'I </.</gD ORIGINAL #1 SMALL WORKS PROJECT MANUAL Spot Coating the #2 Floating Cover Digester, Project 04-10A SCOPE OF WORK City of Port Angeles Public Works and Utilities Department will accept bids to sandblast and spot coat the floating cover digester Number 2, at the City wastewater treatment plant. The work will consist of the following major components: A. This specification details the procedures recommended for the application of a Tar-Guard Coal Tar Epoxy protective coating system to the interior of a process and storage vessel. B. If there is a procedure difference between this specification and any other specification or standard referred to, this specification shall control unless the City's representative authorizes a change. C. The coating material manufacturer's current product data sheets are to be used in conjunction with and become a part of this specification. The applicator should adhere to all manufacturer recommendations of product shelf life, pot life, mixing ratios and acceptable thinners. D. The applicator should use industry standard inspection equipment, quality control and inspection policies in regards to the application of this product. E. The Coating Inspection Form included in this contract must be completed during the project at the required project stages. It is the responsibility of the applicator to adhere to industry standard application and inspection procedures for record keeping purposes. F. The coating system is to be applied in one coat, plus a striping coat to a nominal film thickness required for the intended service. The recommended coating dry film thickness will vary between 8 mils (minimum) to 16 mils with acceptable spots at 16 mils. G. It is the applicator's responsibility to compute and supply adequate ventilation to prevent explosion and toxicity hazard conditions as prescribed by standards of good safety practices, local and state regulations, OSHA and other federal regulations. H. The contractor must have a suitable Confined Space Entry Permit system. 1.02 SUBMITTALS A. Product Data: Submit manufacturer's technical data, installation instructions, and chemical resistance data for the lining. Include certification indicating compliance of materials with requirements. B. Preparation and Application Data: Submit technical data on abrasives, cleaners and application equipment. C. Licenses: Submit qualifications for and prior performance of this type of work. Any certifications held in the performance of this type of work. Must display familiarity with the process of preparing, coating and inspecting similar Page I of 13 J ~ . 1 structures by these aforementioned means. PART II PRODUCTS 2.01 COATING MATERIALS Lining material shall be TAR-GUARD COAL TAR EPOXY (Sherwin Williams) or equal. Any coating other than TAR-GUARD COAL TAR EPOXY (Sherwin Williams) must be approved in writing by the City's representative. 2.02 COLOR A. Striping coat: Red. B. Final coat: Black. PART III EXECUTION 3.01 PRELIMINARY INSPECTION Before any coating is begun, the following shall be done: A. All weld splatter, sharp projections, slivers and pits should be removed. B. Weld metal should be used to fill repairs. Putty should not be used. C. Welds that are rough, irregular and not well formed should be corrected by grinding smooth. D. All sharp corners and edges should be rounded to at least a 1/8" radius. E. No other conditions exist which would shorten the expected life of the applied coatings. 3.02 SURFACE PREPARATION A. Oil and grease should be removed from the surfaces to be coated with a suitable safety solvent per SSPC-SP1 prior to abrasive blasting. B. The dome support angle on the entire tank interior should be blasted to expose sharp edges, welds and other areas prone to coating failure. Entryways in the dome lid must also be blasted to a near white metal. C. All sharp edges and welds should be ground smooth to a rounded contour in accordance with NACE Weld Preparation Designation "D". After metal surfaces are subjected to grinding, the areas must be re-blasted to ensure surface profile is correct. D. Non-carbon steel parts that will not be coated should be removed and/or protected prior to blasting, including but not limited to hatch covers, hatch rings, outlet valves and vents. The lining should be terminated on the non-carbon steel approximately 1" past the interface. Ports containing valves which cannot be removed shall have the valve component face protected and the sealing area protected by masking so that surface Page 2 of 13 . r ., preparation does not damage the valve. E. The compressed air used for blasting should be free of water and oil. To determine cleanliness, blast without abrasive into a white cloth. The trap and separators should be blown down until subsequent cloth tests show no oil or water contamination. F. All weld seams should be individually blasted prior to blasting other areas of the vessel. Weld seams are the areas of early coating failure. Removal of contaminants and achieving the proper anchor pattern in the heat-affected zone at the welds is critical to the service life of the lining. G. Dome Support angle surfaces should be blasted to a "near white metal" in accordance with SSPC-SP10. H. The anchor pattern or "tooth" in the metal should be a minimum of 2 mils. Proper abrasive should be a sharp angular natural abrasive, similar to or equal to G40 or other abrasives having a sharp, hard-cutting surface, properly graded, dry, of best quality and of proper size to produce the specified anchor pattern. The first coat must be applied the same day blasting occurs. I. All internal surfaces should be vacuum cleaned to remove all blast media and dust after blasting is completed. External surfaces may be air blown clean using dry, oil-free air. Magnets are suggested to remove steel grit particles not removed by other methods. 1. No visible oxidation should be permitted between the time of blasting and striping the blasted surface. 2. The interior of the vessel should be protected from moisture from the time of blasting to the time that application and curing are complete. 3. The surface preparation must conform to SSPC-VIS 1 standards of steel cleanliness. 4. The adjoining painted area is to be brush blasted in accordance with SSPC-SP7 to a width of at least 4 inches on all sides in order to insure the adherence of the new coating to the old coating. 3.03 COATING APPLICATION A. Before starting coating application, it is recommended that the applicator read all available safety data including, but not limited to, OSHA approved material safety data sheet, product data sheet and backup label. B. TAR-GUARD consists of two parts, which must be mixed prior to using. Mix contents of each component separately and thoroughly using power agitation. Make sure no pigment remains at the bottom of the container. Mix well until obtaining a smooth liquid free of any unmixed particles of pigment. Then combine four (4) parts Part A by volume with one (1) part, Part B by volume. Thoroughly agitate the mixture with a power agitator. Restir prior to use. If reducer solvent is used, add only after both components are mixed. After the coating and curing agent have been combined and mixed, it has a 2-hour pot life at 7JOF. It may be necessary Page 3 of 13 ." I ~ to thin the coating with Reducer R24K (Sherwin Williams) or equal. Reduction shall not be added at greater than 15% by volume. C. The lining application must not proceed until the substrate temperature is a minimum of 50F above the dew point. Minimum air or surface temperature at the time of application should be 500F and a maximum of 120oF. If necessary due to temperature and humidity at the time of application, appropriate dehumidification and heating equipment must be used. Applicator will document temperature, humidity and dew point at the time of application. D. Coating will be applied in two steps: a. Striping Coat (Red). b. Second spray coat (Black). E. All areas subject to over spray and drips (such as the vessel bottom) should be protected by a suitable covering while spraying other areas in the vessel. F. When airless spray equipment is used, the recommended liquid pressure is 3000 psi with tip size from .017" to .025", Adjust spray tip orifice size and material fluid pressure to obtain a spray pattern with the best possible atomization. G. Air supply should be uncontaminated. H. Apply a mist-bonding pass. I. Apply a crisscross multi-pass moving gun at a fairly rapid rate maintaining a wet appearing film. Use a 50% overlap with each pass of the gun to avoid holidays, bare areas and pinholes. By allowing the solvents to flash off for a few minutes, additional fast multi-passes may be applied until you have a film thickness of approximately 11 to 22 wet mils (measured on a wet film thickness gauge) and approximately 8 to 16 mils dry film. J. Venting from the bottom of the vessel is recommended during the application and initial curing process. K. Overcoat time will vary with the temperature and ventilation and will require >10 hours at 7rF for enclosed spaces. L. Be sure to remove any dust from sanding before applying topcoat. 3.04 CURING A. Normal cure will take place in 7 days at 7rF. As ventilation and other factors affect the time/cure of the coating, additional time allowance is recommended if cure time is questioned. B. Curing must be complete before the vessel is closed up or subjected to weather conditions below the 500F minimum curing requirements (time and temperature). This may require force curing. C. Force curing at elevated temperatures does increase resistance to certain exposures; therefore, when exposure is severe, force curing is recommended to obtain maximum resistance. Page 4 of 13 ~ " , '" 3.05 AREA TO BE COATED A. The support beams (angle steel) welded under the dome of the entire interior of the #2 digester will be coated according to these specifications on all carbon steel surfaces. This includes the hatches and all penetrations where corrosion has occurred. B. The interior of the digester #2 that has been properly coated (that area between the supports) is not included in the scope of this project. Contractor must ensure that the coated product will adhere to the existing coal tar epoxy and that it is properly prepared at the interface of the two coatings to a width of at least four inches. Flanges and piping ports having equipment such as valves attached and not exposed during the project are not included for coating except that these piping ports will be prepared and coated as far as practical within the port. C. Approximate volume of the tank in the coated area is 215,000 gallons. 3.06 INSPECTION A. Determine degree of blast obtained using NACE or SSPC standards. B. Depth of profile should be determined by visual comparison to Clemtex anchor pattern standards or by using Press-O-Film replica tape. C. Total dry film thickness should be determined using non-destructive dry film thickness gauges, which have been properly calibrated. SSPC Volume 1, Chapter 6, shall be used as a guide for the number of readings required per square foot. D. After a minimum 24-hour cure at 70 to gooF, the coating film will be tested for discontinuities with a low voltage holiday detector. All discontinuities shall be marked and repaired. NOTE: Discontinuity tests should be performed with a non-destructive type holiday detector such as the Tinker Rasor Model M 1. E. Repair of discontinuities will include grinding the coating in the affected area to bare metal and applying two coats of the coating material in the approved method. All repaired areas will be retested with the holiday detector. F. Inspection by City Representative and authorization to proceed to the next step must occur after the following stages: a. Surface preparation (Le. sand blast). b. Striping coat. c. Final spray coating. d. Final inspection (holiday detector) G. Scheduling the inspections and coordination is the responsibility of the Contractor. H. Inspections must be recorded on the Coating Inspection Form included with the contract. Page 5 of 13 , ( I' 3.07 SAFETY THE SOLVENT IN THIS COATING IS FLAMMABLE AND CARE AS REQUIRED BY GOOD PRACTICE, OSHA, STATE AND LOCAL SAFETY CODES, ETC. MUST BE FOLLOWED CLOSELY. ADDITIONAL REQUIREMENTS 1. The bid shall be submitted on the attached Bid Form and mailed or delivered to the Director of Public Works & Utilities, City of Port Angeles, 321 East Fifth Street, P. O. Box 1150, Port Angeles, Washington 98362. Questions may be directed to Jeff Young, WWTP Superintendent, at 360-417-4845. Faxed bids will not be accepted. 2. The attached Washington State Prevailing Wage Rates for Clallam County shall apply to this contract. 3. The bid may be awarded to the lowest responsible bidder. The attached Contract will then be signed, requiring the Contractor to meet the requirements in the Contract as well as the entire Project Manual. No bidder will be permitted to withdraw its bid between the closing time for receipt of bids and the execution of a Contract, unless the award is delayed for a period exceeding thirty (30) calendar days. The City of Port Angeles reserves the right to reject all bids. 4. Bids shall be submitted no later than 1 :30 pm Tuesday, November 9, 2004. 5. Because this Contract is for an amount less than $35,000, a bid bond, performance and payment bond, and retainage will not be required for this work. However, the City shall have the right of recovery against the Contractor for any payments made on the Contractor's behalf. 6. The performance period for this work is 45 working days. Contractor is to mobilize and start work within 45 working days. NOW, THEREFORE, in consideration of the terms, conditions, and agreements contained herein, the parties hereto agree as follows: 1. General Provisions The Contractor's bid and the Request for Bids for this project are hereby incorporated and shall be construed as part of this contract. The Contractor shall provide all equipment, work, and labor of any sort whatsoever that may be required to complete the work provided for in this Contract. All work shall be executed in accordance with the specifications stated in this contract and with the best practices and standards of the industry. Time is of the essence in the performance of this Contract and in adhering to the time frames specified herein. Page 8 of 13 . ' . . 3. Compensation and Method of Payment. a. The City shall pay the Contractor for work performed under this Contract the amount detailed in the bid, at the completion of work and submission of a detailed invoice. b. Payments for any alterations in or additions to the work provided under this Contract shall be on a negotiated time and materials basis. 4. Independent Contractor Relationship. The relationship created by this Contract is that of independent contracting entities. No agent, employee, servant, or representative of the Contractor shall be deemed to be an employee, agent, servant, or representative of the City, and the employees of the contractor are not entitled to any of the benefits the City provides for its employees. The Contractor shall be solely and entirely responsible for its acts and the acts of its agents, employees, servants, subcontractors, or representatives during the performance of this Contract. The Contractor shall assume full responsibility for payment of all wages and salaries and all federal, state, and local taxes or contributions imposed or required, including, but not limited to, unemployment insurance, workers compensation insurance, social security, and income tax withholding. The Contractor shall control the method and manner of the work. 5. Prevailinq Waqe Requirements. The Contractor shall comply with applicable prevailing wage requirements of the Washington State Department of Labor & Industries, as set forth in Chapter 39.12 RCW and Chapter 296-127 WAC. The Contractor shall document compliance with said requirements and shall file with the City appropriate affidavits, certificates, and/or statements of compliance with the State prevailing wage requirements. The Washington State Prevailing Wage Rates For Public Works Contracts, Clallam County, incorporated in this Contract have been established by the Department of Labor & Industries and are included as an Attachment to this Contract. The Contractor shall also ensure that any subcontractors or agents of the Contractor shall comply with the prevailing wage and documentation requirements as set forth herein. 6. Indemnification and Hold Harmless. a. The Contractor shall defend, indemnify, and hold harmless the City, its officers, officials, employees, and volunteers against and from any and all claims, injuries, damages, losses, or lawsuits, including attorney fees, arising out of or in connection with the performance of this Contract, except for injuries and damages caused by the sole negligence of the City. It is further provided that no liability shall attach to the City by reason of entering into this Contract, except as expressly provided herein. Page 9 of 13 . . , .., b. Should a court of competent jurisdiction determine that this Contract is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Contractor and the City, its officers, officials, employees, and volunteers, the Contractor's liability hereunder shall be only to the extent of the Contractors negligence. It is further specifically and expressly understood that the indemnification provided herein constitutes the Contractor's waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this Contract. Contractor Initials 7. Insurance. The Contractor shall procure and maintain for the duration of the Contract, insurance against claims for injuries to persons or damage to property which may arise from or in connection with the performance of the work hereunder by the Contractor, their agents, representatives, employees or subcontractors. Failure by the Contractor to maintain the insurance as required shall constitute a material breach of contract upon which the City may, after giving five working days notice to the Contractor to correct the breach, immediately terminate the Contract or at its discretion, procure or renew such insurance and pay any and all premiums in connection therewith, with any sums so expended to be repaid to the City on demand, or at the sole discretion of the City, off set against funds due the Contractor from the City. 8. Minimum scope of insurance. a. The Contractor shall obtain insurance of the types described below: i. Automobile Liability insurance covering all owned, non-owned, hired and leased vehicles. Coverage shall be written on Insurance Services Office (ISO) form CA 00 01 or a substitute form providing equivalent liability coverage. If necessary, the policy shall be endorsed to provide contractual liability coverage. ii. Commercial General Liability insurance shall be written on ISO occurrence form CG 00 01 and shall cover liability arising from premises, operations, independent contractors, products-completed operations, personal injury and advertising injury, and liability assumed under an insured Contract. The Commercial General Liability insurance shall be endorsed to provide the Aggregate Per Project Endorsement ISO form CG 25 03 11 85. There shall be no endorsement or modification of the Commercial General Liability insurance for liability arising from explosion, collapse or underground Page 10 of 13 . " , . property damage. The City shall be named as an insured under the Contractor's Commercial General Liability insurance policy with respect to the work performed for the City using ISO additional insured endorsement CG 20 10 11 85 or a substitute endorsement providing equivalent coverage. III. Workers' Compensation coverage as required by the Industrial Insurance laws of the State of Washington. b. Minimum Amounts of Insurance The Contractor shall maintain the following insurance limits: i. Automobile Liability insurance with a minimum combined single limit for bodily injury and property damage of $1,000,000 per accident. ii. Commercial General Liability insurance shall be written with limits no less than $1,000,000 each occurrence, $2,000,000 general aggregate and a $2,000,000 products-completed operations aggregate limit. c. Other Insurance Provisions The insurance policies are to contain, or be endorsed to contain, the following provisions for Automobile Liability and Commercial General Liability insurance. I. The Contractor's insurance coverage shall be primary insurance as respect the City. Any Insurance, self-insurance, or insurance pool coverage maintained by the City shall be excess of the Contractor's insurance and shall not contribute with it. II. The Contractor's insurance shall be endorsed to state that coverage shall not be cancelled by either party, except after thirty (30) days prior written notice by certified mail, return receipt requested, has been given to the City. d. Acceptability of Insurers Insurance is to be placed with insurers with a current AM. Best rating of not less than A:VII. e. Verification of Coverage The Contractor shall furnish the City with original certificates and a copy of the amendatory endorsements, including but not necessarily limited to the additional insured endorsement, evidencing the insurance requirements of the Contractor before commencement of the work. Page II of 13 . . , . 9. Compliance with Laws. a. The Contractor shall comply with all applicable federal, state, and local laws, including regulations for licensing, certification, and operation of facilities and programs, and accreditation and licensing of individuals, and any other standards or criteria as set forth in the project manual. b. The Contractor shall pay any applicable business and permit fees and taxes, which may be required for the performance of the work. c. The Contractor shall comply with all legal and permitting requirements as set forth in the project manual. 10. Non-discrimination. The parties shall conduct their business in a manner which assures fair, equal and nondiscriminatory treatment of all persons, without respect to race, creed, color, sex, Vietnam era veteran status, disabled veteran condition, physical or mental handicap, or national origin, and, in particular: a. The parties will maintain open hiring and employment practices and will welcome applications for employment in all positions from qualified individuals who are members of the above-stated minorities. b. The parties will comply strictly with all requirements of applicable federal, state or local laws or regulations issued pursuant thereto, relating to the establishment of nondiscriminatory requirements in hiring and employment practices and assuring the service of all patrons and customers without discrimination with respect to the above-stated minority status. 11. Assiqnment. a. The Contractor shall not assign this Contract or any interest herein, nor any money due to or to become due hereunder, without first obtaining the written consent of the City, nor shall the Contractor subcontract any part of the services to be performed hereunder without first obtaining the consent of the City. b. The Contractor hereby assigns to the City any and all claims for overcharges resulting from antitrust violations as to goods and materials purchased in connection with this Contract, except as to overcharges resulting from antitrust violations commencing after the date of the bid or other event establishing the price of this Contract. In addition, the Contractor warrants and represents that each of its suppliers and subcontractors shall assign any and all such claims for overcharges to the City in accordance with the terms of this provision. This Contract shall be administered by Russel Myron on behalf of the Contractor and by Jeff Young on behalf of the City. The most significant issue is fire flow for the Mill, and costs also mclude the additional task of an Emergency Response Plan for the Water Utility. Director Cutler advised the Council that the City is looking to provide utilities to that area no later than November 1, 2005, and the fire flow would follow. He noted there is a meeting scheduled With the property owners this coming Thursday, 7:00 p.m., to diSCUSS the project, associated costs, and projected time frames. Following brief diSCUSSiOn, Councilmember Williams moved to authorize the Mayor to sign Amendment No. 1 to the Consultant Agreement with CH2M Hill in the amount of $424,059.00, for a total contract amount not to exceed $842,059.10. Councilmember Rogers seconded the motion, which carried unanimously. 2 Spot Coating #2 Floating Cover, Project 04-JOA Drrector Cutler explained to the Council that the first successful bidder, Square Construction, could not perform the necessary work, so Pubhc Works returned to the bid documents and mqurred of the next bidder if the bid pnce would be honored Grecor Construction agreed to hold the pnce, and staff is recommendmg that the contract for the floating cover be awarded to Grecor. Respondmg to an inquiry from Councilmember Pittis, Attorney Bloor clanfied that the original contractor would be dropped from the Small Works Roster and conSidered to be non-responsive if it bids on any City project on or before December 31, 2005. In addition, Director Cutler indicated staff is studying the possibility of requrrmg a bond for projects over $35,000, acknowledging such a requrrement would be more expensive for contractors. Councilmember Pittis moved to award and authorize the Mayor to sign a contract with Grecor Construction of Olympia in the amount of $30,865.50, for Spot Coating the #2 Floating Digester Cover, Project 04-10A. The motion was seconded by Councilmember Braun and, following brief discussion, a vote was taken on the motion, which carried unanimously. 3 Landfill Compactor Engme Replacement Director Cutler presented informatiOn pertment to the need to replace the engme on the Landfill compactor An engme had to be mstalled nght away and, because ofthe pnce, Council approval was necessary. Councilmember Rogers moved to authorize the Director of Public Works & Utilities to secure the services of NC Machinery to replace the engine in an amount up to $20,000. Councilmember Braun seconded the motion. Discussion ensued with regard to the future use and/or resale of the compactor in view of the upcoming Landfill closure. A vote was taken on the motion, which carried unanimously. 4 Waterfront Trail Repmrs' Director Cutler summanzed the need to perform immediate repalfS to the OlympiC Discovery Trail east of the Rayonier Mill Site, repalfS that were necessitated because of mgh tides and winter storm events that undermmed vanous portions of the Trail. Repairs can commence as of Monday and must be completed by February 15th m order to meet Fish & Wildhfe requrrements on the fish wmdow. Director Cutler indicated that appropnate permIts have been obtamed from the County and, m response to Councilmember Rogers, he mdicated the fundmg would come out of the unallocated portion of the CFP. Councilmember Williams moved to award the project and authorize the Mayor to sign a contract with Horizon Excavating, Inc., in the amount of$27 ,473.55 for the Olympic Discovery Trail Emergency Repairs Project 05-05. The motion was seconded by Councilmember Rogers and carried unanimously. Mayor Headrick recessed the meeting for a break at 7 :20 p.m. The meeting reconvened at 7 35 p.rn. - 7 -
