ESA 09 -03 Applicant: Fran Johnson Owner Same W A S H I N G T O N 0RT, ANG EL Es U S A Environmentally Sensitive Area Decision Proposed Action Replacement of existing wooden deck with retaining wall and patio on fill behind retaining wall. The site is located at the top of the marine bluff/Valley Creek ravine, where the two come together to form a point of land. Both the marine bluff and Valley Creek ravine are environmentally sensitive areas. Location. 427 W Third Street SEPA. A Determination of NonSignificance #1255) has been issued for the proposal. DECISION. Approval with the attached Conditions, Findings, and Conclusions The proposed project is the replacement of an existing wooden deck with a retaining wall and patio on fill behind the retaining wall. The site is a the top of the marine bluff and Valley Creek ravine. Both are environmentally sensitive areas due to the steepness of the slope VI( The site currently provides no buffer to the slopes and has existed that way since its construction in the 1970's The site is therefore considered a previously altered environmentally sensitive area. The project will replace a wooden deck that is supported by a timber retaining wall with a patio on grade. The grade will be stabilized by the replacement of the timber retaining wall with a concrete retaining wall. The replacement wall will be placed approximately 10 feet back from the existing wall, reducing the amount of overhang to the bluff /ravine wall Crushed gravel will be placed behind the wall and a flagstone patio surface placed on the gravel A Geotechmcal report, authored by 4 Seasons Engineering has been submitted with the ESA application. The report indicates that the construction techniques will provide a stable construction. Vegetation on the slope is dominated by nonnative English Ivy and Himalayan Blackberries. Other native vegetation also exists on the slope The applicant's SEPA ESA 09 -02 Johnson October 15 2009 Page 2 document states that the nonnative vegetation will be replaced where disturbed to improve the long term slope stability Conditions. 1 The project shall be constructed substantially in conformance with the submitted plan set. Fmdmvs. 1 An application for review under Chapter 15.20 PAMC (Environmentally Sensitive Areas) was received on September 8, 2009, from Fran Johnson for the replacement of a deck with a patio behind a retaining wall at the top of a steep slope 2. The subject property consists of one parcel, described as the E. 12 feet of Lot 13 and Lots 14 15 of Block 50 TPA, located at 427 W 3rd Street. 3 The proposed patio and retaining wall will result in a reduced intrusion into the environmentally sensitive area than the existing timber wall and deck. 4 The subject site is zoned PBP, Public Buildings and Parks, with a small portion on the northeast corner being zoned IL, Industrial Light. 5 Portions of the subject property meets the definitions of an environmentally sensitive area as defined by PAMC 15.20 (Environmentally Sensitive Areas Ordinance) The purpose of the Chapter is to protect environmentally sensitive areas in accordance with the Growth Management Act. The intent of the Chapter is to use a function and values approach and establish minimum standards for properties containing environmentally sensitive features in order to protect the public health, safety and welfare which includes a) avoiding disturbance of these areas, b) mitigating such impacts, c) protecting the public from personal injury, loss of life or property damage due to erosion and landslides, etc., and d) protecting against publicly financed expenditures from misuse of environmentally sensitive areas. 6 A Geotechnical report authored by 4Seasons engineering was submitted with the application materials. The Geotechnical report indicates that the bluff /ravine wall is currently stable and the project as designed /engineered will not reduce the stability of the slope. 7 All development proposals in environmentally sensitive areas shall comply with the requirements and provisions of Chapter 15.20 PAMC The responsibility for administration and enforcement of the provisions of the Chapter shall rest with the Community and Economic Development Director or his designee. 8 The site meets the criteria of being a Previously Altered environmentally Sensitive Area. The project as proposed will reduce the area of impact to the buffer of the ESA. 9 The application included an environmental checklist as required under RCW 43.21 C and PAMC 15 04 A Determination of Nonsignificance #1255) was issued on September 30, 2009, by the City's SEPA Responsible Official in compliance with RCW 43 21C and WAC 197-11 ESA 09 -02 Johnson October 15 2009 Page 3 Conclusions. 1 As conditioned, the proposal is consistent with the requirements for development adjacent to a steep slope as defined in PAMC 15.20 070(C)(1) &(2) 2 As conditioned, the proposal will result in the least impact to the sensitive area and take into consideration site constraints associated with the subject property 3 The Director of Community and Economic Development concluded that the applicant's environmental information satisfies the requirements of PAMC Sections 15.20 040(E) 4 The Geotechnical report submitted as a part of the environmentally sensitive areas application provide a basis for conditioning the proposed activity such that it will be in the public interest, safety, and welfare 5 As conditioned, the proposal is consistent with the Port Angeles Comprehensive Plan and the City's Zoning, and Environmentally Sensitive Areas Ordinances.
