPLICANTS Charles Bmney.and Barbara Peterson REQUEST Temporary Use Permit to allow the use of an RV as a living unit during. residential home construction in the RS -7 Residential Single Family zone r N DATE December 15, 2009 PROPOSAL. The applicants have requested to reside in a recreational vehicle in the RS -7 Residential Single Family zone during home construction at 1112 E. 6th Street: ACTION Approval for no more than a 6 month -period subject to the following conditions. CONDITIONS Placement of the temporary living unit shall be in compliance with all pertinent local and state development regulations. The location shall be no less than 7 feet from a side yard and 10 feet from a rear yard in the rear 1/3 of the lot. 2 The temporary unit shall either be hooked into the City sewer through a connection approved by the Public Works and,Utilrties Department or the RV shall be removed' at least weekly to a proper dump location. An approved power hookup shall be made per the City's Electrical Inspector prior to occupancy of the unit. 3 Approval is for a 6 month period only Upon approval of final inspection of the residential unit, the RV shall be stored in an appropriate location per the City's Municipal Code and shall not be used for residency on site. Residential hookups shall be abandoned. If the residential construction extends beyond the 6 month period and the applicants wish to continue residency of the RV unit, it shall be removed to an appropriate location but shall no longer be used for occupancy at 1112 East 6th Street. Temporary Use Permit — TUP 09-01 Binney/Peterson December 15, 2009 Page 2 This decision is based on the following findings-andconclusions included in this report. FINDINGS 1 A request to occupy a mobile RV unit on site during residential construction was received on November 20, 2009, from Mr Charles Burney and Ms. Barbara Peterson. Mr Binney and Ms. Peterson are constructing a residential unit in the RS -7 Residential Single Family zone 2. Section 17.95 060 of the Port Angeles Municipal Code authorizes the Planning Manager of the Department of Community and Economic Development to authorize permits for occupancy of temporary buildings, including mobile homes, used in conjunction with construction or reconstruction projects, or buildings used as real estate tract offices, for a period not to exceed one (1) year Such temporary buildings may be located in any zone, provided, however, sufficient setbacks are maintained to protect the public health, safety, and welfare. 3 A building permit is required for residential construction. Building permit # 09 - ???? has been issued for the construction of a single family residence for Mr Burney and Ms. Peterson. The applicants verbally stated that they will not need to occupy the RV more than 6 months. 4 Placement of a temporary unit must be inspected and approved by the City's Fire Department and Electrical Inspector to ensure that all relevant local and state regulations are followed prior to occupancy CONCLUSIONS 1 As conditioned, the use complies with Section 17.95 060 (Temporary Buildings) of the Port Angeles Municipal Code and with development standards of the RS -7 .Residential Single Family zone. 2 As conditioned, the use does not endanger the public health, safety, or welfare nor interfere with the ultimate development of the on site residential unit but permits the property owners lo, be on site during construction without the need to rent a home during the process.
