We have reviewed our files concerning the previous sloughing and have found we cannot agree with the former owner's statement that it Is the City's responsibility On April?' 15, 1982, the City of Port Angeles wrote to the attorneys representing Mr Charles Beaudette concerning the City's intention on a slide which had just occurred (copy enclosed). It was the City's determination that the slide was an act of nature caused by ground water seepage and, therefore, the City had no liability and was not responsible for the slide. This previous posture by the City would still hold true today in the case of the bank sloughing into Peabody Creek.
