LOU MARk FlU; March 11, 1997 RE: Developer Reimbursement Agreement Information Dear Erin: Enclosed is sample copy of an agreement for reimbursement. This mayor may not help you with the wording for your sanitary sewer construction project. But it may give you some idea on how to word your agreement for possible future connections based on your engineer's design. I would suggest that you have your document and map of the area to be served recorded with the county. The developer reimbursement dollar amount is based on the construction cost distribute over the number of possible connections. The monies are collected at time of connection. The reimbursement agreement would not relieve the proposed property /connections from paying sanitary sewer connection fees to the City. Hope this helps. Smith GKENWORT, GCUTLER 6/13/01 8:29am Private sewer lines 9th and 10th Streets at I Street Gary What should have been a short and simple Real Estate Commitee meeting last night was hardly that. Previously, the Committee had asked that I prepare a sale listing of 5 City owned lots (#1 ,2,3,4,and5) in Block 307 TPA. As you know, that is the same block wherein a City Employee is preparing his property (Lots #9 and 10) for construction. I spoke with you and Cutler about 3 weeks ago about the potential for partnering with that property owner in order to try and affordably get sewer to the City lots at the same time it is being put into lots g and 10. ( I still have not heard back on that issue.) The listing which I was recommending last night was a listing "as is", with the buyer having to deal with the utility services. However, the Committee was only intersted in getting some answers to what is going on between the exisiting neighbors and an existing, private sewer line in the area...? Apparently there are several concerns regarding the existing and proposed sewer line connections involving existing residents and the City Employee? It seems that each of the Committee members have received citizen calls/complaints regarding the sewer line issue and other issues (something about some trees that may have been cut and removed in the area and the delivery of some pipe???? Although I attempted to shift resolution of the concerns directly toward the Public Works Engineering, the Committee wants me to get further involved. I will take that issue up with Mike. They also declined listing the City property until they get some answers to whatever is going on with the sewer infrastructure. I am really in the dark on this and need some background. They also asked that the City Attorney be briefed on the situation? After reviewing the situation, my decision is that the sidewalk must be installed in accordance with the City's Urban Services Ordinance, PAMC 18.08.040 D. I have also decided, however, that the City will allow you to utilize the City's 50/50 cost sharing arrangement that normally only applies where sidewalks are not required to be installed as a part of the development. In making this decision, I want to emphasize that this compromise will apply only to the 100 feet of sidewalk for your new residence at West Tenth Street and not to any of the other lots that you own or may be in the process of selling. In response to your statement that another newly constructed home down the street did not have to put in sidewalks, it is my understanding that the only reason the Public Works Department waived the sidewalk requirement in that instance was due to the lack of curb and gutter that would have made sidewalk installation impractical unless the City had been able to redesign the street and install the curb and gutter, which was not feasible at that time. It is also my understanding that since the Urban Services Ordinance became effective in February 1995, all new development creating pedestrian traffic on arterials and school walking routes has been required to include sidewalks. I would also like to make it clear that the SO/50 participation offer made by a City staff member was not consistent with the City's normal policy but that since the offer has been made I feel somewhat obliged to honor it. Accordingly, I am hereby instructing the Public Works Department to prepare an estimate of your share of the sidewalk installation, which you will need to pay prior to receiving your building permit. While you may or may not be satisfied with this decision, I feel that it is the most favorable decision to you that I am able to make given the requirements of the City's ordinances and policies. Councilman Hulett has been contacted by Ms. Erin Johnstad at the address above. (spelling and exact address could be slightly wrong but is close) Councilman Hulett says that a garage permit has been held up and wonders why. The grage permit has not been held up since no application has been recieved by the building department. The issue regarding the garage is the access off of "K" street, which is unimproved and is covered in my response to item 4). Resposes to specific issues raised: 1) The sewer line noted is a private force main in the 9/10 alley to serve only Mrs. Johnstad's lots. If she sells a lot and wishes to include a latecomer fee in the sale price she can. The only latecomer fees for utilities which we collect are those which are dedicated to the City with a developer latecomer agreement approved by City Council. 2) & 3) City will construct the sidewalk this summer. See forwarded City Manager letter of 2/27/98 and Director of Public Works letter of 4/23/99. 4) See Director of Pullic Works letter of 4/23/99 in response to Mrs. Johnstad's letter of 4/19/99 also forwarded.
