No discharge of stormwater shall be directed over the marine bluff 3 No excavation or earth disturbance shall occur closer than 20 feet from the upper terrace of the existing retaining wall. 4 The property owner shall complete and sign a hold harmless agreement with the City and such agreement shall be recorded with the Clallam County Auditor's Office ESA 04 -04 Clarke Page 2 Fmdmes. 1 An application for review under Chapter 15.20 PAMC (Environmentally Sensitive Areas) was received on March 30, 2005, from Zenovik and Associates, agent for Denise Clarke, owner, for the construction of an addition to an existing single family residence within 50 feet of the marine bluff. 2 The subject property consists of one parcel, located at 220 W Second Street, Port Angeles, WA 98362 The property is owned by Denise Clarke 3 The subject property is located at the top of the marine bluff A 50 foot buffer from the top of the Marine bluff is required for structures and the project is proposed to take place less than 50 feet from the top of the marine bluff The structure existed prior to the implementation of the City's current Environmentally Sensitive Areas regulations 4 The subject site is zoned RS -7, Residential Single Family 5 The March 28, 2005, Geotechnical report prepared by Zenovic and Associates, Inc., indicated that the site is a residential yard and the residence has an existing concrete retaining wall system with helical anchors that secure the wall to the slope. This wall was constructed in 1999, subsequent to a 1998 slope failure. The existing house is located 22 feet from the upper tier of the wall system which marks the top of the marine bluff. A minimum of 20 -feet setback from the top of the marine bluff is recommended. 6 Portions of the subject property meets the definitions of an environmentally sensitive area as defined by PAMC 15.20 (Environmentally Sensitive Areas Ordinance) The purpose of the Chapter is to protect environmentally sensitive areas in accordance with the Growth Management Act. The intent of the Chapter is to use a function and values approach and establish minimum standards for properties containing environmentally sensitive features in order to protect the public health, safety and welfare which includes a) avoiding disturbance of these areas, b) mitigating such impacts, c) protecting the public from personal injury loss of life or property damage due to erosion and landslides, etc., and d) protecting against publicly financed expenditures from misuse of environmentally sensitive areas. 7 The site meets all the requirements listed in 15.20 080.3 PAMC to be considered a Previously Altered Environmentally Sensitive Area. 8 All development proposals in environmentally sensitive areas shall comply with the requirements and provisions of Chapter 15.20 PAMC.
