Environmentally Sensitive Area Decision Date: December 10, 2002 File Number: ESA 02-08 Applicant: Jim White Owner: Same Proposed Action: Remove trees and grade area for placement of home on parcel adjacent to Peabody Creek at top of ravine, an environmentally sensitive area. Location: Lots 1, 2, 3 of Block 226, 628 E. 76 Street, Port Angeles, WA SEPA: A Determination of NonSignificance was made on December 10, 2002. Decision: Approval with the following conditions: 1. No portion of the project (building, pavement, or other structure) can be located closer than 25 feet from the top of the ravine as determined by City of Port Angeles Public Works. 2. A silt fence shall be placed at the top of the ravine prior to any earth disturbing activity on site. The silt fence shall remain in place until such time that the 25 foot buffer at the top of the ravine is revegetated. 3. The 25 foot buffer at the top of the ravine shall be replanted with native trees and shrubs. The buffer shall remain undisturbed after replanting. 4. Tree removal shall be limited to only those trees that occupy the proposed building footprint, the wild cherries that are diseased, and immature trees less than 4 inches in diameter. Findings: 1. The project is located on a site with a ravine and creek that is classified as an Environmentally Sensitive area. An undisturbed 25 foot buffer is required at the top of the ravine. 2. Previous use of the site included stockpiling spoils from other projects. Mounds of earth and shallow excavations have left the site uneven. Some areas have been overgrown with exotic plant species. The site is unbuildable without some clearing and grading. The site meets the criteria of a previously altered environmentally sensitive area. ESA 02-08 City of Port Angeles Page 2 plant species. An area large enough to place a standard sized home exists on the site outside of the environmentally sensitive area and the required 25-foot buffer. 4. On December 10, 2002, a Determination of Nonsignifance was issued by the SEPA Responsible Official in accordance with RCW 43.21C, WAC 197-11 and PAMC 15.04. 5. Public notice was provided on the application during the SEPA process whereby no objections or comments were received. Conclusions: 1. As conditioned, the proposal is consistent with the requirements for developing within an Environmentally Sensitive Area as defined in PAMC 15.20. As designed, the proposal will incorporate design techniques and best management practices which will result in the least impact to the sensitive area. 2. As conditioned, the proposal will maintain the public safety and welfare. 3. As conditioned, the proposal is consistent with the Port Angeles Comprehensive Plan. Prepared by: S. The site contains an environmentally sensitive area (Peabody Creek and ravine) and a portion of the site contains a required 25-foot buffer at the top of the ravine.
